In Georgia, House Bill 1 was passed by the state Senate and state House on March 25, 2015, and was signed by Governor Nathan Deal on April 16, 2015. Governor Nathan Deal also signed a Georgia Executive Order on March 27, 2015 to prepare state agencies for the use of cannabis oil. House Bill 1 allows the use of cannabis oil with no more than 5 percent THC to treat 8 conditions as recommended by a physician.

Georgia does not allow medical marijuana, despite the efforts of some medical marijuana advocates. Unlike other populous states, Georgia has not even had a medicinal marijuana bill introduced in the legislature in recent years.
What is the Medical Marijuana Registry? Is there a Georgia Marijuana Registry?
States with legalized medical marijuana typically have registries to assist law enforcement in identifying patients with valid doctor’s recommendations. Because Georgia does not have full, legalized medical marijuana, there is no Georgia medical marijuana registry.
Furthermore, individuals who are on registry lists in other states receive no legal benefits or additional defenses from prosecution while in Georgia.

Possession of less than one ounce of marijuana is classed as a misdemeanor and may be punished by a maximum one year jail sentence and a fine of up to $1,000 but for a first drug conviction the offender may be placed on probation, successful completion of which will see the proceedings against him discharged.

Medical Marijuana Clinics and Dispensaries Georgia

The federal marijuana enforcement policy declares federal authorities will no longer be raiding state licensed medical marijuana dispensaries and clinics that are in compliance with their own state laws and regulations concerning the medical use and safe access to marijuana. Under current federal law however, the use, sale or possession of marijuana, whether medically prescribed or not, is still unlawful and carries significant criminal penalties.
Of the fifty states that have medical marijuana laws, currently, thirteen of them, Alaska, California, Colorado, Hawaii, Maine, Michigan, Georgia, Nevada, New Mexico, Oregon, Rhode Island, Vermont and Washington, have legally authorized the medicinal use of marijuana and it's dispensaries within their respective state borders. Most of these marijuana dispensaries and clinics are in full compliance with local and state regulations; other marijuana dispensaries have not been so careful and have been closed down and/or cited by local law enforcement agents for noncompliance.

Wear your pot-leaf shirt and register voters, as feasible. Gather signatures for any related petitions that are happening at the time as well.
This is a chain e-mail you can't refuse. Unlike most, this will actually help you - and a whole buncha others - just by passing it on.
Cannabis consumer or not - from the folks just trying to take care of themselves or a loved one to those who simply see the expensive, immoral waste of making war on the sick and dying - everyone is affected by this issue.
To accomplish this you need to first click on the following links and send a message to all the reps and media you can on the issue.
Then get everybody else to do the same. And follow up.
To do this you need to tell everybody you know.
And can confide in.
Then/or anonymously tell everybody you don't know
- or can't confide in. Yet.
Tell everybody else by Letters-to-the-Editor, displaying signage at street corners and over-passes (wear trenchcoat, fedora and sunglasses if afraid of exposure), and/or anonymously leaving literature and posting on-line at places where people are likely to find it.

Inform, Educate, Activate
INFORM and EDUCATE. Distribute medical marijuana brochures and other literature to your friends, family, local leaders and elected officials in an effort to educate the public and garner support. Educate your community by Printing, posting and handing out Flyers and other Printables in a mall, coffee shop, laundromat, college campus, lamp post, telephone poll, business window (ask first), hospital, or anywhere people will see them. Contact these groups for some.

Legislation: Posession is an arrestable offense, although it is a misdemenor and usually results in fines and community service on your first arrest. Posession of more than 1 oz and cultivating/selling is a felony.
The laws in GA, as they are scripted are somewhat tough, however they are rarely enforced by the book in Atlanta. >28 grams=felony, any sale=felony
* GA is one of the few states with “per se drugged driving law” which states that if you have any traceable amount of an illegal drug in your system while driving you are guilty of DUI. This law is currently being challenged in the state supreme court.
Law Enforcement: Law enforcement in Atlanta is actually pretty lax. We’ve ridden through downtown blazin countless times with no problems. Like most modern big cities, the police force has much bigger problems to dedicate their time to. For the most part they have deprioritized cannabis.
In most cases if you are caught by the Atlanta PD with anything less than 1 ounce you will probably lose your stash, recieve a harsh verbal warning and be on your way.
Where to buy Marijuana in Atlanta: Little 5, is a cultural area of Atlanta with a very strong community. Your best bet is to go into a bar such as the Vortex and buy a beer, I reccomend Atlanta’s own Sweetwater 420 ale brewed by local hippies, and make a friend at the bar. Asking around might work here, but I don’t know how many people will be receptive and asking the wrong person could get you busted. Dreads are a good sign.
Marijuana prices: The Herb is amazing but these guys know it’s the best. Be prepared to pay upwards to $650 an ounce for real Kush. This is the best bud in the city and quite possibly in the world. Usually it goes 20-30 per gram and 200 per quarter- worth every penny. Purps can go 120-150 a quarter. and 10-20 per gram. I wouldnt buy mids or schwagg.

