Legislation: The possession of marijuana for personal use in Berlin is tolerated, as long as the amount does not exceed a quantity of 10 grams. Nonetheless, I would not suggest traveling around the city with 10 one gram baggies in your pocket.
Law Enforcement: As long as you don’t indulge in the herb in public, you have nothing to worry about. If you do decide to, you still have almost nothing to worry about. Just don’t go making a big deal out of it and you’ll be fine.
Where to Buy Marijuana in Berlin: If you go behind cafe zapata around 945 or later you can get crazy buds!

Legislation: Although marijuana is technically illegal, personal consumption is arguably decriminalized due to the “ban on excessive punishment” inherent in German law. According to federal guidelines prosecution can be declined in cases of up to 30 grams in several regions.
Where to buy marijuana: At the Hofgarten near the university, when it is getting dark. Black guys are usually selling weed, but they are expensive, although the weed is ok. Arabs or Turks sell hash, which is ok, and it seems to me that they are a bit less expensive.
Usually, you meet black guys OR Arabs, they don’t seem to be around the same time. Make eye contact, they will initiate the deal.
Whenever I went there, the dealers were pretty relaxed, since it’s not a big city. They let you check the merchandise first, which you should do.
During the day, there might be civil police you wouldn’t recognize.

Legislation: Although marijuana is technically illegal, personal consumption is arguably decriminalized due to the “ban on excessive punishment” inherent in German law. According to federal guidelines prosecution can be declined in cases of up to 30 grams in several regions.
Law Enforcement: In the State Hessen (which is a state in Germany) up to 30 grams are considered just to be for own consumption. If you have more than 30 grams on you, you will probably be considered a Dealer. Yet, you might get arrested for only having 1 gram or even just a joint, it really is up to the police officer’s mood. On the other hand it is commonly known, that even Cops in Germany smoke up themselves. Sometimes when they catch you, they’ll just take you weed, say that the weed will be destroyed (probably by smoking it..) and you’re free to go.

I've heard that it's very commonly smoked over there, as with here in Canada -where it's not legal, but not exactly that big a deal either...(you can be fined $25 for being caught smoking in a park, and have what you were smoking consfiscated without even being searched for more)
... You're right, marijuana is commomly smoked here but it's not legal. The punishment depends on the amount you have with you. Normally you are not being punished for owning up to 20 grams of it, but that depends on the state.
It's also easy to buy it, just ask anyone who is less than thirty years old, where you can get it.

Is there an area in Germany where it's legal to smoke Marijuana?
According to this survey, in Germany there is no difference between "hard drugs" (such as heroin) and "soft drugs" (such as cannabis). Since in Germany the actual use of drugs (as opposed to possesion of drugs and trafficking of drugs) is not considered an offense, you can smoke cannabis everywhere in Germany.
Now, in 1994 the German Constitutional Court ruled that possession of small amounts of cannabis, for irregular use and in circumstances in which there's no public interest in prosecuting will not be prosecuted in Germany.
The drug policy in Germany is decentralized between the different federal states, and different states regard different amounts of cannabis as "small amount" (the range is 6-30 grams).
... Roee is right we have there is no German "Freetown Christiania" (as in a legal smoking zone) it's not legal all over Germany, but marijuana is commonly smoked here and easily bought. N.J. Senate approves medical marijuana bill -

TRENTON BUREAU:
A Senate committee today cleared a measure that would allow medical use of marijuana in New Jersey.
The Senate Health, Human Services and Senior Citizens Committee voted to approve the long-stalled bill by a 6 to 1 margin; two senators abstained.
The bill calls for creating “alternative treatment centers” where people with chronic and terminal diseases would be allowed access to marijuana. Supporters say marijuana is a viable treatment option to alleviate pain in many cases.
“It is the definition of basic human decency that we do whatever we can to ease the pain and suffering of people living with severe chronic and terminal diseases,” said bill sponsor Sen. Nicholas Scutari, D-Union.
“When all other avenues of currently-approved pain relief have been exhausted, we need to give doctors the freedom to prescribe medical marijuana to give their patients a measure of comfort and dignity in the face of their debilitating diseases. This bill is about the most humane, compassionate option for those state residents who have nowhere else to turn in managing their illnesses.”
If ultimately approved by the full Legislature and signed by Governor Corzine, New Jersey would be the 14th state to allow medical use of marijuana.

