Cannabis in Switzerland - Wikipedia, the free encyclopedia

Cannabis in Switzerland that contains more than 1,0 % of THC is classified as an illegal drug in Switzerland. Thus, according to the Federal Law on Drugs, production, culture, use and possession of cannabis are prohibited, and considered as criminal infringements. These infringements are punishable by three years of imprisonment, or by a fine.
Since 28 September 2012, the possession of less than 10 grams of cannabis is no longer a criminal infringement, but is still punished by a 100 Swiss francs flat fine. Professional cannabis trade, as well as the possession of a quantity of cannabis that can affect the health of a large number of people (4 kg of hashish, according to the Federal Court), are punished by one to three years of imprisonment, that can be cumulated with a fine.
The enforcement of the prohibition on cannabis is spotty, because around 500,000 Swiss people are believed to use cannabis regularly or occasionally. In a health poll conducted in 1997, 7% of people aged 15 to 39 stated that they were currently consuming cannabis. Overall, enforcement varies substantially depending on the canton.
On 5 October 2012, the Federal Court invalidated the Latin Concordat on hemp culture and trading, that came into force on 1 January 2012, which allowed private citizens in the cantons of Geneva, Freiburg, Valais, Vaud, Neuchâtel, Bâle-Town and Ticino to grow up to 4 hemp plants (containing less than 1% of THC), for violating the Federal Law on drugs.

UPDATE: This post has been the target of some controversy in the comments section, where there has been some confusion of whether Switzerland is indeed allowing the growth of 4 cannabis plants in someone’s home. Since we are one of the few English-speaking publications to address this issue, it has been hard to ascertain any information contrary to what is stated in the post below.
But thanks to a reader, we may be able to shed more light on the subject. Pat Mächler from the comments section emailed us about the story, and provided links to us that serve to clarify it. He sent us a link to it being covered in what they say is Switzerland’s largest circulating newspaper, which happens to be in French. You can find the English translation here.

The story states that people in Switzerland can indeed grow up to four plants in their home, but the THC content can in no case exceed 0.3%, basically meaning they can grow hemp.
In which case the new law seems rather useless. Hemp can be used for many things, but you can’t just cut down a plant and make a shirt.
There is industrialization involved, although hemp seeds can be eaten raw and it can be used in a variety of foods. But for those who seek relief in a medical sense and need THC to achieve that relief, that is still illegal in Switzerland.

Law enforcement:
Although it’s still illegal to smoke dope, Basel’s city prosecutor is known to tolerate doses up to 30 grams of marijuana. Dealing, however, is verboten.
Where to buy marijuana:
Marijuana can be found all over the city – if you know where to look. The easiest place to buy though is by the Rhine in Klein Basel, in between MittleBrucke and JohaniteBruke. All along the river (especially in Summer) there are groups of Africans and Moraccans selling bud, and hashish. Quality varies wildly from group to group – most will try and sell you outdoor grown swiss weed – but if you ask for it you can usually find some great indoor grown skunk. Hashish is just as easy to find in the same places, but the quality is not normally as good as the bud.
Marijuana Prices:
Typically 50chf for 3.5g of the outdoor weed, or for 2-3g of indoor.
Smaller bags are normally no problem – with prices at around 20chf for about 1g of indoor.
hashish is about the same price (50chf for an 8th) but most dealers will haggle a bit, especially if you want to buy alot.
Marijuana brands:
Only high potency no seeds weed is sold. You may find many brands for purchase.

