Status of Medical Marijuana (Cannabis) in Missouri.

Info on Missouri and Medical Cannabis

Currently, Missouri has MEDICAL MARIJUANA (cannabis) LAWs, But it Does Not Cover the State - Municipal level Only.

In 2004, Columbia, Missouri passed two initiatives, one of which allows patients to possess small amount of marijuana (35 grams) and the other removes jail time for adults who possess less than 35 grams of marijuana for personal use.

In 2008, Sensible Joplin attempted to qualify a marijuana decriminalization initiative for the ballot, but fell short just 531 signatures of the necessary 4,656 signatures needed to qualify the question for the ballot. Sensible Joplin and more than 4,000 Joplin residents that support marijuana policy reform will be back in 2012 to make another run at the ballot.

In February, the small town of Cliff Village voted 3-2 to enact an ordinance that allows the medical use of marijuana.

Here are some more things you can do to help forward legislation:

  • Write a short, powerful letter to the editor in support of medical marijuana access for seriously ill patients.

  • Please send your legislators an e-mail urging them to give the medical marijuana bill — HB 277 — the attention it deserves this year.

  • Set up a free screening of the award-winning medical marijuana documentary Waiting to Inhale, or other movie. If you are interested in hosting a screening, please send an e-mail to MPP letting them know.

  • Ask your doctor, clergy member, local leader, or organization you are a member of to sign MPPs statement of principle. Simply print it out and ask your doctor or other individual to sign it the next time you have the opportunity. Then send it to MPP at P.O. Box 77492, Washington, D.C. 20013.

  • Help get the word out by downloading and sharing MPP's public service announcements with radio stations in your area. If you're a talk radio listener, call in and express support for medical marijuana laws. Even if the subject being discussed isn't explicitly about marijuana, many related issues can be a springboard for urging reform. For example, if the issue is health care, you can point out that treatment decisions are better off being left to patients and physicians than police and prosecutors.

  • Print and hand out MPP's medical marijuana brochures to your friends, family, local leaders, and elected officials in an effort to educate the public and garner support.

  • Go to The People and get them in the loop. Using MPP's sign-up sheets, collect as many valid e-mail addresses as you can and send them to MPP. You can scan and e-mail the information you collect to them or mail it to MPP legislative analyst Nathan Miller at P.O. Box 77492, Washington, DC 20013.

Visit the MPP Action Page for links to help with all these action items!

The "war on drugs" costs billions of dollars and thousands of lives, which is also the only thing the "war" has accomplished: a needless waste of life and your tax dollars. If you want the war to stop, join now. Marijuana, or "cannabis" as it is known around the world, has been a multi-purpose plant since the dawn of humankind --for medicine, clothing, paper, fuel, and wood. The plant has hundreds of uses, none of them harmful, and it's status as an illegal substance is an absurdity. Cannabis a psychoactive has the potency of a cup of coffee or a glass of wine. At press time, the Missouri Medical Marijuana Initiative was ahead in incomplete returns. Columbia's ballot initiative revises the city criminal code so that medical marijuana patients are not subject to "any arrest, prosecution, punishment or sanction." Places that have decriminalized non-medical cannabis in the United States Places that have decriminalized non-medical cannabis in the United States - From Wikipedia, the free encyclopedia | Multiple places have decriminalized non-medical cannabis in the United States; however, cannabis is illegal under federal law. Gonzales v. Raich (2005) held in a 6-3 decision that the Commerce Clause of the United States Constitution allowed the federal government to ban the use of cannabis, including medical use even if local laws allow it. Most places that have decriminalized cannabis have civil fines, drug education, or drug treatment in place of incarceration and/or criminal charges for possession of small amounts of cannabis, or have made various cannabis offenses the lowest priority for law enforcement. Missouri - Marijuana (cannabis) News, by MPP - Medical marijuana bill awaits hearing in Missouri Legislature Medical marijuana bill awaits hearing in Missouri Legislature - Last Update: March 6, 2012 | For the sixth year in a row, medical marijuana legislation has been introduced in Missouri. Unfortunately, the bill has not yet been given a hearing. The bill ( HB 1421) is sponsored by Rep. Mike Colona (D-St. Louis), along with eight fellow co-sponsors. It would allow patients with serious, debilitating conditions like cancer, multiple sclerosis, and HIV/AIDS to cultivate up to three mature marijuana plants and possess up to an ounce per plant without fear of arrest. It would also allow for the establishment of registered dispensaries where patients can legally obtain medical marijuana.   Visit - http://www.mpp.org/states/missouri/ - for more.

