There are a number of medical cannabis (marijuana) bills in play in states across the US. Here we network on Ways and Means anyone can help with the effort to make each a medical marijuana state.
We need to get the word out and people contacting reps and officials and get this legislation into law. Also, lets not forget efforts at the Federal level.
NETWORK and Spread The Word, both On-Line and Off (!) ON-LINE, You can tell everybody in cyber-space by e-mailing a link to this website to them and/or (OFF-LINE> printing off the info and handing out where possible / necessary. Also phone call and read off and/or visit and hand deliver the info. You can take literature with you and approach businesses, organizations and even people on the street while you're out and about. Wear your pot-leaf shirt and register voters, as feasible. Gather signatures for any related petitions that are happening at the time as well.
This is a chain e-mail you can't refuse. Unlike most, this will actually help you - and a whole buncha others - just by passing it on.
Cannabis consumer or not - from the folks just trying to take care of themselves or a loved one to those who simply see the expensive, immoral waste of making war on the sick and dying - everyone is affected by this issue.
To accomplish this you need to first click on the following links and send a message to all the reps and media you can on the issue.
Then get everybody else to do the same. And follow up.
To do this you need to tell everybody you know.
And can confide in.
Then/or anonymously tell everybody you don't know
- or can't confide in. Yet.
Tell everybody else by Letters-to-the-Editor, displaying signage at street corners and over-passes (wear trenchcoat, fedora and sunglasses if afraid of exposure), and/or anonymously leaving literature and posting on-line at places where people are likely to find it.

Inform, Educate, Activate
INFORM and EDUCATE. Distribute medical marijuana brochures and other literature to your friends, family, local leaders and elected officials in an effort to educate the public and garner support. Educate your community by Printing, posting and handing out Flyers and other Printables in a mall, coffee shop, laundromat, college campus, lamp post, telephone poll, business window (ask first), hospital, or anywhere people will see them. Possession:
Possession of 2oz or less of marijuana: maximum jail sentence of 180 days; maximum fine of $2,000
Supply:
Delivery, without remuneration of up to¼
oz marijuana: maximum 180 days in jail; maximum fine of $2,000
Special Considerations:
Any sale to a minor: minimum 2 to maximum 20 years in prison; maximum fine $10,000
Repeat Misdemeanor Offenses:
If charged with a Class A misdemeanor and defendant has been before convicted of a Class A misdemeanor or any degree of felony: minimum 90 days to maximum 1 year in prison; maximum fine $4,000

It is illegal to cultivate or sell marijuana (or possess marijuana with the intent to do so) in Texas. Penalties vary according to the amount cultivated or sold, with increased penalties for sales to a minor or within a drug free school zone. (Texas Stat. and Code Ann. § 481.120.)
Drug Paraphernalia
|
It is illegal in Texas to manufacture, sell, or use drug paraphernalia (or possess paraphernalia with the intent to do so). Paraphernalia includes items used in growing, harvesting, processing, selling, storing, or using marijuana. Penalties for possession include a fine of up to $500, but no jail time. Selling paraphernalia may be punished with a fine of up to $4,000, up to one year in jail, or both. (Texas Stat. and Code Ann. § 481.125.)

Multiple places have decriminalized non-medical cannabis in the United States; however, cannabis is illegal under federal law. Gonzales v. Raich (2005) held in a 6-3 decision that the Commerce Clause of the United States Constitution allowed the federal government to ban the use of cannabis, including medical use even if local laws allow it.
Most places that have decriminalized cannabis have civil fines, drug education, or drug treatment in place of incarceration and/or criminal charges for possession of small amounts of cannabis, or have made various cannabis offenses the lowest priority for law enforcement.

Committee Votes In Favor Of Legislation To Reduce First-Time Cannabis Possession Offenses
| Members of the House Criminal Jurisprudence Committee on Tuesday, April 23, approved by a 6-3 vote substitute language to significantly reduce marijuana possession penalties for first-time, youthful marijuana possession offenders.
House Bill 184 amends minor marijuana possession penalties for certain first-time offenders to a fine-only, Class C misdemeanor. Under present law, the possession of one ounce of cannabis or less is classified as a Class B criminal misdemeanor publishable by up to 180 days in jail and a $2,000 fine.
Annually, in Texas some 80,000 citizens are arrested for marijuana violations; an estimated 97% of those arrested and charged for possession alone — not trafficking, cultivation, or sale. House Bill 184 would significantly reduce state prosecutorial costs associated with these tens of thousands of minor marijuana arrests and allow law enforcement resources to be refocused on other, more serious criminal offenses.

