New Approach Missouri - Missouri - Medical Cannabis (marijuana) Ballot Number: N/A — A judge has ruled that a decision to invalidate many signatures from registered voters was proper; as a result, the measure will not appear on the 2016 ballot. Summary: The initiative would have created a statewide system for production and sale of medical cannabis and medical cannabis products. It also provides for limited and regulated patient cultivation. The initiative levies a four percent retail tax, and all revenue in excess of the cost of regulating the medical cannabis program will go to help Missouri's veterans. The initiative maintains the current prohibition on public use and driving under the influence. It also allows the Department of Health and Senior Services to institute a seed-to-sale tracking system to ensure that the product and money do not reach the illicit market. The initiative puts the Missouri Department of Health and Senior Services in charge of licensing and implementation, but also allows the department to contract with other state agencies when necessary for effective and efficient regulation. Sixty-two percent of registered voters voiced support for the measure, according to survey data compiled by Public Policy Polling. Learn more >>

    Missouri Cannabis Conference

    Please join us in Kansas City this Saturday at Event Port, 208 West 19th Street, Kansas City, Missouri, for the 2015 Missouri Cannabis Conference co-sponsored by Missouri NORML and Show-Me Cannabis. The lineup of speakers has grown and includes some new and very interesting presentations. You may have heard about Shona Banda, a Garden City, Kansas woman whose child was taken from her after he spoke up in a drug “education” class and challenged the claim that marijuana has no value as medicine. Her attorney, Sarah Swain, will be speaking to us about this case which has received major media attention across the nation and around the world. Our other speakers include the former State Commander of the Veterans of Foreign Wars, Mr. Tom Mundell; Mike Mizanskey, the brother of Jeff Mizanskey who is serving life in prison for marijuana; nationally-recognized medical marijuana expert and author, Mary Lynn Mathre and physician Dr. Gil Mobley.

    We will hear from medical marijuana patients, caregivers and others who have seen first-hand damage marijuana prohibition does to people who need marijuana for the treatment of illnesses and injuries. On Saturday morning we will be hearing from Missouri NORML Chapter Leaders from around the state and Show-Me Cannabis Board Members about recent activities and upcoming events including the campaign to place a marijuana law reform initiative on the ballot in Missouri for the November, 2016 election. Learn how you can be involved in this undertaking.

    Please stick around Saturday evening for our social event. For only $15, you can join a great party which will include a cash bar and a live auction to raise money for the cause of legalizing marijuana in Missouri! We also have another fundraising event scheduled for Friday evening at The Rieger Hotel Grill & Exchange at 1924 Main Street, which will feature fine food and drink.     Missouri legislators, activists to helm marijuana legalization push

    For those in attendance last week at the Columbia Public Library, the panel discussion of statewide marijuana legalization was an emotional one. “I’m painful,” one woman told the crowd. “I’m painful all the time. I wish you would get it decriminalized and legalized so that I can have a joint. I’m afraid to have one because a SWAT team could end up on my porch.” Her words came on the heels of an impassioned series of arguments by a panel of local figures. Among those was Dan Viets, the evening’s moderator and the Missouri coordinator of the National Organization for the Reform of Marijuana Laws. Viets spoke alongside state Reps. Chris Kelly, D-Columbia, and Rory Ellinger, D-St. Louis, Columbia Daily Tribune publisher emeritus Hank Waters and Tribune columnist Bob Roper.     Missouri has MEDICAL MARIJUANA (cannabis) LAWs; (1) a MEDICAL MARIJUANA (cannabis) LAW; But it is Limited, CBD-Only; and (2) several Municipal level Only.

    Status: CBD Specific, Law Signed: 2014

    QUALIFYING CONDITIONS: Intractable epilepsy

    PATIENT POSSESSION LIMITS: Twenty ounces of cannabis extracts containing five percent or more of CBD and no more than three-tenths of one percent of THC

    HOME CULTIVATION: No

    STATE-LICENSED DISPENSARIES: Yes

    STATE-LICENSED DISPENSARIES OPERATIONAL: Not yet. In spring 2016, state regulators granted approval to two applicants seeking to provide high-CBD products. Those products are anticipated to become available to qualified patients in the fall of 2016.

    Missouri - ASA : Becoming a Patient in Missouri ASA : Becoming a Patient in Missouri | Information of how to become a legal medical cannabis (medical marijuana) patient, and how to get safe access and legal access in Missouri. Visit: www.safeaccessnow.org/missouri_legal_information

    In 2004, Columbia, Missouri passed two initiatives, one of which allows patients to possess small amount of marijuana (35 grams) and the other removes jail time for adults who possess less than 35 grams of marijuana for personal use.

    In 2008, Sensible Joplin attempted to qualify a marijuana decriminalization initiative for the ballot, but fell short just 531 signatures of the necessary 4,656 signatures needed to qualify the question for the ballot. Sensible Joplin and more than 4,000 Joplin residents that support marijuana policy reform will be back in 2012 to make another run at the ballot.

