Missouri legislators, activists to helm marijuana legalization push

For those in attendance last week at the Columbia Public Library, the panel discussion of statewide marijuana legalization was an emotional one. “I’m painful,” one woman told the crowd. “I’m painful all the time. I wish you would get it decriminalized and legalized so that I can have a joint. I’m afraid to have one because a SWAT team could end up on my porch.” Her words came on the heels of an impassioned series of arguments by a panel of local figures. Among those was Dan Viets, the evening’s moderator and the Missouri coordinator of the National Organization for the Reform of Marijuana Laws. Viets spoke alongside state Reps. Chris Kelly, D-Columbia, and Rory Ellinger, D-St. Louis, Columbia Daily Tribune publisher emeritus Hank Waters and Tribune columnist Bob Roper. The panel spent much of the evening championing marijuana policy reform — namely, statewide legalization and decriminalization.   Read more >>> < here.

Status of Medical Marijuana (Cannabis) in Missouri.

Info on Missouri and Medical Cannabis

Currently, Missouri has MEDICAL MARIJUANA (cannabis) LAWs, But it Does Not Cover the State - Municipal level Only.

In 2004, Columbia, Missouri passed two initiatives, one of which allows patients to possess small amount of marijuana (35 grams) and the other removes jail time for adults who possess less than 35 grams of marijuana for personal use.

In 2008, Sensible Joplin attempted to qualify a marijuana decriminalization initiative for the ballot, but fell short just 531 signatures of the necessary 4,656 signatures needed to qualify the question for the ballot. Sensible Joplin and more than 4,000 Joplin residents that support marijuana policy reform will be back in 2012 to make another run at the ballot.

In February, the small town of Cliff Village voted 3-2 to enact an ordinance that allows the medical use of marijuana.

ACTION; Get involved in the movement for safe and legal access to medical cannabis today. Our power comes from our collective action. Whether it's calling Congress, attending rallies, organizing a local activity or chapter, signing an online petition, or supporting federal defendants, take action today!   There are a number of medical cannabis (marijuana) bills in play in states across the US.   Here we network on Ways and Means anyone can help with the effort to make each a medical marijuana state. We need to get the word out and people contacting reps and officials and get this legislation into law. Also, lets not forget efforts at the Federal level.

South Dakota - Action, Medical Marijuana Patients NETWORK and Spread The Word, both On-Line and Off (!)   ON-LINE, You can tell everybody in cyber-space by e-mailing a link to this website to them and/or (OFF-LINE> printing off the info and handing out where possible / necessary. Also phone call and read off and/or visit and hand deliver the info. You can take literature with you and approach businesses, organizations and even people on the street while you're out and about. Wear your pot-leaf shirt and register voters, as feasible. Gather signatures for any related petitions that are happening at the time as well.

This is a chain e-mail you can't refuse. Unlike most, this will actually help you - and a whole buncha others - just by passing it on. Cannabis consumer or not - from the folks just trying to take care of themselves or a loved one to those who simply see the expensive, immoral waste of making war on the sick and dying - everyone is affected by this issue.

To accomplish this you need to first click on the following links and send a message to all the reps and media you can on the issue. Then get everybody else to do the same. And follow up.

To do this you need to tell everybody you know. And can confide in. Then/or anonymously tell everybody you don't know - or can't confide in. Yet.

Tell everybody else by Letters-to-the-Editor, displaying signage at street corners and over-passes (wear trenchcoat, fedora and sunglasses if afraid of exposure), and/or anonymously leaving literature and posting on-line at places where people are likely to find it. Coffeeshops are good places to leave printed material and you can go to the websites of the local newspapers to post items as well. More ideas and supporting tools via the links below.

Missouri - Resource, Org; local Greater St.Louis NORML | NORML is an acronym for the "National Organization for the Reform of Marijuana Laws." The "war on drugs" costs billions of dollars and thousands of lives, which is also the only thing the "war" has accomplished: a needless waste of life and your tax dollars. If you want the war to stop, join now. Marijuana, or "cannabis" as it is known around the world, has been a multi-purpose plant since the dawn of humankind --for medicine, clothing, paper, fuel, and wood. The plant has hundreds of uses, none of them harmful, and it's status as an illegal substance is an absurdity. Cannabis a psychoactive has the potency of a cup of coffee or a glass of wine. At press time, the Missouri Medical Marijuana Initiative was ahead in incomplete returns. Columbia's ballot initiative revises the city criminal code so that medical marijuana patients are not subject to "any arrest, prosecution, punishment or sanction." While it sets out specific illnesses that qualify for medical marijuana use, it also says any other serious condition for which a doctor has recommended cannabis is appropriate under the law. Places that have decriminalized non-medical cannabis in the United States Places that have decriminalized non-medical cannabis in the United States - From Wikipedia, the free encyclopedia | Multiple places have decriminalized non-medical cannabis in the United States; however, cannabis is illegal under federal law. Gonzales v. Raich (2005) held in a 6-3 decision that the Commerce Clause of the United States Constitution allowed the federal government to ban the use of cannabis, including medical use even if local laws allow it. Most places that have decriminalized cannabis have civil fines, drug education, or drug treatment in place of incarceration and/or criminal charges for possession of small amounts of cannabis, or have made various cannabis offenses the lowest priority for law enforcement. Cannabis Law Reform Efforts Under Way in Springfield

