There are a number of medical cannabis (marijuana) bills in play in states across the US. Here we network on Ways and Means anyone can help with the effort to make each a medical marijuana state.
We need to get the word out and people contacting reps and officials and get this legislation into law. Also, lets not forget efforts at the Federal level.
NETWORK and Spread The Word, both On-Line and Off (!) ON-LINE, You can tell everybody in cyber-space by e-mailing a link to this website to them and/or (OFF-LINE> printing off the info and handing out where possible / necessary. Also phone call and read off and/or visit and hand deliver the info. You can take literature with you and approach businesses, organizations and even people on the street while you're out and about. Wear your pot-leaf shirt and register voters, as feasible. Gather signatures for any related petitions that are happening at the time as well.
This is a chain e-mail you can't refuse. Unlike most, this will actually help you - and a whole buncha others - just by passing it on.
Cannabis consumer or not - from the folks just trying to take care of themselves or a loved one to those who simply see the expensive, immoral waste of making war on the sick and dying - everyone is affected by this issue.
To accomplish this you need to first click on the following links and send a message to all the reps and media you can on the issue.
Then get everybody else to do the same. And follow up.
To do this you need to tell everybody you know.
And can confide in.
Then/or anonymously tell everybody you don't know
- or can't confide in. Yet.
Tell everybody else by Letters-to-the-Editor, displaying signage at street corners and over-passes (wear trenchcoat, fedora and sunglasses if afraid of exposure), and/or anonymously leaving literature and posting on-line at places where people are likely to find it.

Inform, Educate, Activate
INFORM and EDUCATE. Distribute medical marijuana brochures and other literature to your friends, family, local leaders and elected officials in an effort to educate the public and garner support. Educate your community by Printing, posting and handing out Flyers and other Printables in a mall, coffee shop, laundromat, college campus, lamp post, telephone poll, business window (ask first), hospital, or anywhere people will see them. Contact these groups for some.

OUTREACH and Gather TESTIMONY. Ask your doctor, clergy member, local leader, or organization you are a member of to sign a statement of principle. One way to get that done is to download MPPs medical marijuana statement of principle, print it out, and ask your doctor or other individual to sign it the next time you have the opportunity. And TESTIFY. If you are a patient or caregiver that could benefit from such a law and would like to help advance legislation by sharing your story with others. Call in to radio, TV and other media; write LTEs and contact you legislators. These groups are helping with this activity:

BROADCAST and PUBLICIZE. Help get the word out by downloading and sharing MPP's public service announcements with radio stations in your area. Legislation: Marijuana is illegal in New York state, and so is any activity related to marijuana (possession, cultivation, and of course dealing).
For small amounts (less than 25 grams) first time offenders, there is no Incarceration, and a fee of $100.
Punishment for possessing a small but commercial quantity is 1-3 years (not less than 1, not more than 3).
Law Enforcement: I can’t speak for NYC, but here in Albany some of the cops are cool, but most will bring you in. I’ve never been in, but my frinds have, and i know guys who gone done. With Pataki’s right wing Bush loving ass, he fully suports the archaic Rockefellar laws, so local gov’t tries to look good for him. We need to get Spitzer in there…. 13th midicinal state?

Police presence in Albany is relatively light in most areas since it is primarily concentrated in the Arbor Hill area.

Legislation: Marijuana is illegal in New York state, and so is any activity related to marijuana (possession, cultivation, and of course dealing).
Law Enforcement:
Marijuana is technically illegal and most of the time you won’t get busted for personal stashes. Pushers get hassled often. It’s not a good idea to walk down the street smoking. But I have smoked in broad daylight.
It really depends on the cop. And most cops will go harder on a minority than a white. Buffalo only has one officer car so they’ll be less likely to stop and mess with some teens just because they’re stoned.
Our latest reporter tells us: The police in the city of Buffalo basically do not care about weed. They have more important things to do. They have actually given me back a blunt, thrown the weed out and let me go, they also told me one time “thanks for the free smoke” I ride around regularly in my car smoking blunts it’s one of my favorite things to do. The only people who really have a problem with weed and cops are the sellers, which in buffalo is alot of bud houses and teenage hustlers on the street.

