The Campaign to Legalize Medical Marijuana in Florida

Now the march toward the 2016 election has officially begun for supporters of medical marijuana in Florida, as John Morgan and United For Care submitted a revised amendment to the state’s Division of Elections in early January. Like the previous go-around, the Florida Secretary of State had to approve United For Care’s new petition. Before the new and improved Amendment 2 is added to the 2016 ballot, a little more than 68,000 signatures must be collected from voters throughout Florida.
After that occurs, the state Supreme Court will once again look over the ballot’s language to ensure certain legal requirements are satisfied. Upon the Florida Supreme Court’s approval of the proposed amendment, 683,140 signatures must be collected by February 1, 2016 to ensure the initiative is included on the election ballot. - See more at >>

Woman's Advocacy for Medical Marijuana for her Son Results in Investigation by CPS
A woman's advocacy for medical marijuana for her son, who suffers from a rare form of pediatric epilepsy, results in an investigation by the Child Protective Services.
Renee Petro's advocacy on behalf of her son resulted in CPS agents arriving at her home - where an investigator then isolated and interrogated her 9 year old daughter, and terrified the whole family.
They found zero evidence of Petro providing marijuana to her son - because she didn't. She simply advocated for the right to do so.
This is exactly why we need to go to Tallahassee - and why we need your support to get word out about stories like Renee's and her family's.

ON-LINE, You can tell everybody in cyber-space by e-mailing a link to this website to them and/or (OFF-LINE> printing off the info and handing out where possible / necessary. Also phone call and read off and/or visit and hand deliver the info. You can take literature with you and approach businesses, organizations and even people on the street while you're out and about. Wear your pot-leaf shirt and register voters, as feasible. Gather signatures for any related petitions that are happening at the time as well.
This is a chain e-mail you can't refuse. Unlike most, this will actually help you - and a whole buncha others - just by passing it on.
Cannabis consumer or not - from the folks just trying to take care of themselves or a loved one to those who simply see the expensive, immoral waste of making war on the sick and dying - everyone is affected by this issue.

Then get everybody else to do the same. And follow up.

And can confide in.
Then/or anonymously tell everybody you don't know

Inform, Educate, Activate
INFORM and EDUCATE. Distribute medical marijuana brochures and other literature to your friends, family, local leaders and elected officials in an effort to educate the public and garner support. Educate your community by Printing, posting and handing out Flyers and other Printables in a mall, coffee shop, laundromat, college campus, lamp post, telephone poll, business window (ask first), hospital, or anywhere people will see them. There's a push by students at Florida State University to legalize marijuana.
Students are gathering petitions for a constitutional amendment. They'll need almost 700,000 to get it on the ballot next year.
Kim Russell is one of the organizers and says it could help her father with Parkinson's disease avoid surgery.
"It's a pain reducer. It's a neuro-protector, meaning it protects the brain. It has anti-oxidant properties. There's many medicinal purposes for it".
Thirteen other states have already taken some steps to legalize medical uses of marijuana.
Nine others, including Florida, could vote on the measure in 2010.

