What is medical marijuana, and is it legal? >
Marijuana is a drug that is made up of the leaves, flowers, and buds of the hemp plant Cannabis sativa. Medical marijuana is the use of this drug to help treat symptoms like pain, muscle stiffness (spasticity), nausea, and lack of appetite. It may be used by people who have conditions like cancer, AIDS, or multiple sclerosis.
In the United States, it is against federal law to possess, sell, give away, or grow marijuana for any purpose. It's also against federal law for doctors to prescribe this drug. But more than a dozen states have passed laws that allow people with certain health problems to buy or grow marijuana for their own use. Some states also allow or license people to provide medical marijuana to those who need it.
If you use medical marijuana to treat an approved medical condition, the federal government might not prosecute you. But there's no guarantee.
What do the experts say? >
The medical use of marijuana has been studied for decades. But experts still don't agree on how safe it is or how well it works.
Some medical experts don't recommend marijuana because:
It hasn't been approved by the Food and Drug Administration.
Marijuana may impair your memory, judgment, and coordination. It can increase your risk of being in a car crash.
Marijuana smoke may harm your lungs.
There are legal drugs that may work just as well, such as new kinds of pain and nausea medicines.
Other medical experts do recommend marijuana because:
It can provide pain relief when normal pain medicines don't work or have unwanted side effects.
It can improve appetite and relieve nausea in people who have cancer or AIDS.
It may help relieve symptoms such as pain and muscle stiffness (spasticity) in people who have multiple sclerosis.
Be sure to let your doctor know if you are using medical marijuana. If you're pregnant, it is not safe to use alcohol or drugs, including marijuana.

There are a number of medical cannabis (marijuana) bills in play in states across the US. Here we network on Ways and Means anyone can help with the effort to make each a medical marijuana state.
We need to get the word out and people contacting reps and officials and get this legislation into law. Also, lets not forget efforts at the Federal level.
NETWORK and Spread The Word, both On-Line and Off (!) ON-LINE, You can tell everybody in cyber-space by e-mailing a link to this website to them and/or (OFF-LINE> printing off the info and handing out where possible / necessary. Also phone call and read off and/or visit and hand deliver the info. You can take literature with you and approach businesses, organizations and even people on the street while you're out and about. Wear your pot-leaf shirt and register voters, as feasible. Gather signatures for any related petitions that are happening at the time as well.
This is a chain e-mail you can't refuse. Unlike most, this will actually help you - and a whole buncha others - just by passing it on.
Cannabis consumer or not - from the folks just trying to take care of themselves or a loved one to those who simply see the expensive, immoral waste of making war on the sick and dying - everyone is affected by this issue.
To accomplish this you need to first click on the following links and send a message to all the reps and media you can on the issue.
Then get everybody else to do the same. And follow up.
To do this you need to tell everybody you know.
And can confide in.
Then/or anonymously tell everybody you don't know
- or can't confide in. Yet.
Tell everybody else by Letters-to-the-Editor, displaying signage at street corners and over-passes (wear trenchcoat, fedora and sunglasses if afraid of exposure), and/or anonymously leaving literature and posting on-line at places where people are likely to find it.

Inform, Educate, Activate
INFORM and EDUCATE. Distribute medical marijuana brochures and other literature to your friends, family, local leaders and elected officials in an effort to educate the public and garner support. Educate your community by Printing, posting and handing out Flyers and other Printables in a mall, coffee shop, laundromat, college campus, lamp post, telephone poll, business window (ask first), hospital, or anywhere people will see them. Contact these groups for some.

Legislation: Conditional release is valid in Wisconsin, meaning The state allows conditional release or alternative or diversion sentencing for people facing their first prosecutions. Usually, conditional release lets a person opt for probation rather than trial. After successfully completing probation, the individual’s criminal record does not reflect the charge.
Possession of marijuana is punishable by up to 6 months of jail, plus a fine of up to $1,000 for the first offense, and for subsequent offenses, the possible penalties double.
Possession within 1,000 feet of a school, school bus, public park, public pool, youth center or community center adds an additional 100 hours of community service to the sentence for possession.