Legislation: “Possession of 25 grams or less of marijuana is punishable by a fine of $100 for the first offense. For the second offense, the penalty increases to a $200 fine and for subsequent offenses the fine increases to $250 and a maximum of 15 days in jail time may be imposed. [for a third offense the website shows it as a potential misdemeanor of up to 5 days jail time and/or fine up to $250]
Possession of greater than 25 grams or possession of any amount in public where the marijuana is burning or open to public view, is a class B misdemeanor and is punishable by up to three months in jail and a fine up to $500.
For possession of greater than two ounces, the penalty increases to a possible one year in jail and a fine up to $1,000.
Updates from criminal justice officials in NYC:
“1- By law, you’re supposed to see a judge within 24 hours of arrest
2- 1st time small amount offenders are almost always offered to have their cases adjourned 1 year and dismissed so long as they are not rearrested. IN all likelihood rearrests in other jurisdictions will not have the case reoppened.
3- It is not a crime to posses small amounts, I do not have the exact weight off hand. It is only a crime if you pass a threshold weight, you have your weed in public view or it is actually burning.
4- They will arrest and prosecute you for residue: e.g., an empty pipe or bag.”
and a later update: “Apparently one of our local senators recently recovered from prostate cancer, so now his eyes have oppened toward medical marijuana legalization, N.Y. has also made some decriminilization efforts, i.e. less than 25 grams, (almost an ounce), you will get off with a “violation” and a $100.00 fine.”
Law Enforcement: Cops patrol teh areas. No DT’s (undercovers) sell weed. If you have out of state plates, don;t get surprised if you get stopped. When you do leave uptown, stick to the main streets, NOT the side streets.
Marijuana is illegal in NY, and that is enforced by the police – NY Police have been busting people for extremely small quantities for about the last 8 years. If NY cops catch you with ANY weed they absolutley will arrest you and detain you in a NY jail for 48 hours. back in the 70?s, 80?s and early 90?s they would let you go but this is no longer the case. There are special police squads in NY who’s sole purpose is to find people smoking weed or drinking beer in public and arrtes them. Everyone who lives here and smokes knows about it.

Legislation: Typical New York State Laws Apply. Possession is largely decriminalized. Selling and Manufacturing is not.
Law enforcement: Mostly local police are around but as long as you are not violent, they will seldom mess with you. Police are like anyone else, some do not want to do their jobs unless they have to, others are gung-ho and will arrest anyone at the first opportunity. Don’t make the police have to do their job and you’ll be fine.
Where to buy marijuana: Where not? It’s Woodstock! Hang out, be social, and ask around. There aren’t a ton of sources, but most fellow smokers will let you chill with little if any questions asked. If you hang out enough you might become privied to certain information. Check out the drum circles, and talk to fellow shoppers in certain and browsers. Don’t be aggressive…just chill.
There is a very laid back vibe and if you are too gung-ho in your pursuits then you’re going to turn people off. The Village Green is called the Village Green for a reason…find out where it is, bring yourself and just chill. Keep your ear out for events, shows, and gatherings at nearby hotspots.
Marijuana prices: Not cheap, but all types can be found. Usually 40+ for an 1/8 and that is the smallest quantity you’ll find. Every once in a while some rarities can be found or otherwise observed with the senses…$500+ for a lid.

Multiple places have decriminalized non-medical cannabis in the United States; however, cannabis is illegal under federal law. Gonzales v. Raich (2005) held in a 6-3 decision that the Commerce Clause of the United States Constitution allowed the federal government to ban the use of cannabis, including medical use even if local laws allow it.
Most places that have decriminalized cannabis have civil fines, drug education, or drug treatment in place of incarceration and/or criminal charges for possession of small amounts of cannabis, or have made various cannabis offenses the lowest priority for law enforcement.

