Ariz. ruling on return of seized marijuana stands

PHOENIX (AP) — The Arizona Supreme Court is letting stand a lower court's ruling that the Yuma County sheriff must return marijuana seized from a woman with a California medical marijuana authorization honored by Arizona. The justices without comment on Monday declined to review a January ruling by the Court of Appeals.

The January ruling said medical marijuana seized from Valerie Okun must be returned to her. It said that's because Arizona's medical marijuana law allows people with medical marijuana authorizations from other states to legally possess marijuana in Arizona.

The marijuana was found in Okun's vehicle at a Border Patrol checkpoint near Yuma. State drug charges against her were dismissed after she showed she had authorization under California's medical marijuana program. Prosecutors argued that federal drug law invalidates Arizona's medical marijuana law.   - Read more>> - on this Item.

Physician wants change in med pot law for research purposes

PHOENIX -- A University of Arizona physician has taken the first political steps in her bid to do medical marijuana research at state-run schools. Sue Sisley, a specialist in internal medicine and psychiatry, has formed Americans for Scientific Freedom, which she will chair. The filing with the Secretary of State's Office will allow her to collect donations for political purposes. But Sisley told Capitol Media Services the committee is not designed to elect legislators who support research or defeat those who oppose it. Instead, she wants to lobby lawmakers to change the law to let her do her work at the UA. Potentially more significant, she also is looking at changes to the law to let the state health department fund medical marijuana research. Legislation approved last year was designed to close what some lawmakers saw as a loophole in the state's 2010 medical marijuana law. That initiative allows those with a doctor's recommendation to possess and use up to 2 1/2 ounces of marijuana every two weeks. While the measure banned the drug on public school campuses, it was silent on the question of state-run universities and community colleges.  Visit - Read more>> - on this Item.

Status of Medical Marijuana (Cannabis) in Arizona.

Info on Arizona and Medical Cannabis

Arizona has a MEDICAL MARIJUANA (cannabis) LAW.

SUMMARY: Just over 50 percent of voters (50.13 percent) approved Proposition 203 on November 2, 2010. The law removes state-level criminal penalties on the use and possession of marijuana by patients who have "written cerification" from their physician that marijuana may alleviate his or her condition. Allows registered qualifying patients (who must have a physician's written certification that they have been diagnosed with a debilitating condition and that they would likely receive benefit from marijuana) to obtain marijuana from a registered nonprofit dispensary, and to possess and use medical marijuana to treat the condition.

Requires the Arizona Department of Health Services to establish a registration and renewal application system for patients and nonprofit dispensaries. Requires a web-based verification system for law enforcement and dispensaries to verify registry identification cards. Allows certification of a number of dispensaries not to exceed 10% of the number of pharmacies in the state (which would cap the number of dispensaries around 124). Specifies that a registered patient's use of medical marijuana is to be considered equivalent to the use of any other medication under the direction of a physician and does not disqualify a patient from medical care, including organ transplants.

Specifies that employers may not discriminate against registered patients unless that employer would lose money or licensing under federal law. Employers also may not penalize registered patients solely for testing positive for marijuana in drug tests, although the law does not authorize patients to use, possess, or be impaired by marijuana on the employment premises or during the hours of employment.

Approved Conditions: Patients diagnosed with the following illnesses are afforded legal protection under this act: Cancer, glaucoma, HIV/AIDS, Hepatitis C, ALS, Crohn's disease, Alzheimer's disease, cachexia or wasting syndrome, severe and chronic pain, severe nausea, seizures (including epilepsy), severe or persistent muscle spasms (including multiple sclerosis). Other conditions will be subject to approval by the Arizona Department of Health Services.

Possession/Cultivation: Qualified patients or their registered designated caregivers may obtain up to 2.5 ounces of marijuana in a 14-day period from a registered nonprofit medical marijuana dispensary. 2: If the patient lives more than 25 miles from the nearest dispensary, the patient or caregiver may cultivate up to 12 marijuana plants in an enclosed, locked facility.

