MPP, a partner in the Regulate Rhode Island coalition, worked closely with Motif Magazine to survey candidates for state representative and state senator regarding their positions on marijuana policy. Hawkins and Thomas C. Slater Medical Marijuana Act took effect immediately upon passage on January 3, 2006. The law removes state-level criminal penalties on the use, possession and cultivation of marijuana by patients who possess "written certification" from their physician stating, "In the practitioner's professional opinion, the potential benefits of the medical use of marijuana would likely outweigh the health risks for the qualifying patient." Patients diagnosed with the following illnesses are afforded legal protection under this act. Patients (and/or their primary caregivers) may legally possess 2.5 ounces of cannabis and/or 12 plants, and their cannabis must be stored in an indoor facility. The law establishes a mandatory, confidential state-run patient registry that issues identification cards to qualifying patients. Patients who do not register with the Department of Health, but have received certification from their physician to use medicinal cannabis, may raise an affirmative defense at trial.   Approved Conditions:   Cancer, glaucoma, positive status for HIV/AIDS, Hepatitis C, or the treatment of these conditions; A chronic or debilitating disease or medical condition or its treatment that produces cachexia or wasting syndrome; severe, debilitating, chronic pain; severe nausea; seizures, including but not limited to, those characteristic of epilepsy; or severe and persistent muscle spasms, including but not limited to, those characteristic of multiple sclerosis or Crohn’s disease; or agitation of Alzheimer's Disease; or any other medical condition or its treatment approved by the state Department of Health. If you have a medical marijuana registry identification card from any other state, U.S. territory, or the District of Columbia you may use it in Rhode Island. It has the same force and effect as a card issued by the Rhode Island Department of Health. Possession/Cultivation: Limits the amount of marijuana that can be possessed and grown to up to 12 marijuana plants or 2.5 ounces of cultivated marijuana. Primary caregivers may not possess an amount of marijuana in excess of 24 marijuana plants and five ounces of usable marijuana for qualifying patients to whom he or she is connected through the Department's registration process. PATIENT POSSESSION LIMITS: Two and one-half ounces HOME CULTIVATION: Yes, up to 12 plants and 12 seedlings. Must be stored in an indoor facility. Two or more cardholders may cooperatively cultivate marijuana in residential or non-residential locations subject to the following restrictions: Non-residential - no more than 10 ounces of usable marijuana, 48 mature marijuana plants, and 24 seedlings. Residential - no more than 10 ounces of useable marijuana, 24 mature marijuana plants, and 12 seedlings. AMENDMENT(s):   Yes Amended: H5359 (70 KB) - The Edward O. Hawkins and Thomas C. Slater Medical Marijuana Act (substituted for the original bill) Effective June 16, 2009: Allows the creation of compassion centers, which may acquire, possess, cultivate, manufacture, deliver, transfer, transport, supply, or dispense marijuana, or related supplies and educational materials, to registered qualifying patients and their registered primary caregivers. The first dispensary, the Thomas C. Slater Compassion Center, opened on Apr. 19, 2013. Update(s): N / A In 2009, lawmakers enacted legislation authorizing the establishment of state-licensed not-for-profit 'compassion centers' to "acquire, possess, cultivate, manufacture, deliver, transfer, transport, supply or dispense marijuana, or related supplies and educational materials, to registered qualifying patients and their registered primary caregivers." However, in October 2011, Gov. Lincoln Chafee announced that he was suspending the licensing system indefinitely, stating: "I have decided that the State of Rhode Island cannot proceed with the licensing and regulation of medical marijuana compassion centers under current law. ... I have received communications from both the United States Department of Justice and from the United States Attorney for the District of Rhode Island that large scale commercial operations such as Rhode Island's compassion centers will be potential targets of 'vigorous' criminal and civil enforcement efforts by the federal government. Amended: In 2010, lawmakers enacted legislation, House Bill 8172, ensuring the confidentiality of medical marijuana patients' records. Amended: On Tuesday, May 22, 2012, Gov. Lincoln Chafee signed legislation, SB 2555, into law authorizing state regulators to license three small-scale 'compassion centers.' Under the law, compassion centers will not be allowed to cultivate more than 150 cannabis plants on the premises at any one time, only 99 of which may be mature. In 2012, an MPP-led lobbying effort culminated in passage of a law that reduced the penalty for possessing up to an ounce of marijuana to a $150 civil fine. State law allows the Warwick HIV patient to use the drug to alleviate his chronic pain -- but it offers him no place to buy it legally. So Ebert did what many of Rhode Island's medical marijuana patients do. Frail and in pain, he made his way from his suburban apartment to the streets of Providence in search of a drug dealer. The first time he went, he was robbed. Ebert's problem is not unique. Since Rhode Island permanently legalized the use of medical marijuana two years ago for those suffering from chronic and painful illnesses, it has provided no legal access to the drug, leaving most patients no option but to buy it on the street, or enlist a caregiver to grow it for them. Now Rep. Thomas C. Slater and Sen. Rhoda E. Perry, the Providence legislators who sponsored the original marijuana bill, have proposed allowing licensed dispensaries or "compassion centers" which would grow and sell the drug at affordable prices to the 600 patients now enrolled in the state's program. "Licensing a nonprofit compassion center would solve the problems by allowing a safe, state-regulated place for patients to get their medicine," Slater said. A similar bill was approved by the Senate last year, only to die in a House committee. The governor later vetoed a compromise plan to study the concept. But a year can make a big difference. Last session, lawmakers cited concerns about a spate of federal raids on dispensaries in California, one of the few other states besides Colorado and Rhode Island that legalize sales. Could Rhode Island clinics face similar problems? Last week, however, U.S. Attorney General Eric Holder publicly indicated that the Obama administration will no longer tolerate such raids. Joseph McNamara, D-Warwick, chairman of the House Committee on Health Education and Welfare , said that development, along with language in this year's bill pledging security measures at the centers, have made him view the proposal "much more favorably" than he did last year. "The questions I had have been answered and I'm pleased the federal government has made a commitment not to come in and arrest these very vulnerable individuals," McNamara said after a hearing on the bill last night. Massachusetts voters in November approved a ballot initiative to decriminalize the possession of small amounts of marijuana, a move some say shows an increased public tolerance. No one testified in opposition of the House bill last night, and the Health Department said it is not taking a position. (Last year the department opposed it.) But several committee members signaled lingering concerns, questioning the logistics of how the centers would be run and how they would be received in neighborhoods. No vote was taken in that hearing, or in a simultaneous one in a Senate committee. For Bobby Ebert and the dozens of other fragile patients who filled the committee rooms yesterday, the generally positive reaction brought a new sense of relief. "Depending on how my body is feeling, every inch hurts," said Daniel Rivera, 37, of East Providence, who suffers from fibromyalgia and chronic pain syndrome.
