    Alaska Marijuana News > Commercial marijuana is almost here, and Alaska's government is feeling the strain | A state government that's already lost hundreds of jobs this year is grappling with how to balance that with the workload that comes with the emergence of an entirely new industry: marijuana. Some Alaska municipalities have a plethora of questions about rules for new marijuana businesses — how to measure the distance from a business to a church? What types of signs can entrepreneurs have? — and the state's Alcohol and Marijuana Control Office doesn't have the time or resources to answer every one. Meanwhile, the digital paperwork for new marijuana business applications just keeps rolling in.

    Sarah Daulton Oates, a program coordinator at the Alcohol and Marijuana Control Office, said that the staff of 15 people (plus a director) has been shorthanded in trying to keep up with all the inquiries and applications. "It's a ton of work," Daulton Oates said. "We've had a lot of pressure with local governments who are trying to figure out how to write their own laws." >> Read more >>

    Alaska has Legalization (Cannabis) LAW Reform in progress

    SUMMARY: Fifty-two percent of Alaska voters approved Ballot Measure 2. Under the measure, the adult possession of up to one ounce of cannabis as well as the cultivation of up to six-plants for personal consumption will be legal and untaxed. Commercial production and retail sales of cannabis will be subject to licensing and taxation.     Since 1975, Alaskans have enjoyed personal privacy protections allowing for the possession and cultivation of small quantities of cannabis. However, state law has never before permitted a legal market for marijuana production and sales.     Alaska MEDICAL MARIJUANA (cannabis) LAW

    SUMMARY: Fifty-eight percent of voters approved Ballot Measure #8 on November 3, 1998. The law took effect on March 4, 1999. It removes state-level criminal penalties on the use, possession and cultivation of marijuana by patients who possess written documentation from their physician advising that they "might benefit from the medical use of marijuana."

    Approved Conditions: Patients diagnosed with the following illnesses are afforded legal protection under this act: cachexia; cancer; chronic pain; epilepsy and other disorders characterized by seizures; glaucoma; HIV or AIDS; multiple sclerosis and other disorders characterized by muscle spasticity; and nausea. Other conditions are subject to approval by the Alaska Department of Health and Social Services. Patients (or their primary caregivers) may legally possess no more than one ounce of usable marijuana, and may cultivate no more than six marijuana plants, of which no more than three may be mature. The law establishes a confidential state-run patient registry that issues identification cards to qualifying patients.

    Amended: Senate Bill 94 Effective: June 2, 1999 Mandates all patients seeking legal protection under this act to enroll in the state patient registry and possess a valid identification card. Patients not enrolled in the registry will no longer be able to argue the "affirmative defense of medical necessity" if they are arrested on marijuana charges.

    Update: Alaska Statute Title 17 Chapter 37 (PDF 36KB) Creates a confidential statewide registry of medical marijuana patients and caregivers and establishes identification card.

    MEDICAL MARIJUANA STATUTES: Alaska Stat. §§ 17.37.10 - 17.37.80 (2007).

    CAREGIVERS: Yes. The caregiver must be 21 years of age or older. The caregiver can never have been convicted of a felony controlled substances offense. The caregiver must be listed by the patient as either the primary caregiver or an alternate caregiver. Only one primary caregiver and one alternate caregiver may be listed in the registry for a patient. A person may be a primary caregiver or alternate caregiver for only one patient at a time, unless the primary caregiver or alternate caregiver is simultaneously caring for two or more patients who are related to the caregiver by at least the fourth degree of kinship by blood or marriage. Alaska Stat. §17.37.010 (2007).

    Alaska - The Laws concerning marijuana Regulate Marijuana In Alaska Thirty-five years after landmark Alaska Supreme Court decision, Alaska’s marijuana law is still contested Last update: June 15, 2010 On April 13, Alaska lost a champion for sensible marijuana policy when Irwin Ravin passed away at the age of 70. Ravin was the plaintiff — and, along with his law partner Robert Wagstaff, one of the attorneys — in the landmark 1975 Alaska Supreme Court case that ruled that although there was no state constitutional right to possess, ingest, purchase, or sell marijuana, the state constitution’s right to privacy included a right to privacy in one’s home, giving Alaskans the right to personal possession in their homes. Since then, lawmakers and reformers have been fighting over the implications of that case, Ravin v. Alaska. In 2006, the legislature and the executive branch attempted to re-criminalize marijuana legislatively. The legislature passed and then-Gov. Frank Murkowski (R) signed House Bill 149, which among other things sought to re-criminalize marijuana possession in one’s home. That attempt was challenged in court, but the issue has not been decided on its merits. On June 5, 2006, the ACLU of Alaska filed suit against the new law.     Law enforcement: Police normally won't bother you unless you are smoking out in the open, and even then they don't pay too much attention to you. up to 4oz. or 4 plants will be ignored as 'personal use.' Where to buy marijuana: Pretty much anywhere inside of the town, downtown is an especially active place for finding dealers and also by parks.     More information: A cool place to smoke, you can go out to the woods and smoke and no one will ever find you. Lots of places to drive when your high, and good scenery. All in all a good place to come and smoke. There is no such thing as kind bud here because its all good. Even the not great stuff was good.     Alaska, News - Alaska's legalization law takes effect Alaska's legalization law takes effect - Last update: September 9, 2016 | On November 4, 2014, Alaskans voted 53-47% to end decades of harmful and ineffective marijuana prohibition, and replace it with a system in which marijuana is taxed and regulated like alcohol.     Beginning in 2016, marijuana will be cultivated, tested, and sold by licensed, taxpaying businesses that require proof of age, instead of criminal enterprises in the underground market.     First retail business license issued as cannabis café rules appear to stall | The Marijuana Control Board issued the state’s first retail business license on September 8, 2016, reaching yet another milestone in the rollout of the state’s regulatory program. Many other license applications continue to be reviewed, and that process continues. Unfortunately, the board’s commitment to establish rules for cannabis cafés by now seems to have stalled. With establishments that provide alcohol commonly available for most adults, it is reasonable for those 21 and over to have access to locations that provide a safer substance — whether they are residents or not. We are monitoring the situation closely and encourage Alaska to follow through with its sensible solution to a problem that has persisted in other similar state programs.

