WIN: Columbia, Mo. - Columbia Medical Marijuana Initiative.
At press time, the Missouri Medical Marijuana Initiative was ahead in incomplete returns. Columbia's ballot initiative revises the city criminal code so that medical marijuana patients are not subject to "any arrest, prosecution, punishment or sanction."
While it sets out specific illnesses that qualify for medical marijuana use, it also says any other serious condition for which a doctor has recommended cannabis is appropriate under the law. The Medical Marijuana Initiative also requires that all medical marijuana cases be referred only to the local prosecuting attorney and no other prosecutor.

Places that have decriminalized non-medical cannabis in the United States -
From Wikipedia, the free encyclopedia |
Multiple places have decriminalized non-medical cannabis in the United States; however, cannabis is illegal under federal law. Gonzales v. Raich (2005) held in a 6-3 decision that the Commerce Clause of the United States Constitution allowed the federal government to ban the use of cannabis, including medical use even if local laws allow it.
Most places that have decriminalized cannabis have civil fines, drug education, or drug treatment in place of incarceration and/or criminal charges for possession of small amounts of cannabis, or have made various cannabis offenses the lowest priority for law enforcement.

Cannabis Law Reform Efforts Under Way in Springfield
Medical Marijuana Legislation Introduced
| Representative Mike Colona (D-District 67) has introduced legislation, House Bill 688, to protect patients who engage in physician authorized marijuana therapy.
House Bill 688 would allow patients with a physician's recommendation to possess up to one ounce of usable marijuana and grow up to three mature and four immature marijuana plants. HB 688 also authorizes the state to license nonprofit compassion centers to distribute medicine to qualified patients. You can read the full text of the measure >> here

According to a December 2012 CBS News nationwide telephone poll of 1,100 adults, 83 percent of Americans favor allowing doctors to authorize specified amounts of marijuana for patients suffering from serious illnesses.

Industrial Hemp Legislation Heard by Senate
| Legislation to legalize the licensed cultivation of industrial hemp, Senate Bill 358, has received a hearing and awaits action by the Missouri Senate General Laws Committee. You can read the full text of this measure >> here
<<
The United States is the only developed nation that fails to cultivate industrial hemp as an economic crop, according to a 2005 Congressional Resource Service (CRS) report. Hemp is a distinct variety of the plant species cannabis sativa that contains only minute (less than 1%) amounts of tetrahydrocannabinol (THC), the primary psychoactive ingredient in marijuana.
Farmers worldwide grow hemp commercially for fiber, seed, and oil for use in a variety of industrial and consumer products, including food and clothing. Senate Bill 358 would allow Missouri to authorize a licensed, statewide hemp industry.

Marijuana Decriminalization Measure Introduced
| Legislation that seeks to significantly reduce marijuana possession penalties has been introduced in the Missouri legislature. Representatives Rory Ellinger (D-University City) and Chris Kelly (D-Columbia) have introduced legislation, House Bill 512, to decriminalize marijuana penalties for adults who possess up to thirty five grams of marijuana.
Under present law, the possession of up to thirty five grams of cannabis is classified as a Class A criminal misdemeanor, publishable by up to a year in jail and a $1000 fine. This proposal seeks to make minor marijuana offenses a fine-only, non-criminal infraction, punishable by a maximum fine of $250. Doing so would significantly reduce state prosecutorial costs and allow law enforcement resources to be refocused on other, more serious criminal offenses. You can read the full text of this proposal

Medical marijuana initiative will not appear on November’s ballot
-
Last update: October 6, 2016
|
Unfortunately, after months of signature collection and hours of courtroom testimony, the decision is in: Missouri voters will not get to vote on establishing a medical marijuana program for the state this November. The Marijuana Policy Project extends its condolences to the thousands of families throughout the state that will continue to suffer from lack of access to this important medical treatment option.
The Secretary of State’s office originally ruled that the initiative fell short by about 2,200 signatures in one congressional district. Sponsors took that determination to court arguing that certain errors made in the signing of the petition should not invalidate the will of the voters. While the court agreed with the campaign on that point, it still ruled the initiative fell short by 23 signatures, a heartbreaking near miss for volunteers that worked tremendously hard to present this question to the voters.

