The Bill to Be Introduced, Making Maryland 15th State to Allow It, Might Be the Most Stringent in the Nation

Maryland - Action, Change Even as a proposal to legalize medical marijuana emerges in Maryland, a backlash over the burgeoning industry has developed in other states - and is likely to influence legislation here. Last week, the Los Angeles City Council tried to rein in the growth of marijuana dispensaries, limiting the number to 70 and imposing tight restrictions on where and how they can operate. And in Colorado, towns are trying to shutter some of the hundreds of dispensaries that have popped up.

But supporters of the Maryland proposal say they have learned from problems in states that approved use of the drug without uniform regulations on the dispensaries providing it. The result, they say: Maryland's measure could be among the most stringent in the nation. "I looked at a compendium of legislation from all the other states and I knew from being in California that we absolutely didn't want to do that," said Del. Dan Morhaim, a Baltimore County Democrat and a physician who plans to sponsor a bill that would make Maryland the 15th state to allow the medical use of marijuana. "From the physician-patient point of view, I wanted a bill that I would be supportive of as a doctor."

Advocates and some medical experts say a growing body of research shows the drug can be an effective tool to help patients struggling with some diseases. The Maryland proposal would allow marijuana to be given to patients with a "debilitating medical condition," such as seizures, severe chronic pain or severe nausea as a result of cancer treatment. But not all physicians agree it's a good idea. Dr. Kevin Cullen, an oncologist and director of the University of Maryland Marlene and Stewart Greenebaum Cancer Center, isn't sure the state needs a new law. He said he'd probably never recommend medical marijuana to cancer patients because other drugs are more effective.

"It's important that the lawmakers speak to the medical community directly and assess the need for this," he said. "It may be that they're having a 'me, too' reaction to other states. I have no idea who the lobby may be for this." Unlike laws in some other states, the proposal Morhaim discussed last week would license growers and dispensaries, would allow doctors to recommend marijuana only to patients with whom they have a long-standing relationship and would control who could provide the drug to homebound patients. People would not be able to grow their own marijuana and would be limited in the amount they could buy each month as well as the ailments they could use it for.

(Sen. David Brinkley, a Republican from Frederick, is the measure's sponsor in the Senate.) Morhaim, a longtime medical-marijuana supporter, said this legislative session is the right time to pursue the change. Last fall, the American Medical Association urged the federal government to downgrade its classification of marijuana from a dangerous drug with no medical use, clearing the way for more clinical research of the drug and development of cannabis-based medicines.

At the same time, access to medical marijuana has been growing nationwide since the Obama administration loosened federal enforcement of the drug last fall, saying it would not prosecute users in states with medical marijuana laws. With other states legalizing medical marijuana, Maryland had an opportunity to study their successes and missteps. In crafting the measure in the House of Delegates, Morhaim, who is originally from Los Angeles, looked at that city's experience with medical marijuana as an example of what not to do.

Because California's 1996 law legalizing medical marijuana did not regulate dispensaries or set up a means for distributing the drug, localities had to come up with rules on their own. While cities such as Oakland mandated regulation of dispensaries, including restrictions on where and how they can operate, Los Angeles left the question open; storefront dispensaries with on-site doctors flourished across the city. "I don't want doctors who will just write an open-ended marijuana prescription to a patient they just met," he said. "I am quite aware of the L.A. problem; it's clearly out of control."

Similarly in Colorado, which has had a medical marijuana law since 2000, towns have begun trying to close dispensaries. Until last year, there were only about a dozen dispensaries statewide. Since then, hundreds have opened, serving about 40,000 patients. But the state didn't address dispensaries in the law, creating a lack of uniformity in how they operate, said Brian Vicente, co-chair of Colorado's Sensible Patient and Provider Coalition. The coalition includes medical marijuana advocacy groups, business owners, caregivers and patients who are seeking some new regulation of medical marijuana.