Law enforcement: Local cops in the city of GB are dealing with local happenings in town to really notice the car driving smoker. Parks you’ll be alright with a joint, however watch for family activities which need a wide berth. disc golfing courses are pretty low key and a place among friends. Freeway Cops on Interstate 43 are looking for mysterious vehicles, and are quick to pull over speeders. Drunk Driving is a more important problem for police in the northeast WI Area, as it should be, so don’t drink & drive stupid and save that after bar bowl for home.

Law Enforcement: Wisconsin is not a stoner friendly state watch out for cops there is no shortage on cops patroling the streets.
If arrested, please bare in mind that conditional discharge is available for first time offenders.
Cops in Milwaukee look for things out of the ordinary. Cops in Milwaukee are very racist and look for minorities and beat up cars. If you look like a thug chances are you will be stopped w/o doing any thing wrong. If you look like you do not belong or live in the area chances are you will be questioned. Milwaukee is a very segregated city and people can become out of place fast. Suburbs in Milwaukee County are cop hot spots (they are everywhere) and the cops have nothing better to do than bust people.
Occasionally you might get a break for a small amount or a pipe but that is only if you aren’t an asshole with the cop. City cops are more focused on murder, armed robbery and DUIs they could care less about personal amounts. They just take it away and don’t issue a ticket. Just be respectful to cops don’t cause problems and be discreet. In the city if you don’t cause problems you will be fine even if you look like a rasta or huge stoner.
Where to buy Marijuana in Milwaukee: Milwaukee is a big city and it has its share of pot and it is so so easy to find it. The best place to buy pot at is to ask around and just chill out on the north side just ask around you will most likely get a score very soon doing this half of the people in the area of north ave. and holten st. Smoke weed and nearly the rest are cool with it.
a recent report we received is: “The best place to go is the East side. It has a traditional hippie upbringing eversince the 60s & 70s. Right by the lake front or off of Oakland or Brady St. The area is flocked w/ college students. People need 2 know if u are chill or not, start small talk w/ people and then see what they can get. No one cares if you smoke, everyone does or knows some1 but people only sell if you aren’t sketch. Bars are also a good place- any college bar on Brady or North Avenue has many stoners at night. All you will find on the East side is nugs though. This is the safest area in Milwaukee, people are very friendly. Usually the lowest they sell is 1/8ths, ocassionally you can find a 1/16th. Bulk weed is hard to find unless you know people. The Rave (concert hall) has many potheads on concert nights and during summerfest there is also an abundance of weed on the grounds.
Anywhere else in the Milwaukee area is a Schwag hub. All that is around is Mexican commercial g rade. Occassionally there are middies. The Northside and Southside are flooded w/ nicks,dimes & quarters(schwag only). Be careful though there are a lot of shady characters and do not buy alone. A lot of people in Milwaukee will rob you or rip you off. Avoid going alone & be a very strict judge of character- weed is all around & so are the con artists in Beertown. ”

and our most recent report is: “The current report reccomends the North Side, which should be distinguished from the neighboring Riverwest neighborhood, which starts east of Holton Avenue between about Capitol and North Ave. Riverwest is a much better prospect for weed seekers than the North Side, where you are likely to get ripped off or worse. It might be easier to find crack than weed on the North Side.
The current report fails to mention the UWM campus itself on the East Side. There are many, undercover cops at UWM, so be very careful. The Coffehouse on campus might be a good place to find kind pot-heads, but there are stoners hanging out all over campus, too.
The current report fails to mention the Bay View neighborhood, which is considered the “other East Side,” and also has a reputation for hippie/alternative/progressive types. Most of the patrons of Cactus Club and Club Garibaldi at Superior and Russell probably have weed on them and know where to get more. Same with the folks you’d meet at the coffeehouses and bars that align Kinnickinnic Ave (commonly called KK).
The current report is spot-on about Thurman’s on Arlington just off Brady on the lower East Side. Yup, that’s the place I’d go if I were totally dry and didn’t know anyone.
Bottom line about scoring weed in M’waukee: It’s not that easy to get a total stranger to go out of his way to find you weed. People are paranoid about cops and it’s just not usually done that way. However, if you have any “stonar” (stoner radar) whatsoever, you can easily find people who smoke pot who will be willing to help you out once they get to know you. It’s hard NOT to find people who enjoy marijuana in Milwaukee — well at least at certain places among the 20-40 crowd. ”

Multiple places have decriminalized non-medical cannabis in the United States; however, cannabis is illegal under federal law. Gonzales v. Raich (2005) held in a 6-3 decision that the Commerce Clause of the United States Constitution allowed the federal government to ban the use of cannabis, including medical use even if local laws allow it.
Most places that have decriminalized cannabis have civil fines, drug education, or drug treatment in place of incarceration and/or criminal charges for possession of small amounts of cannabis, or have made various cannabis offenses the lowest priority for law enforcement.