We believe there needs to be a new paradigm in New York regarding our drug policies—one that takes us beyond repeal, and asks “What comes after repeal of these failed laws?” We need a public health approach to drug use and abuse—expanding community based drug treatment, reducing criminal penalties for simple drug possession, restoring judicial discretion, and utilizing our public health system to address key drug policy issues.
The criminal justice approach to drug use and abuse has failed—a failure embodied by the Rockefeller Drug Laws. The laws have promoted institutional racism, failed to reduce drug abuse in our communities, contributed to mass incarceration, and wasted taxpayer dollars and human lives. The time for change is now.

Although many bills that would have improved New York’s medical marijuana program were introduced by Assemblyman Richard Gottfried and Senators Gustavo Rivera and Diane Savino in 2016, none of them passed. Most of them died in the Health Committee of the state Senate. Patients are struggling to find doctors that will recommend medical marijuana, because less than 1% of the doctors in New York have taken the costly 4.5 hour course on medical cannabis that is required in order to register with the program. In addition, New York law only permits 20 dispensaries, the second lowest number of dispensaries per capita of any medical state. This helps explain why, in a recent survey of patients, 77% reported that they are unable to afford the medicine they need. Finally, the New York program leaves behind the vast majority of patients who could benefit from medical marijuana, including those with chronic pain or PTSD. The health commissioner recently refused to add PTSD to the list of qualifying conditions despite compelling evidence that medical cannabis can help and has far fewer side effects than the cocktail of drugs usually prescribed.

New York was one of the first states in the nation to decriminalize the possession of marijuana. Unfortunately, in recent years, the “public view” exception to the law has been widely abused by police officers, who order people, mostly young people of color, to empty their pockets, often as part of an improper “stop and frisk” of people not suspected of any crime. Once the marijuana is in public view, the person is arrested.
In November 2014, Mayor Bill DeBlasio ordered the New York Police Department to stop arresting people for marijuana possession and instead issue civil citations. Unfortunately, over 16,000 people were still arrested last year for marijuana possession in New York City, and over 90% of them were people of color. Even more disturbing, arrests for marijuana possession for the first six months of 2016 are up 29% from the same period last year. Several bills were introduced to address this problem, but none passed during the 2016 session.

As public opinion shifts away from prohibition, these two states will serve as test cases for full-on legalization. Here’s what to watch for in the early stages of this experiment:
THE FATE OF THE BLACK MARKET One of the basic arguments in favor of legalization is that it could eliminate the black market and create new tax revenue. But it’s not clear how quickly and to what extent this will actually happen. Marijuana sold at retail shops that pay taxes may well cost more than illegal marijuana, potentially keeping off-the-books dealers in business.
UNDER-AGE SMOKING When the Justice Department announced in August that it would not sue to block state laws legalizing marijuana, James Cole, the deputy attorney general, emphasized that local governments must employ “strong and effective regulatory” systems. To avoid federal intervention, states will have to prove that they’re capable of enforcing bans on selling the drug to anyone under 21. Roughly 36 percent of 12th graders reported having used marijuana in 2013. From a public-health standpoint, it will be important to monitor whether youth usage rates in Colorado and Washington diverge from those in other states. MARKETING Washington banned marijuana ads near schools, libraries and playgrounds. In Colorado, marijuana vendors may run ads in print media only if there is “reliable evidence” that no more than 30 percent of the readership is under 21. New York legalizes medical marijuana

(CNN) | New York became the latest state to permit the use of medical marijuana on Monday.
At a news conference in New York City, Gov. Andrew Cuomo signed the Compassionate Care Act, which allows doctors to prescribe marijuana in a nonsmokable form to patients with serious ailments that are recognized by the state on a predefined but flexible list of conditions.
The bill was passed by the State Assembly and Senate in June, said Jason Elan, a spokesman for Sen. Diane Savino, a sponsor of the bill.
Cuomo said Monday that it was difficult to develop and pass the bill because it needed to embrace increased medical acceptance of marijuana while rejecting situations and conditions that state legislators said could have "good intent and bad results."
"There is no doubt that medical marijuana can help people," Cuomo said Monday. "We are here to help people. And if there is a medical advancement, then we want to make sure that we're bringing it to New Yorkers."
Senate Co-Leader Jeffrey D. Klein said the "patient-centric program" will provide relief to thousands of people and will be "one of the safest, most tightly regulated medical marijuana programs in the country."

