Places that have decriminalized non-medical cannabis in the United States -

Multiple places have decriminalized non-medical cannabis in the United States; however, cannabis is illegal under federal law. Gonzales v. Raich (2005) held in a 6-3 decision that the Commerce Clause of the United States Constitution allowed the federal government to ban the use of cannabis, including medical use even if local laws allow it.
Most places that have decriminalized cannabis have civil fines, drug education, or drug treatment in place of incarceration and/or criminal charges for possession of small amounts of cannabis, or have made various cannabis offenses the lowest priority for law enforcement.

New Mexico Legislature adjourns, prevents vote on legalization

Tax and regulate:
The New Mexico Legislature’s 2016 session adjourned on February 18 without enacting new marijuana legislation. Three bills were introduced — HB 75, SJR 5, and SJR 6 — that would have legalized adult use of marijuana through a taxed and regulated system.
SJR 5, which would have allowed the voters to decide whether to legalize marijuana, was passed by the Senate Rules Committee, but failed on the Senate floor by a vote of 17-24, meaning voters will not be able to decide the issue for themselves in November.

Recent polls have found that two-thirds of New Mexicans support taxing and regulating marijuana like alcohol. Marijuana prohibition is a failed policy that costs a tremendous amount in law enforcement resources, all while depriving New Mexico of tens of millions of annual tax revenue. Taxing and regulating marijuana would allow for increased funding for New Mexico’s schools, Medicaid program, and drug and alcohol counseling, just as it has in Colorado.
Let your elected officials know you care about ending marijuana prohibition and that you want New Mexico to be one of the first states in the nation to end cannabis prohibition through legislative reform.

New Mexico is one of 25 states (plus D.C.) that have removed criminal penalties for the medical use of marijuana. As of June 2016, there were over 26,568 registered patients served by 35 licensed non-profit producers. There are also 5,865 active personal production licenses.

Decriminalization

While New Mexico’s marijuana laws are less draconian than those of most states, the state still criminalizes its residents for using a substance that is safer than alcohol. Possession of one ounce or less of marijuana for non-medical purposes is punishable by a $50-100 fine and up to 15 days in jail. A second offense, or a conviction for possession of more than an ounce, can lead to a fine of up to $1,000 and a prison term of up to one year.
In 2015, the Senate approved a bill to replace criminal penalties for possessing up to an ounce of marijuana with a $50 civil fine, but the House failed to take a vote on the measure. Some localities are taking action on their own: In November 2014, voters in Santa Fe and Bernalillo Counties — representing 40% of the state’s population — approved advisory questions asking their elected officials to support decriminalization. The questions won with 73% support in Santa Fe County and 59% in Bernalillo County.

Legislator Wants NM To Legalize Marijuana
New Mexico -- A day after Colorado opened its doors to the legalized sale of recreational marijuana, a state senator said New Mexico should consider following suit.
Sen. Gerald Ortiz y Pino, an Albuquerque Democrat, said he will introduce a constitutional amendment proposal to legalize recreational marijuana when the Legislature convenes this month.
The constitutional amendment would go on the general election ballot this November if approved by both the House and Senate. Constitutional amendment proposals go straight from the Legislature to voters, and Gov. Susana Martinez would not be able to act on the measure if it were approved by lawmakers.
Martinez, a Republican and a former district attorney, opposes drug legalization.
There also were indications Thursday that Ortiz y Pino’s proposals could get cold shoulders from Republicans in the Legislature.
Ortiz y Pino said his proposal will be modeled after the Colorado voter referendum that in 2012 legalized recreational marijuana use in that state. Colorado on Wednesday allowed marijuana dispensaries to begin selling the drug to the public, with a 25 percent tax earmarked to help fund education programs.

Doctor: Medical Board's charges part of 'witch hunt' to shutter marijuana program
A Santa Fe judge has denied a request to stop the New Mexico Medical Board from sanctioning an Albuquerque physician accused of “injudiciously prescribing” marijuana — a charge the physician says is a politically motivated effort to stymie the state’s medical marijuana program.
Dr. Nicholas Nardacci had sought a temporary restraining order and preliminary injunction from the First Judicial District Court in a case filed Dec. 28 under the pseudonym “John Doe M.D.” But on Thursday, state District Judge Sarah Singleton denied the request. This means the board will hear Nardacci’s case Feb. 5, which could lead to revocation or suspension of his medical license, or other sanctions.
“The board’s on a little bit of witch hunt,” Nardacci said Friday. “The Governor’s Office has fired two or three major people at the Department of Health who run the Medical Cannabis Program. They’re trying to discourage people like myself from doing what I do. …
“They’re cracking down now on doctors. The whole thing is a political thing because the Governor’s Office is Republican. They don’t agree with this. … They’re taking a guy who has a high volume of people [whom he recommends to the medical marijuana program], and they’re trying to shut me down.”

