Legislation: In November 2004, Montana voters by a significant margin (62 percent) passed Initiative 148, allowing certain patients with specific medical conditions to alleviate their symptoms through the limited use of marijuana under medical supervision.
The new law, effective immediately upon passage, also allows qualified patients and their caregivers to grow and/or possess a restricted number of marijuana plants. Montana is the 10th state to pass a medical marijuana law. Under federal law, it is still illegal to grow, sell, purchase, or use marijuana, even for health-related reasons.
Law enforcement: Police won’t actively target pot users, but they will respond to complaints, and you will be ticketed and charged if caught with marijuana or a pipe. Fines for possession are typically $550. Don’t do it in public and don’t be stupid. Butte is known for its parties, but law enforcement will be in full force during festivals such as St. Patrick’s Day or Evel Knievel Days (August), so be discreet.
Where to buy marijuana: Your best bet is to make conversation with someone at the Silver Dollar Saloon, or during festivals approach a stoner-looking person. Be friendly and honest and someone will probably be able to smoke you up, if not find you a small amount. Uptown Butte is a funky historic district with stunning architecture and old mine yards; a great place for a stoner to explore. The uptown area has several coffee shops, a few art galleries, and many decent bars, along with a few sketchy ones.
Locals are very accepting of weed, but they mostly like to drink. The Silver Dollar Saloon is more of a hippie bar and very pot friendly.
A good place to smoke is on the “M” of Big Butte overlooking the city, at Granite Mountain Memorial near Walkerville, or in any of the funky back alleys of Uptown.
Marijuana prices: 1/8 = $50;
1/4 = $80-100.
Marijuana brands: Usually your standard B.C. fare, although occasionally Humboldt nugs will come through town. Shwag is uncommon, but available if you find the right people.

Multiple places have decriminalized non-medical cannabis in the United States; however, cannabis is illegal under federal law. Gonzales v. Raich (2005) held in a 6-3 decision that the Commerce Clause of the United States Constitution allowed the federal government to ban the use of cannabis, including medical use even if local laws allow it.
Most places that have decriminalized cannabis have civil fines, drug education, or drug treatment in place of incarceration and/or criminal charges for possession of small amounts of cannabis, or have made various cannabis offenses the lowest priority for law enforcement.

We are excited to have the ability to educate people for three days in the great state of MONTANA. We hope to change and save lives and improve our state in many ways, this is our start.
Our festival takes place on September 25th-27th at the Rock Creek Lodge approximately 20 east of Missoula (I-90).
When Steve Zabawa used his reefer madness tactics to divert focus from the hundreds of people who are healed and comforted every day by cannabis to bring repeal, he moved the great state of Montana backwards.
Montana is all about making history. Making history as the first date to lose medical marijuana is not what we have in mind.
The people voted, yet he thinks his narrow mind should somehow be louder than the majority of the state.
Montanans aren't known for being bossed around and are also known for sticking up for their loved ones & their sick.
When loved ones who live in pain every day can walk outside and enjoy a conversation with you free of the chains of narcotics and other medications prescribed regularly with cannabis, how can you turn your back on that? When children make miraculous recoveries with cannabis oil when NOTHING ELSE is working, how can some say they are against that?
Other states have led the way to proving the benefits to communities and Montana needs to move forward with them and see those benefits in state.
We need the industry to band together and collaborate and help us pull off this amazing weekend. Our goal is break even, create an amazing weekend of education, collaboration and entertainment. Thanks to so many who have already volunteered to help!

Medical marijuana initiative makes ballot

The Montana Secretary of State approved I-182 for the November ballot this year, giving Montana voters an opportunity to repair the state’s medical marijuana program. The measure would both re-establish patient access to medical marijuana providers and create a more regulated system. It would allow providers to serve more than three patients and would require both licensing and regular inspections from agency officials. The voter initiative is in response to a recent Montana Supreme Court decision that imposes the full weight of a 2011 law passed by state lawmakers in an effort to make the medical marijuana system as burdensome as possible — long referred to as “repeal in disguise.”
Several other marijuana-related measures did not make the ballot. Two were aimed at allowing voters to adopt a system to tax and regulate marijuana for adults 21 and older. A third, prohibitionist measure would have banned marijuana unless rescheduled by the federal government, but it also fell short of the number of signatures needed.

