Status of Medical Marijuana (Cannabis) in Hawaii.

Hawaii has a MEDICAL MARIJUANA (cannabis) LAW

SUMMARY: Governor Ben Cayetano signed Senate Bill 862 into law on June 14, 2000. The law took effect on December 28, 2000. The law removes state-level criminal penalties on the use, possession and cultivation of marijuana by patients who possess a signed statement from their physician affirming that he or she suffers from a debilitating condition and that the "potential benefits of medical use of marijuana would likely outweigh the health risks." Patients diagnosed with the following illnesses are afforded legal protection under this act: cachexia; cancer; chronic pain; Crohn’s disease; epilepsy and other disorders characterized by seizures; glaucoma; HIV or AIDS; multiple sclerosis and other disorders characterized by muscle spasticity; and nausea. Other conditions are subject to approval by the Hawaii Department of Health. Patients (or their primary caregivers) may legally possess no more than one ounce of usable marijuana, and may cultivate no more than seven marijuana plants, of which no more than three may be mature. The law establishes a mandatory, confidential state-run patient registry that issues identification cards to qualifying patients.  

Possession/Cultivation: The amount of marijuana that may be possessed jointly between the qualifying patient and the primary caregiver is an "adequate supply," which shall not exceed three mature marijuana plants, four immature marijuana plants, and one ounce of usable marijuana per each mature plant.

This means they are federally illegal to cultivate, buy, possess, or distribute (sell, trade or give) in all forms (cannabis plants, extracts, hash, hash oil, thc, etc) except synthetic THC (Marinol) which is Schedule III. The federal scheduling of Cannabis was disputed in 1988 by Judge Francis Young, an administrative law judge for the DEA, who recommended that marijuana be reclassified as schedule II on the grounds that if a respectable minority of doctors endorse it, then it has a "currently accepted medical use". Oklahoma - The Laws concerning marijuana Legal and medical status of cannabis - Wikipedia, the free encyclopedia | Cannabis is in Schedule IV of the Single Convention on Narcotic Drugs, making it subject to special restrictions. Article 2 provides for the following, in reference to Schedule IV drugs:

A Party shall, if in its opinion the prevailing conditions in its country render it the most appropriate means of protecting the public health and welfare, prohibit the production, manufacture, export and import of, trade in, possession or use of any such drug except for amounts which may be necessary for medical and scientific research only, including clinical trials therewith to be conducted under or subject to the direct supervision and control of the Party.

This provision, while apparently providing for the limitation of cannabis to research purposes only, also seems to allow some latitude for nations to make their own judgments. Resources, Organizations - Patients Out of Time, a patient advocacy organization Patients Out of Time is a patient advocacy organization with a universal constituency. They support the rights of patients to have a legal and safe access to the therapeutic use of cannabis. The mission of their organization, a 501 (c) 3 non-profit, is the education of health care professionals and the public about the therapeutic use of cannabis. Their leadership is composed of medical and nursing professionals with expertise in the clinical applications of cannabis and five of the seven patients (two wish to remain anonymous) who receive their medical cannabis from the US government. In July, Gov. Linda Lingle (R) vetoed HB 2675, which would have established a temporary task force comprised of state officials, physicians, and patients to examine critical issues affecting Hawaii's medical marijuana program. Although the Senate voted overwhelmingly (21-1) to override Gov. Lingle's veto, the House failed to follow suit, which means that questions regarding adequate supply, growing facilities, and the inter-island transport of medical marijuana will remain unanswered for at least another year. Gov. Lingle's veto was surprising given her 2002 campaign pledge to uphold Hawaii's medical marijuana law. In her official veto statement, Gov. Hawaii's law was enacted by the legislature and signed by the governor in 2000, Vermont's was enacted by the legislature and passed into law without the governor's signature in May 2004, Rhode Island's was passed into law over the governor's veto in January 2006, and New Mexico's legislation was signed into law by Governor Bill Richardson on April 2, 2007.
