Multiple places have decriminalized non-medical cannabis in the United States; however, cannabis is illegal under federal law. Gonzales v. Raich (2005) held in a 6-3 decision that the Commerce Clause of the United States Constitution allowed the federal government to ban the use of cannabis, including medical use even if local laws allow it.
Most places that have decriminalized cannabis have civil fines, drug education, or drug treatment in place of incarceration and/or criminal charges for possession of small amounts of cannabis, or have made various cannabis offenses the lowest priority for law enforcement.

Medical marijuana: In March, Sen. Tommy Garrett’s compassionate medical marijuana bill came a few votes shy of the super-majority needed to stop a filibuster. If patients are to get the protections they deserve next year, they’ll need legislators who stand up for them. And you can help make that happen.
On Tuesday, November 8, half of the Nebraska Legislature is up for re-election. Please look up your Senate district, check out our voter guide, spread the word (shortcut URL: mpp.org/NEvoterguide), and then get out and vote on Election Day!
Please also thank your senators if they stood up for patients or implore them to reconsider next year if they voted no.

Decriminalization
|
Nebraska is one of the 21 states that do not jail first-time offenders found in possession of a small amount of cannabis. First offense possession of up to an ounce of marijuana is a civil infraction punishable under Nebraska law by a $300 fine — and a possible drug education course — instead of jail time and is a citation as opposed to an arrest. Second offense possession of up to an ounce carries a $400 fine and up to five days in jail, and third offense possession is punishable by up to a week in jail and a fine of $500. Second and third offense possession are misdemeanors, but are only citable, and not arrestable, offenses.
Even so, Nebraska has one of the highest marijuana arrest rates in the country, with 7,756 marijuana arrests and/or citations in 2012. Unfortunately, these arrests disproportionately affect minority communities. According to the ACLU, African Americans in Nebraska are nearly five times as likely to be arrested for marijuana possession as their white neighbors, despite similar use rates.

Kerrey Open to Use of Medical Marijuana, Especially for Vets

Democrat Bob Kerrey says it's time the nation considered allowing doctors to prescribe medical marijuana, especially to returning veterans with mental health issues.
But Kerrey says there is no way he supports the wholesale legalization of marijuana, despite being close friends with a billionaire who supports loosening marijuana laws.
“Under no circumstance am I talking about legalizing marijuana to the point where you can buy it over the counter on street corners,” he said Wednesday.
Kerrey is running for the U.S. Senate against Republican Deb Fischer. His views on marijuana have been raised and speculated on by Republicans and others recently, in large part, because of an article in which his friendship with Peter Lewis was disclosed on the Huffington Post website.

The discussion has begun about legalizing marijuana for medical purposes in Nebraska.
Three members of the State Board of Pharmacy will quiz their colleagues on the topic at the annual meeting May 22-25 of the National Boards of Pharmacy in Anaheim, Calif., reports Paul Hammel of World-Herald News Service.
The Nebraskans hope to learn more about the pros and cons of legalization and any problems that have arisen in the 14 states that now allow cannabis to be used medicinally.
“It’s probably an issue we’re going to have to address in the future,” said Board Chairman Rick Zarek, a Gothernburg, Neb., pharmacist, who said he had no personal opinion on the subject.

More than a dozen people on Monday asked the Nebraska Board of Pharmacy to reclassify marijuana so it can be authorized as medicine.
Those testifying included a medical doctor, a lawyer, one of the original Yippies from the 1960s and an Iowa trucker wearing a "Reverend Reefer" t-shirt, reports Paul Hammel at the Omaha World-Herald.

If you have ever heard of the song, “Lets Go Get Stoned,” as sung by Ray Charles or Joe Cocker, you know the lyrics were referring to getting high or using cannabis aka marijuana. This mind altering drug goes by other names as well; names such as weed, pot, joint, blunt, hash and mary jane are quite common among users. Cannabis is a plant that contains a chemical called cannabinoids or cannabinolidic acids.
Another substance that is found in cannabis is THC, or Tetrahydrocannabinol, which gives the users that “high” sensation. When speaking of marijuana, the actual substance used in creating the high feeling comes from the leaves and flowering tops of the cannabis plant. Marijuana is considered to be a schedule 1 controlled substance today, because of the THC, which can be highly potent, depending upon the concentration factor of the THC.

1. Since 1996, twelve states have legalized medical marijuana use: AK, CA, CO, HI, ME, MT, NV, NM, OR, RI, VT, and WA. Eight of the twelve did so through the initiative process. Hawaii's law was enacted by the legislature and signed by the governor in 2000, Vermont's was enacted by the legislature and passed into law without the governor's signature in May 2004, Rhode Island's was passed into law over the governor's veto in January 2006, and New Mexico's legislation was signed into law by Governor Bill Richardson on April 2, 2007.