The Colorado law said only that sick patients with a doctor's permission could possess and cultivate marijuana - or appoint a caregiver to do it for them if they were too sick or didn't have the expertise. One caregiver could handle many patients - the patients would merely have to designate the person as their caregiver. Some caregivers began opening stores, a boon to those who can't or don't want to grow their own marijuana and don't want to buy it "on the street or in an alley," he said. The Maryland proposal hopes to avoid that situation by allowing caregivers to serve only one patient, Morhaim said. Vicente said most dispensary owners are paying taxes and working to help sick people, but the coalition fears "a select handful are probably breaking some laws."

In the meantime, he said, towns have reacted differently. Denver "embraced them," and has written regulations for the dispensaries. But Centennial, Colo., tried to close its dispensary and the owners sued. Maryland, he said, has an opportunity to set a statewide, even national, standard for how to deal with the medical-marijuana issue by establishing a system of uniform taxation and regulation of dispensaries - no squabbling over rules.

But Vicente also warns the lawmakers not to make the rules too restrictive. The state should let patients grow marijuana, because it's cheaper than prescription medication, he said, and many patients can't afford traditional health care. Also, requiring a recommendation from a long-time doctor would be a problem for patients whose physicians fear federal prosecution or just won't write a referral. Maryland lawmakers suggest having growers be licensed by the Department of Health and Mental Hygiene and the Department of Agriculture, which would charge a licensing fee. Growers would have to submit to regular testing and monitoring.

"If you're going to have people use this, you have to make sure it's a safe and secure unadulterated supply. Grow-your-own approach opens the door to all kinds of misuses," Morhaim said. Meanwhile, doctors disagree over whether marijuana is even helpful for their patients, and whether they would prescribe it. Cullen, the UM cancer specialist, said marijuana is a carcinogen, and when you're treating people with cancer you don't want to expose them to more carcinogens. He also said marijuana is used as an anti-nausea medicine, but newer medicines developed in the past 10 years are better. And, finally, the active ingredient in marijuana has been made available as a pill, called Marinol, for those with chemotherapy induced nausea.

"It's rarely used because it doesn't work as well as newer medications," he said. "And most patients don't like the feeling they get from Marinol on top of chemotherapy." Cullen said he's "fairly agnostic" on medical marijuana for other purposes, but for cancer it's not a useful drug. Dr. Steven P. Cohen, a pain specialist and an associate professor of anesthesiology at the Johns Hopkins School of Medicine, said he would recommend marijuana to patients, but only after other therapies had failed. He'd make sure patients were responsible, compliant and informed about the risks of the drug and would agree to routine monitoring.

Marijuana, and the class of marijuana-like drugs called cannabinoids, can be effective treatment for people with central nervous system pain, such as those with multiple sclerosis and stroke, said Cohen. "For these patients, it would be great; these things are notoriously hard to treat." But there's no research on the long-term effects of the drug and few can justify using it as a first-line treatment, he said.

"Some studies have shown efficacy in the short-term, like six weeks or two months, but what happens after a year?" he said. "Especially if you smoke, you have questions about motivation, memory problems, there may be risks for cancer, bronchitis, lung disease and emphysema." Still, because treating pain is so complicated and few drugs offer long-term relief, Cohen doesn't see a problem with adding marijuana as another tool to help patients.

"People die from opioids, I see it all the time," he said. "They are probably inherently more dangerous than cannabinoids and they are used all the time for chronic pain. So why wouldn't you use cannabinoids?"

Maryland - Action, Change ASA MoCo Chapter History Since 2007, ASA chapters in MD have hosted numerous meetings, provided trainings and teach-ins across the state, organized art parties, and created a public presence by attending street festivals in Bethesda, Wheaton, Fell’s Point, and outside the M&T Bank Stadium during the Baltimore Ravens’ home games – all to spread awareness about medical cannabis and to recruit new members. The chapters worked with the Drug Policy Alliance to promote the Maryland Patients for Access campaign, designed to build grassroots support and identify potential leadership for upcoming reform efforts. In addition to public awareness sessions, the ASA chapters have hosted spokesperson and media trainings, making Marylanders better informed about of the vulnerabilities that patient’s face and how to navigate law enforcement encounters.

