In May 2016, the legislature amended a provision related to university research. The law now allows university research for 0.6% THC, allows any university in the state to participate, and allows research to be conducted on intractable seizures, cancer, and other diseases. However, the law also requires any study to be “certified by the drug enforcement administration located in the state,” effectively hampering supply.
There is no legal protection offered for independent patient caregivers, dispensaries, producers or processors. Recommending physicians must supply a report to Tennessee’s General Assembly by January 2018 on the results of all cannabis research, including the number of patients involved, the parameters of the study and the outcomes of each participant.

Tennessee Medical Marijuana Doctors

Medical marijuana in Tennessee is all but non-existent. However, upon its signing by Tennessee Governor Bill Hallam, on May 16, 2014, Senate Bill 2531 effectively commissioned “a clinical research study on the treatment of intractable seizures when supervised by a physician practicing at a university having a college or school of medicine.”
The bill called for Tennessee Tech to cultivate cannabis, but that was basically an unworkable situation because the school relies on federal grant money — and cultivating weed remains illegal under federal law. Since the federal government was not willing to allow the university to grow weed, it chose not to participate in the program.
The study, scheduled to be conducted over four years, allows for the use of cannabidiol (CBD) cannabis oil — cannabidiol is one of many cannabinoids found in cannabis that has shown to have that contains no more than 0.9% tetrahydrocannabidiol (THC).
Furthermore, Governor Hallam effectively passed Senate Bill 280 into law, upon signing on May 05, 2015, thus permitting the medical use of CBD oil that contains no more than 0.9% THC, which may be “obtained legally in the United States and outside of Tennessee.” This means that while certain patients are allowed to possess low-THC oil, they can’t get it within Tennessee’s borders. They would have to go out of state to obtain the oil, risking a violation of federal law by transporting it over state lines.

Tennessee lawmakers practice the “no marijuana for anybody, no matter what” tactic. Therefore, it is illegal to sell, grow, use or possess even small amounts of cannabis in this state. However, a bill was recently passed which allows state universities to take part in cannabis studies.

Also phone call and read off and/or visit and hand deliver the info. You can take literature with you and approach businesses, organizations and even people on the street while you're out and about. Wear your pot-leaf shirt and register voters, as feasible. Gather signatures for any related petitions that are happening at the time as well.
This is a chain e-mail you can't refuse. Unlike most, this will actually help you - and a whole buncha others - just by passing it on.
Cannabis consumer or not - from the folks just trying to take care of themselves or a loved one to those who simply see the expensive, immoral waste of making war on the sick and dying - everyone is affected by this issue.

Tennessee Congressman Calls Federal Medical Marijuana Policy |
Congressman Steve Cohen (D-TN) wrote a letter to Drug Czar Gil Kerlikowske on Monday, urging a change to the country’s drug policy with regard to marijuana. In addition to calling the federal policy on medical marijuana “misguided,” Cohen said, “Marijuana does not belong on Schedule I of the Controlled Substances Act.”
There is no evidence that marijuana has the same addictive qualities or damaging consequences as these harder drugs and it should not be treated as such.

Next year the Tennessee state legislature may look at whether medical marijuana should be available in the state and have agreed to call on state health, agriculture and law enforcement officials to study the issue and report on it no later than February 15. Brilliant – until you learn that the committee did not approve any additional funding for the study, meaning that it will be up to the state’s Board of Pharmacy to decide whether to take up the issue.
If they do decide to move forward on this, the study could set up a debate over medical marijuana next year.

Multiple places have decriminalized non-medical cannabis in the United States; however, cannabis is illegal under federal law. Gonzales v. Raich (2005) held in a 6-3 decision that the Commerce Clause of the United States Constitution allowed the federal government to ban the use of cannabis, including medical use even if local laws allow it.
Most places that have decriminalized cannabis have civil fines, drug education, or drug treatment in place of incarceration and/or criminal charges for possession of small amounts of cannabis, or have made various cannabis offenses the lowest priority for law enforcement.