State Senator Pushing Bill To Legalize And Tax Marijuana In NY | State Senator Liz Krueger is pushing ahead for something even bigger: “It is my intention as a New York State senator to soon introduce a law that would actually decriminalize, regulate and tax marijuana in New York,” she told a crowd this week on the Upper East Side.
According to CapitalNY, Krueger unveiled a draft of her bill, "Marijuana, Regulation, and Taxation Act.” Under it, NY adults would be allowed ot grow up to six pot plants at home; they could buy and sell weed just like alcohol; weed sales would be regulated by the New York State Liquor Authority; drivers wouldn't be allowed to operate vehicles under the influence; and pot would be taxed heavily, around $50 an ounce.

New York WILL Be The Next Medical Marijuana State |
Just Announced: New York Governor Andrew Cuomo released a statement tonight that his state of the union speech next week will include an announcement of an executive order making medical cannabis legal.

New York State Is Set To Loosen Marijuana Laws | Albany -- Joining a growing group of states that have loosened restrictions on marijuana, Gov. Andrew M. Cuomo of New York plans this week to announce an executive action that would allow limited use of the drug by those with serious illnesses, state officials say.
The turnabout by Mr. Cuomo, who had long resisted legalizing medical marijuana, comes as other states are taking increasingly liberal positions on it — most notably Colorado, where thousands have flocked to buy the drug for recreational use since it became legal on Jan. 1.
Mr. Cuomo’s plan will be far more restrictive than the laws in Colorado or California, where medical marijuana is available to people with conditions as mild as backaches. It will allow just 20 hospitals across the state to prescribe marijuana to patients with cancer, glaucoma or other diseases that meet standards to be set by the New York State Department of Health.
While Mr. Cuomo’s measure falls well short of full legalization, it nonetheless moves New York, long one of the nation’s most punitive states for those caught using or dealing drugs, a significant step closer to policies being embraced by marijuana advocates and lawmakers elsewhere.

Medical Marijuana Measure Passes Assembly Committee
| Legislation that would allow for the medical use of cannabis by qualifed patients, Assembly Bill 6357, has been approved by the Assembly Committee on Health in a 21-4 vote. It now awaits action from the full General Assembly. It's companion legislation, Senate Bill 4406, still has yet to be scheduled for a hearing by the Senate Health Committee.
These measures would allow for the medical use of cannabis by qualified patients and are being supported by a bi-partisan coalition of more than 50 lawmakers. Under this act, physician-authorized patients would be allowed to possess up to 2 and one-half ounces of cannabis. The measure also allows for the establishment of licensed not-for-profit and for-profit facilities to produce and distribute cannabis to qualified patients. Lawmakers Likely to Debate Marijuana Decriminalization Measure
| New York Governor Andrew Cuomo reaffirmed his commitment to decriminalize the public possession of 15 grams or less of marijuana during his 2013 State of the State address. Governor Cuomo had previously announced his support for a similar legislative proposal in 2012, but state lawmakers failed to act on it.
Under state law, the private possession of up to 25 grams of marijuana is a non-criminal civil citation, punishable by a $100 fine. By contrast, the possession of any amount of cannabis in public view is classified as a criminal misdemeanor [NY State Penal Law 221.10].

