Czech medical marijuana
| You hear of dramatic illness reversals due to cannabis. Epileptic seizures that stop after the first administration of cannabis high in CBD. The research into cannabis’s medicinal value is growing and proving the benefits of the plant. Unfortunately for cancer, epileptic, multiple sclerosis and chronic pain suffering patients the Czech medical marijuana system is in a disgraceful state.
The law has been passes allowing doctors to provide cannabis to seriously ill patients since April of 2013 but patients have still not had access to medical marijuana. The government gave out an import license to a plastic container manufacturer, Elkoplast Slušovice sro, and we have been waiting for the medical marijuana ever since.
A poor distribution network has meant few pharmacies have access to medical marijuana. They don’t have the required software to provide an electronic receipt to order the medicine. Also doctors don’t want to prescribe it due to a lack of information on its medical properties.
For a European country that is in the top three per capita marijuana users, it is a sad state of affairs that the government has not done their research on the plant. The Czech drugs agency is falling behind the wide spread international movement that is embracing medical marijuana. Czech patients are suffering for the medical professions ignorance.
The Czech government are also in talks with potential suppliers of medical marijuana. When the required pound of flesh is paid, you can enter the market and become a marijuana producer. There was a competition earlier in the year to obtain a medical marijuana license but we are still waiting for the results. The Czech Republic is a notoriously corrupt society. During communism everyone was taught how to be corrupt. It is the normal way of doing business and the ones who profited the most from this system are now in charge. I can only presume that government officials are trying to work out how exactly they can make money from this new industry.
Who bribes who to get the job done. That is nice if you are a high ranking civil servant with a Swiss bank account and no morals, but what about the suffering of a child with severe epilepsy? There are groups of hard working activists interested in these issue in the Czech Republic. Their voices get drowned out in a sea of other complaints that Czechs have as we try to emerge from the long shadow cast by the corrupting nature of this countries communist past.
This is not a hopeless situation however. Do not underestimate the resourcefulness of the Czech people. Patients and growers are connecting with each other in spite of the law and risks involved. The nature of marijuana allows it to be spread regardless of the restrictions placed upon it. I am hopeful that the legalize movement here and across Europe can inspire a change in the Czech system.
Patients that can benefit from medical marijuana should be allowed to. Until a united voice speaks on behalf of the ill, we will see lazy, greedy figures in places of authority seeking to enrich themselves at the expense of other’s suffering.

Marijuana Prohibition Enforcement Continues In Czech Republic Despite Reform

| Five years ago the Czech Republic reformed its marijuana laws. Possession of up to 15 grams of marijuana and cultivation of up to five plants is no longer a prosecutable offense. Instead, if those limits are not exceeded the penalty is a fine. There was speculation that these reforms would make Prague the ‘new Amsterdam’ of Europe.
While Prague is definitely a cannabis friendly destination, it is still not the free-for-all that some expected.
Law enforcement in the Czech Republic seems willing to turn a blind eye to small possession and cultivation, but they are still very much cracking down on larger operations.
While I’m a fan of decriminalization, the scenario in the Czech Republic highlights the need for further reform. There is large scale grow operations and sales occuring right now in Washington State and Colorado, with virtually no problems and huge benefits.
I’d like to see the Czech Republic, and the world for that matter, get on board with the next great industry. Uruguay is set to start their legalized industry next year. I’m hopeful that more countries follow suit.

The production and possession (but not the consumption) of cannabis became a punishable crime in Czechoslovakia in the year 1938. The possession of cannabis (less than 15 grams) is not a crime and consumption of cannabis is not punishable ever since the year 1992.
The country is a popular destination for cannabis smokers despite the fact that cannabis sale and plant remain illegal from the year 2010 onwards.

Cannabis's accepted medical use in the United States is increasingly recognized by health care professionals and the medical community, including the Institute of Medicine. Numerous medical organizations support legal access to cannabis for medicinal purposes. A new medical journal released in 2001 focuses on the medicinal use of cannabis and cannabinoids. National clinical conferences on the medicinal use of cannabis have been held in the United States in 2000 and 2002 and are scheduled to continue on a biennial basis. Most importantly, data on the number of physicians currently recommending therapeutic marijuana use to their patients demonstrate its acceptance by the medical community in the United States.

TRENTON BUREAU:
A Senate committee today cleared a measure that would allow medical use of marijuana in New Jersey.
The Senate Health, Human Services and Senior Citizens Committee voted to approve the long-stalled bill by a 6 to 1 margin; two senators abstained.
The bill calls for creating “alternative treatment centers” where people with chronic and terminal diseases would be allowed access to marijuana. Supporters say marijuana is a viable treatment option to alleviate pain in many cases.
“It is the definition of basic human decency that we do whatever we can to ease the pain and suffering of people living with severe chronic and terminal diseases,” said bill sponsor Sen. Nicholas Scutari, D-Union.
“When all other avenues of currently-approved pain relief have been exhausted, we need to give doctors the freedom to prescribe medical marijuana to give their patients a measure of comfort and dignity in the face of their debilitating diseases. This bill is about the most humane, compassionate option for those state residents who have nowhere else to turn in managing their illnesses.”
If ultimately approved by the full Legislature and signed by Governor Corzine, New Jersey would be the 14th state to allow medical use of marijuana.