California may be the center of the marijuana trade and the controversies over its legalization. But Florida has surpassed it in one important category: the Sunshine State is now the country's leader in indoor marijuana cultivation. It is a potent distinction because most of the marijuana grown this way is cultured hydroponically — that is, mostly without soil and with a carefully calibrated cocktail of chemicals and lighting — to create some of the highest level of highs on the market.
In 2006, Florida law enforcement here discovered 480 homes growing marijuana indoors. Last year, 1,022 grow houses were busted. "This isn't your grandma's marijuana," quipped a Miami-Dade narcotics officer at one bust as he tossed garbage bags stuffed with confiscated marijuana into an unmarked police truck.
Levels of THC — the agent in marijuana that produces feelings of euphoria, and in some users mild hallucinations and paranoia — have risen dramatically because of indoor techniques. Thirty years ago, most marijuana contained about 7% THC. Today, indoor growers boast THC levels of 25% or higher thanks to the additional care that indoor plants receive. Legislation: Possession of 20 grams or less of marijuana is a misdemeanor, punishable by up to one year in jail and a fine of up to $1,000. Possession of greater than 20 grams of marijuana is a felony, punishable by up to five years in prison and a fine of up to $5,000.
Law Enforcement: City of Fort Lauderdale police are usually too busy chasing murderers to worry about average consumer level potheads, but don't smoke in too public of a place or a crowded area. Stay away from the main strip along Ft. Lauderdale beach. Smaller municipal local city cops may be bored and looking for some stoned kids to mess with, such as in the areas of Hollywood , Tamarac, Cooper City, Weston, and especially Pembroke Pines (fuckers!).
But most of the county is patrolled by the Broward Sheriffs Office, which is an underpaid, under funded, lazy and corrupt work force. I wouldn’t worry too much about them, but stay out of slummy and ghetto areas where they like to pull white people over and search their car (i.e. Systrunk). Use your head and you should be alright.
Where to buy marijuana in Fort Lauderdale, FL: Some of the clubs and bars such as the elbow room on the beach will have some locals hanging out looking to deal to some out-of-towners, but those guys will most likely rip you off with some South American crap.
Downtown, Las Olas, and Riverfront are good areas to be social and meet some fellow stoners that will hook you up. Most in the Biz people are stoners so ask restaurant and bar employees where to hook up. Also, if you are willing to venture 2 or 3 miles, Dania Beach and Hollywood are infamous for breeding super stoners that can smoke you to the ground, probably because there isn't shit else to do in there towns but sit back and toke up.
Check out the Dania Beach pier area (although it’s also a secret late night gay hang out, watch out where you bend over) and the Hollywood OceanWalk area, OceansEleven beach bar, BU's, etc. Watch out for pesky French Canadians complaining about the quality of american herb (if you don't like it, go back to Montreal). Hollywood Beach is a colony of Quebec. Stoners tend to hang out in front of Haagen Dazs on the beach there, just look for surfer beach bum types, don't be too direct or they'll think you're cops!

Fort Lauderdale, Florida marijuana Brands: Figuring that Port Everglades is the largest cruise ship port in the world and goes all over the Carribean and South America, you can imagine that we have quite the selection. Most popular is Columbia and Mexican regs, compressed, and you'll be pickin some seeds, but usually decent, compared to what the rest of the country is smoking.
Fort Lauderdale also has various homegrown hydro from local producers. Common strains are Hash Plant, Blueberry, Haze, and some krypie hybrids. If your lucky, you'll run into some awesome purple stuff from time to time.
City tale: Fort Lauderdale has been called Fort Liquordale for good reason, it is as much a drinking town as it is a smoking town, but watch out for pesky US-1 D.U.I. check points. Fort Lauderdale is also a fishing town and supposed to be the billfishing capital of the world with its annual competitions and boat shows and expos, so if you like stoned fishing or boating this is the place to be. In states where affirmative rights to use marijuana for medicinal purposes have not been enacted, individuals may still be prosecuted for growing, possessing or using marijuana for treatment of their medical condition. When these prosecutions occur, raising the "medical necessity defense" may provide a means of avoiding a criminal conviction.
The medical necessity defense is usually grounded in either a state's common law or general necessity defense statute. Regardless of its origin, the basis of the necessity defense is that society is sometimes willing to excuse or even justify conduct that would otherwise be illegal if that conduct was done to avoid an even worse or greater evil.
This defense theory reflects society's understanding that external forces beyond a person's control sometimes place that person in an emergency situation where he or she must choose between the harm or "evil" of breaking the criminal code or complying with the code and allowing an even greater harm or "evil" to occur.
In these situations, if a person violates the law in order to avoid the greater harm, the defense of necessity excuses the person from being guilty of what would otherwise be a crime.
The elements of a necessity defense vary from state-to-state, and from the federal standard. Generally, the defense must show 1) that the defendant did not intentionally bring about the circumstance which caused the unlawful act; 2) that the defendant could not accomplish the same objective using a less offensive (i.e. "more legal") alternative available to the defendant; and 3) that the evil sought to be avoided was more heinous than the unlawful act perpetrated to avoid it.
Under federal law, a defendant must establish the existence of four elements to be entitled to a necessity defense: 1) that he was faced with a choice of evils and chose the lesser evil; 2) that he acted to prevent imminent harm; 3) that he reasonably anticipated a causal relation between his conduct and the harm to be avoided; and 4) that there were no other legal alternatives to violating the law. See , e.g., United States v. Aguilar, 883 F.2d 662, 693 (9th Cir. 1989).
Necessity defenses are sometimes labeled "competing harms". Under such circumstances, the evil brought about from violating the law is deemed to be less than the evil which would have resulted from literal compliance with the law.
In the medical necessity context, courts must balance the interest of an individual in his or her health and welfare against the government's interest in upholding the criminal law. To successfully present the defense in this context, the defendant will typically be required to convince the court that his/her health is threatened to the degree that engaging in otherwise criminal activity is warranted.
Although the specific requirements vary from state to state, this usually requires a person using marijuana for medicinal purposes to show that he/she acted under the reasonable belief that the marijuana use was necessary to avoid serious medical harm. Medical testimony and evidence from a treating physician or medical expert is nearly always required to support the claim. Without medical testimony, a court is likely to refuse a jury instruction on the medical necessity defense.
Many jurisdictions also require that there be no other available options for the individual to avoid the harm. For example, in Idaho, the defense is not applicable where the compelling circumstances have been brought about by the accused or where a legal alternative is available to the accused. In other words, if a viable, legal alternative treatment to marijuana exists, the individual cannot claim necessity as a defense.
This issue is frequently the subject of pretrial motions and hearings, and may be hotly contested at trial. The prosecution and the defense frequently disagree about whether a legal alternative exists. Medical experts are used by both sides and the question is left for the judge or jury to decide.
Although the current law of necessity in some states technically limits marijuana's medicinal use to situations where individuals have no other alternative, the law is usually applied in a more compassionate manner.