I heard someone talking about there being a law in the works to getting medical marijuana legalized. He didn't seem to know too many technical terms which would've been helpful. However, I live in TN, and I find it hard to believe that there may be considerations in this particular state. I'm very happy to hear such news, but would like to know if anyone else has heard anything about this, and when will it be on the ballot (so i make sure i dont miss out)

However, the Nashville Tennessean newspaper in an editorial did speak in favor of the bill. It's a small step.

Study committee on medical marijuana continues to work!

While Tennessee lawmakers heard testimony on medical marijuana this session, lawmakers’ adjourned with issues surrounding medical marijuana unresolved. Many of the bills brought up this year can be brought back in January when lawmakers return, since 2017 was the first part of a two-year session.
House Speaker Beth Harwell and Lt. Gov. Randy McNally ordered the formation of a committee to study the impact of medical marijuana in Tennessee. The committee will be chaired by Sen. Steve Dickerson and Rep. Jeremy Faison. The committee will meet for the first time on Thursday, September 21, and members listened and asked questions of marijuana experts. Further hearings will be scheduled in the coming months.
Hopefully, the Legislature will catch up with the vast majority of Tennesseans, 75% of whom agree that seriously ill patients should have access to medical cannabis, according to a 2014 MTSU poll. Please take a moment to encourage your legislators to pass a meaningful, inclusive medical marijuana bill that includes in-state access to medical cannabis.

Current marijuana laws in Tennessee

Marijuana, for both medical and recreational uses, is not legal in Tennessee. However, there is an exception, effected by bill SB 280, that allows the use of high-CBD, low-THC cannabis oil for seizure patients.
Possession and cultivation both remain illegal. Possession of any amount is a misdemeanor, punishable by one year in jail and up to a $2,500 fine. Cultivation of 10 plants or less is a felony, punishable by one to six years in prison and a $5,000 fine, and the penalties increase exponentially for each additional plant being grown.
Decriminalization hits roadblock

The two largest cities in Tennessee, Memphis and Nashville, both passed ordinances in 2016 that give an officer the discretion to charge someone with a civil infraction for possessing small amounts of marijuana. One of the reasons for this was that the criminal law has been enforced unequally: In 2010 in Tennessee, there were four African Americans arrested for marijuana possession for every white arrested, despite the fact that both races consume marijuana at about the same rate.
However, Gov. Bill Haslam signed a bill that repealed marijuana decriminalization laws in Nashville and Memphis. The bill said “state government law preempts local government enactments with respect to the regulation of and appropriate sanctions for conduct involving drugs and other similar substances.” This controversy highlights the need for statewide reform. Please ask your legislators to support replacing criminal penalties with civil fines for simple possession.

Tennessee slightly reduces penalties for marijuana possession

Third and subsequent convictions for the possession of marijuana used to be felonies, punishable by one to six years in prison and a fine of up to $3,000.
But in 2016, the legislature reduced that penalty to a misdemeanor, so people convicted of non-violent possession of most drugs will no longer suffer the stigma of a life-long felony record.
Timeline of marijuana policy reform in Tennessee

1981: In 1981, HB 314 created a therapeutic research program — which was operational — for cancer chemotherapy or radiology or glaucoma (marijuana or THC). The program was administered by a Patient Qualification Review Board within the Board of Pharmacy, which was authorized to contract with the federal government for marijuana.
The program was repealed by SB 1818 in 1992.
2015: Tennessee Governor Bill Haslam signed SB 280 into law, against his earlier opposition. The bill legalized the possession and use of marijuana to treat a limited number of severe conditions, including epilepsy.
The bill has no provisions for legal sale, thus requiring patients to acquire the drug outside the state of Tennessee; possession of CBD oil without proof that it was obtained legally outside of Tennessee is a misdemeanor.
2016: Tennessee tweaked its ineffective low-THC law by enacting HB 2144 on May 20, 2016.
The law provides that patients may possess CBD oils with no more than 0.9% THC if they have “a legal order or recommendation” for the oil and they or an immediate family member have been diagnosed with epilepsy by a Tennessee doctor.