Missouri - Medical Marijuana Legislation Introduced Medical Marijuana Legislation Introduced | Representative Mike Colona (D-District 67) has introduced legislation, House Bill 688, to protect patients who engage in physician authorized marijuana therapy. House Bill 688 would allow patients with a physician's recommendation to possess up to one ounce of usable marijuana and grow up to three mature and four immature marijuana plants. HB 688 also authorizes the state to license nonprofit compassion centers to distribute medicine to qualified patients. You can read the full text of the measure   >> here << According to a December 2012 CBS News nationwide telephone poll of 1,100 adults, 83 percent of Americans favor allowing doctors to authorize specified amounts of marijuana for patients suffering from serious illnesses.   >> Act Now! <<

Missouri - Industrial Hemp Legislation Heard by Senate Industrial Hemp Legislation Heard by Senate | Legislation to legalize the licensed cultivation of industrial hemp, Senate Bill 358, has received a hearing and awaits action by the Missouri Senate General Laws Committee. You can read the full text of this measure   >> here << The United States is the only developed nation that fails to cultivate industrial hemp as an economic crop, according to a 2005 Congressional Resource Service (CRS) report. Hemp is a distinct variety of the plant species cannabis sativa that contains only minute (less than 1%) amounts of tetrahydrocannabinol (THC), the primary psychoactive ingredient in marijuana. Farmers worldwide grow hemp commercially for fiber, seed, and oil for use in a variety of industrial and consumer products, including food and clothing. Senate Bill 358 would allow Missouri to authorize a licensed, statewide hemp industry.   >> Act Now! <<

Missouri - Marijuana Decriminalization Measure Introduced Marijuana Decriminalization Measure Introduced | Legislation that seeks to significantly reduce marijuana possession penalties has been introduced in the Missouri legislature. Representatives Rory Ellinger (D-University City) and Chris Kelly (D-Columbia) have introduced legislation, House Bill 512, to decriminalize marijuana penalties for adults who possess up to thirty five grams of marijuana. Under present law, the possession of up to thirty five grams of cannabis is classified as a Class A criminal misdemeanor, publishable by up to a year in jail and a $1000 fine. This proposal seeks to make minor marijuana offenses a fine-only, non-criminal infraction, punishable by a maximum fine of $250. Doing so would significantly reduce state prosecutorial costs and allow law enforcement resources to be refocused on other, more serious criminal offenses. You can read the full text of this proposal   >> here <<

Missouri - Marijuana (cannabis) News, by MPP - The “Show-Me” State considers a full range of bills to improve cannabis The “Show-Me” State considers a full range of bills to improve cannabis - Last Update: April 22, 2014 | Legislators in Missouri have sponsored bills ranging from one that would lower criminal penalties for possession of a small amount of marijuana, to bills to establish a workable medical marijuana program for the state, to bills that would even tax and regulate marijuana similar to alcohol. HB 1325, sponsored by Rep. Rory Ellinger, would lower the criminal penalty for possession of less than 35 grams of cannabis to a Class A misdemeanor, punishable by a fine only. Currently, under Missouri law, a person in possession of that amount can face up to one year in jail and up to a $1000 fine. While a person convicted of a Class A misdemeanor would still have a criminal record, which could affect current employment, housing, and educational opportunities, this bill is still a step in the right direction. The bill was referred to the House Judiciary Committee, but has not yet received a hearing. >>   Visit - http://www.mpp.org/states/missouri/ - for more.