    Alaska - News: Alaska Becomes Fourth State To Legalize Recreational Marijuana Alaska Becomes Fourth State To Legalize Recreational Marijuana (11/05/2014) | Alaska legalized recreational marijuana for adult use on Tuesday, becoming the fourth state in the nation to do so. The state joined Oregon and Washington, D.C., both of which also voted Tuesday to legalize the drug for recreational use. Colorado and Washington state legalized recreational cannabis use in 2012.

    Alaska voters approved Measure 2, which legalizes the possession, use and sale of the drug for recreational use. Adults age 21 and older may possess up to 1 ounce of marijuana and grow up to six plants (with no more than three being mature) for personal use. The measure also legalizes the manufacture, sale and possession of marijuana paraphernalia, such as devices used for smoking or storing the plant. In a statement early Wednesday morning, Marijuana Policy Project Executive Director Rob Kampia said, “The folks trying to keep marijuana illegal are relying on the same scare tactics today that they have relied on for decades, but voters just aren’t falling for it anymore. The results are particularly encouraging since voter turnout during a midterm election is typically smaller, older, and more conservative. Clearly, support for ending marijuana prohibition spans the political and ideological spectrums."

    Though Alaska was not the only place to weigh the issue on Tuesday, the fate of the measure in that state seemed the most uncertain. (December 28, 2011) | Growing up in the Pacific Northwest in the days before the internet, there was always a rumor that growing marijuana in Alaska was legal. I always dismissed it as a marijuana myth until I started studying marijuana law when I was older. It always surprises me how few marijuana consumers know about the legendary case of Ravin v. State of Alaska (1975). For those that just want the summary, I think Alaska NORML summarizes it best, “Possession of less than 25 plants is protected under the Alaska Constitution’s right to privacy.” The constitutionality of Alaska’s statute prohibiting possession of marijuana is put in issue in this case. Petitioner Ravin was arrested in 1972 and charged with violating AS 17.12.010. Before trial Ravin attacked the constitutionality of AS 17.12.010 by a motion to dismiss in which he asserted that the State had violated his right of privacy under both the federal and Alaska constitutions, and further violated the equal protection provisions of the state and federal constitutions….

    Here Ravin raises two basic claims: first, that there is no legitimate state interest in prohibiting possession of marijuana by adults for personal use, in view of the right to privacy; and secondly, that the statutory classification of marijuana as a dangerous drug, while use of alcohol and tobacco is not prohibited, denies him due process and equal protection of law.     Alaska - Law: How To Grow Bud Alaska Law by How To Grow Bud (October 5, 2009) | Ballot Measure 8 was passed on November 3rd, 1998 by 58% of voters and took effect on June 2nd, 1999. Ballot Measure 8 was then amended by Senate Bill 94, which mandated that all patients seeking legal protection under this act MUST enroll in the state patient registry and possess a valid identification card. The patient applicant must, in addition to submitting the necessary fees with the application, provide a legible photocopy of the Alaska State Driver’s License or Identification Card of the patient and all caregivers.

    The Alaska state medical marijuana law does not provide any method for patients to receive medical marijuana. There is no place in the State of Alaska to legally purchase medical marijuana. Qualified medical marijuana patients cannot go to a pharmacy to fill a prescription for medical marijuana. Pharmacies can only dispense medications that are “prescribed.” The Alaska State medical marijuana law does not allow for Dispensing Collectives or Cooperatives. Specifically, a patient, primary caregiver, or alternate caregiver may not sell or distribute marijuana to any person, except that a patient may deliver marijuana to the patient’s primary caregiver and a primary caregiver may deliver marijuana to the patient for whom the caregiver is listed.

    Alaska Residents: Alaska currently has no reciprocity agreements with other states to honor Alaska’s medical marijuana law. This includes even those states that currently have medical marijuana laws of their own. However, in Montana, medical marijuana patients from other states who are valid medical marijuana patients under that state’s law are protected under Section 4(8) of the Montana Medical Marijuana Act [Sec. 50-46-201(8), MCA]. Additionally, in Rhode Island, The Edward O. Hawkins and Thomas C.     Normally, I would check my trusty Garden Writers Manual for advice, but given that Alaska is only the fourth state to re- legalize use of pot, there isn't anything on the matter. I am on my own, perhaps even setting the policy for other garden writers in other states that will eventually legalize pot. I know that writing about this plant has the potential to upset a portion of my readership. Cannabis sativa is a plant that has been maligned for reasons political as well as economic, with screaming racial overtones (which is why I call it by its proper Latin name, cannabis, and not "marijuana"ť). Most don't realize that some mere 70 years ago, I would have written about Cannabis sativa for both medicinal uses and fiber production and no one would have blinked an eye.

    This was before the likes of Randolph Hearst, who wanted paper to come from his pulp, not hemp, and Harry J. Anslinger, fresh new head of a federal agency that he needed to grow into a bureaucracy -- and so repeatedly claimed cannabis made people commit violent crimes and otherwise act like antisocial maniacs. What ensued really was "reefer madness" (fueled in the recent election, in my opinion). It is time to stop this nonsense. "
