  • In the News

Alaska Marijuana News > Commercial marijuana is almost here, and Alaska's government is feeling the strain | A state government that's already lost hundreds of jobs this year is grappling with how to balance that with the workload that comes with the emergence of an entirely new industry: marijuana. Some Alaska municipalities have a plethora of questions about rules for new marijuana businesses — how to measure the distance from a business to a church? What types of signs can entrepreneurs have? — and the state's Alcohol and Marijuana Control Office doesn't have the time or resources to answer every one. Meanwhile, the digital paperwork for new marijuana business applications just keeps rolling in.

Sarah Daulton Oates, a program coordinator at the Alcohol and Marijuana Control Office, said that the staff of 15 people (plus a director) has been shorthanded in trying to keep up with all the inquiries and applications. "It's a ton of work," Daulton Oates said. "We've had a lot of pressure with local governments who are trying to figure out how to write their own laws." >> Read more >>

Alaska - The Laws concerning marijuana Regulate Marijuana In Alaska Thirty-five years after landmark Alaska Supreme Court decision, Alaska’s marijuana law is still contested Last update: June 15, 2010 On April 13, Alaska lost a champion for sensible marijuana policy when Irwin Ravin passed away at the age of 70. Ravin was the plaintiff — and, along with his law partner Robert Wagstaff, one of the attorneys — in the landmark 1975 Alaska Supreme Court case that ruled that although there was no state constitutional right to possess, ingest, purchase, or sell marijuana, the state constitution’s right to privacy included a right to privacy in one’s home, giving Alaskans the right to personal possession in their homes. Since then, lawmakers and reformers have been fighting over the implications of that case, Ravin v. Alaska. In 2006, the legislature and the executive branch attempted to re-criminalize marijuana legislatively. The legislature passed and then-Gov. Frank Murkowski (R) signed House Bill 149, which among other things sought to re-criminalize marijuana possession in one’s home. That attempt was challenged in court, but the issue has not been decided on its merits. On June 5, 2006, the ACLU of Alaska filed suit against the new law. Among other things, House Bill 149 effectively re-criminalized possession of small amounts of marijuana by adults in the privacy of their homes. ...   Visit - http://www.regulatemarijuanainalaska.org/home/.

Alaska - Law: Alaska Marijuana Laws Alaska Marijuana Laws | In November 2014, Alaska voters adopted an initiative legalizing personal, nonmedical use of marijuana in the state. The initiative, Ballot Measure 2, expands the legalized possession of marijuana for personal use by adults and sets up a system to license, regulate, and tax commercial production, processing, and sales of the drug for personal use. Ballot Measure 2 The new Alaska law legalizes the possession of marijuana by adults age 21 and over for personal, nonmedical use. Alaska has an existing medical marijuana law that allows use for certified medical purposes. Ballot Measure 2 expressly states that it will not “diminish the rights” of medical marijuana patients under Alaska’s existing medical marijuana law.

Commercial sale and regulation | The Alaska Alcohol Beverage Control Board has nine months to enact regulations for the production, processing, and sale of marijuana for personal use. The regulatory board will begin accepting applications from those interested in growing, processing, or selling marijuana one year after the effective date of the law. The law allows municipalities to ban retail marijuana establishments, but cities may not ban personal possession or marijuana growing for personal use. Ballot Measure 2 creates the following types of marijuana establishments: retail stores, cultivation facilities, marijuana-infused product manufacturers (to make edibles and extracts for vaporizer pens), and testing facilities. Under the new law, Alaska imposes a $50 excise tax on every ounce of marijuana sold or transferred from a cultivation or production facility to a retail outlet.

