Rhode Island - Marijuana decriminalization heard in committee State Legislative and Statewide > Rhode Island - Marijuana Legalization Legislation Held for Study in House, Still Pending in Senate | The House Judiciary Committee voted to hold House Bill 5274, which sought to make Rhode Island the third state to legalize and regulate the adult use of marijuana, for study. Making further action on it during this legislative session unlikely. Companion legislation introduced by State Senator Donna Nesselbush, Senate Bill 334, is still pending in the Senate Judiciary Committee. State lawmakers last year approved legislation decriminalizing marijuana possession offenses for those age 18 or older. That measure takes effect on April 1, 2013. It is important that elected officials know that their constituents will continue to support them if they vote for positive marijuana policy. Also, please make sure your friends and family are aware of this proposal so they can support marijuana decriminalization as well.   >> Act Now! <<

Status of Medical Marijuana (Cannabis) in Rhode Island.

Rhode Island has a MEDICAL MARIJUANA (cannabis) LAW

SUMMARY: The Edward O. Hawkins and Thomas C. Slater Medical Marijuana Act took effect immediately upon passage on January 3, 2006. The law removes state-level criminal penalties on the use, possession and cultivation of marijuana by patients who possess "written certification" from their physician stating, "In the practitioner's professional opinion, the potential benefits of the medical use of marijuana would likely outweigh the health risks for the qualifying patient." Patients diagnosed with the following illnesses are afforded legal protection under this act. Patients (and/or their primary caregivers) may legally possess 2.5 ounces of cannabis and/or 12 plants, and their cannabis must be stored in an indoor facility. The law establishes a mandatory, confidential state-run patient registry that issues identification cards to qualifying patients. Patients who do not register with the Department of Health, but have received certification from their physician to use medicinal cannabis, may raise an affirmative defense at trial.  

Approved Conditions:   Cancer, glaucoma, positive status for HIV/AIDS, Hepatitis C, or the treatment of these conditions; A chronic or debilitating disease or medical condition or its treatment that produces cachexia or wasting syndrome; severe, debilitating, chronic pain; severe nausea; seizures, including but not limited to, those characteristic of epilepsy; or severe and persistent muscle spasms, including but not limited to, those characteristic of multiple sclerosis or Crohn’s disease; or agitation of Alzheimer's Disease; or any other medical condition or its treatment approved by the state Department of Health. If you have a medical marijuana registry identification card from any other state, U.S. territory, or the District of Columbia you may use it in Rhode Island. It has the same force and effect as a card issued by the Rhode Island Department of Health.

Possession/Cultivation: Limits the amount of marijuana that can be possessed and grown to up to 12 marijuana plants or 2.5 ounces of cultivated marijuana. Primary caregivers may not possess an amount of marijuana in excess of 24 marijuana plants and five ounces of usable marijuana for qualifying patients to whom he or she is connected through the Department's registration process.

AMENDMENT(s):   Yes

    Amended: H5359 (70 KB) - The Edward O. Hawkins and Thomas C. Slater Medical Marijuana Act (substituted for the original bill) Effective June 16, 2009: Allows the creation of compassion centers, which may acquire, possess, cultivate, manufacture, deliver, transfer, transport, supply, or dispense marijuana, or related supplies and educational materials, to registered qualifying patients and their registered primary caregivers. The first dispensary, the Thomas C. Slater Compassion Center, opened on Apr. 19, 2013.

    Update(s): N / A In 2009, lawmakers enacted legislation authorizing the establishment of state-licensed not-for-profit 'compassion centers' to "acquire, possess, cultivate, manufacture, deliver, transfer, transport, supply or dispense marijuana, or related supplies and educational materials, to registered qualifying patients and their registered primary caregivers." However, in October 2011, Gov. Lincoln Chafee announced that he was suspending the licensing system indefinitely, stating: "I have decided that the State of Rhode Island cannot proceed with the licensing and regulation of medical marijuana compassion centers under current law. ... I have received communications from both the United States Department of Justice and from the United States Attorney for the District of Rhode Island that large scale commercial operations such as Rhode Island's compassion centers will be potential targets of 'vigorous' criminal and civil enforcement efforts by the federal government.

    Amended: In 2010, lawmakers enacted legislation, House Bill 8172, ensuring the confidentiality of medical marijuana patients' records.

    Amended: On Tuesday, May 22, 2012, Gov. Lincoln Chafee signed legislation, SB 2555, into law authorizing state regulators to license three small-scale 'compassion centers.' Under the law, compassion centers will not be allowed to cultivate more than 150 cannabis plants on the premises at any one time, only 99 of which may be mature. Centers will also be restricted to possessing no more than 1,500 ounces of usable product at any one time.

MEDICAL MARIJUANA STATUTES: The Edward O. Hawkins and Thomas C. Slater Medical Marijuana Act, R.I. Gen. Laws § 21-28.6 (2006).

CAREGIVERS: Yes. The caregiver must be 21 years of age or older. Primary caregiver may assist no more than 5 qualifying patients with their medical use of marijuana. R.I. Gen. Laws 1956, §21-28.6-3 (9) (2006).

RECIPROCITY:   Accepts other states' registry ID cards? - Yes, but only for the conditions approved in Rhode Island. Authorizes a patient with a debilitating medical condition, with a registry identification card (or its equivalent), to engage in the medical use of marijuana. Also authorizes a person to assist with the medical use of marijuana by a patient with a debilitating medical condition. R.I. Gen. Laws § 21-28.6-4(k) (2006).