A new study entitled Marijuana Effectiveness as an HIV Self-Care Strategy, which was released this past weekend in Clinical Nursing Research, indicates that persons living with HIV/AIDS rate cannabis as more effective in treating the symptoms of anxiety, depression, fatigue, diarrhea, and neuropathy than other prescription and over the counter medications.
The study, which was conducted over a two year period and included 775 patients from the USA, Africa, and Puerto Rico, assessed the use of cannabis as a symptom management approach for anxiety, depression, fatigue, diarrhea, nausea, and peripheral neuropathy. 27% of survey participants reported using cannabis for medicinal purposes.
Researchers wrote that cannabis use “was rated slightly more effective than antidepressants for anxiety and depression, Imodium for diarrhea, [over the counter] (OTC) medications for fatigue, and anti-epileptics and OTC medications for neuropathy” while cannabis was rated “slightly less effective for nausea than either prescribed or OTC medications.” Authors concluded that cannabis “is perceived by users as at least as effective as prescribed medications in symptom management.”

The fight for medical cannabis looks like a simple exercise with respect to what has happened since this spring. First of all, the drug police accused one magazine and its two journalists for “spreading drug abuse” because they had papers and filters in one issue and there was a distorted picture inside with a caption: “If you want to see this properly, smoke a joint.”
This obvious joke was followed with an attempt to make them a target for prosecution and trial with punishment up to 5 years in prison. However, the justice official who was overlooking the case nullified it so the trial never even started. This seemed to be good news in the bad times—not for a long time, though.
The owners of the Hydroponic growshop heard the judicial decision last month: they were sentenced to 7 and 6 years in prison, after two and half years spent in custody (again—these businessmen and ordinary citizens were treated as murderous criminals and had to endure the terrible and humiliating conditions of custody prison). They appealed immediately and the whole cannabis community is hoping that common sense will prevail and all charges will be dropped.
There was also a ruling of Czech Constitutional Court at the end of the summer 2013 that revoked the government decriminalization act, which means that “15 grams and 5 plants is just an offense” rule is not valid anymore, as was the state of things before 2010. However, the Constitutional Court is not exactly to blame, because the judges were not considering the actual content of this act—they just pointed out that no government can issue such acts on its own—it has to be through a proper legislative process, passed through both Houses of Parliament.
Prior to this, in winter 2012, the Czech Supreme Court ruled that a single growshop cannot sell everything from “seed to joint” under one roof, because it is “inducing customers to commit a crime”. Although this ruling hardly makes any sense and seems to be meant as an abuse of all growshop owners, almost all of the growshops complied and stopped selling at least one key category in this “chain” (the key categories being: literature about growing / seeds, fertilizers, lights and other growing tools and materials / rolling papers, grinders and other smoking devices).
Still, this Supreme Court’s decision was enough ammunition for the “drug czar” Frydrych who started an unprecedented crackdown on about 50 growshops on November 4, 2013. So far 19 people have been arrested and charges were pressed against 9 of them. The goods confiscated in the shops in the eastern part of the country during two days filled up three large army trucks.

It Is Hard To Find Medical Marijuana In The Czech Republic

The Czech Republic legalized medical marijuana earlier this year. However, medical marijuana is still very hard to find. It saddens me to hear stories about patients who are caught up in a political battle, all the while suffering due to lack of access to the medicine they should legally be able to obtain. It’s a common story in parts of the United States, and I know people here feel for the patients in the Czech Republic.
The Czech Republic situation is very similar to states like New Jersey, where I get e-mails all the time from patients asking when they should expect things to change. Sadly, I don’t see it happening, at least not legally. With so few safe access points, and no right to home cultivation, patients are stuck in a tough situation. It sounds like the problems in New Jersey are the same thing people are experiencing in the Czech Republic.
Patients have no choice but to purchase marijuana from the unregulated black market, which comes with a host of potential issues. Patients could get bad meds that have who knows how many foreign pesticides sprayed on them. Patients could potentially get robbed by a thug drug dealer, or at the least ripped off. In a lot of cases, the potential for harm is enough to turn off patients that aren’t comfortable purchasing from the black market.
Political foot dragging should not be tolerate, whether it’s in the Czech Republic, New Jersey, or anywhere. Protest these practices, contact your politicians and the local media, and don’t give up until true safe access is achieved.

Medical Marijuana Now On Sale in Czech Pharmacies

Medical marijuana became legal Monday in the Czech Republic and is now available for sale in pharmacies. Monday was part of the Easter holiday there, so it didn’t actually go on sale until Tuesday.
Medical marijuana is available by prescription only and has been approved for people suffering from cancer, Parkinson’s disease, multiple sclerosis, and psoriasis.
Medical marijuana is being imported — either from Israel or the Netherlands — for the first year, while the State Institute for Drug Control prepares regulations for national production.
It must determine how much marijuana will need to be cultivated and organize tenders for marijuana purchases from Czech farmers. The regulatory body intends to issue licenses to local growers for a maximum of five years each.