Medical Marijuana and Adult Use Legalization and Regulation
Several marijuana policy reform bills — both modest and far-reaching — were introduced during Wisconson’s 2015-2016 legislative session, but none received a floor vote.
State Rep. Melissa Sargent (D-Madison) once again introduced legislation that would have legalized and regulated the production and sale of marijuana to adults 21 and older and created a medical marijuana program for seriously ill residents of Wisconsin. Unfortunately, this legislation failed to pass through the committee process.

Legislators also considered efforts to expand Wisconsin’s limited medical cannabis law, which only allows a non-psychoactive component of marijuana — cannabidiol. Those, too, fell short.
Legislative change often takes several years, so don’t give up the fight. Ask your lawmakers to support a comprehensive medical marijuana bill. Meanwhile, if you are a patient with a serious medical condition who could benefit from medical cannabis, the loved one of a patient, or a supportive medical professional, please email state@mpp.org to get involved.

Decriminalization

In addition to Rep. Sargent’s legalization bill, a proposal to replace the criminal penalty for possession of less than 25 grams of marijuana with a less severe civil fine was jointly introduced by Rep. Mandela Barnes in the Assembly and Sen. Chris Larson in the Senate. This bill also stalled during the committee process.
Currently, an individual in Wisconsin convicted of mere possession of less than an ounce of marijuana faces a sentence of up to six months in jail and a fine of up to $1,000. Ask your legislators to support legislation that replaces the threat of jail time and the disastrous criminal record that accompanies a criminal conviction for marijuana possession with a simple civil fine.

This simple policy change would allow law enforcement to focus on violent crimes. It would also help reduce the consequences of alarming racial disparities in marijuana enforcement.
According to the ACLU, African Americans in Wisconsin are almost six times as likely to be arrested for marijuana possession as their white neighbors are.

More and more cities across Wisconsin are relaxing penalties against people caught with small amounts of marijuana, as the decriminalization movement sweeps across the state. Nine of the state's 10 largest cities have already decriminalized simple cannabis possession, a Gannett Central Wisconsin Media review reveals, reports the Associated Press. Madison and Milwaukee were among the first cities in Wisconsin to relax their pot laws. Stevens Point is the latest municipality in the state to adopt and then modify a new marijuana ordinance. Last month, the city reduced the fine for first-time pot possession to $100.
Under Wisconsin law, people caught with small amounts of weed can be charged with a misdemeanor crime, punishable by jail time and a permanent criminal record. With some cities in the state now enforcing lesser penalties, those "suspects" can now face anything from up to six months in jail, to no jail time or fine at all. Some law enforcement types say they don't support decrim because they claim marijuana can lead to harder drugs, i.e., the long discredited "gateway theory." Decrim advocates say those caught with small amounts of cannabis shouldn't be treated any differently than other minor offenders. - See more at:

Wisconsin has some of the harshest penalties related to marijuana possession, sale and cultivation. All levels of cultivation and sale are considered felonies, as are repeat possession offenses, with incarceration terms increasing based on quantity grown or sold. Wisconsin did pass a cannabidiol law in 2014.
Recreational Marijuana in Wisconsin | Recreational marijuana possession and sale or delivery are illegal for any amount of marijuana. First offense for possession of marijuana is a misdemeanor, while a subsequent offense is a felony, which carries a 3.5 year prison term. Legislators in Wisconsin did introduce a bill to legalize recreational marijuana in April of 2015, however this bill is expected to face strong opposition.
Medical Marijuana in Wisconsin | There is currently no policy regarding medical marijuana in Wisconsin. The most recent efforts toward legalization in the state have focused on recreational marijuana as well as CBD hemp extract. Should a recreational marijuana bill pass, medical marijuana patients would have increased access as well. MADISON (WKOW) -- A law passed nearly a year ago in Wisconsin to help children with seizure disorders hasn't helped anyone here yet. Families who pushed for it say they feel duped and want to know what happened.
The bill was a bit controversial because it centered around a form of medical marijuana and a component of Cannabis called Cannabidiol or "CBD." Even though doctors say CBD doesn't give you a high like other parts of Cannabis can, there's still a hesitation to prescribe it.
The law is aimed at helping children with severe seizure disorders, like Nic Volker and Ava Gehrung. Nic is a 10-year-old Monona boy who has up to 200 seizures a day, twice as many now as he did when the legislation was first passed. His mom, Amylynne, was one advocate who pushed for the law so Nic could try CBD as a treatment. Ava, 9, and her family met Amylynne and Nic at the hearings on CBD.
Ava's mom, Nancy, says she was relieved when the bill was first passed. "I remember thinking, we just have to wait until the fall to get it." That's when many families thought it would be available, after harvest time. Amylynne says, "My hope for Nic was that he would be seizure free by now."
But both children's conditions have gotten worse, even with traditional treatments like surgery and anti-seizure medication. That's why their parents want to at least try CBD. Even though Wisconsin law says people can legally possess it, they still can't get it.
Doctors have to go through a lengthy process to prescribe it, including obtaining an Investigational New Drug permit from the Food and Drug Administration. The FDA wasn't able to tell 27 News whether any Wisconsin doctors have applied for the permit, but those who keep a close eye on the situation haven't heard of any.
Plus, there's nowhere in Wisconsin that dispenses CBD, even if a doctor was willing to get a permit and prescribe it.
If a patient gets it from another state, like Colorado, they would get in trouble with the law for transporting it across state lines because the Drug Enforcement Administration regulates CBD like a Schedule I controlled substance. Amylynne says, "If I knew this bill wasn't going to work, I would have moved to Colorado. It's bothersome to me now that a year has gone by and Nic has lost another year of his life."

MADISON, WI — A bill to legalize both recreational and medical marijuana has been introduced in the Wisconsin House, although the Democrat-backed bill has a tough road ahead in the Republican controlled legislature.

Representative Melissa Sargent (D-Madison) introduced LRB-0188 on Monday. If passed, the bill would allow adults 21 or older to legally possess marijuana for any purposes. Wisconsin residents would be allowed to possess up to half an ounce of marijuana, while out of state visitors to Wisconsin would be allowed to possess up to a quarter ounce.
“Marijuana prohibition has not worked for Wisconsin,” Rep. Sargent said in a statement Monday. “Ending this prohibition in our state would promote personal freedom and liberty, create financial opportunity, and increase safety and security in our communities.”
“We have spent countless taxpayer dollars, imprisoned non-violent offenders, perpetuated falsehoods, and created a dangerous black market. This must end,” Sargent added.
Rep. Sargent’s legalization proposal establishes a system of state regulated marijuana retail outlets, with retail marijuana sales subject to a special 25% sales tax. Marijuana edibles would not be allowed for sale for recreational use, and bans the recreational marijuana sales via mail, telephone, or internet.

Wisconsin Gov. Signs Limited CBD-Only 'Medical Marijuana' Law

MADISON, WI — Wisconsin Governor Scott Walker signed a bill into law Thursday legalizing cannabidiol, or CBD, for children suffering from uncontrollable seizures, joining Alabama, Kentucky, Mississippi and Utah in having enacted limited medical marijuana bills this year.
Walker, who has opposed marijuana reform in Wisconsin, agreed to sign Assembly Bill 726, becoming Wisconsin Act 267, due to mounting pressure from families of sick children who would have had to leave the state otherwise.
The high CBD oil was previously illegal in Wisconsin due to it containing a small amount of THC, the psychoactive component found in marijuana, but advocates pointed out that CBD could never be used as recreational marijuana as it delays and even negates the psycho active effects of THC-Delta-9.
The legislation was written specifically to apply only to CBD, and it must be administered by a physician.
The CBD oil that has reportedly been working for children in Colorado will now hopefully be available in Wisconsin by the fall.
While this will help a select few in Wisconsin, a more comprehensive medical marijuana bill, Senate Bill 363, was rejected earlier this month by lawmakers.