    In February, the small town of Cliff Village voted 3-2 to enact an ordinance that allows the medical use of marijuana.

    ACTION; Get involved in the movement for safe and legal access to medical cannabis today. Our power comes from our collective action. Whether it's calling Congress, attending rallies, organizing a local activity or chapter, signing an online petition, or supporting federal defendants, take action today!   There are a number of medical cannabis (marijuana) bills in play in states across the US.   Here we network on Ways and Means anyone can help with the effort to make each a medical marijuana state. We need to get the word out and people contacting reps and officials and get this legislation into law. Also, lets not forget efforts at the Federal level.

    South Dakota - Action, Medical Marijuana Patients NETWORK and Spread The Word, both On-Line and Off (!)   ON-LINE, You can tell everybody in cyber-space by e-mailing a link to this website to them and/or (OFF-LINE> printing off the info and handing out where possible / necessary. Also phone call and read off and/or visit and hand deliver the info. You can take literature with you and approach businesses, organizations and even people on the street while you're out and about. Wear your pot-leaf shirt and register voters, as feasible. Gather signatures for any related petitions that are happening at the time as well.

    This is a chain e-mail you can't refuse. Unlike most, this will actually help you - and a whole buncha others - just by passing it on. Cannabis consumer or not - from the folks just trying to take care of themselves or a loved one to those who simply see the expensive, immoral waste of making war on the sick and dying - everyone is affected by this issue.

    Missouri - Medical Marijuana Legislation Introduced Medical Marijuana Legislation Introduced | Representative Mike Colona (D-District 67) has introduced legislation, House Bill 688, to protect patients who engage in physician authorized marijuana therapy. House Bill 688 would allow patients with a physician's recommendation to possess up to one ounce of usable marijuana and grow up to three mature and four immature marijuana plants. HB 688 also authorizes the state to license nonprofit compassion centers to distribute medicine to qualified patients.     Missouri - Marijuana Decriminalization Measure Introduced Marijuana Decriminalization Measure Introduced | Legislation that seeks to significantly reduce marijuana possession penalties has been introduced in the Missouri legislature. Representatives Rory Ellinger (D-University City) and Chris Kelly (D-Columbia) have introduced legislation, House Bill 512, to decriminalize marijuana penalties for adults who possess up to thirty five grams of marijuana. Under present law, the possession of up to thirty five grams of cannabis is classified as a Class A criminal misdemeanor, publishable by up to a year in jail and a $1000 fine. This proposal seeks to make minor marijuana offenses a fine-only, non-criminal infraction, punishable by a maximum fine of $250. Doing so would significantly reduce state prosecutorial costs and allow law enforcement resources to be refocused on other, more serious criminal offenses.     Missouri - Marijuana (cannabis) News, by MPP - Medical marijuana initiative will not appear on November’s ballot Medical marijuana initiative will not appear on November’s ballot - Last update: October 6, 2016 | Unfortunately, after months of signature collection and hours of courtroom testimony, the decision is in: Missouri voters will not get to vote on establishing a medical marijuana program for the state this November. The Marijuana Policy Project extends its condolences to the thousands of families throughout the state that will continue to suffer from lack of access to this important medical treatment option. The Secretary of State’s office originally ruled that the initiative fell short by about 2,200 signatures in one congressional district. Sponsors took that determination to court arguing that certain errors made in the signing of the petition should not invalidate the will of the voters. While the court agreed with the campaign on that point, it still ruled the initiative fell short by 23 signatures, a heartbreaking near miss for volunteers that worked tremendously hard to present this question to the voters. >>   Visit - http://www.mpp.org/states/missouri/ - for more.

    Lawmakers consider legalizing and regulating marijuana | During the 2016 legislative session, which adjourned in May, several Missouri lawmakers filed legislation to reform the state’s marijuana laws. Among them was Rep. Brandon Ellington’s HJR 57, which sought to regulate marijuana like alcohol for persons 21 years of age and older. While the bill did not pass, it helped foster a long-overdue conversation about whether Missouri should continue criminalizing a substance that is safer than alcohol.     Simple possession will no longer carry jail time as of January 1 | In 2014, lawmakers enacted SB 491, which reduces penalties for those possessing up to 10 grams of marijuana, beginning on January 1, 2017. A first offense will be punishable as a class D misdemeanor (an infraction), and will carry a fine of $250-$1,000 with no jail time. While this is better than the current penalty, a $250 fine is out of reach for some Missourians. The state still has a long way to go to treat marijuana consumers fairly. Possession of over 35 grams — about 1.25 ounces — is a felony subject to a prison sentence of up to seven years and a $5,000 fine.

    In perhaps the most outrageous marijuana sentence in the state, Missourian Jeffrey Mizanskey was until recently serving a life sentence for nonviolent cannabis-related offenses under a severe three-strikes law. Gov. Nixon commuted Mizanskey’s sentence in May 2015, and his parole was subsequently granted. On September 1, 2015, Mizanskey was freed after serving 21 years in prison! Several thousand of Missourians are arrested and branded criminals each year for marijuana offenses. In 2012, Missouri arrested or cited over 18,800 individuals for marijuana-related offenses, 92% of which were for possession. During the same year, 87% of reported burglaries — including home invasions — and 88% of motor vehicle thefts went unsolved by law enforcement.