Details of Tennessee Medical Marijuana Bill Revealed

Bill would give patients with over 10 qualified conditions access to cannabis medicine.
It is distinctly possible that Tennessee could see the legalization of a comprehensive medical marijuana program in 2017.
MERRY JANE reported earlier this week that state Representative Jeremy Faison and Senator Steve Dickerson, both Republicans, planned to introduce legislation in the near future aimed at giving patients with a variety of health conditions access to medical marijuana. The proposal, aptly titled the Medical Cannabis Act of 2017, was officially introduced on Wednesday.
In its current form, the bill would give patients with around 12 serious health conditions access to cannabis medicine. Those qualified conditions include, cancer, HIV/AIDS, post-traumatic stress disorder (PTSD), multiple sclerosis, painful peripheral neuropathy, intractable pain, refractory seizures, seizure disorder, spasticity, Parkinson’s disease, and cerebral palsy.
It would also authorize a 15-21 member Medical Cannabis Commission (MCC) to incorporate additional conditions into the program based on the findings of doctors and the Tennessee Higher Education Commission.
Similarly to other medical marijuana laws that have passed in 28 states across the nation, the bill would require patients to obtain a recommendation from a state-certified physician before having the ability to purchase cannabis products from any of the state’s dispensaries.
When it comes to the types of cannabis products the lawmakers are proposing be sold in these dispensaries, Faison and Dickerson have stolen a page out of some of the most successful medical cannabis programs in the country, suggesting the production and sale of smokable cannabis, edibles, topicals, and pills.
Unfortunately, the bill does not appear to come with a home cultivation provision.
Earlier this week, attorney Doak Patton, who also serves as president for the Tennessee chapter of NORML, told MERRY JANE that all the medical professionals in the state legislature support the legalization of medical marijuana. He only hopes the rest of the lawmakers, especially House Majority Leader Representative Glen Casada, will listen to science before making a decision on whether to allow the bill to be heard.

Tennessee: Will the Next Governor Support Medical Marijuana?

With five out of seven candidates tentatively supporting the legalization of medical marijuana for qualified patients, Tennessee’s voters remain optimistic regarding access to effective medical treatments as they look forward to the 2018 gubernatorial race.
Though none of the seven candidates support recreational consumption, the majority of potential governors believe Tennessee should contemplate legalizing cannabis for patients suffering from a host of debilitating health issues.
An issue that crosses the political divide, “five of the seven candidates – including three of the Republicans – say there may be circumstances under which Tennesseans ought to be allowed to possess and use marijuana,” according to Nashville Public Radio.
On the ‘Pro’ side of the medical marijuana issue, former Nashville Mayor Karl Dean (D), House Minority Leader Craig Fitzhugh (D), Randy Boyd (R), Mae Beavers (R), and House Speaker Beth Harwell (R) have cautiously issued statements of support for legalizing medicinal cannabis in Tennessee.
Simpatico with their electorate, those candidates who support medical marijuana stand the best chance of winning the highest office in the state come Nov. 6, 2018, according to a survey conducted by WKRN News.
Published on Sept. 21, a Tennessee survey has so far polled 4,268 respondents, of which 93.56 percent were supportive of legalizing medical marijuana in the state of Tennessee, and only 5.3 percent – or 229 votes – said no to legalizing the medicinal herb.

NASHVILLE, Tenn. - The Joint Committee on Medical Cannabis met for the first time Thursday to discuss what options the legislature has to legalize medical marijuana in the next session.
A panel made up of state representatives and senators listened to testimony from law enforcement, Tennessee Department of Health staff, various doctors, and experts. The committee was requested by House Speaker Beth Harwell, among other lawmakers, like state representative Jeremy Faison.
"I feel like it's the same arguments that we've heard historically. I feel like the deeper we get into this over the next couple of months, the arguments have no foundation," said Faison. "When it comes just to the strict use of the medical grade cannabis, it's a great benefit all the way around for the state."

