Colorado   Information pages DEA: "It's still a violation of federal law, we're still going to continue to investigate and arrest people." Federal drug-enforcement agents Friday (2/12/09) raided the home of a Highlands Ranch man who a day earlier bragged in a 9News report about the large and profitable medical-marijuana-growing operation in his basement. Along with the raid, Jeffrey Sweetin, the Drug Enforcement Administration's special agent in charge of the Denver office, sent a message to anyone involved in Colorado's increasingly profitable medical-marijuana industry. "It's still a violation of federal law," Sweetin said. "It's not medicine. We're still going to continue to investigate and arrest people." Agents at the scene Friday evening said the marijuana grower, Chris Bartkowicz, had been taken into custody. Jeff Dorschner, a spokesman for the U.S. attorney's office in Denver, said the grower would be held over the long Presidents Day weekend before a decision on charges is made Tuesday. In response, Denver Attorney Rob Corry released a letter yesterday to the Department of Justice accusing the DEA of "waste, fraud, abuse and misconduct" for their continued harassment of medical marijuana caregivers in Colorado. But in Colorado, it has failed to call off one of its dogs. A Coloradan who works for the president's drug-policy office is leading efforts to undermine the state's constitutional amendment allowing cannabis for medical use. On the federal dime, Tom Gorman, director of the Rocky Mountain High Intensity Drug Trafficking Area program, is lobbying state lawmakers to gut the Colorado law. Either Gorman didn't get the memo about changes in federal drug policy, or he's going rogue. Whichever the case, no one in D.C. seems to mind. Read more: here Actually, it's because Tom Gorman, who works in the Obama administration in the Office of Drug Control Policy is leading a campaign to gut and discredit Colorado's constitutional amendment 20 which allows cannabis use for medical reasons. Mr. Gorman is also director of the Rocky Mountain High Intensity Drug Trafficking Area program in Colorado running an arm of the National Drug Control Policy office in four Western States. Gorman has a contract that funnels $150,00 a year in federal money and he claims "Technically, if you ask me who I represent, it's the Colorado Drug Investigators Association" in an interview with Susan Greene he goes on to say "Pot smokers are gaming the system" and "chaos and moral decay will ensue". Tom Gorman was instrumental in the campaign to overturn Arizona's widely supported medical marijuana law in 1996. This is an outrage. This is an Obama administration director who is going against statements made by Attorney General Eric Holder on March 18, 2009 in which he declares the administration will be stopping the raids on medical marijuana patents and dispensaries. Mr. Gorman appears to be violating Federal law which does not allow for government funds to be used for lobbying against legislation or for candidates. It is time to retire Tom Gorman, 66 of the Rocky Mountain HIDTA. Tell our government to respect the rights of patients to use this valuable medicine, the voters spoke. Amid the antique stores, bars and fast-food joints occupying nearly every block are some of Denver's newest businesses: medical marijuana dispensaries. The locals call this thoroughfare "Broadsterdam." As in Amsterdam, Netherlands, these businesses openly advertise their wares, often with signs depicting large green marijuana leaves. "The American capitalist system is working," said attorney and medical marijuana advocate Rob Corry. It's a matter of supply and demand. "The demand has always been there," he said, "and the demand is growing daily because more doctors are willing to do this, and now businesses, entrepreneurs, mom-and-pop shops are cropping up to create a supply." Colorado voters legalized medical marijuana in 2000. For years, patients could get small amounts from "caregivers," the term for growers and dispensers who could each supply only five patients. DENVER -- On Monday, July 20, the Colorado Board of Health voted down a series of controversial restrictions to the state's medical marijuana law. After over twelve hours of testimony and deliberation the Board voted to reject the changes which would have prohibited those who legally use medical marijuana from appointing a state-licensed caregiver who is already helping five patients and created a new definition of the role of a "caregiver" requiring such individuals to provide services beyond marijuana distribution, such as house cleaning and food preparation. Currently, Colorado caregivers -- those legally designated to provide marijuana for a patient who is unable to produce it due to physical, financial, or other limitations -- can help any number of patients who seek their assistance, and are not required to provide services beyond medical marijuana dispensing. The proposals were met with vast opposition from across the state, with approximately 1000 opponents attending the hearing. Hundreds testified against the changes including lawyers, doctors, care providers, veterans, and numerous health-care and religious organizations. Dr. Ned Calonge testified before the state health board in support of proposed new rules that would limit marijuana providers to five patients each. Currently, a voter-approved amendment to the state constitution allows designated caregivers to grow marijuana for an unlimited number of patients.