The discovery that an oil extract from marijuana was successfully treating extremely serious, life-threatening seizures in children with rare disorders has prompted some changes in the way people think about the drug (except, perhaps, for New Jersey Gov. Chris Christie).
Medical marijuana is not legal in Wisconsin, but yesterday Gov. Scott Walker signed a bill making it legal in the state to use cannabidiol, a drug made from cannabis, to treat seizure disorders. This particular, singular type of medical marijuana is approved because there’s no chance anybody would enjoy taking it. From the Journal Times of Racine, Wisconsin:

Wisconsin passes CBD medical marijuana bill, Dane votes 2/1 for legalization

April 1, 2014 was a historic day for Wisconsin marijuana law reform efforts. In the early evening, the state Senate overwhelmingly passed narrowly focused medical marijuana legislation, and in Spring elections held the same day, Dane County voters passed Advisory Referendum #2, asking state lawmakers to enact legislation legalizing marijuana, by a nearly 65/35% margin.
With the state Assembly having already passed AB726, it now heads to Gov. Scott Walker's desk for his signature. 32 Senate members voted in favor with Senator Tom Tiffany (R-Hazelhurst) not voting at all. {UPDATE: 4/10/14: All 33 senators were later listed as voting in favor.}
As with the Assembly's unanimous voice vote in favor of AB726, some names not known to be supportive of medical marijuana cast their first pro-medical marijuana votes. Watching the roll call on Wisconsin Eye was an amazing sound hearing the Ayes in favor from first-time pro-medical marijuana voters Senators Leah Vukmir (R-Wauwatosa), Mary Lazich (R-New Berlin), Alberta Darling (R-River Hills), Majority Leader Scott Fitzgerald (R-Juneau), Julie Lassa (D-Milladore), Sheila Harsdorf (R-River Falls) and Glenn Grothman (R-West Bend).
Two Senators cast their second pro-medical marijuana votes in 32 years, having both voted in favor of the 1982 Therapeutic Cannabis Research Act, which legalized medical marijuana for glaucoma and cancer patients but provided no means of supply outside of the federal government. Those Senators were Fred Risser (D-Madison) and Mike Ellis (R-Neenah). Ellis spoke of constituents who had to travel out west to bring CBD medication to their seizure-afflicted child during the discussion.

Eighteen Wisconsin lawmakers have signed on to a medical marijuana bill introduced yesterday, raising the hopes of medical marijuana activists in the Badger state.
State Rep. Chris Taylor and state Sen. Jon Erpenbach were joined by 16 other lawmakers introduced Senate Bill 363, which would allow medical marijuana patients to and grow their own supply up to twelve plants and keep up to three ounces of herb on them at a time.
The law would also create a state-regulated medical marijuana dispensary industry.
The rules proposed seem to be becoming standard across the country. Qualifying conditions would include cancer, glaucoma, aids, hepatitis, Alzheimer's disease, and several other chronic pain conditions.
Doctors would also be able to recommend cannabis for diseases or medical conditions that cause major nausea, extreme pain or seizures.
Notably, the program would also include provisions for post-traumatic stress disorder.
No doubt opponents will say the bill is too broadly written, as is the case currently in XXX, which we reported earlier this week.

Currently pending in the Wisconsin Legislature is the Jacki Rickert Medical Marijuana Act (JRMMA), the approval of which would allow the use and growth of cannabis for the treatment of certain illnesses.
On Tuesday of this week, the Wisconsin branch of NORML, along with another advocacy group, Is my Medicine Legal YET (IMMLY), held a Day of Pray for Compassion ceremony on the Capitol steps. The protesters sent a pray to the heavens and, just to be on the safe side, to the Wisconsin Legislature as well, asking for the right to use the healing powers of marijuana.
Speakers at the event included Gary Storck, president of Wisconsin NORML and spokesperson for IMMLY, veterans suffering from post-traumatic stress disorder, an Ojibwa Indian performer and others who have diseases for which they say medicinal cannabis is the best option.
Commenting on the protest, James Cleary, associate professor at the University of Wisconsin School of Medicine and Public Heath, said that he had already prescribed oral cannabinoids for patients with advanced cancer. However, he went on to say, “as an oncologist, I am against approving the smoked version. That is the advantage of the Sativex product at this stage, or a vaporized version (of cannabis).”