It’s getting tougher and tougher to justify the Missouri Legislature’s unwillingness to provide legal protections to its most vulnerable citizens. Already, at least one prosecutor in Missouri seems unwilling to prosecute seriously ill patients . Public support remains high, with polls showing upwards of 70% of Americans in support of medical marijuana, and the list of states that allow patients to use marijuana continues to grow — now up to 16. Other states are even expanding their already existing laws, most notably Vermont, which passed a new law allowing for the establishment of medical marijuana dispensaries there. With the growing chorus of voices in Missouri calling for an end to the cruel practice of arresting the seriously ill simply for trying to alleviate their symptoms, the legislature is bound to relent sooner or later. Please help make sure it’s sooner by asking your legislators to support medical marijuana legislation . You can also head over to our action center for more ways to get involved and raise awareness.   Visit - http://www.mpp.org/states/missouri/ - for more.

Marijuana laws in Missouri | Missouri has some of the harshest marijuana laws in the country. Possession of any amount of marijuana — even as little as a gram — can be punished by up to a year in prison and a $1,000 fine. Possession of over 35 grams — about 1.25 ounces — is a felony subject to up to a seven-year prison sentence and a $5,000 fine. You can read more about the effects of Missouri’s harsh marijuana laws (like the fact that over 91% of marijuana arrests in Missouri are for simple possession) in this 2009 report by Jon Gettman, Ph.D. Perhaps the worst part about Missouri’s harsh marijuana laws is that the state treats people who use marijuana to treat a serious medical condition as common recreational users. As a result, Kenneth Wells, a 56 year-old Missouri resident with a seizure disorder and no criminal record, was changed with a felony (maximum 15 years in prison) for cultivating medical marijuana. Fortunately, the case against Mr. Wells was dropped in the face of public opposition, but not before he was arrested, forced to hire a lawyer, and forced to defend himself for over two years against these charges. Please ask your elected officials to support medical marijuana legislation so there are no more Kenneth Wells. You can also sign up with the Show-Me Cannabis Regulation initiative to help end marijuana prohibition altogether in Missouri.

Springfield, Mo., Doctor Opening Marijuana Clinic in Washington State, Pushes Same For Missouri Springfield, Mo., Doctor Opening Marijuana Clinic in Washington State, Pushes Same For Missouri - By KSPR News, Jan 18, 2010 | A Springfield doctor plans to open a medical marijuana clinic in Seattle, Wash. He and his Springfield staff plan to set up appointments for Washington state clients from his clinic on Division Street. Dr. Gil Mobley says he would like to do the same for Missouri patients. A new Missouri house bill could make that goal a reality. Mobley says he used marijuana before he became a doctor but does not anymore. He says he’s decided he wants to a pioneer for pot -- specifically, medical marijuana.

"I think it is profoundly immoral to make prisoners and criminals of patients using marijuana for medical purposes,” Mobley said. “It has been proven to the nth degree to be safe." "In Washington, there is room for someone to carry the banner and say there is a right way to do this," Mobley said. “I'm a licensed physician in Washington. It's a beautiful state and I enjoy the progressive nature."

Soon the state may be progressive enough to make marijuana legal for anyone 21 years or older. Mobley testified at Washington hearings for two controversial marijuana bills. One would legalize marijuana for those 21 and older, and regulate it like alcohol. Another would decriminalize possession of small amounts of pot for adults. Mobley testified that marijuana is not addictive. Many attending the hearings disagreed. Others questioned if legalization and taxation could aid tight government budgets.

“You know it's nonsense, just nonsense," Don Pierce of the Washington Association of Sheriffs and Police Chiefs said about benefits to law enforcement budgets. Washington’s governor pointed out federal law trumps state law."I don't know how you generate any money when federal law makes it illegal,” Christine Gregoire said. “I've already been to the U.S. attorney who says they will continue to enforce federal law." In the more conservative Ozarks, Mobley's staff will set appointments for his Washington medical marijuana clinic. He wants to open on March 1.