Amendments: Amended: Senate Bill 1443 (20 KB) Effective: Signed by Governor Jan Brewer on May 7, 2013 "Specifies the prohibition to possess or use marijuana on a postsecondary educational institution campus does not apply to medical research projects involving marijuana that are conducted on the campus, as authorized by applicable federal approvals and on approval of the applicable university institutional review board." [Editor's Note: On Apr. 11, 2012, the Arizona Department of Health Services (ADHS) announced the revised rules (1.1 MB) for regulating medical marijuana and set the application dates for May 14 through May 25. On Nov. 15, 2012, the first dispensary was awarded "approval to operate." ADHS Director Will Humble stated on his blog that, "[W]e’ll be declining new 'requests to cultivate' among new cardholders in most of the metro area… because self-grow (12 plants) is only allowed when the patient lives more than 25 miles from the nearest dispensary. The vast majority of the Valley is within 25 miles of this new dispensary." On Dec. 6, 2012, the state's first dispensary, Arizona Organix, opened in Glendale.]

RESOURCEs: Information provided by the state on sources for medical marijuana: "Qualifying patients can obtain medical marijuana from a dispensary, the qualifying patient's designated caregiver, another qualifying patient, or, if authorized to cultivate, from home cultivation. When a qualifying patient obtains or renews a registry identification card, the Department will provide a list of all operating dispensaries to the qualifying patient." ADHS, "Qualifying Patients FAQs," (150 KB) Mar. 25, 2010 RECIPROCITY: Accepts other states' registry ID cards? Yes, but does not permit visiting patients to obtain marijuana from an Arizona dispensary. The act defines a 'visiting qualifying patient' as a person 'who has been diagnosed with a debilitating medical condition by a person who is licensed with authority to prescribe drugs to humans in the state of the person's residence.'

Places that have decriminalized non-medical cannabis in the United States Places that have decriminalized non-medical cannabis in the United States - From Wikipedia, the free encyclopedia | Multiple places have decriminalized non-medical cannabis in the United States; however, cannabis is illegal under federal law. Gonzales v. Raich (2005) held in a 6-3 decision that the Commerce Clause of the United States Constitution allowed the federal government to ban the use of cannabis, including medical use even if local laws allow it. Most places that have decriminalized cannabis have civil fines, drug education, or drug treatment in place of incarceration and/or criminal charges for possession of small amounts of cannabis, or have made various cannabis offenses the lowest priority for law enforcement. Arizona, News - Arizona Legislature missed opportunities in 2014 Arizona Legislature missed opportunities in 2014 - Last Update: April 17, 2014 | Arizona’s legislature missed several important opportunities to greatly improve state marijuana laws and contribute to scientific research that could have helped veterans and others suffering from post traumatic stress disorder (“PTSD”). Two bills, one of which would have established a system to tax and regulate marijuana for adults 21 and over, and another, which would have removed criminal penalties for the possession of a small amount of marijuana, did not advance this year. HB 2558, sponsored by Rep. Ruben Gallego, would have legalized marijuana by establishing a tax and regulate approach for adults 21 and over. Please take a moment to reach out to your legislators and ask for their support to establish a system that would regulate marijuana similar to alcohol. Another positive bill, HB 2474, sponsored by Rep. Mark Cardenas, would have decriminalized possession of small amounts of marijuana and imposed a non-criminal fine of up to $100 and made other changes to lower penalties for larger amounts.   >> Visit - http://www.mpp.org/states/arizona/

HB 2333, sponsored by Rep. Ethan Orr, would have used medical marijuana patient registration fees to fund important research on marijuana’s positive effect on those suffering from PTSD – the first such study of its kind in the U.S. Unfortunately, the bill could also have authorized using those same funds to pay for potentially harmful anti-marijuana educational programs. While the bill received a great deal of support in the House of Representatives, it was blocked and ultimately killed by Sen. Kimberly Yee, chairperson for the Senate Education Committee, who refused to advance the bill. Learn about Arizona's marijuana laws | Arizona has some of the harshest marijuana laws in the country. Unlike most states in the U.S., the criminal penalty for possession of just one ounce of marijuana can be a felony that carries a potential penalty of 18 months in jail and a $150,000 fine. A 2013 report by the American Civil Liberties Union found that over 55% of drug arrests in Arizona are for marijuana possession, and that blacks are 2.4 times more likely to be arrested for marijuana possession than whites. Please ask your legislators to support imposing a civil fine, not criminal penalties and possible imprisonment, for possession of marijuana.   >> Visit - http://www.mpp.org/states/arizona/