Distribution | Alaskans will not be able to sell marijuana for personal, nonmedical use legally anywhere in the state until sometime in after licenses are issued and retail operations begin (see above). However, as soon as the law takes effect, it will be legal for anyone age 21 or over give up to one ounce of marijuana or up to six immature marijuana plants to another person age 21 or over for personal, nonmedical use. Such exchanges are legal only if they are gifts; nothing of value may be exchanged for the marijuana. >> http://www.criminaldefenselawyer.com/marijuana-laws-and-penalties/alaska.htm

Another reporter added: "Alaska has has a medical marijuana law since March, 1999: "Fifty-eight percent of voters approved Ballot Measure #8 on November 3, 1998. The law took effect on March 4, 1999. It removes state-level criminal penalties on the use, possession and cultivation of marijuana by patients who possess written documentation from their physician advising that they "might benefit from the medical use of marijuana." Patients diagnosed with the following illnesses are afforded legal protection under this act: cachexia; cancer; chronic pain; epilepsy and other disorders characterized by seizures; glaucoma; HIV or AIDS; multiple sclerosis and other disorders characterized by muscle spasticity; and nausea. AMENDMENTS: Yes. Senate Bill 94, which took effect on June 2, 1999, mandates all patients seeking legal protection under this act to enroll in the state patient registry and possess a valid identification card. Patients not enrolled in the registry will no longer be able to argue the \"affirmative defense of medical necessity\" if they are arrested on marijuana charges.\" Source: http://www.norml.com/index.cfm?Group_ID=4522&wtm_view=medical" Law Enforcement: According to the Alaska state constitution a person can LEGALLY own up to 24 Marijuana plants and 4oz of pot. Fairbanks, AK | Worldwide Marijuana travel Guide with information about Marijuana prices all over the world ! Updated: 09/09/2007 - Smoking tolerance level: 4.9 - Legislation: It is illegal in the US, but highly decriminalized in AK. Until recently marijuana was illeagal here in Fairbanks, but this law was overturned in 2003 and now possession of up to four ounces of marijuana is legal. However if you are found with more than four ounces you can still face fines and some jail time.

Another reporter added: "Alaska has has a medical marijuana law since March, 1999: "Fifty-eight percent of voters approved Ballot Measure #8 on November 3, 1998. Law enforcement: Police normally won't bother you unless you are smoking out in the open, and even then they don't pay too much attention to you. up to 4oz. or 4 plants will be ignored as 'personal use.' Where to buy marijuana: Pretty much anywhere inside of the town, downtown is an especially active place for finding dealers and also by parks. Anyone who looks like a dealer probably is, so just go up to them and tell them that you are going through a dry spell and they can probably help you out. another reporter added: "You can ask nearly anyone down town, off of South Cushman St., in North Pole, off College Rd., and, to a slightly lesser extent, at the University. Its good to know someone though, as we can have an occasional dry spell."

Marijuana prices: Depends on who you buy it from, most prices stay the same. About $20 for an gram, $45-$55 for an eighth, $90 to $100 for a quad, and $250-$300 for an ounce. another reporter added: "Normally always $50/8th, if your lucky $40-45. Sometimes you can get a gram for $20. It is pretty standard, but not exactly the cheapest. "

Marijuana brands: Not too sure of the names, however most any weed you get will be excellent. I have not found any weed that I did not like. Most weed here is grown indoors so the growers can carefully control the plants and modify them to be more potent. If you get bad stuff it was probably just a fluke and when you buy again you will get quality stuff. another reporter added: "There seems to be a wide range here. Not that I always expect the dealer to know what they are talking about, I have been told that I was getting 'God Bud', 'Iceburg' and I have been lucky enough to get the near legendary Matanuska Thunderfuck, which most people around here just refer to as Valley Bud."

More information: A cool place to smoke, you can go out to the woods and smoke and no one will ever find you. Lots of places to drive when your high, and good scenery. All in all a good place to come and smoke. There is no such thing as kind bud here because its all good. Even the not great stuff was good. I wouldn't drive while stoned though because, while pot is decriminalized here, cops hit very hard for driving while intoxicated because there are a lot of drunk drivers here. Fairbanks cops arn't too bad, but the North Pole cops have a reputation for being dicks. ...   Visit - http://www.webehigh.com/city/detail.php?CITYID=2603

Alaska, News - Alaska's legalization law takes effect Alaska's legalization law takes effect - Last update: September 9, 2016 | On November 4, 2014, Alaskans voted 53-47% to end decades of harmful and ineffective marijuana prohibition, and replace it with a system in which marijuana is taxed and regulated like alcohol. The initiative, which took effect on February 24, allows adults 21 years of age and older to possess up to one ounce of marijuana and grow up to six plants (three mature) in a private, secure location.   >> Visit - http://www.mpp.org/states/alaska/

