Places that have decriminalized non-medical cannabis in the United States -

Multiple places have decriminalized non-medical cannabis in the United States; however, cannabis is illegal under federal law. Gonzales v. Raich (2005) held in a 6-3 decision that the Commerce Clause of the United States Constitution allowed the federal government to ban the use of cannabis, including medical use even if local laws allow it.
Most places that have decriminalized cannabis have civil fines, drug education, or drug treatment in place of incarceration and/or criminal charges for possession of small amounts of cannabis, or have made various cannabis offenses the lowest priority for law enforcement.

| At the Biological Psychiatry Institute, Dr. Williams offers the medical model of psychiatry, which is a scientific and rational approach to diagnosing and treating brain disorders.

In addition, Dr. Williams attempts to bridge the gap between current research knowledge and applications to patient care. Dr. Williams continuously reviews the literature and attends conferences to maintain an up-to-date approach to psychiatric problems.
We recognize that the brain is a physical organ system, and realize that it can fail. Our purpose is to diagnose physical problems pertaining to brain failure and prescribe appropriate treatment.
When appropriate, we refer out-patient psychotherapy to local resources. Our major focus is on DSM-IV-TR (Diagnostic Statistical Manual-IV-Text Revision) diagnoses and treatments.
Dr. Williams wants to foster independence, so that patients understand their illness, and can feel as though they are under control to seek help at the appropriate times. The patient is taught by the use of brain models to self-monitor for symptoms of illness.

The Yes on 205 Campaign has begun! Supporters of the Campaign to Regulate Marijuana Like Alcohol in Arizona, sponsored by the Marijuana Policy Project, have collected enough signatures to put the initiative on the ballot. Opponents are challenging the initiative in court, but this appears to be a final, desperate attempt to stop voters from ending prohibition in Arizona, and the campaign expects to win.
The initiative would establish a sensible tax-and-regulate system for retail sales of marijuana to adults in Arizona. Visit the campaign website for a summary of the initiative, or read the full version here.

Replacing marijuana prohibition with regulation is especially important in Arizona, because it has some of the harshest marijuana laws in the country. Unlike most states, the criminal penalty for possession of just one ounce of marijuana can be a felony that carries a potential penalty of 18 months in jail and a $150,000 fine. And this in a state where, in 2012, 92% of all reported burglaries, 74% of all reported rapes, and over 90% of all motor vehicle thefts went unsolved.

Arizona Legislature’s attempts to try to interfere with the will of the voters defeated

In 2010, Arizona voters approved Prop. 203, an MPP-drafted and funded initiative to allow the medical use of marijuana. Almost 90,000 patients are currently registered and are able to obtain their medicine from more than 90 dispensaries. (Click here to learn more.) In addition, the Department of Health Services accepted applications for up to 31 new dispensary licenses in July.
Unfortunately, some members of the Arizona Legislature oppose this progress and continue trying to attack Prop. 203. Thankfully, these efforts were defeated and the legislative session has ended for 2016. Bills were introduced that would have: limited access to medical marijuana by restricting the types of medical professionals who could recommend it (HB 2019); banned the use of medical marijuana by pregnant women (HB 206); and added other unnecessary restrictions (HB 2404 and HB 2405). Thankfully, several of these bills were withdrawn or defeated, and HB 206 was amended so that it simply requires dispensaries to post a sign with a specified warning to pregnant women.
Some of these bills were defeated thanks to the Voter Protection Act (VPA), which states that changes to voter initiatives must “further the purpose” of the original law and must be passed by a super-majority vote of three-quarters of the legislature. Several attempts were made to gut the VPA, two of which, HCR 2023 and HCR 2043, passed the House. Thankfully, both were defeated in the Senate.

65% of Arizona voters support removing criminal penalties for the medical use of marijuana, according to a February 2009 poll. And voters have already passed medical marijuana initiatives twice in the state, in 1996 and 1998. Unfortunately, due to a technical error in the wording of these laws, they have failed to effectively protect medical marijuana patients from arrest. The initiative that will go before voters in 2010 will close this loophole and give patients the protection and peace of mind that Arizonans agree they deserve.
The Arizona Medical Marijuana Policy Project (AMMPP) is a grassroots organization devoted to passing a medical marijuana initiative in Arizona in November 2010. Currently, seriously ill people who use marijuana on the advice of their doctor to treat illnesses such as cancer, AIDS, and multiple sclerosis are subject to arrest and imprisonment, simply for trying to stimulate their appetite or alleviate their pain.
We can change this. On November 2, 2010, Arizona voters could have a chance to vote to protect Arizona’s medical marijuana patients from arrest and jail. But voters will not have that chance unless we collect more than 150,000 valid signatures to get the initiative on the ballot.

SUMMARY: Sixty-five percent of voters approved Proposition 200 on November 5, 1996, which included several provisions regarding prison reform and one specific to the use of medical marijuana. The law took effect on December 6, 1996. It mandates alternative sentencing for non-violent drug offenders, and seeks to establish legal protections for seriously ill patients by allowing doctors to "prescribe" schedule I controlled substances such as marijuana. However, because federal law ultimately forbids physicians from prescribing such drugs, this statute does not adequately protect patients from state-level criminal penalties, as do similar state laws that only require patients to possess a physician’s "recommendation" that medical marijuana therapy may be beneficial. Not surprisingly, the attorney general’s office reports that state physicians are not advocating medical marijuana therapy to their patients under the law.

So, while a majority of Arizona voters have passed ballot measures enacting legislation to allow the use of medica marijuana, the laws do not adequately protect patients nor Doctors who would prescribe it. The legislation as it is currently enacted requires Doctors to write a prescription for medical marijuana to their patients. Since marijuana is still classified as a Schedule 1 drug, the FDA effectively forbids Doctors from doing so. Subsequent ballot initiatives to correct the legislation have thus far failed. JUNEAU, AK - The American Civil Liberties Union of Arizona announced today that it has submitted a letter to the state attorney general's office requesting public acknowledgment of the continued validity of the state's medical marijuana law. The letter comes after newly appointed Arizona Attorney General David W. Márquez last week announced that the state's medical marijuana law was under review and could be declared inoperative following the U.S. Supreme Court decision in Gonzales v. Raich.

If you have ever heard of the song, “Lets Go Get Stoned,” as sung by Ray Charles or Joe Cocker, you know the lyrics were referring to getting high or using cannabis aka marijuana. This mind altering drug goes by other names as well; names such as weed, pot, joint, blunt, hash and mary jane are quite common among users. Cannabis is a plant that contains a chemical called cannabinoids or cannabinolidic acids.
Another substance that is found in cannabis is THC, or Tetrahydrocannabinol, which gives the users that “high” sensation. When speaking of marijuana, the actual substance used in creating the high feeling comes from the leaves and flowering tops of the cannabis plant. 1. Since 1996, twelve states have legalized medical marijuana use: AK, CA, CO, HI, ME, MT, NV, NM, OR, RI, VT, and WA. Eight of the twelve did so through the initiative process. Hawaii's law was enacted by the legislature and signed by the governor in 2000, Vermont's was enacted by the legislature and passed into law without the governor's signature in May 2004, Rhode Island's was passed into law over the governor's veto in January 2006, and New Mexico's legislation was signed into law by Governor Bill Richardson on April 2, 2007.

Their chief concern was that legal medical access would send the message that cannabis is safe. The presidents can, however, lay their safety concerns to rest because the scientific literature overwhelmingly confirms that cannabis is both an effective and safe medicine.