NASHVILLE, Tenn.(WKRN) – Supporters of Tennessee medical marijuana have always said it would take baby steps to make it legal here, but the first of its kind task force could speed up the process.
The task force to study the issue was set up last month by two Republican legislative leaders and it will have its initial meeting on Sept 21st.
Supporters seem to be right that year after year, little by little more lawmakers seem at least more open minded about medical cannabis which of course is better known as medical marijuana.
Case in point is Senate Republican Caucus Chair Bill Ketron.
“I was always a ‘Hell no!’ but I am willing to listen when the issue comes back up in January,” he told News 2.
The senator recently beat cancer with radiation and a stem cell transplant. But the drugs left him, like other patients, with nausea and not wanting to eat.
He’s a firm no on recreational use of marijuana, but not on its medical use.
“Some medical doctors told me cannabis helps with the appetite,” said the Senator.
“And it really helps with the nausea. I am just open minded at this point.”
East Tennessee Republican Jeremy Faison who will co-chair chair the upcoming medical cannabis task force has gone from open minded, to full-fledged support.
The key for him was a call from his pastor.
“He said my nephew has this rare disease and we are trying to get to Colorado because nothing else will work,” Rep. Faison told News2 last session.

The possibility of Tennessee medical marijuana legalization has been given new hope with a recent announcement from state lawmakers.
On Aug. 25, 2017, Tennessee Lt. Gov. Randy McNally and State House Speaker Beth Harwell penned a letter to the chief clerks in the Senate and House of Representatives announcing the creation of the Joint Ad Hoc Committee on Medical Cannabis, as reported by WKRN.
According to the letter, “This committee is hereby authorized and directed to study, evaluate, analyze, and undertake a comprehensive review regarding whether the legalization of cannabis for medicinal purposes is in the best interest of the state.”
The 10-member committee is comprised of Sen. Steve Dickerson, R-Nashville; Rep. Jeremy Faison, R-Cosby; Sen. Richard Briggs, R-Knoxville; Sen. Jeff Yarbro, D-Nashville; Sen. Joey Hensley, R-Hohenwald; Sen. Rusty Crowe, R-Johnson City; Rep. Bob Ramsey, R-Maryville; Rep. Raumesh Akbari, D-Memphis; Rep. Sheila Butt, R-Columbia; and Rep. Sam Whitson, R-Franklin.
Tennessee medical marijuana legalization had been given a chance this past March, but the issue was tabled due to lack of support in the Senate.
The State House Speaker has indicated that a personal situation has caused her to reconsider medical marijuana. Harwell’s sister, a resident of Colorado, broke her back in a yoga accident and was able to get off of opioids by transitioning to medical marijuana, as reported by U.S. News.
According to a poll by Tennesseans for Conservative Action, 52% of conservatives in the state support Tennessee medical marijuana legalization.

A special joint committee of the Tennessee General Assembly will study legalizing marijuana for medical use, legislative leaders announced Friday.
Lt. Gov. Randy McNally and Speaker of the House Beth Harwell appointed members to the Joint Ad Hoc Committee on Medical Cannabis, co-chaired by Sen. Steve Dickerson, a Nashville Republican, and Rep. The Dickerson-Faison billed died because "bless their heart" the Senate was "scared" of passing the bill, according to Faison.

Two of Tennessee’s most prominent public officials are calling for the legislature to study how legalized medical marijuana might impact the state.
Only months after a MMJ bill died in the legislature, Lt. Gov. Randy McNally and House Speaker Beth Harwell are setting up the Joint Ad Hoc Committee on Medical Cannabis, The Tennessean reported.
In a letter announcing the creation of the committee, McNally and Harwell mandated that its members “study, evaluate, analyze and undertake a comprehensive review regarding whether the legalization of cannabis for medicinal purposes is in the best interest of the state.”
Sen. Steve Dickerson and Rep. Jeremy Faison – who introduced an MMJ bill last December that stalled in the Senate – will chair the medical cannabis committee, according to the newspaper. Both are Republicans.
The Senate will be represented on the panel by Republicans Richard Briggs, Rusty Crowe and Joey Hensley and Democrat Jeff Yarbro; Representatives on the panel are Republicans Sheila Butt, Bob Ramsey and Sam Whitson and Democrat Raumesh Akbari.