Lawmakers consider legalizing and regulating marijuana
|
During the 2016 legislative session, which adjourned in May, several Missouri lawmakers filed legislation to reform the state’s marijuana laws. Among them was Rep. Brandon Ellington’s HJR 57, which sought to regulate marijuana like alcohol for persons 21 years of age and older.
While the bill did not pass, it helped foster a long-overdue conversation about whether Missouri should continue criminalizing a substance that is safer than alcohol. Please let your lawmakers know you think it is time for a more sensible approach.

Simple possession will no longer carry jail time as of January 1
|
In 2014, lawmakers enacted SB 491, which reduces penalties for those possessing up to 10 grams of marijuana, beginning on January 1, 2017. A first offense will be punishable as a class D misdemeanor (an infraction), and will carry a fine of $250-$1,000 with no jail time.
While this is better than the current penalty, a $250 fine is out of reach for some Missourians. The state still has a long way to go to treat marijuana consumers fairly. Possession of over 35 grams — about 1.25 ounces — is a felony subject to a prison sentence of up to seven years and a $5,000 fine.
In perhaps the most outrageous marijuana sentence in the state, Missourian Jeffrey Mizanskey was until recently serving a life sentence for nonviolent cannabis-related offenses under a severe three-strikes law. Gov. Nixon commuted Mizanskey’s sentence in May 2015, and his parole was subsequently granted. On September 1, 2015, Mizanskey was freed after serving 21 years in prison!
Several thousand of Missourians are arrested and branded criminals each year for marijuana offenses. In 2012, Missouri arrested or cited over 18,800 individuals for marijuana-related offenses, 92% of which were for possession. During the same year, 87% of reported burglaries — including home invasions — and 88% of motor vehicle thefts went unsolved by law enforcement.
In addition to marijuana prohibition diverting police from more serious crime, it’s also been unevenly enforced among races. Blacks are 2.6 times more likely to be arrested for marijuana possession in Missouri than their white counterparts, even though blacks and whites consume marijuana at similar rates.
For more information on how the war on marijuana consumers is often waged unequally, check out the ACLU’s report.

Verizon Wireless Amphitheater Afraid of Pot Reform? Show-Me Cannabis Says It Was Denied
Show-Me Cannabis, Missouri's marijuana reform advocacy group, has been spreading the word across the state about the need for more sensible pot policies -- and eventually hopes to push for legalization. Next week, the group was supposed to run a booth at Pointfest, 105.7 the Point's annual festival, but yesterday announced that Verizon Wireless Amphitheater had rejected its application.
Why? The managers reportedly were worried about having marijuana advocacy take place at their venue.