Lawmakers in Texas are increasingly supportive of significant change to marijuana policy, gradually catching up to voters. This year, that support was stronger than ever. Unfortunately, time ran out before votes could be taken on two key pieces of legislation, and they will not advance further in 2017.
First, Joe Moody’s bill, HB 81, was aimed at reducing penalties for low-level possession to a civil violation – and avoiding arrest, jail time, prison, loss of driving privileges, and a harmful criminal record. The bill was successfully voted out of committee in the House but did not get a vote in the entire House before a key deadline.
Another bill, HB 2107, sponsored by Rep. Eddie Lucio III, would have sidestepped many of the problems contained in the current Compassionate Use Program, including unrealistic standards for doctors (who must “prescribe” cannabis) and patients (who are limited only to some types of seizure conditions). A majority of House members signed on as supporters of the bill, but as with the decriminalization bill, HB 2107 did not get a vote on the House floor before the deadline.
While disappointing, both lawmakers and advocates made huge strides this year gathering long-term support essential to passing legislation. United States military veterans rallied at a parade in Texas on Wednesday for the right to treat their war wounds, both physical and psychological, with medical marijuana, which remains illegal under federal law and is strictly limited in Texas.
The Veterans Day protest came a day after the U.S. Senate approved a measure allowing federal Veterans Affairs doctors to prescribe medical marijuana in the District of Columbia and the 23 states that have legalized the medicinal use of cannabis.
Texas allows the use of only a nonpsychoactive marijuana oil product for the treatment of severe seizures. The veterans, affiliated with pro-legalization group Texans for Responsible Marijuana Policy (TRMP), want much wider legalization, saying it could help veterans with long-term pain and psychological disorders. Texas has 1.7 million veterans, the second most number in the country, after California.
Dozens of former service members — from the Army, Marines, Air Force and Navy — marched to press their call for change in Austin’s Veteran’s Day parade Wednesday. They then gathered at the Vietnam War memorial near the statehouse to announce the launch of Operation Trapped, a campaign to raise awareness of veterans’ hope for access to medical marijuana, both edible and smokable.
“We feel trapped by pharmaceutical drugs, and we want access to medical marijuana instead of addictive painkillers and psychotropic medication,” said TRMP spokesman Dave Bass, 59, a retired Army major and native Texan who served in Iraq in 2004 and 2005.
For its awareness campaign, Operation Trapped seeks to collect from veterans 1,000 pill bottles that once contained painkillers, antidepressants or mood stabilizers — each containing a slip of paper with the veteran’s name, rank and dates of service. TRMP plans to then put toy soldiers in the bottles and present them to lawmakers at the start of the Texas state legislature’s next session, starting in January 2017. The bottles are meant to show how many veterans feel trapped by the treatment options available to them in their state.