Harwell, who is speaker of the state House of Representatives, told a Republican gathering earlier this month that allowing medical marijuana has come up as part of a discussion about how to tackle the state’s opioid crisis.
The longtime Nashville representative said her sister was recently prescribed opioids after breaking her back.
“She was in a yoga class and came down out of a shoulder stand the wrong way,” Harwell said. “And she was, of course, in a great deal of pain.”
But after the initial doses, she wanted to stop taking the painkillers.
“She called me and said, ‘I want you to know that if I continue this opioid regimen I will become addicted to opioids,'” Harwell said. “She said, ‘There was no doubt in my mind.'”
Harwell’s sister lives in Colorado where marijuana has been legalized, so she decided to send her husband out to buy her some of the drug, which she consumed mixed with coconut oil for four or five days until she felt better.
“So I have some personal interest in this now,” Harwell said.

Harwell, who is speaker of the state House of Representatives, told a Republican gathering earlier this month that allowing medical marijuana has come up as part of a discussion about how to tackle the state's opioid crisis.
The longtime Nashville representative said her sister was recently prescribed opioids after breaking her back.
"She was in a yoga class and came down out of a shoulder stand the wrong way," Harwell said. "And she was, of course, in a great deal of pain."
Harwell said she still opposes the legalization of recreational marijuana, citing her experience visiting her daughter when she attended the University of Colorado in Boulder.
"If you visit Boulder, you won't be for the recreational use of marijuana," she said.
Harwell earlier this year formed a House task force to work on proposals to address opioid and prescription drug abuse in Tennessee. She said the panel will evaluate medical marijuana as part of that process.
"We're open to that, we're looking at that," said Harwell, though she cautioned that the Republican group of state lawmakers remains wary about the issue.
Harwell is running for the Republican nomination to succeed term-limited Gov. Bill Haslam. Her Republican rivals include state Sen. Mae Beavers of Mt. Juliet, U.S. Rep. Diane Black, and businessmen Randy Boyd of Knoxville and Bill Lee of Franklin.
The state's gubernatorial primary will be held on Aug. 2, 2018.

Tennessee to Consider Medical Marijuana in 2017

(December 12, 2016 ) Although there has been a significant amount of bipartisan support over the past couple of years for reforms related to the legalization of medical marijuana, it has not been enough to put the state on a progressive path to joining the 28 others that have turned this concept into a reality. So far, Tennessee’s brass has only been receptive to passing an ultra-restrictive CBD oil program that has so far only severed a select few seizure patients.
However, Faison recently set out on a fact-finding mission in Colorado because so many patients and their families were being forced to uproot their Tennessee homes and move to more marijuana-friendly ground. The scope of the state’s current medical marijuana law simply does not come with enough reach to truly benefit the majority of those patients living with some of the most debilitating health conditions.
Earlier this year, Faison told NBC affiliate WBIR that he has completely changed his tune with respect to marijuana and was in the midst of planning a push for a more comprehensive program in the upcoming session.
“I thought marijuana use was basically for potheads and over the last few years I have evolved, and this is what I’ve come to believe, this plant is really God’s hope,” Faison told WBIR. “Just because someone might pervert the use of this, doesn’t make me scared to give it to someone who could use it. I see the benefits greatly outweigh the negative.”

(WMC-TV) - A proposal to legalize medical marijuana is once again advancing in the Tennessee House.
A companion bill is scheduled for a hearing in the Senate Government Operations Committee. The House Health Subcommittee approved the measure on a voice vote Tuesday.
A previous proposal to legalize medical marijuana made it through Tennessee House committees two years ago, but did not fare well in the Senate. The sponsor of the latest bill, 89th District Representative Jeanne Richardson, thinks her bill might just pass.
"Medical cannabis is becoming more generally accepted in our society," said Richardson.

