    Lets Help Each Other in South Dakota

    South Dakota - Hopes The easiest thing for a legislator to do is nothing. That becomes less easy when she hears from a few people in her district about a law that is so unjust that it defies characterization. In South Dakota, state law specifically excludes a self-defense or "prevention of a greater harm" defense for using cannabis medically.

    Accused of murder or manslaughter? You have the option of producing evidence that you acted in self-defense, a version of "prevention of a greater harm" (He would have killed me had I not killed him).

    Accused of theft? "I took the car to drive the woman to the hospital, because she was dying." Prevention of a greater harm. Cases like these are rare, but they do occur.

    Accused of assault? "He hit me first. He would have hit me again." Prevention of a greater harm.

    Cops, prosecutors, judges and juries listen to and consider these arguments often.

    Accused of a violation of 22-42-6 (possession of "marijuana")? You have South Dakota - Hopes evidence that without cannabis, life is a much more bleak proposition for you than with it. Your doctor agrees. Doesn't matter.

    You are not allowed to present the "prevention of a greater harm" defense when you're accused of possession of cannabis.

    In other words South Dakota law says that misery or death in your life is a lesser harm than the principle involved in preventing you from using a life-sustaining herbal remedy.

    South Dakota Senator Craig Tieszen and Representative Dan Kaiser have committed to introducing the Medical Necessity Act in the South Dakota legislative session which began January 8 and will continue for 35 days.

    Now we need the support of other credible legislators. You can help by contacting your legislators and asking them to support this bill. No sane person can oppose it, but if there is no apparent support, your legislators can just ignore it. Do this now! This bill will be submitted before Jan. 26, 2013.

    Also take the time to let Sen. Tiezsen and Rep. Kaiser know how much you appreciate their doing the right thing while expending "political capital" while doing so.

    Legislators don’t hear from many individual voters. They get quite a little garbage mail from various national organizations, and they hear from lobbyists on a few matters that concern some special interests. But they don’t hear from many ‘just plain folks” who want legislation just because it’s the right thing to do.

    If the 200 people who have signed the Letters to Legislators were to each email or snail-mail (even better) their three legislators with the following message, SoDakNORML will guarantee you that the Medical Necessity Act will see a full discussion and almost certain passage in the 2013 legislature.

    Copy the message below and send it to your legislators. See below for how you can contact them by email or by snail mail.


    Sen. (or Rep.) [insert name];

    It is unjust that people accused of possession of “marijuana” are not allowed to present evidence that they use cannabis to alleviate their medical conditions.

    Please support the 2013 South Dakota Medical Necessity Act:

    Section 1. Any person arrested or prosecuted for the possession or use of marijuana may submit as a defense, a medical necessity, if:

    (1) The person has a medical condition recognized by a competent medical authority as a condition for which marijuana is a palliative; or

    (2) The person has a recommendation by a competent medical authority for the use of marijuana for a medical condition.

    Section 2. A medical necessity defense pursuant to this Act may, at the discretion of the accused, include:

    (1) Expert testimony;

    (2) A recommendation by a competent medical authority; and

    (3) Testimony by other persons with a similar medical condition.

    You may, of course, add a personal note. The important thing is that you have taken the time to express your desire on an issue a legislator can get behind without annoying very many voters. How, after all, can a person tell his legislator that he doesn’t want people to be able to legally use an effective medicine?

    You can, by investing 10 or fifteen minutes, send this message to all three legislators in your legislative district. You can go to - legis.state.sd.us - and click on “Who are my Legislators?”

    Once you know, you can click on your legislators’ names and send them an email, or get their mailing addresses to send them snail-mail. Just copy and paste the message above, using the legislators’ names, and you’ll have done more to beneficially change cannabis law in South Dakota than any except about two dozen people in the state.

    All that is necessary to allow the evil of denying people an effective, safe herbal remedy is for you to do nothing.

    It's up to You. There is no lobbyist telling any South Dakota politician that passage of the Medical Necessity Defense will result in some campaign funding and that it will provide jobs or revenue.

    Yet, Rep. Kaiser and Sen. Tieszen are willing to sponsor this bill. You can help. You can thank them for their willingness to stand up for what's right.