WAUKESHA - An already controversial session of the state Legislature is about to spark another big fight.
Advocates for legalizing medical marijuana in Wisconsin are gearing up to get a bill passed in the Legislature that would open up the drug to those fighting severe diseases.
Gary Storck, spokesman for the group Is My Medicine Legal Yet? said they expect the bill to be introduced within the next six weeks and given the make up of the current ruling bodies, gives it a good chance of passing.
"We had a poll done in 2002 and the results found that over 80 percent of people statewide supported it," said Storck. "If the representatives and senators truly represent the people, they'll support this one thing that has been introduced into every session since 1997."
State Rep. Leah Vukmir, R-Wauwatosa, who has also worked as a registered nurse, has been a vocal opponent of the medical marijuana bill, saying it would only say it's OK for people to break the law.
"This is nothing more than a back door attempt to try and legalize marijuana," she said, "I took an oath of office to uphold the laws of the land and if I agreed to a bill like that, I'd be asking people to break the law because marijuana isn't a legal substance."
Medical marijuana is currently legal in 13 states and it has been gaining traction in the Great Lakes region.
In November, Michigan voters approved a medical marijuana bill making it legal there. This week the Illinois Senate also approved a similar bill and Minnesota Gov. Tim Pawlenty vetoed a bill legalizing it there, gearing up for a fight with the Legislature.
Storck said the Wisconsin bill would be similar to the Michigan bill in that it would allow for people with severe debilitating diseases to possess and grow a small amount of marijuana for medical purposes.
One difference, he said, was that the Wisconsin law may also exempt veterans suffering from post-traumatic stress disorder.
Although supporters say there are an untold number of medicinal benefits to marijuana medication, Vukmir disagrees with that argument, saying other means of medication are available to patients now that can give the same effects of the drug.
The Freeman was unable to locate an area doctor willing to speak on record about claims made by either side of the debate by press time.
Past Wisconsin bills have gotten support from state Democrats, including Gov. Jim Doyle.
The state's first medical marijuana bill was signed by Republican Gov. Lee Sherman Dreyfus in 1982, which opened the door for more medical marijuana research.

Poll finds over 80 Percent Of Wisconsinites Favor Marijuana To Treat Seriously Ill | It had long been suspected that a scientific poll of Wisconsin residents views on the issue of medicinal marijuana would yield results similar to scientific polls conducted nationally and in other U.S. locations, where the issue has consistently shown strong support, but state supporters had been unable to come up with the necessary funding to confirm this.

1. Since 1996, twelve states have legalized medical marijuana use: AK, CA, CO, HI, ME, MT, NV, NM, OR, RI, VT, and WA. Eight of the twelve did so through the initiative process. Hawaii's law was enacted by the legislature and signed by the governor in 2000, Vermont's was enacted by the legislature and passed into law without the governor's signature in May 2004, Rhode Island's was passed into law over the governor's veto in January 2006, and New Mexico's legislation was signed into law by Governor Bill Richardson on April 2, 2007.

by Ian Williams Goddard | In reaction to medical cannabis access referendums on the ballots in Arizona and California, former presidents Gerald Ford, Jimmy Carter, and George Bush signed a letter stating that they "categorically oppose'' access to cannabis for its many proven therapeutic uses such as the prevention of blindness and epileptic seizures. Their chief concern was that legal medical access would send the message that cannabis is safe. The presidents can, however, lay their safety concerns to rest because the scientific literature overwhelmingly confirms that cannabis is both an effective and safe medicine.
The Cannabis Safety Profile. The journal PHARMACOLOGICAL REVIEWS reports that decades of research prove that, "Compared with legal drugs...marijuana does not pose greater risks." Yet based upon mortality statistics, we can safely conclude that cannabis is one of the safest medical drugs known, for, while prescription drugs, defined as safe by the FDA, kill up to 27,000 and aspirin up to 1,000 Americans per year, cannabis kills 0 per year.
