Recreational Marijuana Use in Alaska
Alaska has, to a certain extent, decriminalized cannabis. First offenses for possession of 1oz or less of marijuana in your residence or home will not attract a jail sentence or a criminal record; mostly it will be viewed in the same way as a minor traffic violation.
Possession of larger amounts or sale of any amounts will attract penalties: the maximum penalty for possession is 5 years in jail and $50,000 fine; maximum penalty for supply is the same.
Medical Marijuana Use in Alaska
Possession: patients (or their primary caregivers) may legally possess no more than one ounce of usable marijuana.
Cultivation: patients (or their primary caregivers) may legally cultivate no more than six marijuana plants, of which no more than three may be mature.
Registration: a confidential state-run patient registry issues identification cards to qualifying patients.
Caregivers: caregivers must be no younger than 21 years and have never had a felony conviction connected with controlled substances. The patient may list one primary caregiver and one alternate caregiver in the registry and caregivers may only be listed for one patient at a time.
The chosen caregiver must be certified by the patient as being either the primary or alternate caregiver, “unless the primary caregiver or alternate caregiver is simultaneously caring for two or more patients who are related to the caregiver by at least the fourth degree of kinship by blood or marriage.”

Registration of both patient and caregiver required for medical marijuana use; here is what you need to do:
1. Download and complete the Medical Marijuana Packet then send it, together with the following items, to the address below
2. $25.00 for first applications or $20.00 for timely renewals
3. A copy of your Alaska State Driver’s License or Identification Card.
4. A copy of your caregivers’ Alaska State Driver’s License or Identification Card.
5. A signed statement from your physician as follows:
i. Stating that the physician personally examined the patient and that the examination took place in the context of a bona-fide physician-patient relationship and setting out the date the examination occurred;
ii. Stating that the patient has been diagnosed with a debilitating medical condition;
iii. Stating that the physician has considered other approved medications and treatments that might provide relief, that are reasonably available to the patient, and that can be tolerated by the patient, and that the physician has concluded that the patient might benefit from the medical use of marijuana.

Chapter 17.37. MEDICAL USES OF MARIJUANA -
Sec. 17.37.010. Registry of patients and listing of caregivers.
(a) The department shall create and maintain a confidential registry of patients who have applied for and are entitled to receive a registry identification card according to the criteria set out in this chapter.
The registry must also contain the name of the primary caregiver and the name of the alternate caregiver of a patient, if either is designated by the patient. Only one primary caregiver and one alternate caregiver may be listed in the registry for a patient. The registry and the information contained within it are not a public record under AS 40.25.100 - 40.25.220.

Summary:
The Alaska Medical Marijuana law was adopted in 1998 and was later amended in 1999. The amendment required anyone seeking to use medical need as an affirmative defense for marijuana charges be registered with the state.
As with most states, the four items of requirement for application are: a registry identification application, a signed physician’s statement, a caregiver application (if necessary), and a photocopy of a valid Alaska State ID or Driver’s License for both patient and caregiver. The process must be completed annually, and if the applicant is denied he/she must wait six months to reapply. The cost of the initial application is $25 and renewals are $20.

In November 2014, Alaska voters adopted an initiative legalizing personal, nonmedical use of marijuana in the state. The initiative, Ballot Measure 2, expands the legalized possession of marijuana for personal use by adults and sets up a system to license, regulate, and tax commercial production, processing, and sales of the drug for personal use.
Ballot Measure 2
The new Alaska law legalizes the possession of marijuana by adults age 21 and over for personal, nonmedical use. Alaska has an existing medical marijuana law that allows use for certified medical purposes. Ballot Measure 2 expressly states that it will not “diminish the rights” of medical marijuana patients under Alaska’s existing medical marijuana law.
Commercial sale and regulation

The Alaska Alcohol Beverage Control Board has nine months to enact regulations for the production, processing, and sale of marijuana for personal use. The regulatory board will begin accepting applications from those interested in growing, processing, or selling marijuana one year after the effective date of the law.
The law allows municipalities to ban retail marijuana establishments, but cities may not ban personal possession or marijuana growing for personal use.
Ballot Measure 2 creates the following types of marijuana establishments:
retail stores,
cultivation facilities,
marijuana-infused product manufacturers (to make edibles and extracts for vaporizer pens), and
testing facilities.
Under the new law, Alaska imposes a $50 excise tax on every ounce of marijuana sold or transferred from a cultivation or production facility to a retail outlet.

Alaskans will not be able to sell marijuana for personal, nonmedical use legally anywhere in the state until sometime in after licenses are issued and retail operations begin (see above).
However, as soon as the law takes effect, it will be legal for anyone age 21 or over give up to one ounce of marijuana or up to six immature marijuana plants to another person age 21 or over for personal, nonmedical use. Such exchanges are legal only if they are gifts; nothing of value may be exchanged for the marijuana.