Beginning in 2016, marijuana will be cultivated, tested, and sold by licensed, taxpaying businesses that require proof of age, instead of criminal enterprises in the underground market. Read a summary of the law here. As the law took effect, we launched Consume Responsibly bus ads explaining, “With great marijuana laws comes great responsibility.” Thank you for helping us make history in Alaska! Passage of this initiative not only made Alaska the third state to regulate marijuana like alcohol (along with Colorado and Washington), but it also provides much needed clarity to the state’s current marijuana laws, which are complex and counterproductive. Congratulations to the Last Frontier and to everyone at the Campaign to Regulate Marijuana Like Alcohol!

Already, since Election Day, advocates have persuaded Anchorage elected officials to defeat a ban on marijuana businesses and have persuaded legislative committees not to replace Measure 2’s comprehensive legal protections with a mere defense.

Agency rules to regulate marijuana under Measure 2 now being considered | Alaska’s new Marijuana Control Board continues the process of considering rules for the emerging adult consumer market and appears to be on track to finalize them by the deadline in late November. Beginning in 2016, marijuana will be cultivated, tested, and sold by licensed, taxpaying businesses that require proof of age, instead of criminal enterprises in the underground market. Read a summary of the law here. As the law took effect, we launched Consume Responsibly bus ads explaining, “With great marijuana laws comes great responsibility.” Stay tuned for alerts as the process continues. You can also find updates on the website for Alaska’s Alcoholic Beverage Control Board here.   >> Visit - http://www.mpp.org/states/alaska/

First retail business license issued as cannabis café rules appear to stall | The Marijuana Control Board issued the state’s first retail business license on September 8, 2016, reaching yet another milestone in the rollout of the state’s regulatory program. Many other license applications continue to be reviewed, and that process continues. Unfortunately, the board’s commitment to establish rules for cannabis cafés by now seems to have stalled. With establishments that provide alcohol commonly available for most adults, it is reasonable for those 21 and over to have access to locations that provide a safer substance — whether they are residents or not. We are monitoring the situation closely and encourage Alaska to follow through with its sensible solution to a problem that has persisted in other similar state programs.

Stay connected! | So far, advocates have persuaded legislative committees not to replace Measure 2’s comprehensive legal protections with a mere defense, persuaded Anchorage elected officials to defeat a ban on marijuana businesses, helped establish protections for cannabis cafés, and avoided a harmful ban on businesses in unincorporated parts of the state. If you have not already, please subscribe to MPP's free legislative alert service and like the Campaign to Regulate Marijuana Like Alcohol in Alaska on Facebook. We're keeping our subscribers posted as we work with our local allies to ensure Measure 2 is faithfully implemented. For specifics on the state program, including a calendar with important benchmarks, an FAQ, the most recently proposed cannabis café regulations, and training videos for applicants, click here.   >> Visit - http://www.mpp.org/states/alaska/

Alaska - News: Alaska Becomes Fourth State To Legalize Recreational Marijuana Alaska Becomes Fourth State To Legalize Recreational Marijuana (11/05/2014) | Alaska legalized recreational marijuana for adult use on Tuesday, becoming the fourth state in the nation to do so. The state joined Oregon and Washington, D.C., both of which also voted Tuesday to legalize the drug for recreational use. Colorado and Washington state legalized recreational cannabis use in 2012.

Alaska voters approved Measure 2, which legalizes the possession, use and sale of the drug for recreational use. Adults age 21 and older may possess up to 1 ounce of marijuana and grow up to six plants (with no more than three being mature) for personal use. The measure also legalizes the manufacture, sale and possession of marijuana paraphernalia, such as devices used for smoking or storing the plant. In a statement early Wednesday morning, Marijuana Policy Project Executive Director Rob Kampia said, “The folks trying to keep marijuana illegal are relying on the same scare tactics today that they have relied on for decades, but voters just aren’t falling for it anymore. The results are particularly encouraging since voter turnout during a midterm election is typically smaller, older, and more conservative. Clearly, support for ending marijuana prohibition spans the political and ideological spectrums."