Meanwhile, two bills were put forth that would each establish a medical marijuana program for seriously ill patients who qualify. SB 951, sponsored by Sen. Jason Holsman, would create a regulatory system supervised by the Department of Health and Senior Services and require an 8% sales tax on the sale of medical marijuana. This bill would place the issue before Missouri voters in the 2014 election. Another bill, HB 1324, sponsored by Rep. Rory Ellinger, would also establish a framework for the regulation of patient access to medical marijuana dispensaries and cultivation centers. Unlike SB 951, this bill would become effective after passage by the legislature and would not require voters for approval. Rep. Chris Kelly introduced HB 1659, a bill that would tax and regulate cannabis for adults 21 and over. However, following a hearing by the House Committee on Crime and Prevention and Public Safety in March, Representative Kelly is considering amending the bill to establish a medical marijuana program, an approach which the committee appeared to favor. Ask your legislators to protect medical marijuana patients. >>   Visit - http://www.mpp.org/states/missouri/

Marijuana laws in Missouri | Missouri has some of the harshest marijuana laws in the country, despite studies which indicate that stiff penalties do not result in lesser use. Possession of any amount of marijuana — even as little as a gram — can be punished by up to a year in prison and a $1,000 fine under state law. Possession of over 35 grams — about 1.25 ounces — is a felony subject to a prison sentence of up to seven years and a $5,000 fine. In 2011, Missouri arrested over 20,000 individuals for marijuana-related offenses, 91% of which were for possession. During the same year, 86% of reported burglaries — including home invasions — and 87% of motor vehicle thefts went unsolved by law enforcement. In addition to marijuana prohibition diverting police from more serious crime, it’s also been unevenly enforced between races. For instance, did you know that African-Americans are 2.6 times more likely to be arrested for marijuana possession, even though blacks and whites consume marijuana at similar rates? For more information on how the war on marijuana consumers is often waged unequally, check out the ACLU’s recent report. And, if you agree Missouri should take marijuana off the criminal market, legalize it for adults 21 and older, and tax and regulate it similarly to alcohol, tell your state representative and senator today! >>   Visit - http://www.mpp.org/states/missouri/

Verizon Wireless Amphitheater Afraid of Pot Reform? Show-Me Cannabis Says It Was Denied

Show-Me Cannabis, Missouri's marijuana reform advocacy group, has been spreading the word across the state about the need for more sensible pot policies -- and eventually hopes to push for legalization. Next week, the group was supposed to run a booth at Pointfest, 105.7 the Point's annual festival, but yesterday announced that Verizon Wireless Amphitheater had rejected its application. Why? The managers reportedly were worried about having marijuana advocacy take place at their venue. >> Read more >> << <<

Springfield, Mo., Doctor Opening Marijuana Clinic in Washington State, Pushes Same For Missouri Springfield, Mo., Doctor Opening Marijuana Clinic in Washington State, Pushes Same For Missouri - By KSPR News, Jan 18, 2010 | A Springfield doctor plans to open a medical marijuana clinic in Seattle, Wash. He and his Springfield staff plan to set up appointments for Washington state clients from his clinic on Division Street. Dr. Gil Mobley says he would like to do the same for Missouri patients. A new Missouri house bill could make that goal a reality. Mobley says he used marijuana before he became a doctor but does not anymore. He says he’s decided he wants to a pioneer for pot -- specifically, medical marijuana.

"I think it is profoundly immoral to make prisoners and criminals of patients using marijuana for medical purposes,” Mobley said. “It has been proven to the nth degree to be safe." "In Washington, there is room for someone to carry the banner and say there is a right way to do this," Mobley said. “I'm a licensed physician in Washington. It's a beautiful state and I enjoy the progressive nature."

Soon the state may be progressive enough to make marijuana legal for anyone 21 years or older. Mobley testified at Washington hearings for two controversial marijuana bills. One would legalize marijuana for those 21 and older, and regulate it like alcohol. Another would decriminalize possession of small amounts of pot for adults. Mobley testified that marijuana is not addictive. Many attending the hearings disagreed. Others questioned if legalization and taxation could aid tight government budgets.

“You know it's nonsense, just nonsense," Don Pierce of the Washington Association of Sheriffs and Police Chiefs said about benefits to law enforcement budgets. Washington’s governor pointed out federal law trumps state law."I don't know how you generate any money when federal law makes it illegal,” Christine Gregoire said. “I've already been to the U.S. attorney who says they will continue to enforce federal law." In the more conservative Ozarks, Mobley's staff will set appointments for his Washington medical marijuana clinic. He wants to open on March 1.

"From cancer patients going through chemo and radiation, to AIDS and hepatitis C, they have terrible nausea and vomiting and often have failure on traditional medicine," Mobley said. Mobley says every patient he'll recommend must bring written documentation from a qualified doctor that proves they have a terminal or debilitating medical condition. He says he also wants each patient to have used marijuana before.