Although technically illegal as a drug, marijuana production (agricultural and private) and distribution in the form of stores specializing in the sale of “hemp” products are found throughout the country. The report pointed out that marijuana cultivation in Switzerland had greatly increased during the 1990s and that most of the crop was destined for the illegal market rather than the legal one (e.g. as a renewable raw material for textile production). According to an investigation in all cantons, hashish was mainly sold on the street while marijuana was being sold more and more through hemp shops as “aromatic pillows.”
Switzerland is comprised of 26 states (cantons), each with its own constitution, parliament, government and court system as provided by the Federal Constitution. Understanding Switzerland’s political structure helps to understand its drug policy. It can be argued that Switzerland has 26 different drug polices, one for each canton and half-canton.
The police view is that the vast majority of hemp fields in Switzerland are used to produce cannabis supplied to the drug trade. It can be assumed that in 1998 considerably more than 100 metric tons of drug-grade cannabis were harvested. Today Switzerland has an almost nationwide network of 135 hemp shops.
The big increase started in 1996 and led to the creation of major centers in the city and canton of Zurich (a total of 36), in the canton of St. Gallen (18), in Ticino (16) in Basel (7) and in the canton of Berne (6). Police information shows that between 85 and 95 percent of sales in most hemp shops come from drug products (“hemp pillows”, “aromatic bags”, “refills for aromatic bags”, “hemp coins” etc.) The THC content of cannabis sold in “aromatic bags” is frequently between 8 and 10 percent, for example.

It is not legal to smoke pot in Switzerland, but very common.
Law enforcement:
It depends a bit from the Cantons, sometimes strict, sometimes really easy.
If they catch you with a small amounth, the leave you. Sometimes you get a fine.
Where to buy marijuana:
It is very easy to get weed and hash in a good quality. Go to the old town and ask young people there. Perhaps you get even a free smoke or even a good deal outside Restaurant St.Gervais.
Marijuana Prices:
Outdoor from 5 to 8 Swissfranc a gramm.
Indoor organic or hydroponic from 8 to 15 Swissfrancs.
Marocan, Lebanese or what ever Hash between 8 and 20 Francs.
Marijuana brands:
Unbelievibel but thru, you get even a better choice then in Amsterdam.
All kind of out-and indoorweed, local hash and hash who comes from everywhere on this world. People from Biel are really cannabislovers.

Switzerland is a federal state and the law on drugs is the same for all provinces. According to the Swiss law- it is illegal to own or carry pot or hash, except for private smoking involving small quantities in a private place.
In Switzerland there are many cantons, which each have there own rules so depending where you are marijuana is legal. In Zürich and Bern it has been legalized.
In Geneva the legalization of Marijuana is a big topic of debate, though due to huge demand it should be legalized quite soon.
Law enforcement:
In most of Switzerland where marijuana has not YET been legalized, its smoking is quiet tolerated by police and the general public as long as you are not causing any trouble.
Geneva is alot less strict that most other places I’ve been to, its pretty easy just to go to a small park and smoke quietly with some friends.
as long as u don’t make too much noise or cause trouble, and try not to smoke around police areas, then the police force doesn’t generally give you too much hassle. if you are caught it depends on the officer and your age, but they usually take it away from u and give you a warning (unless you have more than 1g or 2gs).

most of the time their cops usually around the docks and in the train station but its easy to find a place to chill try a place close to the bus stops making getting home blazed a lot easier.
Where to buy marijuana:
a park by the lake called parc de st jean is your best bet, its just by the bridge… go there and ask around… otherwise there are some rasta guys who sit by the port near rue du rhone, just go and ask them.
Although buying off the street is relatively risky as the police monitor many of the big dealers; the best places would be the park near the Jet d’eau (although all you can find there is hashish, but this tends to be relatively good quality), and the park across the bridge from the Stand tram stop. If you have problems finding just find some racailles (teenagers with tracksuits and baseball caps) and ask them. Most of them either deal or can direct you to the best weed in Geneva.
another report added: well you can try basicaly any of the parks around 10 at night or ask any of the teenagers with the white track suits on. go for the ones in white not blue the blue are French not swiss. any private dealer will give u a much better run for your money, don’t give the dealer the money befor u get the weed because a lot of time the guys in the park have weed hidden in a bush and go to get it.

Don’t walk around the main street with a spliff in your hand yelling I’m high.
Lots of nice secluded areas in and around the town were you can skin up and smoke away.

in Interlaken, Bern -
There are two train stations around interlaken (west and east(ost) and 1 main road connecting them.
Cruise to the west train station and walk under the station (the underpass to the other rail road tracks), just look for some younger swissie kids, they are very approachable, although a bit pricey for switzerland it’s still a good buy.
Marijuana Prices:
I wouldnt pay them any more than 15 swiss francs per gram of indoor and not more than 10 for outdoor.

most outdoor in this area is decent stuff apart from havin seeds.
indoor does the job though sometimes its not properly flushed and doesnt have the full taste.