"From cancer patients going through chemo and radiation, to AIDS and hepatitis C, they have terrible nausea and vomiting and often have failure on traditional medicine," Mobley said. Mobley says every patient he'll recommend must bring written documentation from a qualified doctor that proves they have a terminal or debilitating medical condition. He says he also wants each patient to have used marijuana before.

"There's no way a doctor would approve smoking marijuana but there are other ways to dose it,” Mobley said. “The most recommended is to use a vaporizer. You vaporize the THC to harmless water vapor." Mobley would like to recommend the same treatment in Springfield and plans to promote HB 1670 -- a bill introduced in this year's General Assembly.

Democrat Kate Meiners from Kansas City and Republican Robert Schaaf from St. Joseph are co-sponsoring a bill that would allow medical marijuana use. "I'll be the wind in their sails," Mobley said. He doesn't know if his support of medical marijuana will keep Springfield patients away who disagree. "I could lose a little skin but those people need to be educated and that's what I’m campaigning to do." Mobley says he will fly to Washington on the weekends until he hires a full time staff. He says he plans to charge about $200 a patient. Click > here < to read the Missouri bill. Click > here < to read more on Washington’s medical marijuana laws. Missouri, News - People for Change: Medical Cannabis Testimonies: Rod of Missouri Pt. People for Change: Medical Cannabis Testimonies: Rod of Missouri Pt. Added: Nov 20, 2008; From: CannabisPatientNet, Duration: 8:53 | Rod's house burned down in January 2007. While his house was still burning, the fire department there in St. Charles, Missouri chose to break down the door into his grow room, even though that part of his house wasn't involved in the fire. They also chose to pry open the locked drawers of a steel desk looking for cash rather than fight the fire that was consuming the rest of his house. Rod's lacerations and burns had to wait while he was handcuffed in the street in front of his neighbors and children and hauled off to jail, while his home still burned. Though Rod used cannabis from his personal garden for his personal use to treat his Epilepsy, he was charged with manufacture, distribution, and other felonies just like a street drug dealer. Missouri, News - Medical Marijuana Bill Unanimously Passes Senate Public Health Committee Missouri Medical Marijuana Bill Unanimously Passes Senate Public Health Committee, February 22, 1996 | Jefferson City, MO, USA - A medical marijuana bill (Senate Bill 573) introduced by State Senator Joe Mosley has unanimously passed the Senate Public Health Committee. The bill states that "no criminal or civil penalty shall apply to any person for the act of possessing marijuana provided that ... a [physician] certifies in writing that the person is under professional care [and] ... needs marijuana as part of a therapeutic regimen". Missouri NORML Coordinator Dan Viets says that he is pleased with the committee's recommendation to the Senate to pass the bill. However, he added a note of skepticism regarding a last minute amendment to the bill that instructs the University of Missouri to conduct research on the efficacy and safety of whole-smoked cannabis to that of the synthetic-THC drug Marinol. Missouri, News - Election Day 2004 - Municipal Marijuana Initiatives Election Day 2004 - Municipal Marijuana Initiatives, November 3, 2004 | Medical marijuana questions appeared on the ballot in three local elections this Election Day, two in cities that did not currently have laws covering patients and their caregivers.

WIN: Columbia, Mo. - Proposition 2 This initiatve eliminates the possibility of any jail time for marijuana possession and reduces the maximum fine from $1,000 to $250 for up to 1.25 ounces. It also forbids the police from arresting adults on marijuana possession charges, and requires a summons to city court (not county or state prosecutors) instead. Drug convictions in municipal court do not bar students from receiving federal aid under the Higher Education Act.

