Vermont - Medical Marijuana Distribution Bill On Its Way to Governor's Desk State Legislative and Statewide > Vermont - Medical Marijuana Distribution Bill On Its Way to Governor's Desk | Vermont is now one step closer to allowing state-licensed dispensaries to distribute marijuana to qualified patients. On Thursday, May 5, House lawmakers voted 99-44 in favor of Senate Bill 17, which allows for the state-sanctioned sale of marijuana to qualified patients. Under the bill, four dispensaries may be established to serve up to 1,000 patients. House lawmakers overwhelmingly decided to pass the measure despite warnings from the US Department of Justice claiming that the operation of such facilities could place citizens and state officials in conflict with federal law. However, in response to the DOJ’s actions, lawmakers added a provision to the law giving the governor power to “suspend the implementation” of marijuana dispensaries “if the governor determines that it is in the interest of justice and public safety.” Senators previously passed a version of SB 17 in April and are expected to concur with the minor changes made by the House. Urge Your Representative to Support HB 427 State Legislative and Statewide > Vermont - Legislation to Reduce Marijuana Possession Penalties Introduced in Vermont. Urge Your Representative to Support HB 427 | Legislation to reduce adult marijuana possession penalties has been reintroduced in Vermont. House Bill 427 amends state law so that the adult possession of up to one ounce of marijuana is reduced from a criminal misdemeanor (punishable by six months in jail and a $500 maximum fine) to a civil offense, punishable by a $150 fine, no jail time, and no criminal record. Passage of the measure, which has been endorsed by Governor Peter Shumlin, will allow state law enforcement to reallocate an estimated $700,000 annually in criminal justice resources. Status of Medical Marijuana (Cannabis) in Vermont.

  Info on Vermont and Medical Cannabis 

Vermont has a MEDICAL MARIJUANA (cannabis) LAW

SUMMARY: Senate Bill 76 became law without Gov. James Douglas' signature on May 26, 2004. The law takes effect on July 1, 2004. The law removes state-level criminal penalties on the use, possession and cultivation of marijuana by patients diagnosed with a "debilitating medical condition." Patients diagnosed with the following illnesses are afforded legal protection under this act: HIV or AIDS, cancer, and Multiple Sclerosis. Patients (or their primary caregiver) may legally possess no more than two ounces of usable marijuana, and may cultivate no more than three marijuana plants, of which no more than one may be mature. The law establishes a mandatory, confidential state-run registry that issues identification cards to qualifying patients.  

Possession/Cultivation: No more than two mature marijuana plants, seven immature plants, and two ounces of usable marijuana may be collectively possessed between the registered patient and the patient’s registered caregiver. A marijuana plant shall be considered mature when male or female flower buds are readily observed on the plant by unaided visual examination. Until this sexual differentiation has taken place, a marijuana plant will be considered immature.

Amendment(s): Senate Bill 7, which took effect on JULY 1, 2007, expands the definition of "debilitating medical condition" to include: "(A) cancer, multiple sclerosis, positive status for human immunodeficiency virus, acquired immune deficiency syndrome, or the treatment of these conditions, if the disease or the treatment results in severe, persistent, and intractable symptoms; or (B) a disease, medical condition, or its treatment that is chronic, debilitating, and produces severe, persistent, and one or more of the following intractable symptoms: cachexia or wasting syndrome; severe pain; severe nausea; or seizures." The measure also raises the quantity of medical cannabis patients may legally possess under state law from one mature and/or two immature plants to two mature and/or seven immature plants. Senate Bill 7 also amends state law so that licensed physicians in neighboring states can legally recommend cannabis to Vermont patients.

We need to get the word out and people contacting reps and officials and get this legislation into law. Also, lets not forget efforts at the Federal level.

Chapter 86 - A GUIDE FOR PATIENTS AND PHYSICIANS | WHAT IS THE MARIJUANA REGISTRY PROGRAM? In 2004, the Vermont General Assembly passed S. 76, An Act Relating to Marijuana Use by Persons with Severe Illness. Vermont Legislature passes bill to authorize medical marijuana dispensaries - Last update: May 18, 2011 | With Jim Douglas out and Peter Shumlin in as governor, we had a chance this year to improve on Vermont’s medical marijuana law and we took it. With the help of patients and advocates throughout Vermont, the legislature passed S. 17, a bill that will authorize up to four medical marijuana dispensaries, meaning patients in Vermont will finally have a safe, legal way to obtain their medicine. This was a major victory for MPP. We funded a two-year lobbying campaign to pass the measure. We started by finding the best sponsors we could last year, including then Senate President Peter Shumlin. We then helped elect Shumlin to the governorship to provide guidance from the top. It’s a good thing, too. Vermont’s U.S. Attorney sent a threatening letter on the very day the House was to vote on the measure, arguing that dispensaries would still be illegal under federal law. With another governor, that letter could have killed the bill.

Many thanks our lobbying team and to Senator Jeannette White, the bill’s sponsor. Most of all though, thanks to the patients who, despite debilitating conditions, traveled to Montpelier to explain to legislators why this law was sorely needed. Finally, thanks to all of you for your letters, emails, calls, and advocacy and donations on behalf of the bill. This doesn’t happen without you. Non-medical marijuana laws in Vermont | Vermont’s marijuana laws (18 V.S.A. § 4230) are relatively harsh given the state’s relaxed reputation. Possession of less than two ounces of marijuana is punishable by up to six months in jail and a fine of up to $500. The good news: first-time offenders are eligible for deferral of their sentence. The bad news: second time offenders can be sentenced to two years incarceration and a fine of up to $2,000. So, are these harsh penalties working? According to this excellent summary by Jon Gettman, Ph.D., the arrest rate for marijuana offenses in Vermont went up over 4% annually from 2003 to 2007 — but rather than reducing marijuana use, past-month use rates actually went up during this period, from 52,000 to 54,000. This shows, as MPP has known for some time, that marijuana penalties and enforcement patterns have little to no impact on marijuana use rates. The state could better protect its citizens by decriminalizing marijuana and freeing up valuable law enforcement resources to combat violent crimes and other real threats to public safety. Peter Shumlin (D) last Thursday signed into law a bill that will create a system of up to four explicitly authorized and state regulated dispensaries for medical marijuana patients.

Medical marijuana has been approved by voters in 16 states and the District of Columbia, but only half of those states explicitly allow dispensaries.