The cops are almost not even there. It is tough to find places to smoke because the cops ride motorcycles and they can sneak up on you a little. That said, people openly smoke pot in public at the park so im guessing the cops might be a little lax.
Also, this place to go has been for a couple years with the same dude so i figure if there worth there weight in salt they would do something if they cared. So my advice to you is relax and indulge but if you see cops anywhere I would skat.
Where to buy marijuana:
There is a park by the lake – It’s big so you will find it for sure. Inside the park there is one path that is a circle. You follow that until you see a shelter looking structure and there will usually be chilling there. Make sure you go after 2 though because they do not usually get there until then. Anyways, there should be a scroungy looking guy there that has a brown and white pitt bull that he sometimes chills with. He will most likely approach you but if he doesn’t walk by him and say “Dove Ganja”. He is stingy and won’t negotiate on prices but hey that’s the spot i know…

Lugano Marijuana Prices: I paid 50 francs which is like 40 dollars maybe a little more. In the US i would not pay that much for the quality or quantity I received BUT like i said before thats the spot i know.

The weed he sells is decent. Its not anything that would be sold in Amsterdam but its not bad. There might be a seed or two. The buds have very dark hairs brown in color. I smoked two joints (one big one small) between 4 people and the high was nice and lasted for about 4 hours. It gave me bad cottonmouth but it might be a result drinking enough water.

Smoking is usually not risky on most spots, as there aren’t really that many cops. . If you do get in trouble, the police will write you a ticket and fine. Teenagers under 18 who are caught smoking pot, will be arrested until released by their parents.
Near the lake is probably the least safe place to smoke outdoors, while smoking indoors is safe.

in CH there are no more head shop after 2004 (i live there)..its so difficult now to find anything!!!
Buying Mrijuana or hash on the street is not recommended, but if you get to the Langstrasse area (which is also the red light district of Zurich), you will find street dealers.
Marijuana Prices:
4 grams of top quality pot costs about 50 francs = 40 USD.
For the same price, you may also get approx. 7 grams of top quality Hash.
The prices in Zurich have been stable for the last few years.

While it is technically illegal to light up that hash pipe while kicking back and taking in the sights, most police officers and locals will turn a blind eye and nose to your heavily scented smoke as long as your indulgence is subtle, and you’re over 18. The Swiss Federal Office of Public Health and the Federal Commission for Drug Issues are both pushing for liberalization of the nation’s drug laws to make dealing and smoking pot and hash a legal pastime.
“Altered habits of consumption have turned [cannabis] into a recreational drug enjoyed by a large percentage of the population, unaccompanied by any feelings of wrong doing and a world away from the consumption of ‘hard’ drugs,” the office of Public Health said.
The government is currently debating whether to adopt a system making personal consumption legal — similar to the situation in Amsterdam – or establish a completely legal cannabis marketplace.

As it's now autumn and winter comes next I was wondering if there is still the possibility of growing outdoors or do I need to wait for spring.

switzerland is separated into different cantons, think different states
as such I believe their policies on weed are separate based on each individual canton

Home growing was legalized there about a year ago. If I remember right, they can grow 4 plants for personal use. No retail sales or anything.

i live here. we can get the plants at shops but they are baby. its 100 franc fine for smoking in front of cops. its really stupid. its like half legal. growing was legalized in my canton but according to wikipedia it was overturned by the federal government. whether weed is legal or not, the reality is no one really cares. It really depends on the canton. My canton, close to france is more strict. the german cantons have more free flowing cannabis. for example solothurn is like dank weed city, while montreux is like rip off shwag city.
the answer to your question is half legal. we had a referendum on full legalization in 2008, where all of the swiss voted, but it was turned down like prop 19. we would have had shops and everything. i hope the next one will be very soon. anyone know when it is?