Until recently marijuana was illeagal here in Fairbanks, but this law was overturned in 2003 and now possession of up to four ounces of marijuana is legal.
However if you are found with more than four ounces you can still face fines and some jail time.

Law enforcement: Police normally won't bother you unless you are smoking out in the open, and even then they don't pay too much attention to you.

Where to buy marijuana: Pretty much anywhere inside of the town, downtown is an especially active place for finding dealers and also by parks. Anyone who looks like a dealer probably is, so just go up to them and tell them that you are going through a dry spell and they can probably help you out.

Marijuana prices: Depends on who you buy it from, most prices stay the same. About $20 for an gram, $45-$55 for an eighth, $90 to $100 for a quad, and $250-$300 for an ounce.

Marijuana brands: Not too sure of the names, however most any weed you get will be excellent. I have not found any weed that I did not like. Most weed here is grown indoors so the growers can carefully control the plants and modify them to be more potent. If you get bad stuff it was probably just a fluke and when you buy again you will get quality stuff.

More information: A cool place to smoke, you can go out to the woods and smoke and no one will ever find you. Lots of places to drive when your high, and good scenery. All in all a good place to come and smoke.
There is no such thing as kind bud here because its all good. Even the not great stuff was good. I wouldn't drive while stoned though because, while pot is decriminalized here, cops hit very hard for driving while intoxicated because there are a lot of drunk drivers here. Fairbanks cops arn't too bad, but the North Pole cops have a reputation for being dicks.

Raich (2005) held in a 6-3 decision that the Commerce Clause of the United States Constitution allowed the federal government to ban the use of cannabis, including medical use even if local laws allow it.

The status of possessing an amount between one ounce and four ounces is unclear, pending clarification by the courts. Possession of 4 ounces or more of marijuana is a felony punishable by up to five years in prison and a fine of up to $50,000.
Possession of less than 25 plants is protected under the Alaska Constitution’s right to privacy (See Ravin v. Alaska). Possession of 25 or more marijuana plants is “Misconduct involving a controlled substance in the fourth degree” and is punishable by a fine of up to $50,000 or five years in prison.

Alaska's legalization law takes effect

On November 4, 2014, Alaskans voted 53-47% to end decades of harmful and ineffective marijuana prohibition, and replace it with a system in which marijuana is taxed and regulated like alcohol.
The initiative, which took effect on February 24, allows adults 21 years of age and older to possess up to one ounce of marijuana and grow up to six plants (three mature) in a private, secure location.

Beginning in 2016, marijuana will be cultivated, tested, and sold by licensed, taxpaying businesses that require proof of age, instead of criminal enterprises in the underground market. Thank you for helping us make history in Alaska! Passage of this initiative not only made Alaska the third state to regulate marijuana like alcohol (along with Colorado and Washington), but it also provides much needed clarity to the state’s current marijuana laws, which are complex and counterproductive. Already, since Election Day, advocates have persuaded Anchorage elected officials to defeat a ban on marijuana businesses
and have persuaded legislative committees not to replace Measure 2’s comprehensive legal protections with a mere defense.
Agency rules to regulate marijuana under Measure 2 now being considered
| Alaska’s new Marijuana Control Board continues the process of considering rules for the emerging adult consumer market and appears to be on track to finalize them by the deadline in late November. Beginning in 2016, marijuana will be cultivated, tested, and sold by licensed, taxpaying businesses that require proof of age, instead of criminal enterprises in the underground market.

First retail business license issued as cannabis café rules appear to stall

The Marijuana Control Board issued the state’s first retail business license on September 8, 2016, reaching yet another milestone in the rollout of the state’s regulatory program. Many other license applications continue to be reviewed, and that process continues.
Unfortunately, the board’s commitment to establish rules for cannabis cafés by now seems to have stalled. With establishments that provide alcohol commonly available for most adults, it is reasonable for those 21 and over to have access to locations that provide a safer substance — whether they are residents or not. We are monitoring the situation closely and encourage Alaska to follow through with its sensible solution to a problem that has persisted in other similar state programs.

So far, advocates have persuaded legislative committees not to replace Measure 2’s comprehensive legal protections with a mere defense, persuaded Anchorage elected officials to defeat a ban on marijuana businesses, helped establish protections for cannabis cafés, and avoided a harmful ban on businesses in unincorporated parts of the state.