Delegate Henry Heller (D-Montgomery County) introduced legislation, HB 1339, that creates a task force to study the issues related to medical marijuana throughout the state of Maryland. If the bill passes, the State Department of Health and Mental Hygiene would be required to staff a Governor-appointed task force to evaluate whether the current state law is effective, fair, and equally enforced across all state jurisdictions in addition to other issues concerning the limited, therapeutic use of cannabis. SUMMARY: The "Darrell Putman" Bill -- Resolution #0756-2003 -- Approved in the state senate by a vote of 29-17. Signed into law by Gov. Robert L. Ehrlich, Jr. on May 22, 2003 Effective: Oct. 1, 2003 | Maryland's legislature passed a medical marijuana affirmative defense law in 2003. The law allows defendents being prosecuted for the use or possession of marijuana to introduce evidence of medical necessity and physician approval, to be considered by the court as a mitigating factor. This law requires the court to consider a defendant's use of medical marijuana to be a mitigating factor in marijuana-related state prosecution. If the patient, post-arrest, successfully makes the case at trial that his or her use of marijuana is one of medical necessity, then the maximum penalty allowed by law would be a $100 fine. Maryland Cases Show Law's Flaws, Activists Say

Maryland's medical marijuana law worked as intended in two cases this month, but activists say the cases show the problems with the law and have vowed to press for changes. Each of the cases involved a seriously ill patient - including one who is a founding member of the local chapter of Americans for Safe Access -- who received $100 fines and misdemeanor convictions after demonstrating that their doctors had recommended cannabis for their conditions.

"ASA-Maryland is more committed than ever to changing our state's medical marijuana law," said Tony Bowles, the chapter's spokesperson. "We should not be wasting the limited resources of the state on multi-day trials that result in a simple $100 fine. The law should provide better protection for patients and direction for law enforcement." In the unrelated cases, each patient had been charged with felony possession with intent to distribute. Maryland law still classifies medical use of marijuana as a criminal offense, but limits the punishment to misdemeanor possession with a fine of $100.

One case involved a woman who uses cannabis to control her epilepsy, the other a man who suffers from a condition that causes episodes of severe vomiting that require hospitalization. The woman's attorney told reporters that he was unaware of Maryland's medical marijuana law prior to taking the case, but nonetheless successfully argued in court that she should be covered by presenting medical studies showing that epilepsy can be controlled with cannabis.

In the other case, the judge refused to allow a medical necessity defense or any mention of the patient's condition at trial, though the cannabis seized by police was clearly labeled "For Medicinal Use Only," and the man has written recommendations from two physicians, including to a gastro-intestinal specialist who noted that no other medication is effective. That medical evidence was allowed at a sentencing hearing, and ASA's Director of Government Affairs, Caren Woodson, also testified to his long-standing activism as a medical cannabis patient.

"ASA is happy that patients and defense attorneys are able to get reduced sentences in Maryland," said Woodson. "But no one who uses cannabis in accordance with a physician's recommendation should be treated as a criminal by law enforcement or subjected to fines or any other penalties." Article 2 provides for the following, in reference to Schedule IV drugs:

    A Party shall, if in its opinion the prevailing conditions in its country render it the most appropriate means of protecting the public health and welfare, prohibit the production, manufacture, export and import of, trade in, possession or use of any such drug except for amounts which may be necessary for medical and scientific research only, including clinical trials therewith to be conducted under or subject to the direct supervision and control of the Party.

This provision, while apparently providing for the limitation of cannabis to research purposes only, also seems to allow some latitude for nations to make their own judgments. Medical marijuana law needs improvement; task force bill dies in committee - Last update: May 27, 2009 | Current medical marijuana law. In 2003, Gov. Robert Ehrlich (R) signed the Darrell Putman Compassionate Use Act into law. It protects seriously ill patients from being sentenced to prison for possessing marijuana if they can prove a "medical necessity" for using it. However, it does not protect them from arrest, and it does not provide them with safe access to their medicine (such as by cultivation). Although the law does not protect medical marijuana patients from harassment, arrest, and trial, the bill was a step in the right direction: The maximum penalty for patients who prove "medical necessity" for possessing medical marijuana or paraphernalia is now a $100 fine.