i will be going to switzerland in a month for skiing, and was starting to check up on the laws there. i have heard they are pretty relaxed, one of my german friends who used to live close to the swiss border said that they sell it in stores there. but then, last night i was watching a tv show, and they were talking drug tourism to switzerland (this is on german tv btw), and for a segment they followed the swiss police around while they were busting weed shops. now, these shops didnt mark themselves as such, but sold pretty openly. and, the police was busting them, as well as busting people that they saw who left the place.
now, from my research on the internet, i have come across all sorts of different opinions as to what the law in switzerland is. one site said that it is legal to grow, posses, and sell weed, but not smoke it. another one said that it varied by 'kanton' (state). some said that marijuana has not been decriminalized at all, but im sure thats not true as the police officer on the tv show said that the penalties that even the people who sold from the store were facing are very miniscule.
anyone know the de jure and de facto situation of weed in switzerland?

TRENTON BUREAU:
A Senate committee today cleared a measure that would allow medical use of marijuana in New Jersey.
The Senate Health, Human Services and Senior Citizens Committee voted to approve the long-stalled bill by a 6 to 1 margin; two senators abstained.
The bill calls for creating “alternative treatment centers” where people with chronic and terminal diseases would be allowed access to marijuana. Supporters say marijuana is a viable treatment option to alleviate pain in many cases.
“It is the definition of basic human decency that we do whatever we can to ease the pain and suffering of people living with severe chronic and terminal diseases,” said bill sponsor Sen. Nicholas Scutari, D-Union.
“When all other avenues of currently-approved pain relief have been exhausted, we need to give doctors the freedom to prescribe medical marijuana to give their patients a measure of comfort and dignity in the face of their debilitating diseases. This bill is about the most humane, compassionate option for those state residents who have nowhere else to turn in managing their illnesses.”
If ultimately approved by the full Legislature and signed by Governor Corzine, New Jersey would be the 14th state to allow medical use of marijuana.

A new study entitled Marijuana Effectiveness as an HIV Self-Care Strategy, which was released this past weekend in Clinical Nursing Research, indicates that persons living with HIV/AIDS rate cannabis as more effective in treating the symptoms of anxiety, depression, fatigue, diarrhea, and neuropathy than other prescription and over the counter medications.
The study, which was conducted over a two year period and included 775 patients from the USA, Africa, and Puerto Rico, assessed the use of cannabis as a symptom management approach for anxiety, depression, fatigue, diarrhea, nausea, and peripheral neuropathy. 27% of survey participants reported using cannabis for medicinal purposes.
Researchers wrote that cannabis use “was rated slightly more effective than antidepressants for anxiety and depression, Imodium for diarrhea, [over the counter] (OTC) medications for fatigue, and anti-epileptics and OTC medications for neuropathy” while cannabis was rated “slightly less effective for nausea than either prescribed or OTC medications.” Authors concluded that cannabis “is perceived by users as at least as effective as prescribed medications in symptom management.”

Switzerland has officially become the 23rd nation in the world to approve Sativex for use by those with multiple sclerosis; Sativex is a medical spray made up entirely of cannabis-derived cannabinoids.
“This approval in Switzerland marks yet another regulatory success for Sativex, which is now approved in a total of 23 countries,” stated Justin Gover, Chief Executive Officer of GW Pharmaceuticals, the company behind the product. “We now look forward to working with our partners.. towards this launch so as to enable MS patients in Switzerland to benefit from this important new treatment.”
According to the company’s press release; “Sativex is approved for use in the treatment of MS spasticity in 23 countries, including 17 countries in Europe. The medicine is currently available on prescription in the UK, Spain, Germany, Canada, Denmark, Norway, Israel, Switzerland, Poland, Sweden, Italy and Finland with launches currently in preparation for a further 8 European countries, as well as Australia, New Zealand and Kuwait.”

| Switzerland has decriminalized marijuana possession. The new law, which took effect October 1, changes the penalties for possession of up to 10 grams of pot. Previously, those caught with any amount of cannabis in Switzerland faced legal proceedings that could result in a permanent criminal record. Under the new law, adults over the age of 18 who are in possession of marijuana can simply pay a fine of 100 Swiss Francs (roughly $110) and get on with their day.
Pot decriminalization was the subject of a lengthy debate in the Swiss parliament. The move to make possession a minor misdemeanor is expected to unify pot policy across the country – previously drug laws had been enforced inconsistently from region to region. It will also offer relief to the court system, which on average heard 30,000 marijuana possession-related cases annually. This in turn will save the government money and free police to focus on more serious crimes.

