Status of Medical Marijuana (Cannabis) in Uruguay.

  Info on Uruguay and Medical Cannabis 

Uruguay does not have a Specific MEDICAL MARIJUANA (cannabis) LAW. Possession of cannabis has been federally legal in Uruguay since 1974.

Uruguay - status Uruguay | Uruguay has no legislation regarding personal usage of cannabis. While this technically allows its consumption, the lack of definition of "personal usage" is still a cause of discrepancies between courts of law, as allows the case law system. It is popular belief that possessing over an ounce (28 grams) is illegal and prosecutable, while lesser amounts are permitted to carry. Recently, Uruguayan government officials President Jose Mujica and his administration announced, as part of a 16 proposals "package" to be introduced to Parliament, that the State would produce and commercialize cannabis to registered consumers for personal usage.

In 8 August 2012, on a bill presented to Parliament, Mujica's administration proposes that "the State assumes control and regulation of activities pertaining import, production, acquisition of any title, storage, commercialization, and distribution of marijuana and its derivatives, on terms and conditions of what the regularization states." This broad bill is explained in detail on a letter Mujica's administration wrote to Parliament explaining their philosophy on the subject. The letter was signed by the Ministry of State and president Mujica. The letter mentions supposed facts on historical usage, failure in international regulation and a lost War on Drugs, among other subjects. The bill contains no mention to a list of registered consumers, as announced by the administration, nor is it mentioned on the letter to Parliament.

On an interview with CNN En Espanol, president Mujica announced a private company, under strict governmental control, would sell cannabis to users. To control illegal cannabis trade from narcotics gangsters, Uruguay is the world's first that allowed to planting, distributing and using cannabis. A registered person can plant up to 6 plants and in November 2014 there are 1,200 registered persons, while a registered users can buy up to 40 grams cannabis per month in drug stores. Since 1998, cannabis smoking is legal and now Uruguay has about 150,000 mild cannabis smokers. >> Click > here < for source.

Uruguay - News: Uruguay: Medical Marijuana May Cost More Than Recreational Pot Uruguay: Medical Marijuana May Cost More Than Recreational Pot | Citing Uruguay's drug czar Julio Calzada, El Observador newspaper reported on Feb. 6 that medical marijuana will cost more than recreational weed. A National Drug Council spokesman confirmed on Wednesday that cannabis grown in Uruguay for medicinal uses — like treating pain and nausea caused by chemotherapy, or helping boost appetites for HIV/AIDS patients — will cost more than recreational pot. The reason: Medical marijuana will be grown separately from the recreational type, by different companies. It will likely have higher levels of tetrahydrocannabinol or THC, the plant's chemical compound that makes users high, and will be grown under stricter controls than pot grown purely for fun. Uruguay - status Legal and medical status of cannabis From Wikipedia, the free encyclopedia | Uruguay (South America) Legal | In December, Uruguay became the first nation to approve marijuana legalization and regulation. President Jose Mujica said his goal is to drive drug traffickers out of the dope business and reduce consumption by creating a safe, legal and transparent environment in which the state closely monitors every aspect of marijuana use. Once registered and licensed, any Uruguayan adult will be allowed to choose one of three options: grow plants at home, or join a pot-growing club, or buy marijuana cigarettes from pharmacies. Currently "Possession for personal use not penalized; law does not specify quantity for "personal amount."

Originally, Uruguay was expected to have written the fine print on its regulations. But the president has postponed the implementation to 2015 and parts of the opposition claim that the new law will never be implemented. The new law says that buyers must be 18 or older, residents of Uruguay, and must register with the authorities. Uruguay - News: Uruguay unveils marijuana regulation details Uruguay unveils marijuana regulation details | The regulations allow three forms of access to marijuana. Uruguayans can purchase up to 40 grams per month – with a limit of 10 grams per week – from registered pharmacies. They can also choose to cultivate up to 6 homegrown plants, with a cap on annual production at 480 grams. Finally, as members of cannabis clubs, Uruguayans will be able to cultivate up to 99 plants per group, with a production cap of 480 grams per member. But smokers must choose one form of acquiring pot, and will be denied access to the drug by the other two means. The law officially takes effect on May 6, the government announced Friday. International law