Legalizing of Marijuana Raises Health Concerns
In the ’60s, marijuana was a hallmark of the counterculture, along with free love, bell bottoms, long hair and bandannas. But marijuana has had the most staying power.
This month, in a remarkable first, the recreational use of marijuana became legal (depending on your definition) in Colorado and Washington. Over a dozen other states have decriminalized possession of small amounts, and Massachusetts recently became the 18th state to allow its use for medicinal purposes.
While marijuana can be addictive, scientists generally agree that fewer than 10 percent of marijuana smokers become dependent on the drug, compared with 15 percent for alcohol, 23 percent for heroin and 32 percent for tobacco. Marijuana does contain carcinogens, including tar and other toxins similar to those found in tobacco, but people generally do not smoke marijuana in the same amounts as cigarettes.

US NY: No Cause For Marijuana Case, But Enough For Child
New York Times, 18 Aug 2011 - The police found about 10 grams of marijuana, or about a third of an ounce, when they searched Penelope Harris's apartment in the Bronx last year. The amount was below the legal threshold for even a misdemeanor, and prosecutors declined to charge her.
But Ms. Harris, a mother whose son and niece were home when she was briefly in custody, could hardly rest easy. The police had reported her arrest to the state's child welfare hot line, and city caseworkers quickly arrived and took the children away.

Marijuana, whose botanical name is cannabis, has been used by humans for thousands of years. It was classified as an illegal drug by many countries in the 20th century. But over the past two decades, there has been a growing movement to legalize it, primarily for medical purposes.
Medical marijuana use has surged in the 15 states and the District of Columbia that allow its use. But states and cities are also wrestling with the question of what medical marijuana is, or should be.
The Montana House of Representatives voted in February 2011 to repeal the state’s six-year-old medical marijuana law. The 63-to-37 vote, largely along party lines in the Republican-controlled chamber, pushed Montana to the front lines of a national debate about social policy, economics and health regarding medical marijuana use
Montana's House speaker, Mike Milburn, a Republican and sponsor of the repeal bill, who said he thought that the arguments about medical use had been a pretext for encouraging recreational use and creating a path to full legalization. He said he feared gang drug wars in Montana’s cities and debilitation of its youth. If the legislation is passed by the Montana Senate, it would face an uncertain fate on the desk of Gov. Brian Schweitzer, a Democrat, who has said he believes the laws need to be tightened, but he has not taken a position on repeal.

New York: Medical Marijuana on the Move in Albany and NYC |
A bill that would legalize the use of medical marijuana in New York state passed one of its first legislative hurdles Wednesday at the state capitol in Albany, while two days earlier in New York City a resolution expressing the city council's support for a state medical marijuana bill also moved forward.
The medical marijuana bill in Albany, A0576, was okayed by the Assembly's Health Committee on an 18-6 vote a day after dramatic and sometimes wrenching testimony before the committee, including some from surprising sources. "If you have ever seen anyone on their deathbed, dying in agony, screaming in pain every day as I had with my father who had cancer, the risks of smoking marijuana are outweighed by the therapeutic benefits," conservative Assemblyman Robert Prentiss (R-Colonie) told his colleagues.
The bill is rapidly picking up bipartisan support in the Democratic-dominated Assembly, with 41 Democrat and seven Republican cosponsors. It is now headed for the Assembly Codes committee, then the Ways and Means committee before coming up for a floor vote.
"We are on our way," said Vince Marrone, who is working the issue as a paid lobbyist for the Marijuana Policy Project (http://www.mpp.org).
"We got through that first committee in good shape, and the Codes committee, which must review all legislation that impacts the criminal justice system, already approved it once last year," he told DRCNet. "And we have Republicans on the Ways and Means committee who will vote for this, so I think it is safe to say we will have this bill on the floor of the Assembly by the end of the year. The question then becomes whether the leadership will act on it."

1. Since 1996, twelve states have legalized medical marijuana use: AK, CA, CO, HI, ME, MT, NV, NM, OR, RI, VT, and WA. Eight of the twelve did so through the initiative process. Hawaii's law was enacted by the legislature and signed by the governor in 2000, Vermont's was enacted by the legislature and passed into law without the governor's signature in May 2004, Rhode Island's was passed into law over the governor's veto in January 2006, and New Mexico's legislation was signed into law by Governor Bill Richardson on April 2, 2007.