Health Secretary Adds Severe Chronic Pain with Specific Criteria to Medical Cannabis Program - May 6, 2009 |
(Santa Fe) – Health Secretary Alfredo Vigil, MD, announced today that the New Mexico Department of Health is adding severe chronic pain to the Department’s Medical Cannabis Program. To qualify, patients must have objective proof of severe chronic pain (X-rays, CT scans, MRIs) and receive two recommendations, one from their primary care physician and one from a specialist consulting on their case. Medical cannabis must be patients’ treatment of last resort because no other medication has provided relief.
“There is substantial support in medical literature that medical cannabis can relieve chronic unremitting pain, but we do not want an overly broad definition of chronic pain that might result in abuse of medical marijuana. We are trying to target a narrow group of people who have severe chronic pain and can’t get relief from any other treatment,” Dr. Vigil said. “We will not approve diagnoses to make medical cannabis a routine treatment. It must be the last resort.”

Paralyzed New Mexico woman faces eviction over medical marijuana - Silver City Sun-News | SILVER CITY — A handicapped Silver City woman says she is being discriminated against because she has medical marijuana in her home and was told to move out of her apartment as a result.
Bobbie Wooten, who lives in the Silver Cliffs apartments in Silver City (NM), said an apartment management representative performed a surprise inspection on Tuesday and discovered two marijuana plants. According to Wooten, the representative left and came back a short while later and gave her a notice telling her she had three days to move out.

As the New Mexico Department of Health struggles to create a medical-marijuana distribution system mandated by state lawmakers, some advocates say that interim rules are not adequate for the needs of patients, the Santa Fe New Mexican reported Sept. 8.
"It's a very complicated program," said health department spokesperson Deborah Busemeyer. "We consider this a medicine that will provide relief to people. But it comes down to balancing access for patient needs with public safety."
Currently, interim rules under the state's medical-marijuana law allow patients to grow up to four mature plans and possess up to six ounces of marijuana. "This definition of adequate supply will not be enough for many patients," said Reena Szczepanski, director of Drug Policy Alliance New Mexico, who said that some patients use a quarter-ounce of marijuana a day.

Bill Richardson (D) Monday signed into law a bill making the state the 12th to approve the medicinal use of marijuana. Richardson is a candidate for the Democratic Party 2008 presidential nomination. Leonard French received a license to cultivate and use small quantities of marijuana for medicinal purposes from the State of New Mexico under the Lynn and Erin Compassionate Use Act. The American Civil Liberties Union (ACLU) of New Mexico, which represents French, says the deputies' actions violated not only that law, but also state forfeiture laws and a constitutional prohibition on unreasonable searches and seizures. "The New Mexico state legislature, in its wisdom, passed the Compassionate Use Act after carefully considering the benefits the drug provides for people who suffer from uncontrollable pain, and weighing those benefits against the way federal law considers cannabis,"¯ said Peter Simonson, ACLU Executive Director. "With their actions against Mr. French, Eddy County officials thwarted that humane, sensible law, probably for no other reason than that they believed federal law empowered them to do so."

New Mexico Becomes Twelfth State To Authorize Medical Cannabis Use
April 5, 2007 - Santa Fe, NM, USA: New Mexico Gov. Bill Richardson (D) signed legislation into law this week ordering the establishment of a statewide medicinal cannabis distribution program.
Senate Bill 523, the "Lynn and Erin Compassionate Use Act," mandates the state Department of Health to promulgate rules governing the use and distribution of medical cannabis to state-authorized patients. These rules shall address the creation of state-licensed "cannabis production facilities" and "define the amount of cannabis that is necessary to constitute an adequate supply" for qualified patients.

New Mexico Medical Marijuana Bill Approved
March 14, 2007 | A bill calling for legalization of medical use of marijuana in New Mexico was approved in the state legislature after winning the support of Gov. Bill Richardson, the Santa Fe New Mexican reported March 13.
The legislation was approved in the state Senate last week, but went down to defeat in the House on a 33-36 vote. However, a slightly amended version was reintroduced this week and, after two hours of debate, passed by a 36-31 margin.
The measure allows New Mexicans to use marijuana to treat pain and other symptoms of diseases like cancer, epilepsy, multiple sclerosis, HIV/AIDS, and spinal-cord injuries. The state Health Department will be charged with developing a system for patients to obtain the drug.

This mind altering drug goes by other names as well; names such as weed, pot, joint, blunt, hash and mary jane are quite common among users. Cannabis is a plant that contains a chemical called cannabinoids or cannabinolidic acids.
Another substance that is found in cannabis is THC, or Tetrahydrocannabinol, which gives the users that “high” sensation. When speaking of marijuana, the actual substance used in creating the high feeling comes from the leaves and flowering tops of the cannabis plant. Marijuana is considered to be a schedule 1 controlled substance today, because of the THC, which can be highly potent, depending upon the concentration factor of the THC.

1. Since 1996, twelve states have legalized medical marijuana use: AK, CA, CO, HI, ME, MT, NV, NM, OR, RI, VT, and WA. Eight of the twelve did so through the initiative process. Hawaii's law was enacted by the legislature and signed by the governor in 2000, Vermont's was enacted by the legislature and passed into law without the governor's signature in May 2004, Rhode Island's was passed into law over the governor's veto in January 2006, and New Mexico's legislation was signed into law by Governor Bill Richardson on April 2, 2007.