A new study entitled Marijuana Effectiveness as an HIV Self-Care Strategy, which was released this past weekend in Clinical Nursing Research, indicates that persons living with HIV/AIDS rate cannabis as more effective in treating the symptoms of anxiety, depression, fatigue, diarrhea, and neuropathy than other prescription and over the counter medications.
The study, which was conducted over a two year period and included 775 patients from the USA, Africa, and Puerto Rico, assessed the use of cannabis as a symptom management approach for anxiety, depression, fatigue, diarrhea, nausea, and peripheral neuropathy. 27% of survey participants reported using cannabis for medicinal purposes.
Researchers wrote that cannabis use “was rated slightly more effective than antidepressants for anxiety and depression, Imodium for diarrhea, [over the counter] (OTC) medications for fatigue, and anti-epileptics and OTC medications for neuropathy” while cannabis was rated “slightly less effective for nausea than either prescribed or OTC medications.” Authors concluded that cannabis “is perceived by users as at least as effective as prescribed medications in symptom management.”

It is just a few hours now until the 15th Hanfparade ("hemp parade") will start in Berlin, Germany, to demand the legalisation of Cannabis as medicine, raw material and natural stimulant.
And you can join us! We will have a 9 hour live stream to cover the whole parade. Most of it will be in German though, but we will try to account for viewers from abroad.
We have been really busy during the last weeks and days, had lots of problems, for example that the authorities of the City of Berlin are still trying to cut off some parts of our final rally. We have to go to court!

German Court Approves Limited Medical Marijuana Growing

(2012) MUNSTER, GERMANY — A German court ruled earlier this month that seriously ill patients can grow their own medicine, but the ruling won’t apply to all medical marijuana patients. The Federal Administrative Court in Munster held that people for whom no other effective remedies are available or affordable can apply to the Federal Institute for Drugs and Medical Devices (BfArM) for a license to grow their medicine if done under a doctor’s supervision.
Previously, all requests for personal cultivation had been rejected by under a directive from the Federal Ministry of Health, but that is unlawful, the court held.
“If an affordable treatment option is missing, a license for personal cultivation of cannabis has to be taken into consideration — at the discretion of the BfArM,” the court ruled, according to an account in Deutsche Welt.
The decision was welcomed by medical marijuana advocates.

According to this article, US Attorney General Eric Holder has said that states will be allowed to make their own rules about medical marijuana, and that the US federal government will stop raiding medical marijuana dispensaries in California. In the 1990s, several US states passed referendums which allowed marijuana to be used legally for medical purposes. In a referendum, the registered voters vote directly on the proposed law, as opposed to the law being passed by the state legislature. Thus, when these states passed these referendums, it meant that the citizens of these states really wanted medical marijuana to be made legal.
However, in a blatant disregard for democracy and the people’s will, under the Bush administration, the national government refused to accept this law, and carried out raids of the medical marijuana dispensaries.

But medical marijuana has been effectively illegal in Germany, with only 40 patients in the entire country having obtained cannabis prescriptions.

Germany: First patients to receive cannabis from the pharmacy
On 7. February the first patient has received cannabis herb as a medicine from a pharmacy. The Head of the Federal Office for Opium Affairs at the Federal Institute for Pharmaceuticals and Medical Products of the the Federal Health Ministry in Bonn, Dr. Winfried Kleinert, stated that to date seven patients have received such a permission and are now receiving their first deliveries of cannabis from the Netherlands where it is available in pharmacies. Another 27 patients received an exemption for the use of cannabis extract that is produced from the Dutch cannabis.
The seven patients suffer from chronic pain, multiple sclerosis, Tourette’s syndrome and other severe illnesses. The cost of cannabis are approximately EUR 15 (about 19 US Dollars) per gram of cannabis with a dronabinol content of 18 per cent, approximately twice the cost charged by the Dutch pharmacies. Currently, the application for an exemption is rather extensive since the patient’s physician needs to produce an expertise justifying the need for a cannabis therapy. In a recent expert opinion by Dr. Lorenz Boellinger, a professor of law at the University of Bremen and Dr. Harald Hans Koerner, senior public prosecutor from Frankfurt and a well-known commentator on the German narcotics law, the authors recommend that the application process be made easier as to accommodate the patients’ need for an expeditious alleviation of their suffering.