Changes imposed by the supreme court ruling went into effect September 1, and state officials estimate that about 10,000 patients will be denied access to medical marijuana until the law can be changed.

Montana’s harsh marijuana laws and efforts to change them

In Montana, possession of even a single joint for non-medical purposes can land a person in jail for six months, while possession of 60 grams or more (a little over two ounces) can result in a sentence of up to five years. These stiff marijuana penalties cause related negative consequences.
In 2012, there were 1,502 arrests or citations for marijuana-related offenses, 95% of which were for possession. The number of marijuana arrests more than tripled since 2003. At the same time, law enforcement was unable to solve 91% of all burglaries — including home invasions — and over 85% of all motor vehicle thefts. Instead of arresting adults for possession of a product that is safer than alcohol, law enforcement should focus its limited resources on going after real criminals. It’s past time for a better solution. Ask your legislators to support reducing the penalty for possession of cannabis to a civil fine.

Voters uphold partial repeal of Montana’s medical marijuana law; new governor may support sensible reforms in 2013 -

Sadly, in the 2012 general election, Montana voters upheld the legislature’s decision to gut the state’s medical marijuana law by passing IR-124, a ballot referendum identical to S.B. 423, which passed and became law without Governor Brian Schweitzer’s signature in 2011.
Check out this summary of S.B. 423. Some key provisions include stripping the law of its provision that recognized out-of-state cards, adding onerous restrictions for pain patients, changing possession limits to four mature plants, 12 seedlings, and one ounce of marijuana, a ban on advertising, a ban on providers receiving compensation, a ban on providers serving more than three patients, and requiring doctors who recommend to 25 or more patients to pay to be investigated.
Although S.B. 423 passed in 2011, courts have so far prevented some provisions from being implemented. Unfortunately, the passage of IR-124 may result in thousands of patients losing access to medical marijuana, which would be a tragedy for patients and their families.
There is, however, a glimmer of hope on the horizon. Montana’s next governor will be Democratic Attorney General Steve Bullock, an opponent of the legislature’s partial repeal. Legislators and medical marijuana advocates will have an opportunity to start fresh with the legislature in 2013 and work to pass sensible reforms that protect patients and make sure they have safe, legal access to medical marijuana.

If Paul Befumo had known that marijuana could have eased his father's pain during the last few months of his life, he would have broken the law to get it for him.
Befumo, a 48-year-old registered investment adviser in Missoula, lost his father, also named Paul, to lung cancer two years ago after the family auditioned a long list of drugs to reduce his pain and nausea and to increase his appetite.
What they didn't try was the one treatment some chronically ill patients say has been their last, best resort: marijuana.
Since then, Befumo has researched the drug's benefits and hopes Montanans will reach beyond marijuana's stigma on Nov. 2 when they're asked to vote to legalize its medicinal use.

If you have ever heard of the song, “Lets Go Get Stoned,” as sung by Ray Charles or Joe Cocker, you know the lyrics were referring to getting high or using cannabis aka marijuana. This mind altering drug goes by other names as well; names such as weed, pot, joint, blunt, hash and mary jane are quite common among users. Cannabis is a plant that contains a chemical called cannabinoids or cannabinolidic acids.
Another substance that is found in cannabis is THC, or Tetrahydrocannabinol, which gives the users that “high” sensation. When speaking of marijuana, the actual substance used in creating the high feeling comes from the leaves and flowering tops of the cannabis plant. 1. Since 1996, twelve states have legalized medical marijuana use: AK, CA, CO, HI, ME, MT, NV, NM, OR, RI, VT, and WA. Eight of the twelve did so through the initiative process. Hawaii's law was enacted by the legislature and signed by the governor in 2000, Vermont's was enacted by the legislature and passed into law without the governor's signature in May 2004, Rhode Island's was passed into law over the governor's veto in January 2006, and New Mexico's legislation was signed into law by Governor Bill Richardson on April 2, 2007.