NASHVILLE, TN — A Tennessee bill that would have legalized medical marijuana died following testimony before a key House committee on Wednesday, despite testimony from supporters that the legislation would benefit hundreds of chronically ill people and generate roughly an added $34 million for the state.
State Representative Jeanne Richardson (D-Memphis), sponsor of the Safe Access to Medical Cannabis Act, withdrew the bill after testimony on behalf of the legislation in the House Health and Human Resources Committee. The hearing capped a surprising week for the bill, set in motion by an unexpected vote in its favor in a Republican-led subcommittee last week.

But the editorial board at The Tennessean (motto: "Pandering to generations of middle Tennessee's cranks and wingnuts!") can usually be counted upon to make the occasional salient point, even when it invites accusations of "liberal bias" from the Red Staters who write in to complain.

Tennessee medical marijuana bill clears first House hurdle,
by Andy Sher | NASHVILLE — A bill legalizing the use of medical marijuana as prescribed by doctors emerged out of the House Health and Human Resources Committee today on a voice vote.
The bill’s sponsor, Rep. Jeanne Richardson, D-Memphis, said the bill would allow doctors to prescribe marijuana to cancer and other patients.
It creates a licensure and enrollment program for the production, distribution and dispensing of marijuana for a qualifying medical condition. The measure also authorizes a person with a qualifying medical condition to enroll in a “safe access” program in which the patient can receive a prescription from a licensed practitioner for marijuana and receive the product from a licensed pharmacist at a participating pharmacy.
Rep. Joey Hensley, R-Hohenwald, a physician, opposed the measure, saying “we’re not really trained to prescribe cannabis” and doctors “don’t know how much is needed” to relieve pain or nausea. ... Visit:

It is estimated that 25,000 Tennesseans use marijuana to deal with chronic conditions or the side effects of diseases such as cancer, AIDS and multiple sclerosis. Currently, of course, their use of the drug is illegal and Ellis’ bill is designed to bring these users the reassurance of knowing they will not be prosecuted for using their medication of choice.
Skeptics are not convinced, however, saying there has not been enough research on medicinal uses of weed.
Family medic, Rep Joey Hensley, said “We don’t know how to prescribe it. We don’t know what doses any problem needs. Any other drug, we have a certain dose, a certain time to use it, a certain way to use it. There’s just a lot of issues with marijuana I see as a physician who’s prescribing other medications.”
The study was agreed as a compromise.
Given such resistance, supporters of medical marijuana have abandoned their plans to pass legislation legalizing it in favor of the study group led by the Board of Pharmacy. Among others, this board would include representatives from the Board of Medical Examiners, the Tennessee Bureau of Investigation, the Tennessee Sheriffs’ Association and the Department of Agriculture.

Tennessee Medical Marijuana Bill Advances

NASHVILLE, TN — A proposal to legalize medical marijuana has advanced in the Tennessee House, passing a House Health subcommittee hearing Tuesday on a voice vote. It now goes before the whole House Health Committee and must clear other panels before going to the House floor for a vote.
A similar bill filed in the Senate is scheduled for a hearing in the Senate Government Operations Committee, but no hearing date has been set.
House Bill 294, and its companion measure Senate Bill 251, would allow patients with specified diseases or conditions to use medical marijuana and would set up a state-regulated and -licensed distribution system.
A previous proposal to legalize medical marijuana made it through Tennessee House committees two years ago, but died in the Senate. Rep. Jeanne Richardson (D-Memphis), sponsor of HB 294, thinks her bill has a good chance of passing this year due to increased acceptance and usage of medical cannabis across the country.

1. Since 1996, twelve states have legalized medical marijuana use: AK, CA, CO, HI, ME, MT, NV, NM, OR, RI, VT, and WA. Eight of the twelve did so through the initiative process. Hawaii's law was enacted by the legislature and signed by the governor in 2000, Vermont's was enacted by the legislature and passed into law without the governor's signature in May 2004, Rhode Island's was passed into law over the governor's veto in January 2006, and New Mexico's legislation was signed into law by Governor Bill Richardson on April 2, 2007.