The Italian government has decided that in the future cannabis may be used for the treatment of pain. The parliament has still to hold a vote on this issue. The measure has "nothing to do with joints" Health Minister Livia Turco stated. The reform can only become into effect after the House of Representatives and the Senate have approved it.
The opposition is divided on this question. While the right-wing nationalists accused the government to legalize a soft drug, Chiara Moroni of the party "Forza Italia" of opposition leader Silvio Berlusconi supported the decision of the cabinet.
The lawmaker in Switzerland also made a first step to the possibility of a legal use of cannabis products for medical purposes.
The Health Committee of the parliament (Nationalrat) has decided with clear majority to suggest to the parliament to change the narcotics law accordingly, said the physician Felix Gutzwiller, president of the parliamentary party FDP and member of the Health Committee, on 24 October in the news of the Swiss television. He therefore assumes that "there will be also a majority in the Nationalrat for the legalization of cannabis as a medicine."

US Government Says It Will Stop Interfering with Medical Marijuana |
According to this article, US Attorney General Eric Holder has said that states will be allowed to make their own rules about medical marijuana, and that the US federal government will stop raiding medical marijuana dispensaries in California. (See article “Can Marijuana Help Rescue California’s Economy?”at this link)
In the 1990s, several US states passed referendums which allowed marijuana to be used legally for medical purposes. In a referendum, the registered voters vote directly on the proposed law, as opposed to the law being passed by the state legislature. Thus, when these states passed these referendums, it meant that the citizens of these states really wanted medical marijuana to be made legal.
However, in a blatant disregard for democracy and the people’s will, under the Bush administration, the national government refused to accept this law, and carried out raids of the medical marijuana dispensaries.

Although Switzerland has at times been obliged to tighten its cannabis laws somewhat in keeping with international law, their approach has traditionally been one of tolerance and lenience.

According to R C Clarke’s seminal work Cannabis Evolution and Ethnobotany, cannabis was introduced to most of Europe during the period 10,000 – 2,000 BP; ancient remnants discovered in the course of archaeological digs have afforded us some evidence of this, although these examples are often disputed due to the difficulty of distinguishing hemp fibre from flax and nettle. While few such sites exist within the borders of present-day Switzerland, there are plentiful sites that lie well within its historic cultural zone, and it is likely that the entire Central European region—settled throughout its history by wide-ranging Celtic, Roman and Germanic peoples—made considerable use of cannabis for fibre and food purposes over several millennia.
Pollen grain analysis conducted in 1996 indicated that Cannabaceae species were present in the lowland regions of the Swiss Alps from around 6,500 BP onwards. Indeed, presence of Cannabaceae (and cereals, from around 4,000 BP onwards) is used as a marker of civilisation by the researchers (it is generally accepted that intentional cultivation of cannabis typically occurs soon after it is first encountered by indigenous peoples). Cannabaceae levels remained consistently high until around 200 BP, at which point a noticeable decline in Cannabaceae and other crop species occurred. This tallies with the height of the Industrial Revolution, and marks the point at which much intensive agriculture was replaced by grazing livestock.

1. Since 1996, twelve states have legalized medical marijuana use: AK, CA, CO, HI, ME, MT, NV, NM, OR, RI, VT, and WA. Eight of the twelve did so through the initiative process. Hawaii's law was enacted by the legislature and signed by the governor in 2000, Vermont's was enacted by the legislature and passed into law without the governor's signature in May 2004, Rhode Island's was passed into law over the governor's veto in January 2006, and New Mexico's legislation was signed into law by Governor Bill Richardson on April 2, 2007.