Marijuana is in Schedule IV of the Single Convention on Narcotic Drugs, making it subject to special restrictions. Article 2 provides for the following, in reference to Schedule IV drugs:

    A Party shall, if in its opinion the prevailing conditions in its country render it the most appropriate means of protecting the public health and welfare, prohibit the production, manufacture, export and import of, trade in, possession or use of any such drug except for amounts which may be necessary for medical and scientific research only, including clinical trials therewith to be conducted under or subject to the direct supervision and control of the Party.

This provision, while apparently providing for the limitation of marijuana to research purposes only, also seems to allow some latitude for nations to make their own judgments. Cannabis's accepted medical use in the United States is increasingly recognized by health care professionals and the medical community, including the Institute of Medicine. Numerous medical organizations support legal access to cannabis for medicinal purposes. A new medical journal released in 2001 focuses on the medicinal use of cannabis and cannabinoids. National clinical conferences on the medicinal use of cannabis have been held in the United States in 2000 and 2002 and are scheduled to continue on a biennial basis. Most importantly, data on the number of physicians currently recommending therapeutic marijuana use to their patients demonstrate its acceptance by the medical community in the United States.

The study, which was conducted over a two year period and included 775 patients from the USA, Africa, and Puerto Rico, assessed the use of cannabis as a symptom management approach for anxiety, depression, fatigue, diarrhea, nausea, and peripheral neuropathy.  27% of survey participants reported using cannabis for medicinal purposes.

Researchers wrote that cannabis use “was rated slightly more effective than antidepressants for anxiety and depression, Imodium for diarrhea, [over the counter] (OTC) medications for fatigue, and anti-epileptics and OTC medications for neuropathy” while cannabis was rated “slightly less effective for nausea than either prescribed or OTC medications.”   Authors concluded that cannabis “is perceived by users as at least as effective as prescribed medications in symptom management.”   ...   Visit - http://safeaccessnow.org/blog/?cat=22.

Uruguay - News: Uruguay's marijuana experiment is evaporating LEGAL MARIJUANA TAKES ROOT IN LATIN AMERICA | MONTEVIDEO ( AFP ) - After Uruguay first moved to legalize marijuana in 2013, the approach has taken root in Latin America with several other countries now considering a revamp of their own drug laws. "Someone has to start in South America," Uruguayan President Jose Mujica said in late 2013 as he unveiled plans to make cannabis legal in his country. Under Mujica, Uruguay became the first country in the world to fully legalize marijuana all the way from the cannabis field to the joint, setting up a regulated market for cultivation, sales and use. Though marijuana is not yet being sold in pharmacies, the National Drug Council, or JND, already counts 1,300 of the country's 3.3 million inhabitants registered as self-producers. There are also six clubs of up to 45 consumers.

Uruguay's neighbors are intrigued.

"Because Uruguay did it and has not yet suffered any massive negative consequence, either in terms of international relations, foreign policy, sanctions or domestic political repudiation, it's become an option for other countries to consider," John Walsh of the Washington Office on Latin America said. Pien Metaal of the Transnational Institute in Amsterdam agreed that "Uruguay has inspired many countries to at least take a few steps in that direction." "It is not possible to go back. The genie came out of the bottle and there is no way to get him back inside," she added. In late October, Chile became the first in the region to grow cannabis for therapeutic uses, though the drug is still officially considered a narcotic. A bill under consideration seeks to decriminalize growing cannabis for personal uses. In Colombia, parliament is debating a bill allowing medical use of the drug, with support from center-right President Juan Manuel Santos. A bill backed by Argentine Secretary General to the Presidency Anibal Fernandez seeks to decriminalize marijuana cultivation for personal use, but the government overall is still opposed. Another bill seeks to decriminalize therapeutic consumption and uses of the drug. In several countries in the region, marijuana possession for personal use is no longer subject to penalties.