Legislation: Possession of less than one ounce of marijuana is a misdemeanor and can be punished by up to one year in jail and a fine of up to $1,000. However, upon a first drug conviction the offender may be placed on probation, and upon successful completion the proceedings against him may be discharged. Possession of one ounce or more is a felony and is punishable by 1 – 10 years in prison.
Law enforcement: Savannah police are very overworked and underpaid. If you have small amounts (under a couple of grams) you’ll probably get let off with little or no issues. Up to an ounce, you’ll be looking at a fine and maybe a night or two in jail. Just don’t toke up in the touristy squares or on River St., and you’ll be fine.
Where to buy marijuana: Anywhere on the Southside. Stay away from the downtown square area since the clubs are in the area and you will see cops. Southside Savannah is a bad area but the safest to look for smoke. The easiest way to go is to look for someone standing on the street curb infront of a house with people on the porch. Highway 204 area contains numerous dealers as well as Meth dealers. 37 street exit of Highway 16 is also a good spot. Make sure you have your money counted out and do not flash because yes, rapper’s get shot in Savannah.
Marijuana prices: Shwag: 20-30 1/8, 30-50 1/4, 120 oz;
Mids: 30-40 1/8, 70-80 1/4, 200 oz;
Dank: 50-60 1/8, 80-100 1/4, 400+ oz;
and also: “20-30 1/8 mids,
20-25 a gram for dank”.
Marijuana brands: I’ve seen Kind Bud, Northern Lights, Skunk, and I seen White Widow once. Savannah is called the c-port and it is easy to shift through the area. Believe it or not alot of the good smoke comes from the Arabic people so we see many different strands.
More information: Very little of the stuff is grown locally, most is brought in from Florida or Atlanta. In that respect, prices are a bit higher. But dealers tend to not bother moving low grade stuff down here, so it’s tough to get really bad weed.
To find bud you really need to know someone. Best way is find someone who looks like they sell, ask “you good for it” and down south it hits the scales before you eyes, so don’t be uncomfortable or ppl get nervous.

Multiple places have decriminalized non-medical cannabis in the United States; however, cannabis is illegal under federal law. Gonzales v. Raich (2005) held in a 6-3 decision that the Commerce Clause of the United States Constitution allowed the federal government to ban the use of cannabis, including medical use even if local laws allow it.
Most places that have decriminalized cannabis have civil fines, drug education, or drug treatment in place of incarceration and/or criminal charges for possession of small amounts of cannabis, or have made various cannabis offenses the lowest priority for law enforcement.

Will state lawmakers repair broken medical marijuana law in 2017?

Patients were left disappointed when the state legislature adjourned in 2016 without improving the state’s largely unworkable medical marijuana law. While patients technically have protections for possession of a limited range of cannabis products, there is no in-state cultivation, processing, or sale. The law leaves it to seriously ill patients or their loved ones to violate federal law and the laws of other states by bringing it across state lines. As a result, the current law leaves most patients behind.
Yet, the conversation is far from over. Since then, the Georgia Republican convention endorsed a resolution to support in-state production and sale of cannabis oil. The resolution was a vote of confidence for Rep. Peake’s measure, and he vowed to fight on in his effort to make the program more functional.

Medical marijuana has strong support among voters in Georgia, which has been shown in poll, after poll, after poll. Given voter support in finding a better approach, it is clear the conversation is far from over, and we expect another improvement bill in 2017.
ACLU study shows Georgia’s harsh marijuana laws result in racially disproportionate arrest rates

Georgia has some of the most punitive marijuana laws in the country, with possession of a mere two ounces being punishable by up to 10 years in prison. It’s clear these laws have not been successful, and new evidence shows that Georgia’s laws are not being evenly enforced.
A 2013 study by the American Civil Liberties Union found that although blacks and whites use marijuana at nearly identical rates, blacks in Georgia are 3.7 times more likely than whites to be arrested for marijuana possession.
Please take a moment to send a letter to your legislators asking them to reduce the penalty for possession of marijuana to a civil fine or ask them to end marijuana prohibition entirely.

About one hundred opponents of marijuana prohibition rallied at the State Capitol on Saturday, November 12, 2011, to help educate the public and to dispel old, worn out myths and misinformation about marijuana.
Organizations represented at the rally included Georgia For Cannabis, Coalition for Abolition of Marijuana Prohibition (CAMP), Cannabis Reformers, National Organization for the Reform of Marijuana Laws (NORML) Georgia Chapter, and Group-Civil Disobedience.
The rally is the second annual November rally at the Capitol organized by Jonathon Weaver; the first took place in 2010.
Activists circulated a petition to ask US Representatives and Senators from Georgia to support HB 2306, the Ending Federal Marijuana Prohibition Act of 2011. Currently, the bill, introduced by US Rep. Barney Frank (D-MA), has sixteen co-sponsors, none from Georgia.... A plea for medical marijuana in Augusta, Georgia | The NORML Stash

AUGUSTA, GA – In September, Elizabeth Wilsey of South Augusta became one the nation’s most unusual casualties in the government’s war against marijuana and medical marijuana users.
According to news reports, 80-year-old Wilsey, a white-haired grandmother, was a medical patient who used marijuana for relief of severe migraine headaches. When Richmond County narcotics officers raided her home, they found approximately one-half pound of marijuana.
They charged her with possession with intent to distribute. She admitted selling it. Sources close to the case say the reason she had so much on hand was because her dealer was moving out of the city, so she stocked up, not knowing when she’d get more.
Yet, to our knowledge, she had no firearms on the premises. Wilsey had no prior criminal record. That helps explain her relatively light sentence of five years probation.