    You can send a message to your legislators (most of you have three). You can do this by following directions at - sodaknorml.org/2013necessityact.htm#legemail (read the left column when you get there).

    You can ask your acquaintances who use cannabis medically to get hold of us. You can let us know of medical professionals in So. Dak. who agree with us. You need to do this in the next few days. It will be a shame if we miss this chance to alleviate fear of punishment for those cannabis patients who have the misfortune of being arrested.

    South Dakota - Event; Action - Black Hills Hemp Hoe Down Black Hills Hemp Hoe Down, western South Dakota’s Spring Celebration, returns with its tenth annual showcase of original music and sustainable living-related activities.     South Dakota, News - South Dakota medical marijuana advances, but fails to pass this year South Dakota medical marijuana advances, but fails to pass this year - Last update: August 17, 2016 | Earlier this year, the Secretary of State determined that a ballot initiative by New Approach South Dakota that would have created a medical marijuana program in the state fell short of collecting the required signatures. As a result of the campaign’s efforts, however, the South Dakota Legislature introduced the language of the ballot initiative as a bill, SB 171. The legislature then held a hearing on February 17, 2016. Unfortunately, the bill was amended by the Senate Committee on Health and Human Services to allow only CBD oil containing less than 3% THC. It would also have been ineffective because it required doctors to prescribe the oil, which they cannot do under federal law.     Nevertheless, even having a hearing on medical marijuana was a positive step for the legislature and generated additional support for medical marijuana that can be built upon in the next session. Please ask your legislators to support access to medical marijuana for seriously ill South Dakotans suffering from cancer, HIV/AIDS, multiple sclerosis, and other conditions that can be relieved by medical cannabis.

    South Dakota marijuana possession laws may be the nation’s harshest | Possession of just a small amount of marijuana in the state carries a potential penalty of a year in jail and a $2,000 fine. Even more alarmingly, individuals who have consumed marijuana elsewhere are also subject to this penalty if they test positive for past use — even if they consumed marijuana in a state where it was legal. South Dakota appears to be the only state with such an “internal possession” law. In addition, possession of any amount of hash or concentrates is a felony, punishable by up to five years in prison and a fine of up to $10,000. A study by the American Civil Liberties Union found that South Dakota was among the top 10 states for racial disparity in marijuana possession arrest rates. Despite people of all races using marijuana at very similar rates, blacks in South Dakota are nearly 4.8 times more likely than whites to be arrested for marijuana possession.

    South Dakota - Marijuana (cannabis) News: Lawmakers consider marijuana bill Lawmakers consider marijuana bill | Two lawmakers, including a former Rapid City police chief, are seeking support for a bill that would allow anyone arrested with two ounces or less of marijuana to use medical necessity as a defense in the courts. Sen. Craig Tieszen, R-Rapid City, and Rep. Dan Kaiser, R-Aberdeen, were looking Tuesday to line up supporters for the legislation, which they hope to introduce today.

    Tieszen said the intent of the legislation isn’t to legalize marijuana or to allow storefront pharmacies. “All they can do is defend themselves in court. They can bring their experts, they can show their disease or illness, and let the judge and jury decide,” he said.

    Kaiser, a police officer, said the bill would give defendants the option to present the defense and judges would decide whether to consider it. “It doesn’t legalize it,” he said. Kaiser stressed that the marijuana still would be confiscated at the time of arrest and the person in possession would be booked on criminal charges.

    Asked whether the marijuana would be returned to the person if the judge accepted the medical necessity argument, Kaiser said that would not be the case. “The bill does not authorize that, because the marijuana would still be illegal,” he said. Tieszen said former Rep. Tom Hennies, another former Rapid City police chief, offered similar legislation in 2001. Hennies, who died in 2009, was the only legislator who signed his name to the bill, which was killed after its first committee hearing, where it was opposed by police chiefs, sheriffs, the highway patrol, the attorney general's office and the state Health Department.   Please Read more>> < here

With 603 of 791 precincts reporting Tuesday night, voters rejected Initiated Measure 13 by a 64 percent to 35 percent margin. A similar measure was defeated in 2006 by a much tighter 52 percent to 48 percent. Measure 13 moved to legalize medical marijuana for people suffering from "debilitating medical conditions." Under the law, patients could receive recommendations for medical marijuana from a physician. They would then be required to register with the state. According to the article, Judge Delaney took issue not so much with Newland's advocacy but rather disliked "the idea of an adult doing anything that would encourage kids to drink or do drugs."