Polls gauging support for replacing marijuana prohibition with regulations in Arizona tend to show majority support. In a May 2013 poll, 56% of Arizonans supported legalization. A January poll showed 51% opposed, while a poll in February showed the reverse, with 51% in favor of legalization. Medical marijuana in Arizona | In 2010, Arizona voters approved Prop. 203, an MPP-drafted and funded initiative to allow the medical use of marijuana. To learn about the program, visit the Department of Health Services’ medical marijuana web page. The Arizona Department of Health Services is considering changes to agency rules which for the most part represent improvements to the program, including by allowing more patients to qualify for a reduced fee. Those changes, once complete, will go into effect in late 2014.

The department is expected to accept additional applications which could allow up to 126 dispensaries, beginning on May 18, 2015 and ending on June 1, 2015.   some HISTORY

Arizona - Action, Change 65% of Arizona voters support removing criminal penalties for the medical use of marijuana, according to a February 2009 poll. And voters have already passed medical marijuana initiatives twice in the state, in 1996 and 1998. Unfortunately, due to a technical error in the wording of these laws, they have failed to effectively protect medical marijuana patients from arrest. The initiative that will go before voters in 2010 will close this loophole and give patients the protection and peace of mind that Arizonans agree they deserve.

The Arizona Medical Marijuana Policy Project (AMMPP) is a grassroots organization devoted to passing a medical marijuana initiative in Arizona in November 2010. Currently, seriously ill people who use marijuana on the advice of their doctor to treat illnesses such as cancer, AIDS, and multiple sclerosis are subject to arrest and imprisonment, simply for trying to stimulate their appetite or alleviate their pain. We can change this. On November 2, 2010, Arizona voters could have a chance to vote to protect Arizona’s medical marijuana patients from arrest and jail. But voters will not have that chance unless we collect more than 150,000 valid signatures to get the initiative on the ballot. Our signature drive is now underway! Please volunteer, sign up to collect signatures, or donate today. Visit - http://stoparrestingpatients.org/

Arizona - Status, summary SUMMARY: Sixty-five percent of voters approved Proposition 200 on November 5, 1996, which included several provisions regarding prison reform and one specific to the use of medical marijuana.   The law took effect on December 6, 1996. It mandates alternative sentencing for non-violent drug offenders, and seeks to establish legal protections for seriously ill patients by allowing doctors to "prescribe" schedule I controlled substances such as marijuana. However, because federal law ultimately forbids physicians from prescribing such drugs, this statute does not adequately protect patients from state-level criminal penalties, as do similar state laws that only require patients to possess a physician’s "recommendation" that medical marijuana therapy may be beneficial. Not surprisingly, the attorney general’s office reports that state physicians are not advocating medical marijuana therapy to their patients under the law. Click here > AZ NORML Legal < for more.