Rhode Island - Resource, Org; local The Rhode Island General Assembly directed the Department of Health to create a medical marijuana program (MMP). The "Edward O. Hawkins and Thomas C. Slater Medical Marijuana Act" was enacted on January 3, 2006 (Public Laws 05-442 and 05-443. The MMP will permit persons with debilitating medical condition(s) to use marijuana if a physician certifies in writing that the marijuana may mitigate the symptoms of the condition(s) and that the potential benefits of using medical marijuana would likely outweigh the health risks to the patients. Gonzales v. House Judiciary Committee considers regulating marijuana like alcohol - Last Update: April 16, 2014 | On Wednesday, April 16, the Rhode Island House Judiciary Committee took testimony on H 7506, legislation sponsored by Rep. Edith Ajello and 28 of her House colleagues that would legalize, regulate, and tax marijuana similarly to alcohol. If you are a resident of the Ocean State, please email your state representative and senator today and ask them to support this legislation!   The Marijuana Regulation, Control, and Taxation Act is similar to the laws in Colorado and Washington. The proposal would allow individuals 21 and older to possess and cultivate limited amounts of marijuana. It would also direct the Department of Revenue to license and regulate marijuana producers and 10 retail marijuana stores. This sensible approach to marijuana would create new industries with new jobs and raise needed revenue for the state. The legislature and Gov. Lincoln Chafee removed the threat of jail time for simple possession of marijuana and revised the state’s medical marijuana law to ensure full implementation of the medical marijuana dispensary program.

In June 2012, Gov. Chafee signed legislation to replace the criminal penalties for adults’ possession of up to an ounce of marijuana with a civil violation of $150 for most violations! S2253/H7092 was sponsored by Sen. Josh Miller and Rep. John Edwards and went into effect on April 1, 2013. MPP worked with an outstanding group of advocates in Providence, and we are grateful to everyone who made the victory possible.   Among the many positive outcomes, this victory will help ease the effects of disturbing racial disparities in marijuana-related policing. According to the ACLU, in 2010, African Americans in Rhode Island were 2.6 times more likely to be arrested for marijuana possession than their white neighbors.

In May 2012, a full year after halting implementation of the compassion center program citing fears of federal interference, Rhode Island Gov. Chafee signed legislation that was written to alleviate his concerns and to finally get the compassion centers open. The revised law allows patients and caregivers to sell any excess medical marijuana they have directly to the compassion centers. Rhode Island, News - BILL WOULD LICENSE DISPENSARIES TO SELL MEDICAL MARIJUANA BILL WOULD LICENSE DISPENSARIES TO SELL MEDICAL MARIJUANA PROVIDENCE -- For Bobby Ebert, the legalization of medical marijuana in Rhode Island didn't just bring relief, it brought a slew of unwanted anxieties.

State law allows the Warwick HIV patient to use the drug to alleviate his chronic pain -- but it offers him no place to buy it legally. So Ebert did what many of Rhode Island's medical marijuana patients do. Frail and in pain, he made his way from his suburban apartment to the streets of Providence in search of a drug dealer. The first time he went, he was robbed.

Ebert's problem is not unique. Since Rhode Island permanently legalized the use of medical marijuana two years ago for those suffering from chronic and painful illnesses, it has provided no legal access to the drug, leaving most patients no option but to buy it on the street, or enlist a caregiver to grow it for them. Now Rep. Thomas C. Slater and Sen. Rhoda E. Perry, the Providence legislators who sponsored the original marijuana bill, have proposed allowing licensed dispensaries or "compassion centers" which would grow and sell the drug at affordable prices to the 600 patients now enrolled in the state's program.

"Licensing a nonprofit compassion center would solve the problems by allowing a safe, state-regulated place for patients to get their medicine," Slater said. A similar bill was approved by the Senate last year, only to die in a House committee. The governor later vetoed a compromise plan to study the concept.

But a year can make a big difference. Last session, lawmakers cited concerns about a spate of federal raids on dispensaries in California, one of the few other states besides Colorado and Rhode Island that legalize sales. Could Rhode Island clinics face similar problems? Last week, however, U.S. Attorney General Eric Holder publicly indicated that the Obama administration will no longer tolerate such raids.

Joseph McNamara, D-Warwick, chairman of the House Committee on Health Education and Welfare , said that development, along with language in this year's bill pledging security measures at the centers, have made him view the proposal "much more favorably" than he did last year. "The questions I had have been answered and I'm pleased the federal government has made a commitment not to come in and arrest these very vulnerable individuals," McNamara said after a hearing on the bill last night.

Massachusetts voters in November approved a ballot initiative to decriminalize the possession of small amounts of marijuana, a move some say shows an increased public tolerance. No one testified in opposition of the House bill last night, and the Health Department said it is not taking a position. (Last year the department opposed it.) But several committee members signaled lingering concerns, questioning the logistics of how the centers would be run and how they would be received in neighborhoods.

No vote was taken in that hearing, or in a simultaneous one in a Senate committee. For Bobby Ebert and the dozens of other fragile patients who filled the committee rooms yesterday, the generally positive reaction brought a new sense of relief. "Depending on how my body is feeling, every inch hurts," said Daniel Rivera, 37, of East Providence, who suffers from fibromyalgia and chronic pain syndrome. "So trying to get by without this medical marijuana or not being able to find a place to get it is a very scary position to be in."

The votes override an earlier veto from the state’s Republican governor, who sought to close the statewide program. Under the state’s law, known as the Edward O. Hawkins and Thomas C. At that time, the White House drug policy office declared "the end of medical marijuana as a political issue." The House overrode a veto by Gov. Don Carcieri, 59-13, allowing people with illnesses such as cancer and AIDS to grow up to 12 marijuana plants or buy 2.5 ounces of marijuana to relieve their symptoms.