    Drug policy reformers and civil liberties groups were generally shocked by the Judge's decision. Communications director for the Marijuana Policy Project (MPP), Bruce Mirken, called the decision "appalling" in July 10th's issue of The Drug War Chronicle ("Marijuana Activist Silenced by Judge as Condition of Probation"). In a follow-up piece published by the Rapid City Journal on July 11 ("Judge's Gag Order on Marijuana Advocate Bob Newland Raises Questions"), "Robert Doody, director of the American Civil Liberties Union of South Dakota, said he wasn't prepared to say whether he thought the gag order was legal."     Placing an initiative on a state-wide ballot is very challenging. Such a task requires a lot of time, commitment, and funding from a wide range of people. This week the South Dakota Coalition for Compassion is launching the official petition drive to place the South Dakota Safe Access Act on the 2010 ballot.

    Our membership is growing every day as the Coalition has become increasingly involved in the community to raise awareness about marijuana's medicinal value. Recently our supporters bridged a strong relationship with the Multiple-Sclerosis community by walking and raising $5,000 in the 2009 Walk MS in Sioux Falls.

    The Coalition for Compassion formed for the sole purpose of protecting sick and dying people who are victimized through cruel and outdated state laws which prosecutes and jails them for simply using doctor-approved medicine that relieves their pain and suffering. Medical Marijuana patients deserve our compassion, not attention from law enforcement. The hard-working and respected men and women of law enforcement should stay focused on protecting our citizens from violent and otherwise dangerous criminals, and should not use taxpayer dollars to enforce cruel and unjust laws that put sick people in jail for using their medicine.

    Patient use of medical marijuana is already widely recommended by physicians despite legal obstacles. The sick and dying people protected under the South Dakota Safe Access Act deserve protection from state law so that they can have safe access to effective therapy for their illnesses.

    Despite our own state legislators failing to enact compassionate protection in the 2009 legislative session, South Dakota's voter demographic has never been more politically promising. Whereas thousands of South Dakotans registered to vote in the last general election and the Coalition's strength consisting of an admirable panel of patients, doctors, and former law enforcement, willing to debate and speak publicly on behalf on the South Dakota Safe Access Act puts us in the most viable position ever to pass a medical marijuana initiative in South Dakota!

    On Monday, May 5, the Coalition for Compassion and the South Dakota Safe Access Act's primary sponsors, Pat Lynch, the former chairman for the North Central States Chapter of the Multiple Sclerosis society, and Emmett Reistroffer, both of Sioux Falls, were certified as sponsors for the petition to place the South Dakota Safe Access Act on the 2010 ballot. This week the Coalition will join Keefe Green Productions, at two of its events aimed at celebrating the Cannabis hemp, to launch the official petition drive for the SDSAA. The East River petition kick-off will begin Wednesday, May 6th, at 7pm at The Sioux Hempire Ball at the Center for Veterans of Foreign Wars in Sioux Falls and the Black Hills petition kick-off will begin Thursday, May 7th, at the Hemp Hoe Down in Sturgis.

    The Coalition will continue to circulate for signatures at various community events, concerts, fairs, ect in South Dakota communities throughout the summer. Such a campaign depends on an extensive network of support and an army of volunteers.

    On the national level, in the past 48 hours alone, South Dakota, New Hampshire, and Rhode Island state houses have all have taken steps to enact medical marijuana legislation or improve upon existing law. In 2009 so far, legislators have supported medical marijuana in Alabama, Connecticut, Illinois, Massachusetts, Maryland, Missouri, North Carolina, New Jersey, New York, Tennessee, and Texas.

    The voters of South Dakota will follow suit with modern science and reality. South Dakotans will go to the polls in 2010 to pass the SDSAA with pride and prestige, a reflection of the compassionate and caring values that bind our families and traditions.