Arizona - Law So, while a majority of Arizona voters have passed ballot measures enacting legislation to allow the use of medica marijuana, the laws do not adequately protect patients nor Doctors who would prescribe it.  The legislation as it is currently enacted requires Doctors to write a prescription for medical marijuana to their patients. Since marijuana is still classified as a Schedule 1 drug, the FDA effectively forbids Doctors from doing so. Subsequent ballot initiatives to correct the legislation have thus far failed. Medical Cannabis, History - Letter: Medical Marijuana Informational Guide on Medical Cannabis | If you have ever heard of the song, “Lets Go Get Stoned,” as sung by Ray Charles or Joe Cocker, you know the lyrics were referring to getting high or using cannabis aka marijuana. This mind altering drug goes by other names as well; names such as weed, pot, joint, blunt, hash and mary jane are quite common among users. Cannabis is a plant that contains a chemical called cannabinoids or cannabinolidic acids. Another substance that is found in cannabis is THC, or Tetrahydrocannabinol, which gives the users that “high” sensation. When speaking of marijuana, the actual substance used in creating the high feeling comes from the leaves and flowering tops of the cannabis plant. Marijuana is considered to be a schedule 1 controlled substance today, because of the THC, which can be highly potent, depending upon the concentration factor of the THC. Medical Cannabis - Proven : Cannabis is Safe Medicine Proven : Cannabis is Safe Medicine by Ian Williams Goddard | In reaction to medical cannabis access referendums on the ballots in Arizona and California, former presidents Gerald Ford, Jimmy Carter, and George Bush signed a letter stating that they "categorically oppose'' access to cannabis for its many proven therapeutic uses such as the prevention of blindness and epileptic seizures. Their chief concern was that legal medical access would send the message that cannabis is safe. The presidents can, however, lay their safety concerns to rest because the scientific literature overwhelmingly confirms that cannabis is both an effective and safe medicine. The Cannabis Safety Profile. The journal PHARMACOLOGICAL REVIEWS reports that decades of research prove that, "Compared with legal drugs...marijuana does not pose greater risks." Yet based upon mortality statistics, we can safely conclude that cannabis is one of the safest medical drugs known, for, while prescription drugs, defined as safe by the FDA, kill up to 27,000 and aspirin up to 1,000 Americans per year, cannabis kills 0 per year. Arizona - Medical Dictionary on Cannabis Medical Dictionary on Cannabis $48.95 - CANNABIS A Bibliography, Medical Dictionary, and Annotated Research Guide to Internet References   (marijuana)   A Bibliography, Medical Dictionary, and Annotated Research Guide to Internet References on Cannabis. Pages : 268, Price : $48.95(USD) ISBN : 0597835675 Published : 2003

Synopsis: In March 2001, the National Institutes of Health issued the following warning: "The number of Web sites offering health-related resources grows every day. Many sites provide valuable information, while others may have information that is unreliable or misleading."  Furthermore, because of the rapid increase in Internet-based information, many hours can be wasted searching, selecting, and printing. Since only the smallest fraction of information dealing with cannabis is indexed in search engines, such as www.google.com or others, a non-systematic approach to Internet research can be not only time consuming, but also incomplete. This book was created for medical professionals, students, and members of the general public who want to conduct medical research using the most advanced tools available and spending the least amount of time doing so.

Description: This is a 3-in-1 reference book. It gives a complete medical dictionary covering hundreds of terms and expressions relating to cannabis. It also gives extensive lists of bibliographic citations.  Finally, it provides information to users on how to update their knowledge using various Internet resources. The book is designed for physicians, medical students preparing for Board examinations, medical researchers, and patients who want to become familiar with research dedicated to cannabis. If your time is valuable, this book is for you. First, you will not waste time searching the Internet while missing a lot of relevant information. Second, the book also saves you time indexing and defining entries. Finally, you will not waste time and money printing hundreds of web pages.

Excerpt (Introduction). In addition to offering a structured and comprehensive bibliography, this medical reference on cannabis will quickly direct you to resources and reliable information on the Internet, from the essentials to the most advanced areas of research.  Public, academic, government, and peer-reviewed research studies are emphasized. Various abstracts are reproduced to give you some of the latest official information available to date. Abundant guidance is given on how to obtain free-of-charge primary research results via the Internet. E-book and electronic versions of this book are fully interactive with the Internet. For readers unfamiliar with the Internet, detailed instructions are offered on how to access electronic resources. For readers unfamiliar with medical terminology, a comprehensive glossary is provided. For readers without access to Internet resources, a directory of medical libraries, that have or can locate references cited here, is given. We hope these resources will prove useful to the widest possible audience seeking information on cannabis. visit: http://www.icongrouponline.com/health/Cannabis_ph.html

"There is new contact information for Phoenix NORML:

Arizona deserves the rights that 4 out of 5 surrounding states have: access to medical cannabis. With all the prescription pills, which contain many toxic chemicals and that produce many undesirable side effects, being given out like candy by American doctors, cannabis should certainly be a legal, natural alternative for Americans to choose. Currently, Arizona has some of the country's harshest marijuana laws. We invite everyone to work with us to reform unjust laws. We hold free, public meetings once a month. Everyone is encouraged to join!

We seek to educate our community about the misrepresentation of cannabis in today's society by way of fundraising, festivals, encouraging Voter Registration, holding monthly meetings to inform, motivate & prepare volunteers to defend their rights, donating to National NORML, breaking the stereotype of cannabis consumers by contributing to local charities.