Recent legislative history. This year, Delegate Henry Heller (D-Montgomery County), working with our ally Americans for Safe Access, introduced H.B. 1339, which would create a task force to collect data and make recommendations about Maryland's medical marijuana law. This task force would have evaluated whether the current state law is effective, fair, and equally enforced across all state jurisdictions, recommend whether purchasing marijuana with a recommendation from a health care provider should be included in the law, and study the feasibility of having the Johns Hopkins University School of Medicine and the University of Maryland School of Medicine establish research programs to study the medical and social issues relating to the therapeutic use of marijuana. H.B. 1339 received a hearing in the House Judiciary Committee. However, committee Chairman Joseph Vallario (D-Calvert and Prince George's Counties) refused to schedule the bill for a vote and it died in committee.

Similarly, in 2007, the General Assembly considered legislation that would have significantly improved Maryland's current medical marijuana law. Delegate Vallario also refused to schedule that bill for a vote. When Maryland's medical marijuana was introduced, it allowed for safe access to medical marijuana and did not burden patients with a trial and fine. However, the bill was dramatically revised to its current form in Delegate Vallario's committee. Vallario has been a consistent obstacle to Maryland's medical marijuana patients having full protection of the law and safe access to their medicine.

Hello Pot-TV,

I am 21 and have lived in Maryland all my life. My mother was diagnosed with MS 30 years ago, she is currently 52. The whole time I have known my mother she has had MS, I've helped her with the battle the whole time. For a certain duration she could only be in a wheel chair, also MS has destroyed the optic nerve in her right eye leaving her blind. The doctors always put her on these poisen pills that put her way out in left field and they do alot of harm to her body. At one point my mother was on 10-8 meds and I was giving her injections of Avonex weekly. In the past 3-4 years my mother has been vaping and smoking medical cannabis. Pot-TV, I know and have seen the drastic turn around this plant can do for MS patients on a day to day bases. My mother is down to 2 pills now that she uses Medical cannabis. We can go out and do things like we were never able to do before my whole life of growing up. I am telling this all to you, Pot-TV, becasue in the past week a terrible event have taken place, that has put my mother MS in a terrible state.

On May 2nd in Bel Air Maryland, 15 DEA agents broke into my mothers house while she was going to answer the door. No faces, balaclavas. Drawn guns. Purple laytex gloves. The first thing my mother does is falls back and she goes in the fetal position with her arms rapped around herself tightly. My mother was having a severe MS attack. They drag her up a flight of stairs to the kitchen where they lay her on the floor.

They start drilling her with questions while she is having the attack "WHATS IN THE HOUSE?" All my mother could only just keep repeating is that she use Medical cannabis for her MS and tells them they will find some here. So they just leave her on the floor having the attack and start to tearing the house to apart. They take all here Medcical cannabis, glass art pipes and even some of here pharmaceutical meds. None of the DEA would have called an ambulace.

But thank god my father showed he was out getting a hair cut and showed up about a half an hour after this all happened first thing my father did is say "has anyone called an ambulance for my wife?! She is having an MS attack!" My father is a registered nurse (RN). The DEA would not even let him pick the phone up to call, eventually after they thought he was telling the truth they called. After this event my mother now can only walk with cane, and she has full body tremors. I'm telling this all to you Pot-TV, because I don't know who else to tell. I think your the one in the state of Maryland that would understand our situation the most. But I want the whole world to know what the DEA has done to my mother just for using cannabis to take the edge off the MS sword.

My mother is a Poet&Artist she does not deserve this. If you can help us please let us know, the day time phone (410)803-9469 is my mothers feel free to call it and talk to her I think it might make her feel alot better.

Thanks for taking the time to listen, Pot-TV, I have the feeling deep down inside that you will pull through and that this case will be a stepping stone to the complete and total legalization of medical cannabis with providers and MMJ clubs in the State of Maryland, we will set an example for the whole east coast to follow.