    No longer shall we accept the insane and cruel deprivation of medicine for people who suffer from Glaucoma, Cancer, Multiple Sclerosis, HIV/AIDS, Lupus, and other tragic illnesses.     South Dakota - Info, History Hello South Dakotans for Safe Access, and supporters thereof,

    12 February 2009 - Well, a week ago yesterday, the House Judiciary committee killed the second of two medical cannabis bills we placed in the South Dakota legislature for consideration. The resulting page contains eagle icons that will download the testimony on either bill. HB1127’s testimony and discussion takes two hours. HB1128 shared its two-hour committee meeting with several other bills. On the audio, one bill is heard before 1128, and it only takes about two minutes. Testimony on 1128 takes about 30 minutes.

    I’ve been resting, thinking and catching up on stuff since then. I am trying to be generous in my consideration of the consideration that was paid our proposed laws and the folks who went to Pierre at considerable inconvenience to argue on behalf of those proposals. Here’s what I think. Those who spoke against and voted against allowing sick, disabled and dying people to legally use medicine that works for them are sh!tdrinkers. That’s about as generous as I can be, and may be more generous than they deserve.

    They heard our testimony, they saw our letters from doctors, they saw witnesses in wheelchairs; they know people are being arrested for using medicine. They know cannabis alleviates pain, muscle spasms and spasticity, and nausea. Knowing that, they voted to do nothing to alleviate the legal danger in which many sufferers of several different medical conditions find themselves. That can be due to one or more of only four reasons; ignorance, stupidity, insanity, or malice. I’m not inclined to argue our case before such people any more.

    If we want to change the inhumane laws regarding marijuana use by legitimate medical users, we will have to take the issue to the people, on the ballot.

    Putting an issue on the ballot

    I have been involved in several petition drives, and have directed a couple. If we decide to put the issue of medical marijuana on the ballot in 2010, these are some of the things we must consider. The schedule The first date we can take a signature is April 2, 2009. We have a year from that date to turn in a number of valid signatures equal to 5% of the number of votes cast in the 2006 gubernatorial election. That number was 335508. Five percent of that is 16776 valid signatures needed to place an issue on the ballot.

    The numbers – 16776 valid signatures – 19500 with needed safety margin We should figure on getting 15 percent more signatures than the basic 16776, because some people sign twice or more, and some who sign are not registered to vote in So. Dak. That means that SDSA will need to obtain 55 signatures a day, every day, for a year.

    Or, lets say we have 100 volunteers. Each one would have to obtain 17 signatures a month for 12 months. That’s not a difficult task, for any one person. But I have never been able to inspire even a crew of 10 volunteers to do that much. The reason it’s so tough is that being a volunteer and working on your own is a lonely, minimally-appreciated job. That’s why I think almost nobody will go out one day a month and get 17 signatures; it’s very hard to get up for.

    Groups of volunteers can work more effectively when there are large gatherings of people, town art fairs, county fairs, Black Hills Stock Show, concerts, and the ever-reliable courthouse. You think people won’t sign a medical marijuana petition at the court house? Woh! Truth is, they’ll sign it anywhere, but the courthouse provides a steady stream of folks all year long, some of whom are our friends. Teams of two or three people working and traveling together can be a fun thing to do a few times during the spring and summer.

    Bottom line on a petition drive; It ain’t easy. And it ain’t cheap. To expect a credible volunteer effort, SDSA will have to cover the actual expenses, with some mad money to boot, of traveling to, say, the State Fair. We need to make it so getting signatures doesn’t cost anything for the people who are willing to work free of charge. We aren’t discouraging a volunteer from footing his own expenses, but we expect that a number of volunteers won’t be able to do so.

    The main question is, Can we afford to initiate a petition drive?

    $50k. Even if we put together a credible semi-volunteer effort, there will be expenses (in addition to just gettin’ around). I’ll break those down a little in a subsequent message, but a figure to look at is $50000. I think it’s possible we could put the issue on the ballot for that, and maybe have $3000 left to put on a little party.

    There are about 200 people on this list who live in SD. If everyone of them would commit to getting 10 signatures, we have 10 percent of the job done already. Think about it.

    How about money from MPP or NORML or somebody?