Medical Necessity Defense for Cannabis- 1989 case of Elvy Musikka

Elvy Musikka was a Florida woman with glaucoma who was arrested in 1988 for cultivating 6 cannabis plants. Musikka's physician was an ophthalmic researcher at Miami's famous Bascom-Palmer Eye Institute, he testified that “if marijuana were legal I would have prescribed it for Elvy Musikka's medical use in the treatment of glaucoma.”
Musikka's physician also testified that she would go blind without marijuana. The court allowed her to introduce a common law medical necessity defense. Judge Mark E. Pollin wrote in his decision that,
“This is an intolerable, untenable legal situation. Unless legislators and regulators heed these urgent human needs and rapidly move to correct the anomaly arising from the absolute prohibition of marijuana which forces law abiding citizens into the streets - and criminality - to meet their legitimate medical needs, cases of this type will become increasingly common in coming years.
There is a pressing need for a more compassionate, humane law which clearly discriminates between the criminal conduct of those who socially abuse chemicals and the legitimate medical needs of seriously ill patients whose welfare and very lives may depend on the prudent therapeutic use of those very same chemical substances.”
Later in 1988, Mussika would go on to become a federal marijuana patient as part of the FDA's Compassionate Investigational New Drug program.
She is currently one of four federal patients that still get 8 ounces of marijuana in the form of over 300 joints a month.

Multiple places have decriminalized non-medical cannabis in the United States; however, cannabis is illegal under federal law. Gonzales v. Raich (2005) held in a 6-3 decision that the Commerce Clause of the United States Constitution allowed the federal government to ban the use of cannabis, including medical use even if local laws allow it.
Most places that have decriminalized cannabis have civil fines, drug education, or drug treatment in place of incarceration and/or criminal charges for possession of small amounts of cannabis, or have made various cannabis offenses the lowest priority for law enforcement.

an effective medical marijuana program in the state. United for Care — which led a 2014 medical marijuana campaign — has collected the necessary signatures to put the issue on the ballot.

Medical doctors being restricted from recommending any remedy to patients that’s been proven safe and effective should outrage everyone. Such a restriction should only be allowed in the case of extreme danger to citizens or society. This certainly is not the case with marijuana.
In all of recorded history there has never been a single death from the ingredients in marijuana. In 1988, after reviewing all evidence brought forth in a lawsuit against the government's prohibition of medical marijuana, the DEA's own administrative law judge (Judge Francis Young) wrote:
"The evidence in this record clearly shows that marijuana has been accepted as capable of relieving the distress of great numbers of very ill people, and doing so with safety under medical supervision. It would be unreasonable, arbitrary and capricious for the Drug Enforcement Administration to continue to stand between those sufferers and the benefits of this substance in light of the evidence".

There will be a meeting of the Key West Florida Chapter of the Global Marijuana March at 4:20 PM on Saturday May 5th. We will convene on the Courthouse Steps of the Monroe County Courthouse.
The PLAN is to march down Duvall St, until we get to US 1, turn left, and proceed until we get to the park, where we will disband.
Bring signs, banners, and noisemakers.
This is a protected Free Speech event under the 1st amendment of the United States Constitution. No permit is required, and none shall be filed for.
We strongly feel that having to ask for permission to do something that we are already granted the RIGHT to do is an erosion of our rights and civil liberties.