Though Alaska was not the only place to weigh the issue on Tuesday, the fate of the measure in that state seemed the most uncertain. Two polls released on the same day last month appeared to reach near-opposite conclusions about the sentiments of Alaska voters, with one poll finding 53 percent opposing legalization and the other finding 57 percent supporting it. >> http://www.huffingtonpost.com/2014/11/05/alaska-marijuana-legalization_n_5947516.html

Alaska - News: Is Growing Marijuana Legal In Alaska? Is Growing Marijuana Legal In Alaska? (December 28, 2011) | Growing up in the Pacific Northwest in the days before the internet, there was always a rumor that growing marijuana in Alaska was legal. I always dismissed it as a marijuana myth until I started studying marijuana law when I was older. It always surprises me how few marijuana consumers know about the legendary case of Ravin v. State of Alaska (1975). For those that just want the summary, I think Alaska NORML summarizes it best, “Possession of less than 25 plants is protected under the Alaska Constitution’s right to privacy.” The constitutionality of Alaska’s statute prohibiting possession of marijuana is put in issue in this case. Petitioner Ravin was arrested in 1972 and charged with violating AS 17.12.010. Before trial Ravin attacked the constitutionality of AS 17.12.010 by a motion to dismiss in which he asserted that the State had violated his right of privacy under both the federal and Alaska constitutions, and further violated the equal protection provisions of the state and federal constitutions….

Here Ravin raises two basic claims: first, that there is no legitimate state interest in prohibiting possession of marijuana by adults for personal use, in view of the right to privacy; and secondly, that the statutory classification of marijuana as a dangerous drug, while use of alcohol and tobacco is not prohibited, denies him due process and equal protection of law. Ravin’s arguments necessitate a close examination of the contours of the asserted right to privacy and the scope of this court’s review of the legislature’s determination to criminalize possession of marijuana. >> http://www.theweedblog.com/is-growing-marijuana-legal-in-alaska/

Alaska - Law: How To Grow Bud Alaska Law by How To Grow Bud (October 5, 2009) | Ballot Measure 8 was passed on November 3rd, 1998 by 58% of voters and took effect on June 2nd, 1999. Ballot Measure 8 was then amended by Senate Bill 94, which mandated that all patients seeking legal protection under this act MUST enroll in the state patient registry and possess a valid identification card. The patient applicant must, in addition to submitting the necessary fees with the application, provide a legible photocopy of the Alaska State Driver’s License or Identification Card of the patient and all caregivers.

The Alaska state medical marijuana law does not provide any method for patients to receive medical marijuana. There is no place in the State of Alaska to legally purchase medical marijuana. Qualified medical marijuana patients cannot go to a pharmacy to fill a prescription for medical marijuana. Pharmacies can only dispense medications that are “prescribed.” The Alaska State medical marijuana law does not allow for Dispensing Collectives or Cooperatives. Specifically, a patient, primary caregiver, or alternate caregiver may not sell or distribute marijuana to any person, except that a patient may deliver marijuana to the patient’s primary caregiver and a primary caregiver may deliver marijuana to the patient for whom the caregiver is listed.

Alaska Residents: Alaska currently has no reciprocity agreements with other states to honor Alaska’s medical marijuana law. This includes even those states that currently have medical marijuana laws of their own. However, in Montana, medical marijuana patients from other states who are valid medical marijuana patients under that state’s law are protected under Section 4(8) of the Montana Medical Marijuana Act [Sec. 50-46-201(8), MCA]. Additionally, in Rhode Island, The Edward O. Hawkins and Thomas C. Slater Medical Marijuana Act (MMA) protects patients and primary caregivers from outside Rhode Island who have a state issued medical marijuana ID card, or its equivalent. >> http://www.howtogrowbud.com/alaska/