"There's no way a doctor would approve smoking marijuana but there are other ways to dose it,” Mobley said. “The most recommended is to use a vaporizer. You vaporize the THC to harmless water vapor." Mobley would like to recommend the same treatment in Springfield and plans to promote HB 1670 -- a bill introduced in this year's General Assembly.

Democrat Kate Meiners from Kansas City and Republican Robert Schaaf from St. Joseph are co-sponsoring a bill that would allow medical marijuana use. "I'll be the wind in their sails," Mobley said. He doesn't know if his support of medical marijuana will keep Springfield patients away who disagree. "I could lose a little skin but those people need to be educated and that's what I’m campaigning to do." Mobley says he will fly to Washington on the weekends until he hires a full time staff. He says he plans to charge about $200 a patient. Click > here < to read the Missouri bill. Click > here < to read more on Washington’s medical marijuana laws. However, he added a note of skepticism regarding a last minute amendment to the bill that instructs the University of Missouri to conduct research on the efficacy and safety of whole-smoked cannabis to that of the synthetic-THC drug Marinol. Missouri, News - Election Day 2004 - Municipal Marijuana Initiatives Election Day 2004 - Municipal Marijuana Initiatives, November 3, 2004 | Medical marijuana questions appeared on the ballot in three local elections this Election Day, two in cities that did not currently have laws covering patients and their caregivers.

WIN: Columbia, Mo. - Proposition 2 This initiatve eliminates the possibility of any jail time for marijuana possession and reduces the maximum fine from $1,000 to $250 for up to 1.25 ounces. It also forbids the police from arresting adults on marijuana possession charges, and requires a summons to city court (not county or state prosecutors) instead. Drug convictions in municipal court do not bar students from receiving federal aid under the Higher Education Act.

WIN: Columbia, Mo. - Columbia Medical Marijuana Initiative At press time, the Missouri Medical Marijuana Initiative was ahead in incomplete returns. The Medical Marijuana Initiative also requires that all medical marijuana cases be referred only to the local prosecuting attorney and no other prosecutor. Missouri, History - Letter: Medical Marijuana Letter: Medical Marijuana, Missouri; Jacquelin Patterson; March 24, 2008; Kansas City Star | I was born with cerebral palsy and discovered early on that cannabis mitigated the most painful physical and emotional manifestations of my disorder. I later learned that cannabis can help stutterers speak more clearly and that decades ago, doctors discovered the herb's ability to alleviate muscle spasms, from which I also suffer. A year ago my children and I reluctantly fled our home in Kansas City and headed for the sanctuary of California's Compassionate Use Act. Click > here < for more.

Medical Cannabis, History - Letter: Medical Marijuana Informational Guide on Medical Cannabis | If you have ever heard of the song, “Lets Go Get Stoned,” as sung by Ray Charles or Joe Cocker, you know the lyrics were referring to getting high or using cannabis aka marijuana. This mind altering drug goes by other names as well; names such as weed, pot, joint, blunt, hash and mary jane are quite common among users. Cannabis is a plant that contains a chemical called cannabinoids or cannabinolidic acids. Another substance that is found in cannabis is THC, or Tetrahydrocannabinol, which gives the users that “high” sensation. When speaking of marijuana, the actual substance used in creating the high feeling comes from the leaves and flowering tops of the cannabis plant. Marijuana is considered to be a schedule 1 controlled substance today, because of the THC, which can be highly potent, depending upon the concentration factor of the THC. Medical Cannabis - Proven : Cannabis is Safe Medicine Proven : Cannabis is Safe Medicine by Ian Williams Goddard | In reaction to medical cannabis access referendums on the ballots in Arizona and California, former presidents Gerald Ford, Jimmy Carter, and George Bush signed a letter stating that they "categorically oppose'' access to cannabis for its many proven therapeutic uses such as the prevention of blindness and epileptic seizures. Their chief concern was that legal medical access would send the message that cannabis is safe. The presidents can, however, lay their safety concerns to rest because the scientific literature overwhelmingly confirms that cannabis is both an effective and safe medicine. The Cannabis Safety Profile. The journal PHARMACOLOGICAL REVIEWS reports that decades of research prove that, "Compared with legal drugs...marijuana does not pose greater risks." Yet based upon mortality statistics, we can safely conclude that cannabis is one of the safest medical drugs known, for, while prescription drugs, defined as safe by the FDA, kill up to 27,000 and aspirin up to 1,000 Americans per year, cannabis kills 0 per year. "Drug War Propaganda Counts as State Police Training in Missouri; Sworn law enforcement officers fulfill state- mandated training requirements by learning the latest Reefer Madness talking points. | As it turns out, some of the classes offered aren't exactly what you might consider official law enforcement training. At the annual conference this past March, one course was titled, "Marijuana Legalization: The Issues." It was taught by Tom Gorman— a drug cop from Colorado who travels the country on what seems to be a never-ending anti-legalization crusade. He's been called a "drug-war soldier," and his role as both a federal drug cop and a lobbyist has been repeatedly criticized. Gorman is perhaps most famous for his recent comments on marijuana regulation; he accused entire state legislatures of criminal conspiracy, declaring, "Everybody that has anything to do with this is engaged in a criminal act." Gorman lists books he has written as part of his qualifications to teach the "Marijuana Legalization: The Issues" training course, including The Myths of Drug Legalization and Marijuana Is Not a Medicine. Despite his claim of expertise on the medical value of marijuana, Gorman does not have a medical degree. He has a bachelor's degree in criminology from San Jose State University. The syllabus and course materials for state- certified training courses are public records under Missouri's Sunshine Law. A look at the content from Gorman's "Marijuana Legalization: The Issues" course is, admittedly, laugh- out-loud funny in its absurdity. (You can view the course content in its entirety here) However, it's genuinely concerning that this passes as actual police training in Missouri: The table of contents for the main handout for the course reads like an exercise in drug warrior logic. Tom Gorman originally prepared this handout in 2012 for a group called Healthy and Drug Free Colorado. The table of contents provides a snapshot into the alternate reality in which the course instructor resides—a world where alcohol prohibition was "relatively successful" and the "theory" that drug laws have a racial component is "not supported." >> http://reason.com/archives/20 14/09/23/drug-war-propaganda- counts-as-state-poli"