Alaska Becomes Fourth State To Legalize Recreational Marijuana

Alaska legalized recreational marijuana for adult use on Tuesday, becoming the fourth state in the nation to do so.
The state joined Oregon and Washington, D.C., both of which also voted Tuesday to legalize the drug for recreational use.
Colorado and Washington state legalized recreational cannabis use in 2012.
Alaska voters approved Measure 2, which legalizes the possession, use and sale of the drug for recreational use. Adults age 21 and older may possess up to 1 ounce of marijuana and grow up to six plants (with no more than three being mature) for personal use. The measure also legalizes the manufacture, sale and possession of marijuana paraphernalia, such as devices used for smoking or storing the plant.
In a statement early Wednesday morning, Marijuana Policy Project Executive Director Rob Kampia said, “The folks trying to keep marijuana illegal are relying on the same scare tactics today that they have relied on for decades, but voters just aren’t falling for it anymore. The results are particularly encouraging since voter turnout during a midterm election is typically smaller, older, and more conservative. Clearly, support for ending marijuana prohibition spans the political and ideological spectrums."
Though Alaska was not the only place to weigh the issue on Tuesday, the fate of the measure in that state seemed the most uncertain.
Two polls released on the same day last month appeared to reach near-opposite conclusions about the sentiments of Alaska voters, with one poll finding 53 percent opposing legalization and the other finding 57 percent supporting it.

Is Growing Marijuana Legal In Alaska?

Growing up in the Pacific Northwest in the days before the internet, there was always a rumor that growing marijuana in Alaska was legal. I always dismissed it as a marijuana myth until I started studying marijuana law when I was older. It always surprises me how few marijuana consumers know about the legendary case of Ravin v. State of Alaska (1975). For those that just want the summary, I think Alaska NORML summarizes it best, “Possession of less than 25 plants is protected under the Alaska Constitution’s right to privacy.”
The constitutionality of Alaska’s statute prohibiting possession of marijuana is put in issue in this case. Petitioner Ravin was arrested in 1972 and charged with violating AS 17.12.010. Before trial Ravin attacked the constitutionality of AS 17.12.010 by a motion to dismiss in which he asserted that the State had violated his right of privacy under both the federal and Alaska constitutions, and further violated the equal protection provisions of the state and federal constitutions….
Here Ravin raises two basic claims: first, that there is no legitimate state interest in prohibiting possession of marijuana by adults for personal use, in view of the right to privacy; and secondly, that the statutory classification of marijuana as a dangerous drug, while use of alcohol and tobacco is not prohibited, denies him due process and equal protection of law.
Ravin’s arguments necessitate a close examination of the contours of the asserted right to privacy and the scope of this court’s review of the legislature’s determination to criminalize possession of marijuana.

Ballot Measure 8 was passed on November 3rd, 1998 by 58% of voters and took effect on June 2nd, 1999. Ballot Measure 8 was then amended by Senate Bill 94, which mandated that all patients seeking legal protection under this act MUST enroll in the state patient registry and possess a valid identification card.
The patient applicant must, in addition to submitting the necessary fees with the application, provide a legible photocopy of the Alaska State Driver’s License or Identification Card of the patient and all caregivers.
The Alaska state medical marijuana law does not provide any method for patients to receive medical marijuana. There is no place in the State of Alaska to legally purchase medical marijuana. Qualified medical marijuana patients cannot go to a pharmacy to fill a prescription for medical marijuana. Pharmacies can only dispense medications that are “prescribed.”
The Alaska State medical marijuana law does not allow for Dispensing Collectives or Cooperatives. Specifically, a patient, primary caregiver, or alternate caregiver may not sell or distribute marijuana to any person, except that a patient may deliver marijuana to the patient’s primary caregiver and a primary caregiver may deliver marijuana to the patient for whom the caregiver is listed.
Alaska Residents: Alaska currently has no reciprocity agreements with other states to honor Alaska’s medical marijuana law. This includes even those states that currently have medical marijuana laws of their own.
However, in Montana, medical marijuana patients from other states who are valid medical marijuana patients under that state’s law are protected under Section 4(8) of the Montana Medical Marijuana Act [Sec. 50-46-201(8), MCA].
Additionally, in Rhode Island, The Edward O. Hawkins and Thomas C. Slater Medical Marijuana Act (MMA) protects patients and primary caregivers from outside Rhode Island who have a state issued medical marijuana ID card, or its equivalent.

This mind altering drug goes by other names as well; names such as weed, pot, joint, blunt, hash and mary jane are quite common among users. Cannabis is a plant that contains a chemical called cannabinoids or cannabinolidic acids.
Another substance that is found in cannabis is THC, or Tetrahydrocannabinol, which gives the users that “high” sensation. When speaking of marijuana, the actual substance used in creating the high feeling comes from the leaves and flowering tops of the cannabis plant. 1. Since 1996, twelve states have legalized medical marijuana use: AK, CA, CO, HI, ME, MT, NV, NM, OR, RI, VT, and WA. Eight of the twelve did so through the initiative process. Hawaii's law was enacted by the legislature and signed by the governor in 2000, Vermont's was enacted by the legislature and passed into law without the governor's signature in May 2004, Rhode Island's was passed into law over the governor's veto in January 2006, and New Mexico's legislation was signed into law by Governor Bill Richardson on April 2, 2007.