Springfield, Mo., Doctor Opening Marijuana Clinic in Washington State, Pushes Same For Missouri -
By KSPR News, Jan 18, 2010
|
A Springfield doctor plans to open a medical marijuana clinic in Seattle, Wash. He and his Springfield staff plan to set up appointments for Washington state clients from his clinic on Division Street.
Dr. Gil Mobley says he would like to do the same for Missouri patients. A new Missouri house bill could make that goal a reality.
Mobley says he used marijuana before he became a doctor but does not anymore. He says he’s decided he wants to a pioneer for pot -- specifically, medical marijuana.
"I think it is profoundly immoral to make prisoners and criminals of patients using marijuana for medical purposes,” Mobley said. “It has been proven to the nth degree to be safe."
"In Washington, there is room for someone to carry the banner and say there is a right way to do this," Mobley said. “I'm a licensed physician in Washington. It's a beautiful state and I enjoy the progressive nature."
Soon the state may be progressive enough to make marijuana legal for anyone 21 years or older.
Mobley testified at Washington hearings for two controversial marijuana bills. One would legalize marijuana for those 21 and older, and regulate it like alcohol. Another would decriminalize possession of small amounts of pot for adults.
Mobley testified that marijuana is not addictive. Many attending the hearings disagreed. Others questioned if legalization and taxation could aid tight government budgets.
“You know it's nonsense, just nonsense," Don Pierce of the Washington Association of Sheriffs and Police Chiefs said about benefits to law enforcement budgets.
Washington’s governor pointed out federal law trumps state law."I don't know how you generate any money when federal law makes it illegal,” Christine Gregoire said. “I've already been to the U.S. attorney who says they will continue to enforce federal law."
In the more conservative Ozarks, Mobley's staff will set appointments for his Washington medical marijuana clinic. He wants to open on March 1.
"From cancer patients going through chemo and radiation, to AIDS and hepatitis C, they have terrible nausea and vomiting and often have failure on traditional medicine," Mobley said.
Mobley says every patient he'll recommend must bring written documentation from a qualified doctor that proves they have a terminal or debilitating medical condition. He says he also wants each patient to have used marijuana before.
"There's no way a doctor would approve smoking marijuana but there are other ways to dose it,” Mobley said. “The most recommended is to use a vaporizer. You vaporize the THC to harmless water vapor."
Mobley would like to recommend the same treatment in Springfield and plans to promote HB 1670 -- a bill introduced in this year's General Assembly.
Democrat Kate Meiners from Kansas City and Republican Robert Schaaf from St. Joseph are co-sponsoring a bill that would allow medical marijuana use. "I'll be the wind in their sails," Mobley said.
He doesn't know if his support of medical marijuana will keep Springfield patients away who disagree. "I could lose a little skin but those people need to be educated and that's what I’m campaigning to do." Mobley says he will fly to Washington on the weekends until he hires a full time staff. He says he plans to charge about $200 a patient.

During this day-long event, we met with Missouri Speaker of the House, Rod Jetton, who blocked our Cannabis Compassion Bill in 2007 and was making every effort to block it again for 2008.
This first ever Patient Protection Day 2008 statewide lobbying event video was recorded in the Jefferson City Capital Building Rotunda. The stage and sound system were generously provided by the University of Missouri Columbia. This patient is from Kansas City. She has been battling Autoimmune diseases most of her life; Lupus and Crohn's, to name only two.

People for Change: Medical Cannabis Testimonies: Rod of Missouri Pt. Added: Nov 20, 2008;
From: CannabisPatientNet,

Rod's house burned down in January 2007. While his house was still burning, the fire department there in St. Charles, Missouri chose to break down the door into his grow room, even though that part of his house wasn't involved in the fire. They also chose to pry open the locked drawers of a steel desk looking for cash rather than fight the fire that was consuming the rest of his house. Rod's lacerations and burns had to wait while he was handcuffed in the street in front of his neighbors and children and hauled off to jail, while his home still burned. Though Rod used cannabis from his personal garden for his personal use to treat his Epilepsy, he was charged with manufacture, distribution, and other felonies just like a street drug dealer.

ASA : 2/24/06 News Summary, MISSOURI: State Lawmakers Debate Cannabis Bill, by Josh Vince, Columbia Missourian | Mo. House bill filed to legalize medicinal marijuana. A bill filed in the Missouri House of Representatives reopens the debate about medical marijuana.
The Missouri legislature is also considering legislation on medical cannabis. The bill there is in its earliest stages, but the "Show Me" state may well be the one to show its Midwestern neighbors the way to a more compassionate policy toward patients.

Missouri Medical Marijuana Bill Unanimously Passes Senate Public Health Committee, February 22, 1996 | Jefferson City, MO, USA - A medical marijuana bill (Senate Bill 573) introduced by State Senator Joe Mosley has unanimously passed the Senate Public Health Committee. The bill states that "no criminal or civil penalty shall apply to any person for the act of possessing marijuana provided that ... a [physician] certifies in writing that the person is under professional care [and] ... needs marijuana as part of a therapeutic regimen".
Missouri NORML Coordinator Dan Viets says that he is pleased with the committee's recommendation to the Senate to pass the bill. However, he added a note of skepticism regarding a last minute amendment to the bill that instructs the University of Missouri to conduct research on the efficacy and safety of whole-smoked cannabis to that of the synthetic-THC drug Marinol.