US example

Beyond the region, Latin America is also looking to its huge northern neighbor, the United States. Despite its troubled history with the war on drugs, which saw Washington engage in a long campaign of drug prohibition, military aid and military intervention in Latin America and beyond, reforms are now underway in the country itself. Four states have already regulated cannabis for recreational use-Alaska, Colorado, Oregon and Washington-and 23 have legalized its medical use. "This makes the United States lose a bit of credibility when it dictates its drug policies to Latin America, as it has done for the past several decades," Metaal said. After having long advocated for prohibition, "it is time for the United States to show coherence in the way it deals with countries in the region, and to stop preaching something they cannot apply at home," said Eduardo Vergara, who heads Chile's Asuntos del Sur think-tank. But he noted that "the region remains divided," and some Latin-American countries are still hesitant, Vergara added.

"Legalizing drugs is not on the agenda right now," Brazilian Justice Minister Jose Eduardo Cardozo said recently, despite a raft of bills seeking to do just that. Costa Rica, Mexico, Nicaragua, Panama, Peru and Venezuela also share similar positions. But there is also a chorus defending legalization, including from ex-presidents Fernando Henrique Cardoso of Brazil and Vicente Fox of Mexico. And calls for a new approach are rising in the region, the world's biggest producer of cocaine and long in the grips of violence linked to drug trafficking. The repressive approach has "failed," according to Colombian leader Santos, while his Ecuadoran counterpart Rafael Correa labels it a "complete failure." And with the support of Colombia, Guatemala and Mexico-all facing a bloody drug-related wave of violence-the United Nations will hold a special session on drug policy next year. But while marijuana legalization is taking place in the United States through public pressure, change is more gradual in its southern neighbors. "There is public skepticism in Latin America, where the public may not be pleased with their drug war, but also tend to associate the idea of legalization as permissive or surrendering," Walsh said. Uruguay - News: Uruguay's marijuana experiment is evaporating Uruguay's marijuana experiment is evaporating | DENVER, Colo. — It’s been more than 18 months since the tiny South American country of Uruguay legalized the cultivation, taxation and sale of recreational marijuana. The most striking element of Uruguay’s legislation is that the government has pledged to hire companies to cultivate its own marijuana, which will then be sold to the public in pharmacies. Yet, more than a year and a half later, and the Uruguayan government is yet to announce even the companies that will be growing its weed. In January, a government minister told reporters that the government was days away from announcing the companies. That never happened.

The most radical part of Uruguay’s pioneering pot plan looks in trouble. The pot law was pushed forwards by Uruguay’s former President Jose “Pepe” Mujica, a left-wing former revolutionary, who also ushered in the legalization of gay marriage and abortion. But Mujica, who was termed out this year, was replaced in March by Tabare Vazquez, whose politics are much more centrist. Vazquez has been lukewarm on the idea of government-grown pot all along. Vazquez’s pot czar said back in March that there was “no rush” for the government to start growing and selling marijuana, and since then, there’s been no news about this aspect of the law moving forwards.

Uruguay - News: Uruguay: Medical Marijuana May Cost More Than Recreational Pot Uruguay: Medical Marijuana May Cost More Than Recreational Pot | MONTEVIDEO, Uruguay — As this country's remarkable legal marijuana experiment continues to unfold, an unexpected detail has emerged: It could cost more for cancer patients to buy weed for pain relief than for plain old stoners getting high just for fun. Citing Uruguay's drug czar Julio Calzada, El Observador newspaper reported on Feb. 6 that medical marijuana will cost more than recreational weed. A National Drug Council spokesman confirmed on Wednesday that cannabis grown in Uruguay for medicinal uses — like treating pain and nausea caused by chemotherapy, or helping boost appetites for HIV/AIDS patients — will cost more than recreational pot. The reason: Medical marijuana will be grown separately from the recreational type, by different companies. It will likely have higher levels of tetrahydrocannabinol or THC, the plant's chemical compound that makes users high, and will be grown under stricter controls than pot grown purely for fun.