    In addition to marijuana prohibition diverting police from more serious crime, it’s also been unevenly enforced among races. Blacks are 2.6 times more likely to be arrested for marijuana possession in Missouri than their white counterparts, even though blacks and whites consume marijuana at similar rates.     Show-Me Cannabis, Missouri's marijuana reform advocacy group, has been spreading the word across the state about the need for more sensible pot policies -- and eventually hopes to push for legalization. Next week, the group was supposed to run a booth at Pointfest, 105.7 the Point's annual festival, but yesterday announced that Verizon Wireless Amphitheater had rejected its application. Why?     Springfield, Mo., Doctor Opening Marijuana Clinic in Washington State, Pushes Same For Missouri Springfield, Mo., Doctor Opening Marijuana Clinic in Washington State, Pushes Same For Missouri - By KSPR News, Jan 18, 2010 | A Springfield doctor plans to open a medical marijuana clinic in Seattle, Wash. He and his Springfield staff plan to set up appointments for Washington state clients from his clinic on Division Street. Dr. Gil Mobley says he would like to do the same for Missouri patients. A new Missouri house bill could make that goal a reality. Mobley says he used marijuana before he became a doctor but does not anymore. He says he’s decided he wants to a pioneer for pot -- specifically, medical marijuana.

    "I think it is profoundly immoral to make prisoners and criminals of patients using marijuana for medical purposes,” Mobley said. “It has been proven to the nth degree to be safe." "In Washington, there is room for someone to carry the banner and say there is a right way to do this," Mobley said. “I'm a licensed physician in Washington. It's a beautiful state and I enjoy the progressive nature."

    Soon the state may be progressive enough to make marijuana legal for anyone 21 years or older. Mobley testified at Washington hearings for two controversial marijuana bills. One would legalize marijuana for those 21 and older, and regulate it like alcohol. Another would decriminalize possession of small amounts of pot for adults. Mobley testified that marijuana is not addictive. Many attending the hearings disagreed. Others questioned if legalization and taxation could aid tight government budgets.

    “You know it's nonsense, just nonsense," Don Pierce of the Washington Association of Sheriffs and Police Chiefs said about benefits to law enforcement budgets. Washington’s governor pointed out federal law trumps state law."I don't know how you generate any money when federal law makes it illegal,” Christine Gregoire said. “I've already been to the U.S. attorney who says they will continue to enforce federal law." In the more conservative Ozarks, Mobley's staff will set appointments for his Washington medical marijuana clinic. He wants to open on March 1.

    "From cancer patients going through chemo and radiation, to AIDS and hepatitis C, they have terrible nausea and vomiting and often have failure on traditional medicine," Mobley said. Mobley says every patient he'll recommend must bring written documentation from a qualified doctor that proves they have a terminal or debilitating medical condition. He says he also wants each patient to have used marijuana before.

    "There's no way a doctor would approve smoking marijuana but there are other ways to dose it,” Mobley said. “The most recommended is to use a vaporizer. You vaporize the THC to harmless water vapor." Mobley would like to recommend the same treatment in Springfield and plans to promote HB 1670 -- a bill introduced in this year's General Assembly.

    Democrat Kate Meiners from Kansas City and Republican Robert Schaaf from St. Joseph are co-sponsoring a bill that would allow medical marijuana use. "I'll be the wind in their sails," Mobley said. He doesn't know if his support of medical marijuana will keep Springfield patients away who disagree. "I could lose a little skin but those people need to be educated and that's what I’m campaigning to do." Mobley says he will fly to Washington on the weekends until he hires a full time staff. The bill states that "no criminal or civil penalty shall apply to any person for the act of possessing marijuana provided that ... a [physician] certifies in writing that the person is under professional care [and] ... needs marijuana as part of a therapeutic regimen".     WIN: Columbia, Mo. - Proposition 2 This initiatve eliminates the possibility of any jail time for marijuana possession and reduces the maximum fine from $1,000 to $250 for up to 1.25 ounces. It also forbids the police from arresting adults on marijuana possession charges, and requires a summons to city court (not county or state prosecutors) instead. Drug convictions in municipal court do not bar students from receiving federal aid under the Higher Education Act.

    WIN: Columbia, Mo. - Columbia Medical Marijuana Initiative At press time, the Missouri Medical Marijuana Initiative was ahead in incomplete returns. Columbia's ballot initiative revises the city criminal code so that medical marijuana patients are not subject to "any arrest, prosecution, punishment or sanction." While it sets out specific illnesses that qualify for medical marijuana use, it also says any other serious condition for which a doctor has recommended cannabis is appropriate under the law. The Medical Marijuana Initiative also requires that all medical marijuana cases be referred only to the local prosecuting attorney and no other prosecutor.