(APN) ATLANTA -- "Yes We Cannabis" was the rallying cry of many individuals and organizations on the grounds of the State Capitol, Wednesday, April 20, 2011, in support of marijuana policy reform in the State of Georgia.
The group also celebrated the fact that Georgia has started to implement the Medical Marijuana Necessities Act of 1981 (MMNA 1981) that will establish procedures and a medical board for which patients can be prescribed legal medical marijuana in Georgia as part of clinical research trials.
The Georgia legislature passed the MMNA in 1981; however, after the political climate quickly shifted against marijuana under the President Ronald Reagan Administration, the trials were de-funded. Until now, the state has continued to fail to implement the law.
Over 50 people, representing diverse organizations, rallied at the event, including Law Enforcement Against Prohibition (LEAP), National Organization for the Reform of Marijuana Laws (NORML), Coalition for the Abolition of Marijuana Prohibition (CAMP), Georgia Taxpayers Alliance, Student for Sensible Drug Policy (SSDP), Educators for Sensible Drug Policy (EFSDP), and Cannabis Culture magazine.

On March 24, the Composite Board of Medical Examiners called for applications to fill the Patient Qualifying Review Board pursuant to the Therapeutic Cannabis Research Act of 1981. What does all that gibberish mean?
In 1981 Georgia passed a law then called the Medical Marijuana Necessities Act (OCGA 43-34-120-126). It provides for the distribution of medical cannabis to terminal cancer patients and glaucoma patients only, through approved pharmacies to secret, approved patients only. For 30 years the law has been “on the books,” but unfunded, defunct, and meaningless.
Suddenly last month, however, doctors took the first steps toward reviving it. The law provides for a panel of doctors, including an oncologist, an ophthalmologist, a radiologist, a surgeon and a pharmacist to approve applications by doctors on behalf of patients who wish to use cannabis medically. It seems that this board will soon have actual humans serving on it. Official rules have been published that would govern the program. The weed, BTW, would come from the Federal government and would be strictly controlled.

On March 24, the state medical board oh-so-quietly issued a call for applicants — five doctors in various fields and one pharmacist — to be named to a reformed PQRB. Once that body is in place, perhaps within six months, Cornwell predicts that opening the door officially to widespread use of medical marijuana will be a no-brainer.
“Once the board reviews the past 30 years of studies that have been done, we’d expect them to recommend allowing medical marijuana to be used for a variety of ailments,” he says.

Apr 21, 2011 - The state of Georgia is getting ready to begin clinical trials on medical marijuana, something they’ve legally been allowed to do since the state legislature passed the “Medical Marijuana Necessities Act” in 1981.
The program was de-funded when Ronald Reagan ramped up The War on Drugs. Now the board that oversees the state’s medical policy is putting together a group of doctors and pharmacists to begin clinical trials on medical cannabis. They are also going to take a look at bringing legal medical marijuana to Georgia.
If you were to make a list of the least likely states to legalize medical marijuana, you might be tempted to put Georgia at the top of it – although the state does have a well-organized libertarian contingent. But the fact that they are taking any steps in that direction has to be somewhat heartening to patients and advocates in the state.

If you have ever heard of the song, “Lets Go Get Stoned,” as sung by Ray Charles or Joe Cocker, you know the lyrics were referring to getting high or using cannabis aka marijuana. This mind altering drug goes by other names as well; names such as weed, pot, joint, blunt, hash and mary jane are quite common among users. Cannabis is a plant that contains a chemical called cannabinoids or cannabinolidic acids.
Another substance that is found in cannabis is THC, or Tetrahydrocannabinol, which gives the users that “high” sensation. When speaking of marijuana, the actual substance used in creating the high feeling comes from the leaves and flowering tops of the cannabis plant. Marijuana is considered to be a schedule 1 controlled substance today, because of the THC, which can be highly potent, depending upon the concentration factor of the THC.

1. Since 1996, twelve states have legalized medical marijuana use: AK, CA, CO, HI, ME, MT, NV, NM, OR, RI, VT, and WA. Eight of the twelve did so through the initiative process. Hawaii's law was enacted by the legislature and signed by the governor in 2000, Vermont's was enacted by the legislature and passed into law without the governor's signature in May 2004, Rhode Island's was passed into law over the governor's veto in January 2006, and New Mexico's legislation was signed into law by Governor Bill Richardson on April 2, 2007.
2. The Institute of Medicine's 1999 report on medical marijuana stated, "The accumulated data indicate a potential therapeutic value for cannabinoid drugs, particularly for symptoms such as pain relief, control of nausea and vomiting, and appetite stimulation."