    Simple fact is that the major funders of those orgs have seen their fortunes shrink seriously during the past year. I think we’ll have to show ‘em what we’re made of before they’ll think about handing us a buck. MPP put over $250K (by my rough estimate) into the 2006 election promotion. We got 48%. WE GOT 48%!!! That $250k went partially to three TV ads and a couple radio spots. The results are still being felt. We can run with that.     Really, a petition drive is a major undertaking for the sponsoring party. That would be South Dakotans for Safe Access. First, we need a law to propose. I am not very fond of laws that take up eight pages. Anyone want to try to draft a simpler law than the one just blown off by the legislature? See it > here…

    Then we file our intent, along with a copy of the proposal, with the Secretary of State. Then, as early as April 2, 2009, we can begin obtaining signatures.

    Managing a petition drive is a full-time job. I don’t have the resources to manage a petition drive unless we can raise funds again. We did okay on the legislative campaign fundraising; we asked for $4500, and we got about $6000. That allowed us to even fly in one of the federal marijuana recipients, Elvy Musikka, and Tony Ryan, who gave the LEAP perspective, as well as his own, as a retired cop. But there’s an obvious difference between $6000 and $50,000. I don’t think I can commit to taking on a petition drive with less than $15000 in the bank ready to pay expenses.

    Anybody want to help solve that problem?

    It is possible for a dedicated crew of, say, 30 people to put an issue on the ballot, funding it out of their own pockets, but they’re going to be spending a lot of time and travel to do it.

    Most signature drives are combinations of volunteer and paid work. I’m interested in anything that will help me see how I can afford to invest a year (or less, perhaps) in putting this issue on the ballot. In other words, I am asking for those among the readers of this message who are inclined to help manage a petition drive, or who will commit to getting at least 100 signatures, to respond and let me know what kind of a crew we’re looking at going in.

    And I’m looking for commitments for operating expenses. You tell us what you can donate, and we’ll see how many commitments for how much $ we get before we decide if we’re going to accept the money.

    Ideas for fundraisers?

    The achievement of which I am proudest, over the period of the last 10 years of active statewide cannabis advocacy, is having been able to show up in Pierre with nine medical cannabis users, as well as testimony from two medical doctors and a retired law enforcement officer. All had compelling testimony. Any one of them would have convinced a listener not afflicted with legislativitis terroris (spines of jelly).

    I hope to hear from about 200 of you, each committing to get 100 signatures by the end of July.

    Where do you go when you have a piece of offensive legislation , such as the income tax, that no one in their right mind would normally carry?

    “Thank God” Gerry Lange is back, because in addition to being South Dakota’s resident apologist for murdering terrorists who run airplanes into skyscrapers, for years he’s been the poster child for 10-foot pole worthy measures.

    And this session is no different.

    HB 1127. Sponsored by Representatives Lange and Vanderlinde: An act to provide safe legal access to medical marijuana for certain qualified persons.

    and..

    HB 1128. Sponsored by Representatives Lange, Iron Cloud III, Thompson, and Vanderlinde: An act to allow a medical necessity to be used as a defense in certain cases involving the possession or use of marijuana.

    So, when it comes to a vote, which legislators are going to line up in favor of legalizing some uses of recreational drugs…

    …and which want to be able to be elected again? We shall see.

    But those of us who salivate at the prospects for such measures coming to a vote would like to thank Gerry Lange for providing us with campaign fodder for Fall 2010.

    Today I called So. Dak. Sen. Gordon Howie in Rapid City SD. I asked if he'd support a medical cannaabis bill. He said, "I'd need to see double-blind studies so the proof would be there conclusively."

    "Proof of ...?" I said.

    "Proof that it would be good for someone."

    "Good for someone not to suffer pain?" I said.

    "There are other medicines for pain," he said.

    "They work for some people. Some people only get relief from cannabis."

    He said, "Look, if I had a medical condition that could only be helped by marijuana, I'd make a connection and get some marijuana. If it led to a problem, I'd just deal with it."

    "You mean, if you got arrested?" I said.

    'That's right. I'd deal with it. They can too," He said.

    In other words, the suffering of sick and disabled people ain't my business. And if it becomes my business, I wouldn't have a problem breaking the law either.