We live in a time when the drugs produced in Western countries are allowed, while the drugs originating in other countries, are forbidden. Prague: the new Amsterdam?

PRAGUE, Czech Republic — In the smoky red basement of a popular club in Prague, a Finnish student sits at a table passing a joint to a friend. A young Polish tourist approaches and asks where to get another one. “Just go over there,” says the Finn pointing toward the bathroom.
This scene plays often in Prague these days, a city where the young are flooding in to party hard, with little fear of getting busted.
“We’re not here for girls, we’re here for drugs and fun,” said Mathieu, who declined to give his last name, and who drove from Paris with friends to spend four days in Prague. They are drinking beer and absinthe in Chateau Rogue, one of city’s most notorious tourist clubs for scoring drugs. “Everybody told us that Prague was the best place to find drugs,” said Mathieu’s friend.
Although the Czech capital has long been a tourist attraction with its medieval grandeur, elegant spires and cobbled streets, these days it has become a magnet for stag nights, pub crawls and young Europeans seeking a weekend party in a country cheaper than the Netherlands and more easy-going than its neighbors (in Slovakia, having a small amount of marijuana can lead to three years in prison).
The Czech Republic has always been relatively lenient about drug use, which has been legal since 1990. Possession, paradoxically, remains a crime but isn’t actively prosecuted, mainly due to a lack of resources: The Czech Government Council for Drug Policy Coordination reports there are only 200 people working on the National Drug Squad and they mostly target manufacturers, importers and major dealers.
“The Czech police have mainly been enforcing the drug laws at a certain organizational level,” said Jakub Frydrych, head of National Drug Squad of the Czech Police and the Bureau of Investigation.
The Czech Republic once defined illegal drug possession with the legally vague phrase "more than a small amount."
In January, a new law took effect quantifying the amount of drugs that equals a misdemeanor offense: possession of less than 15 grams of marijuana, 1.5 grams of heroin, 1 gram of cocaine and 4 tablets of ecstasy, for example, can result in a fine of 15,000 Czech crowns ($830), the average monthly salary in the country. Possessing anything more is considered a felony.
Even though those amounts make Czech drug laws among the most lenient in Europe, officials bristle at the suggestion that the new law has liberalized drug possession.
“Drugs are not decriminalized in the Czech Republic,” said Frydrych. “Possession of drugs is at a minimum a misdemeanor. I personally do not consider the new law to be more lenient.”

Danny Kushlick, founder of the Transform Drug Policy Foundation in Bristol, United Kingdom, said the new Czech law is more progressive than a blanket prohibition but still leaves production and supply to organized crime networks and unregulated dealers. He said more needs to be done to coordinate drug laws across borders as well. “We have to look at [unifying] drug policymaking throughout the world in order that particular places don’t become drug havens,” he said.
Czech National Drug Policy Coordinator Jindrich Voboril said that the law has become harsher when it come to methamphetamines, heroin and cocaine, which are increasingly problematic for the country.
In recent years, the Czech Republic has become Europe’s top producer of methamphetamines, made in small secret labs, of which 300 to 400 are raided each year, said Frydrych.
Among European Union countries, the Czech Republic has the highest percentage of people between the ages of 15 and 24 who have tried drugs at least once, according to Tomas Zabransky, head of research and development programs at the Center for Addictology at Charles University in Prague. Zabransky says that instead of leniency, the new drug law simply takes “a pragmatic approach which acknowledges that drug addicts are ill and should not legally be punished for their illness.”
Meanwhile, it is still too early to assess what effect the new law has had, said Viktor Mravcik, head of the Czech National Monitoring Center for Drugs and Drug Addiction. The Center for Addictology predicts little change in the situation for addicts. Where officials say they do expect change, however, is in recreational and experimental use.
In essence, the new law is a lure for drug tourists. Even though there are no official numbers available for this type of tourism, anecdotal evidence shows that Prague has become a top party destination in Europe.
Brandon, who declined to give his last name, a Prague-based pub crawl guide and California native, admitted that part of his job is to take groups to bars where weed can be purchased and smoked inside: “I throw a party, and if people want drugs I introduce them to the right people.”
And even though Czech officials dislike the label of “New Amsterdam” for their capital, they admit it isn’t too far off the mark.
Czech attitudes toward drugs are similar to those in the Netherlands, said Voboril: “It’s still illegal if you do it but we won’t put you in prison for it.”

US Government Says It Will Stop Interfering with Medical Marijuana |
According to this article, US Attorney General Eric Holder has said that states will be allowed to make their own rules about medical marijuana, and that the US federal government will stop raiding medical marijuana dispensaries in California. In the 1990s, several US states passed referendums which allowed marijuana to be used legally for medical purposes. In a referendum, the registered voters vote directly on the proposed law, as opposed to the law being passed by the state legislature. Thus, when these states passed these referendums, it meant that the citizens of these states really wanted medical marijuana to be made legal.
However, in a blatant disregard for democracy and the people’s will, under the Bush administration, the national government refused to accept this law, and carried out raids of the medical marijuana dispensaries.
