The federal scheduling of Cannabis was disputed in 1988 by Judge Francis Young, an administrative law judge for the DEA, who recommended that marijuana be reclassified as schedule II on the grounds that if a respectable minority of doctors endorse it, then it has a "currently accepted medical use".

A Party shall, if in its opinion the prevailing conditions in its country render it the most appropriate means of protecting the public health and welfare, prohibit the production, manufacture, export and import of, trade in, possession or use of any such drug except for amounts which may be necessary for medical and scientific research only, including clinical trials therewith to be conducted under or subject to the direct supervision and control of the Party.
This provision, while apparently providing for the limitation of cannabis to research purposes only, also seems to allow some latitude for nations to make their own judgments. The official Commentary on the Single Convention indicates that Parties are expected to make that judgment in good faith.

Governor vetoes medical marijuana study bill, Hawaii County to have marijuana question on November ballot

Although at least half a dozen bills that would have improved marijuana policy in Hawaii were introduced this session, only one made it to the governor's desk.
In July, Gov. Linda Lingle (R) vetoed HB 2675, which would have established a temporary task force comprised of state officials, physicians, and patients to examine critical issues affecting Hawaii's medical marijuana program. Although the Senate voted overwhelmingly (21-1) to override Gov. Lingle's veto, the House failed to follow suit, which means that questions regarding adequate supply, growing facilities, and the inter-island transport of medical marijuana will remain unanswered for at least another year.
Gov. Lingle's veto was surprising given her 2002 campaign pledge to uphold Hawaii's medical marijuana law. In her official veto statement, Gov. Lingle claimed that, since the federal government doesn't recognize the medical value of marijuana, the studies proposed by HB 2675 would be improper.

Cannabis churches are stepping up to heal the sick with medicinal sacrament.
As the US federal government closes down medical cannabis clubs, churches are springing up to care for those in need of medicinal marijuana.
It may be a farming community in a sloping valley, a sleepy hamlet in the mountains, or a busy metropolis. Down on the corner, the church bells are ringing, and folks with a host of crippling and life-threatening ailments cane or wheelchair down the block to receive their daily sacrament and medicine cannabis. The preachers who distribute the sacrament from these churches have had spiritual experiences deeply rooted in life-threatening illnesses and family compassion.

The Hawaii Senate passed a bill on 24 April that will allow the medical use of Cannabis by patients with certain severe or life-threatening illnesses. The Hawaiian House of Representatives has already approved the measure, and Gov. Ben Cayetano has said he will sign the law.
Hawaii is the first state of the U.S.A. to approve the medicinal use of marijuana through legislation instead of a voter referendum as in Alaska, Washington, California, Arizona, Nevada, Oregon, Maine and the District of Columbia. The Federal Justice Department is challenging those laws.
Patients who want to smoke marijuana to alleviate pain, combat chemotherapy treatments and stimulate appetite would require written certification from a doctor and would have to register annually with the state public safety department.
"This bill will protect from arrest both the patient who might find a use for marijuana and the doctor who might recommend its use," said Democratic Sen. Suzanne Chun Oakland, the chairwoman of the Health and Human Services Committee.

1. Since 1996, twelve states have legalized medical marijuana use: AK, CA, CO, HI, ME, MT, NV, NM, OR, RI, VT, and WA. Eight of the twelve did so through the initiative process. Hawaii's law was enacted by the legislature and signed by the governor in 2000, Vermont's was enacted by the legislature and passed into law without the governor's signature in May 2004, Rhode Island's was passed into law over the governor's veto in January 2006, and New Mexico's legislation was signed into law by Governor Bill Richardson on April 2, 2007.
2. The Institute of Medicine's 1999 report on medical marijuana stated, "The accumulated data indicate a potential therapeutic value for cannabinoid drugs, particularly for symptoms such as pain relief, control of nausea and vomiting, and appetite stimulation."

by Ian Williams Goddard | In reaction to medical cannabis access referendums on the ballots in Arizona and California, former presidents Gerald Ford, Jimmy Carter, and George Bush signed a letter stating that they "categorically oppose'' access to cannabis for its many proven therapeutic uses such as the prevention of blindness and epileptic seizures. Their chief concern was that legal medical access would send the message that cannabis is safe. The presidents can, however, lay their safety concerns to rest because the scientific literature overwhelmingly confirms that cannabis is both an effective and safe medicine.
The Cannabis Safety Profile. The journal PHARMACOLOGICAL REVIEWS reports that decades of research prove that, "Compared with legal drugs...marijuana does not pose greater risks." Yet based upon mortality statistics, we can safely conclude that cannabis is one of the safest medical drugs known, for, while prescription drugs, defined as safe by the FDA, kill up to 27,000 and aspirin up to 1,000 Americans per year, cannabis kills 0 per year.