| (SAN FRANCISCO) - Pressure from the Bush Administration to keep marijuana illegal in other nations is fading. Germany is about to become the fifth country to allow at least some patients to use natural marijuana as medicine. According to a report from the International Association for Cannabis as Medicine, the German government recently notified four patients that they would be allowed to receive medical marijuana produced under the Dutch government’s medical marijuana program. The German program remains limited to special cases.
Other German patients have been allowed to use a liquid extract made from Dutch cannabis, but for some patients the extract proved unsatisfactory. The patients are expected to receive their supply of whole marijuana around mid-January.

Europe: First German Patient Approved to Use Medical Marijuana -

| The German Federal Institute for Drugs and Medical Devices has for the first time approved the use of medical marijuana for a patient. The institute acted in the case of a 51-year-old woman who suffers from multiple sclerosis, who will be able to legally buy marijuana at a pharmacy to ease her symptoms.
Beginning next month, the woman will be allowed to buy a "standardized extract" of the marijuana plant from the pharmacy for a year. The woman's health will be monitored by a doctor. In addition, both the woman and the pharmacy must store the marijuana extract in a safe to prevent theft.
Marijuana is illegal in Germany, but a 2005 German Federal Administrative Court ruling has muddied the waters when it comes to medical marijuana. In that ruling, the court held that it was "in the public interest" to improve the health of patients, so now the federal institute must individually evaluate each case where a patient seeks access to medical marijuana.

A German woman with multiple sclerosis is the first person in her country to be allowed to legally buy pharmaceutical-grade cannabis to ease her symptoms.
Deutsche Welle said Tuesday the newspaper Suddeutsche Zeitung reported that the German Federal Institute for Drugs and Medical Devices' decision to permit the 51-year-old woman to legally buy cannabis from a pharmacy was unprecedented.
Doctors, so far, are only allowed to prescribe a synthetic form of cannabis called Dronabinol, which is not covered by health insurance. Patients who acquire it without a doctor's prescription risk prosecution.
Under the institute's ruling, the woman, identified as Claudia H., will be allowed to buy a "standardized extract" from the cannabis plant at a pharmacy for a one-year period. A doctor has to monitor the medicinal marijuana therapy and the drug must be kept in a safe to prevent theft.

A Dutch crackdown on cannabis growers is pushing the country's drug gangs into Germany.
The warehouse owner was becoming more suspicious by the day: The new tenants occupying his building in a small German town of Kempen on the Dutch border seemed to be using an enormous amount of electricity. It also seemed like they were monkeying around with the water main. It was high time, he thought, to have a word with them.
After his knocking and calls went unanswered, the owner broke open the door to the storage hall. And there he stood before a huge crop.
A heavy, sweet odor filled the air and sprayers covered the plants with a fine mist. A number of large grow lamps had been put in place to keep the 500-square-meter warehouse filled with warm light.
... As Holland cracks down on cannabis cultivation, it is pushing its drug gangs into Germany. Since 2004, 30 "cannabis plantations" have been shut down near the Dutch border. Meanwhile, Holland continues to tolerate pot-selling coffee shops that help fill The Hague's treasury.

The small German state of Schleswig-Holstein recently announced plans to sell marijuana over the counter in an attempt to separate cannabis from the "hard" drug market, according to Reuters News Service. &nbps;The state said it will soon apply to the federal drugs agency for a permit to sell marijuana.
The state Health Minister, Heide Moser, said authorities were losing credibility by treating marijuana as if it were as a dangerous as other "harder" drugs such as cocaine and heroin. "General warnings about the dangers of drugs are no longer being taken seriously," she said.
The idea drew criticism from the German federal government whose spokesman said that, "Schleswig-Holstein's stance has little to do with reality."
The state, which is governed by a coalition of Social Democrats and environmentalist Greens, said it had not yet decided precisely where and how much cannabis would be available if its project wins approval.

Hawaii's law was enacted by the legislature and signed by the governor in 2000, Vermont's was enacted by the legislature and passed into law without the governor's signature in May 2004, Rhode Island's was passed into law over the governor's veto in January 2006, and New Mexico's legislation was signed into law by Governor Bill Richardson on April 2, 2007.