Still, in all but one county, possession of two ounces or less of marijuana can result in a misdemeanor charge, up to 180 days in prison, or a fine of up to $2,000. Four or more ounces is a federal offense punishable by up to two years in prison. Could that soon change?
Police arrest an estimated 70,000 Texans annually for marijuana possession, usually in small amounts. But according to recent polls, 68 percent of Texans support reducing penalties for low-level marijuana possession.
Safe to say, it’s taken the legislators in the Lone Star State a little too long to catch up to public opinion. With the passage of new medical marijuana policy, however, the Texas legislature isn’t as far away from legalizing weed as it would seem.
In September 2017, the Texas Compassionate Use Act, Texas’s first small medical marijuana victory, is set to become viable law thanks to the exhaustive efforts of lobbying groups across the state.
Heather Fazio, the Texas political director for the Marijuana Policy Project, said that despite Abbott’s show of support, the regulatory nature of this legislation does virtually nothing to help the very few patients that it claims to benefit.
“While the passage of this legislation was monumental in that the Texas legislature acknowledged cannabis as medicine, the existing program is unreasonably restrictive,” Fazio says.
According to the legislation, the state will only grant permission to patients who have “intractable epilepsy,” meaning they must have already exhausted two other prescription drug options with no success. Not only that, patients must also receive official prescriptions for cannabis from two state-licensed physicians before they can access treatment.
Medicinal cannabis has been proven to help adults and children by reducing seizure frequency regardless of whether their condition is “intractable” by the Texas definition. One study conducted this year showed a whopping 90 percent of epilepsy patients reported success using cannabis products rather than other seizure medication.
In the 28 other states where medical marijuana programs exist for patients, patients have to go through a formal process to be certified to use medical marijuana. Since it’s illegal under federal law to prescribe cannabis, patients can receive recommendations and certifications directly from a physician, enabling them to then seek out legal dispensaries. But under the Texas Compassionate Use, “recommendations” and “certifications” are not technically the same as a “prescription.”
For Fazio, the flawed language in the bill is perhaps the most problematic in that it doesn’t protect doctors. If the bill’s framing stays as it is now, Texas physicians are required to “prescribe” cannabis—which is both illegal and puts doctors in danger of losing their DEA registration.

AUSTIN, Texas – The Texas House gave final approval Tuesday to a limited medical marijuana bill that would give epilepsy patients access to cannabidiol oil (CBD). The next stop is Gov. Greg Abbott’s desk, marking a milestone that marijuana-reform advocates say is nothing short of historic in Texas.
The Republican hasn’t said whether he will sign one of the most talked-about measures in his first legislative session as governor. Here’s a closer look at the plan:
WHAT DOES IT DO?

The bill, SB 339, allows patients with intractable epilepsy, whose seizures are not controlled by conventional treatments, to receive low-THC cannabis to help treat their seizures. This would likely be in the form of a cannabis oil extract (CBD oil). The low-THC cannabis could not contain more than 0.5 percent tetrahydrocannabinol — marijuana’s psychoactive component — and must have at least 10 percent cannabidiol.
The oil could only be obtained with a prescription and would remain off-limits to patients with other medical conditions.

Fourteen states in the past year have passed similar low-dose cannabis oil laws. Wisconsin Gov. Scott Walker, a potential 2016 presidential candidate, and Florida Gov. Rick Scott were among the first. Republicans in those states have stressed that the oil would be strictly supervised and wouldn’t be a precursor to legalizing recreational marijuana.

Texas Sheriff Refuses to Arrest Marijuana Offenders at Federal Checkpoint
NPR- A federal inspection station on Interstate 10 in the West Texas desert earned the nickname “checkpoint of the stars” for all the entertainers who kept getting busted there. In the past six years, Willie Nelson, Snoop Dogg, Nelly and Fiona Apple were all arrested for possession of marijuana. These days, though, after a decision by a local lawman, everyone from personal pot smokers to medium-size marijuana traffickers can avoid jail.
After federal grants used to help pay for housing offenders arrested on drug charges dried up, Sheriff Arvin West of Hudspeth County, Texas, stopped taking any more cases from the checkpoint. He says they occupied two full-time deputies and one-fourth of the space in the county jail.

POT SMOKING GRANNY CHARGED WITH STATE JAIL FELONY
A 69-year-old woman charged with growing marijuana on her property in Stephenville for medical purposes was arrested Thursday by the Erath County Sheriff's Office.
Colleen McCool said deputies picked her up, booked her, then drove her home when it was over.
She was released on a personal recognizance bond, meaning she didn't have to post any money.
"We asked her to sign an affidavit saying she would not flee the area and would show up for her court date," Sheriff Tommy Bryant said.
Bryant said her age and health were a consideration in allowing her to go home.
McCool is a longtime advocate for legalizing marijuana. Her home was raided by authorities on Sept. 17 after a DPS narcotics helicopter spotted marijuana plants growing on her property.
Deputies seized about 25 plants, weighing more than 4 pounds after they were dried.
McCool has been charged with possession of marijuana, a state jail felony.
Her husband is also facing similar charges.