WIN: Columbia, Mo. - Columbia Medical Marijuana Initiative At press time, the Missouri Medical Marijuana Initiative was ahead in incomplete returns. Columbia's ballot initiative revises the city criminal code so that medical marijuana patients are not subject to "any arrest, prosecution, punishment or sanction." While it sets out specific illnesses that qualify for medical marijuana use, it also says any other serious condition for which a doctor has recommended cannabis is appropriate under the law. The Medical Marijuana Initiative also requires that all medical marijuana cases be referred only to the local prosecuting attorney and no other prosecutor. Missouri, History - Letter: Medical Marijuana Letter: Medical Marijuana, Missouri; Jacquelin Patterson; March 24, 2008; Kansas City Star | I was born with cerebral palsy and discovered early on that cannabis mitigated the most painful physical and emotional manifestations of my disorder. I later learned that cannabis can help stutterers speak more clearly and that decades ago, doctors discovered the herb's ability to alleviate muscle spasms, from which I also suffer. A year ago my children and I reluctantly fled our home in Kansas City and headed for the sanctuary of California's Compassionate Use Act. Click > here < for more.

Medical Cannabis, History - Letter: Medical Marijuana Informational Guide on Medical Cannabis | If you have ever heard of the song, “Lets Go Get Stoned,” as sung by Ray Charles or Joe Cocker, you know the lyrics were referring to getting high or using cannabis aka marijuana. This mind altering drug goes by other names as well; names such as weed, pot, joint, blunt, hash and mary jane are quite common among users. Cannabis is a plant that contains a chemical called cannabinoids or cannabinolidic acids. Another substance that is found in cannabis is THC, or Tetrahydrocannabinol, which gives the users that “high” sensation. When speaking of marijuana, the actual substance used in creating the high feeling comes from the leaves and flowering tops of the cannabis plant. Marijuana is considered to be a schedule 1 controlled substance today, because of the THC, which can be highly potent, depending upon the concentration factor of the THC. Medical Cannabis - Proven : Cannabis is Safe Medicine Proven : Cannabis is Safe Medicine by Ian Williams Goddard | In reaction to medical cannabis access referendums on the ballots in Arizona and California, former presidents Gerald Ford, Jimmy Carter, and George Bush signed a letter stating that they "categorically oppose'' access to cannabis for its many proven therapeutic uses such as the prevention of blindness and epileptic seizures. Their chief concern was that legal medical access would send the message that cannabis is safe. The presidents can, however, lay their safety concerns to rest because the scientific literature overwhelmingly confirms that cannabis is both an effective and safe medicine. The Cannabis Safety Profile. The journal PHARMACOLOGICAL REVIEWS reports that decades of research prove that, "Compared with legal drugs...marijuana does not pose greater risks." Yet based upon mortality statistics, we can safely conclude that cannabis is one of the safest medical drugs known, for, while prescription drugs, defined as safe by the FDA, kill up to 27,000 and aspirin up to 1,000 Americans per year, cannabis kills 0 per year. "I have had seizures for many years. I have also been on Dilantin, Kepra, and Depakote at one time or another. Now I take Kepra and Depakote, but do they really work? The answer is NO. Do they help take care of the pain that is associated with the after math of having a seizure. The answer is NO. Do they cause tremors thru-out my body? Yes, they do. My point being is that Cannabis does help reduce the risk of a seizure, and this is a great amount as well. It prevents me from having to take as much MEDS. which has these side effects on me. Side effects that include being tired all the time, tremors, loss of control of bodily functions, getting words mixed up, over all week and tired. If only, the State of Missouri will listen to what people have to say about how Cannabis helps ease us of pain and other Medical issues one might have, then maybe we could be much better off. HB277 needs to pass. Allow Missouri to use Medical Marijuana as a treatment to many Illness's and you too, might find yourself pain free and with some hope. "

"GRASS-ROOTS EFFORT: VILLAGE LEGALIZES MEDICAL MARIJUANA

CLIFF VILLAGE, Mo. - It's early evening and Joe Blundell is splayed out on his bed, on his stomach.

After a couple days of media interviews, it's just him, some friends, and a bout of pain.

I'm on my stomach because I couldn't sit ( in my wheelchair )," Blundell said.

More than three weeks have passed since Blundell, 30, stopped using marijuana. He abandoned the drug not long before he introduced an ordinance legalizing its use for medical reasons inside Cliff Village, a hamlet on Joplin's southern fringes, where Blundell serves as mayor. That ordinance passed two weeks ago. visit - http://www.mapinc.org/drugnews/v09/n185/a04.html?204 "