Election Day 2004 - Municipal Marijuana Initiatives, November 3, 2004 |
Medical marijuana questions appeared on the ballot in three local elections this Election Day, two in cities that did not currently have laws covering patients and their caregivers.
WIN: Columbia, Mo. - Proposition 2
This initiatve eliminates the possibility of any jail time for marijuana possession and reduces the maximum fine from $1,000 to $250 for up to 1.25 ounces. It also forbids the police from arresting adults on marijuana possession charges, and requires a summons to city court (not county or state prosecutors) instead. Drug convictions in municipal court do not bar students from receiving federal aid under the Higher Education Act.
WIN: Columbia, Mo. - Columbia Medical Marijuana Initiative
At press time, the Missouri Medical Marijuana Initiative was ahead in incomplete returns. Columbia's ballot initiative revises the city criminal code so that medical marijuana patients are not subject to "any arrest, prosecution, punishment or sanction." While it sets out specific illnesses that qualify for medical marijuana use, it also says any other serious condition for which a doctor has recommended cannabis is appropriate under the law. The Medical Marijuana Initiative also requires that all medical marijuana cases be referred only to the local prosecuting attorney and no other prosecutor.

I was born with cerebral palsy and discovered early on that cannabis mitigated the most painful physical and emotional manifestations of my disorder. I later learned that cannabis can help stutterers speak more clearly and that decades ago, doctors discovered the herb's ability to alleviate muscle spasms, from which I also suffer.
A year ago my children and I reluctantly fled our home in Kansas City and headed for the sanctuary of California's Compassionate Use Act.

Informational Guide on Medical Cannabis |
If you have ever heard of the song, “Lets Go Get Stoned,” as sung by Ray Charles or Joe Cocker, you know the lyrics were referring to getting high or using cannabis aka marijuana. This mind altering drug goes by other names as well; names such as weed, pot, joint, blunt, hash and mary jane are quite common among users. Cannabis is a plant that contains a chemical called cannabinoids or cannabinolidic acids.
Another substance that is found in cannabis is THC, or Tetrahydrocannabinol, which gives the users that “high” sensation. When speaking of marijuana, the actual substance used in creating the high feeling comes from the leaves and flowering tops of the cannabis plant. Marijuana is considered to be a schedule 1 controlled substance today, because of the THC, which can be highly potent, depending upon the concentration factor of the THC.

THE REEFER MADNESS ERA, REEFER MADNESS BOOKS (Info, History) By definition, it would be a contradiction in terms to list or classify a Reefer Madness book as a work of "Non-Fiction." Thus both genres are group together here simply as "Hard Cover" books; if only to distinguish them from the "Pulp Fiction" or "Dime Store novels" discussed elsewhere. However where appropriate the terms [Fiction] and [Non-Fiction] are used.

Proven : Cannabis is Safe Medicine
by Ian Williams Goddard | In reaction to medical cannabis access referendums on the ballots in Arizona and California, former presidents Gerald Ford, Jimmy Carter, and George Bush signed a letter stating that they "categorically oppose'' access to cannabis for its many proven therapeutic uses such as the prevention of blindness and epileptic seizures. Their chief concern was that legal medical access would send the message that cannabis is safe. The presidents can, however, lay their safety concerns to rest because the scientific literature overwhelmingly confirms that cannabis is both an effective and safe medicine.
The Cannabis Safety Profile. The journal PHARMACOLOGICAL REVIEWS reports that decades of research prove that, "Compared with legal drugs...marijuana does not pose greater risks." Yet based upon mortality statistics, we can safely conclude that cannabis is one of the safest medical drugs known, for, while prescription drugs, defined as safe by the FDA, kill up to 27,000 and aspirin up to 1,000 Americans per year, cannabis kills 0 per year. Examine the pros, cons, and controversies of marijuana as medicine! | Cannabis is still sending “signals of misunderstanding.”1-3 The result is an exaggeration of beneficial or deleterious effects as well as occasional intermixture of medical science with other moral categories. This book deals with health aspects of the cannabis plant and the cannabinoids while mainly factoring out societal aspects. Some authors refer to social topics that require discussion even within the bounds of a narrow handling of medicinal aspects.