It's the latest twist in the South American country's breakthrough cannabis policy. There have been some notable hold-ups in the rollout, and any new details that emerge need to be taken with a pinch of salt. Until a few months ago, Uruguayan politicians were adamant that pot would be sold for $1 a gram, a claim they're now backing away from. Although Uruguay’s Congress approved the measure in December — becoming the first country in the world to legalize recreational pot use — it was just this week that the government of President José Mujica announced all the details.

The regulations allow three forms of access to marijuana. Uruguayans can purchase up to 40 grams per month – with a limit of 10 grams per week – from registered pharmacies. They can also choose to cultivate up to 6 homegrown plants, with a cap on annual production at 480 grams. Finally, as members of cannabis clubs, Uruguayans will be able to cultivate up to 99 plants per group, with a production cap of 480 grams per member. But smokers must choose one form of acquiring pot, and will be denied access to the drug by the other two means. The law officially takes effect on May 6, the government announced Friday.

The “experiment,” as Mujica has labeled the law, will be closely monitored throughout the hemisphere – from Mexico to Guatemala to Argentina – as a growing list of countries increasingly mull alternatives to a militarized drug policy that has seen governments outgunned by trafficking syndicates, who rake in billions of dollars annually through illicit sales. The rest of the world will be watching, too. The United Nations and United States have cast a wary eye on the measure, which contravenes international agreements on drug control. But the Obama administration finds itself in an awkward position internationally, and will likely temper its criticism of the Uruguay program, since Colorado and Washington state voted to legalize recreational pot use in November 2012. Since then, Latin American leaders have aggressively questioned U.S.-led drug control policy. They wonder why they should spend resources – and lose lives – defending drug laws when the U.S. government has allowed two of its states to experiment with marijuana legalization.

Moreover, the similarities between Uruguay’s measure and those of Colorado and Washington state are no coincidence. Julio Calzada, Uruguay’s drug czar, has long pointed to the U.S. measures as inspiration for his country’s law. Uruguay’s home cultivation provision, for example, mirrors Colorado policy. The Latin American nation will also register and track every government-grown marijuana plant in a process similar to Colorado’s Inventory Tracking System. And like Washington state residents, Uruguayans will be subjected to a DUI provision. Now it is entering the medical cannabis business by taking an 85% interest in Winter Garden Biosciences, a pharmaceutical company based in Uruguay that is developing mass market, non-synthetic cannabis products. The attraction of this small South American nation is that, according to IGS, in the rest of the world laws prohibit growth and research on hemp with a THC content of more than 0.03% (THC being tetrahydrocannabinol, the mind-altering substance in cannabis). As the company says, this has altered every aspect of the plant to the point “that it offers almost no useful research benefits”. IGS argues that if the THC level is below 1%, that level is considered non-psychoactive. The company says the US Drug Enforcement Agency and Food and Drugs Administration have lobbied the world to get level down to 0.03%.

Only synthetic plants can be utilised in most global R&D and, again according to IGS, “these are ineffective and inadequate for both research as well as pharma-grade medical applications”.Winter Garden is at present the only company in the world licensed to operate in Uruguay using natural levels of THC and cannabinoids, with accompanying patent, marketing and clinical trials. Drug czar Julio Calzada told El Observador about the unusual price structure, and a National Drug Council spokesman confirmed the news to The Global Post.

One reason that kind of pricing comes off as odd: The government would be charging more for medicine than they would drugs meant for recreational use, indicating an unusual emphasis. Another reason: It goes against everything the legalization movement has seen in the U.S., where medical prices are often half of their recreational counterparts in Colorado and Washington shops. The reason, according to The Global Post: Medical marijuana will be grown separately from the recreational type, by different companies. It will likely have higher levels of tetrahydrocannabinol or THC, the plant’s chemical compound that makes users high, and will be grown under stricter controls than pot grown purely for fun.