Medical Cannabis, History - Letter: Medical Marijuana Informational Guide on Medical Cannabis | If you have ever heard of the song, “Lets Go Get Stoned,” as sung by Ray Charles or Joe Cocker, you know the lyrics were referring to getting high or using cannabis aka marijuana. This mind altering drug goes by other names as well; names such as weed, pot, joint, blunt, hash and mary jane are quite common among users. Cannabis is a plant that contains a chemical called cannabinoids or cannabinolidic acids. Another substance that is found in cannabis is THC, or Tetrahydrocannabinol, which gives the users that “high” sensation. When speaking of marijuana, the actual substance used in creating the high feeling comes from the leaves and flowering tops of the cannabis plant. Marijuana is considered to be a schedule 1 controlled substance today, because of the THC, which can be highly potent, depending upon the concentration factor of the THC. Medical Cannabis - Proven : Cannabis is Safe Medicine Proven : Cannabis is Safe Medicine by Ian Williams Goddard | In reaction to medical cannabis access referendums on the ballots in Arizona and California, former presidents Gerald Ford, Jimmy Carter, and George Bush signed a letter stating that they "categorically oppose'' access to cannabis for its many proven therapeutic uses such as the prevention of blindness and epileptic seizures. Their chief concern was that legal medical access would send the message that cannabis is safe. The presidents can, however, lay their safety concerns to rest because the scientific literature overwhelmingly confirms that cannabis is both an effective and safe medicine. The Cannabis Safety Profile. The journal PHARMACOLOGICAL REVIEWS reports that decades of research prove that, "Compared with legal drugs...marijuana does not pose greater risks." Yet based upon mortality statistics, we can safely conclude that cannabis is one of the safest medical drugs known, for, while prescription drugs, defined as safe by the FDA, kill up to 27,000 and aspirin up to 1,000 Americans per year, cannabis kills 0 per year. Because our market is so small I am acting as my own distribution system and thereby making this material available at a significant cost saving to the grower. "I try and stay away from politics in this column. Gardening is not supposed to be controversial or divisive (once you stop using poisonous chemicals, that is). Still, it's been my habit to vent a bit in the last column of the year. I suspect this year's comments might be a bit more controversial than others. I hope not. The fact of the matter is that as the garden columnist for a paper in a state that has just voted to legalize the recreational use of pot -- and the possession of up to six cannabis plants -- I find myself in an unusual position. Should I write about this soon-to-be-legal plant >> www.adn.com/article/20141108/weed-really-legal-and-other-things-you-need-know-about-marijuana-alaska << or do I continue to treat it as if it were illegal?

Normally, I would check my trusty Garden Writers Manual for advice, but given that Alaska is only the fourth state to re- legalize use of pot, there isn't anything on the matter. I am on my own, perhaps even setting the policy for other garden writers in other states that will eventually legalize pot. I know that writing about this plant has the potential to upset a portion of my readership. Cannabis sativa is a plant that has been maligned for reasons political as well as economic, with screaming racial overtones (which is why I call it by its proper Latin name, cannabis, and not "marijuana"¯). Most don't realize that some mere 70 years ago, I would have written about Cannabis sativa for both medicinal uses and fiber production and no one would have blinked an eye.

This was before the likes of Randolph Hearst, who wanted paper to come from his pulp, not hemp, and Harry J. Anslinger, fresh new head of a federal agency that he needed to grow into a bureaucracy -- and so repeatedly claimed cannabis made people commit violent crimes and otherwise act like antisocial maniacs. What ensued really was "reefer madness" (fueled in the recent election, in my opinion). It is time to stop this nonsense. "

All these years she did nothing other than adjust his medications for Plantar Fasciitis. Now, she told him yesterday that his condition progressed into a more serious form of arthritis and she gave him 70 pills of vicodin, and she referred him to a specialist next month. Not to mention she wants to put him in some kind of program that will help him with his medication cost, at about 50 thousand a year, something she wants to prescribe. She is dead set against medical marijuana and what do we do? There are so many people who are dying every day from prescription drugs or whose lives depend on prescription drugs or who is on their way to addiction to prescription drugs. I have lost family and I have family who are addicted. My brother needs help, he has a 2 month old, 2 y.o. and a 3 y.o. he cant take heavy drugs. Him and his family are already struggeling, why more pills. He lives in Juneau, Alaska. My email - yaandaayein@yahoo.com - thanks for your time."