"Missouri Governor Signs Cannabis Extract Legislation Individuals with epilepsy that cannot be effectively treated with conventional means will now be able to use a cannabis extract under legislation signed into law in Missouri. On the last possible day to do so, Gov. Jay Nixon signed Missouri legislation that will allow the use of hemp oil containing the chemical cannabidiol (CBD) for consumption by people who have tried other treatments for epilepsy without success. The legislation was sponsored by St. Louis County Republican Eric Schmitt, a state senator whose nine year old son has the disorder. The legislation went to Nixon’s desk in May, and he had until Monday, July 14th to sign or veto it. Under the new Missouri law, patients wanting to use the CBD will be required to register with Missouri’s health department. Additionally, a neurologist will have to vouch that the patient’s epilepsy has not responded to at least three other treatments. The CBD extract is low in THC, the compound which gives users a “high”, and therefore would not be favored for recreational use. The law allows for two nonprofit agencies to be licensed to grow the marijuana plants and produce the oil. The two cannabis centers will be overseen by the Missouri Department of Agriculture. Currently, there has been no timeline set for opening these centers. http://www.cannabispharmacyjo urnal.com/2014/07/15/missouri -governor-signs-cannabis- extract-legislation/"

"Dear Friends,

A bill which would legalize the cultivation of hemp as an agricultural commodity has been filed by Missouri State Senator Jason Holsman. Senate Bill 358 would authorize the cultivation of hemp, defined as cannabis containing less than 1% THC. The bill would exempt hemp from the Missouri Controlled Substances Act and would allow cultivation by anyone who has not been convicted of a felony or a drug- related misdemeanor offense. If charged with possession or cultivation, the burden would be on the defendant to prove the exemption.

An identical bill was filed a couple of years ago in the Missouri House, but did not receive a committee assignment or a hearing. The significance of having the bill filed in the Missouri Senate is that nearly all bills filed in the Senate do receive a hearing at some point during the session. Therefore, it is quite likely that Senate Bill 358 will receive a hearing before a Missouri Senate Committee.

SB 358 joins House Bill 511, which would provide for expungement of misdemeanor marijuana convictions, and House Bill 512, which would effectively decriminalize the possession of small amount of marijuana. These three bills represent an unprecedented level of marijuana law reform legislation pending in a single session of the Missouri General Assembly.

Sincerely, Dan Viets, J.D. Missouri NORML Coordinator "

I'm on my stomach because I couldn't sit ( in my wheelchair )," Blundell said.

More than three weeks have passed since Blundell, 30, stopped using marijuana. He abandoned the drug not long before he introduced an ordinance legalizing its use for medical reasons inside Cliff Village, a hamlet on Joplin's southern fringes, where Blundell serves as mayor. That ordinance passed two weeks ago. visit - http://www.mapinc.org/drugnews/v09/n185/a04.html?204 "