DALLAS, TX — Changing the draconian marijuana policies in Texas is no small task but a coalition of organizations have banded together to reform the Lone Star State: The Marijuana Policy Project, DFW NORML, Progress Texas, Republicans Against Marijuana Prohibition, Mothers Against Teen Violence, Texas NORML, MAMMA, Drug Policy Alliance, SSDP, among others.
Texas unfortunately does not have a ballot initiative process like Colorado or Washington. Therefore they are relying on legislators to change the laws, which has not happened despite several bills being filed over the last 8 years.
Last session 2 bills were filed by Democrats in the Texas House of Representatives.
Representative Elliot Neshtat (D-Austin) has introduced House Bill 594, which would allow for a person arrested for marijuana to enter evidence that their doctor gave instructions that use of the drug could provide benefits for their illness, leading to a dismissal of the charges.
If passed, medical marijuana patients could have the charges dismissed if they were able to provide proof that their doctor had recommended marijuana as a tool to avoid symptoms of their illness.

Witness to Alleged DEA Excessive Force at The Purple Zone Speaks Out
This is a photo of Arielle Lipsen who was thrown to the ground and hit with the butt of a DEA agent’s rifle. She is now wrongfully being charged with assaulting a federal agent during a DEA raid of her sister’s smoke shop in Texas. Her sister gave the following statement to a local news site:
“She was having a conversation with a female agent, and trying to give the agents the lock code,” Ilana Lipsen claimed. “She was trying to tell them there was no key, but a code. There were too many officers and about half of them were doing nothing, then this one agent charged at her, threw her, kicked her legs out from under her, and when she was falling, her leg brushed up against his leg.
That’s when he said ‘you’re trying to beat a federal agent’ and shoved the butt of his rifle into her neck.” (via BigBendNow)

This is a thing to scream about. There’s no reason for a federal agent to put his hands on an unarmed, unthreatening citizen.
Not only was she assaulted, but now they might actually send her to jail - in an outrageously unconstitutional process! - in order to shut her up, cover up and otherwise punish her AND send a message to all us peasants in general.

ALPINE - It's the latest break in The Purple Zone raid controversy in Alpine. It all involves allegations that DEA agents used excessive force on the owner's sister. The owner retracted her allegations of the alleged attack. The DEA says it never happened. But in a new twist, a witness has come forward.
Sul Ross geology student Nicholas Branson lives in a home behind The Purple Zone. He went to run some errands on the morning of Wednesday, May 7. When he returned around 10:30 a.m., he saw numerous law enforcement vehicles out front.
"I just figured it didn't have anything to do with me and I tried to walk back into my house and that's when they told me I couldn't go back there," Branson said.
He says DEA agents broke his gate and entered his home. He claims the motive was because they thought his residence was part of The Purple Zone. Nicholas says the only business he does with Ilana Lipsen, the owner of The Purple Zone, is buy Red Bulls on the way to class.
"They told me that was kind of the cost of living where I live. When I asked to see a warrant he said I didn't need to see any [expletive] warrant," Branson said.
Nicholas claims agents didn't have a search warrant until almost two hours later.
"It's signed at 11:58 a.m. My neighbor was woken up shortly before 10 o'clock with them entering my home," Branson said.
He says he was forced to wait out front on the sidewalk near his mailbox, when he saw the alleged excessive force take place against Lipsen's sister, Arielle, in front of a tree next door on his neighbor's property.
"[The DEA agent] walked up and tried to grab her by the throat and when she tried to step back he threw her to the ground, jumped on top of her, and put a rifle butt in her neck. Then claims she assaulted him," Branson said.
Nicholas says a shotgun and hard drives were seized from his residence during the process.
Just days after these allegations first surfaced by The Purple Zone owner, Ilana Lipsen, she sent out a letter to NewsWest 9 retracting every single word.
In a statement by the Public Information Officer of the DEA, El Paso Division, they say, "As we have maintained throughout and has now been confirmed by Ms. Lipsen, DEA acted professionally at all times during the execution of the warrant.
The allegations against DEA have been recanted and Ms. Lipsen has apologized to DEA and other law enforcement involved for her false allegations."

Hawaii's law was enacted by the legislature and signed by the governor in 2000, Vermont's was enacted by the legislature and passed into law without the governor's signature in May 2004, Rhode Island's was passed into law over the governor's veto in January 2006, and New Mexico's legislation was signed into law by Governor Bill Richardson on April 2, 2007.