Usually On a Saturday, Ploppy Palace Productions and Tobacco
Road host the Annual Medical Marijuana Benefit Concert
to raise funds for PUFMM’s (People United For Medical Marijuana), NORML
of South Florida’s (National Organization for the Reform of Marijuana
Laws) and Patients Out Of Time’s medical marijuana campaign and the
protection of patients’ rights. Currently there is a statewide petition
drive to get the medical marijuana issue on the ballot to change the
laws in Florida. As part of this three stage extravaganza, some of
South Florida's top bands, spoken word artists and community activists
will join together for patients’ and physicians’ right to use medical
cannabis.
As a testament to the diversity of supporters for this cause, there
will
be a broad variety of musical styles including jazz, rock, reggae, folk,
vocal harmonies, hip-hop, funk, experimental, tribal rhythms,
traditional Peruvian, flamenco, world beat fusion, psychedelic grooves
and various interactive jams.
In addition, dancers will be performing a
variety of dance and movement pieces to energetic, rhythmic percussion
and ambient tones.
The Annual Medical Marijuana Benefit Concert will also feature a
selection of community speakers who will present information about the
issues, representatives of PUFMM,
NORML of South Florida and other concerned citizens.
NORML of South Florida, PUFMM, Patients Out Of Time, ACLU of Florida,
Florida Green Party and various other organizations will have
informational booths with literature and handouts to help educate about
community issues and the medical marijuana campaign in Florida.
The event will work to raise funds and awareness for PUFMM, NORML of
South Florida and Patients Out Of Time’s medical marijuana campaign and
the protection of patients’ rights. Previously, a person's right to use
medical necessity as a defense to marijuana charges has been upheld by
several appeals courts in Florida. Marijuana has proven therapeutically
useful in treating numerous medical conditions including muscle
spasticity, arthritis, and the nausea related to AIDS and cancer
chemotherapy. Recently, the City of South Miami passed a resolution to
support medical marijuana on a statewide and national level - this is
the first city in Florida to endorse the issue. About 700,000 Florida
registered voters need to sign the petition in order for the issue to
get on the ballot. Currently there are 15 states that have laws
allowing marijuana to be used as medicine.
In addition there will be vendors and small businesses promoting and
selling their merchandise, including The Wallflower Gallery, Between
Spirit & Stone Jewelry, Progressive Rags, Crystal Fun Design, Mystic
Cottage and selected independent corporations.

Medical pot push gains momentum
› Miami Beach voters overwhelmingly approved a nonbinding medical-marijuana straw-poll issue. Supporters now hope to win over the state.

Miami Beach voters became the first in Florida to call for the decriminalization of marijuana for medical use in a Tuesday vote that gives a glimpse of statewide support for the issue.
The 64-36 percent approval jibed with state and national polls that show medical-marijuana support approaching 60 percent or more.
The nonbinding straw poll — calling on the city to ask the state and federal governments to allow medical cannabis — was so popular that it garnered about 1,000 more votes than the leading candidate for mayor, Philip Levine.
The group People United for Medical Marijuana, which is backing a proposed constitutional amendment to make Florida the 20th pot-decriminalization state, hopes Tuesday’s Miami Beach vote reflects state sentiment.
“It speaks pretty positively to our chances next November,” said Benjamin Pollara, treasurer of the Orlando-based group.
“This was a very low turnout election in Miami Beach,” he said. “It’s a relatively old electorate, and yet it still got close to 65 percent of the vote.”

Update on Florida medical marijuana: Department of Health holds public workshops focusing on proposed guidelines -

In February, the Florida Department of Health held five public workshops in municipalities across the state, providing an opportunity for the public to voice concerns over the proposed guidelines for implementation of the medical marijuana program established by Amendment 2. Unfortunately, the Department of Health’s proposed guidelines are too restrictive and inconsistent with the overwhelmingly popular Amendment 2, which was approved by 71% of Florida voters in the November 2016 election.
Hundreds of medical marijuana advocates attended the Department’s public hearings and argued that the proposed regulations would restrict access to medical marijuana and would limit the number of prescribing physicians. The Department of Health has until July to draft workable rules and may face additional pressures from the state legislature, which may pass a medical marijuana bill during its session, beginning on March 7, 2017.
Amendment 2 requires the Department of Health to regulate medical marijuana treatment centers, which will cultivate and dispense medical marijuana to qualifying patients who have been diagnosed with a debilitating medical condition and have a physician’s certification and a valid identification card. While the Department of Health is trying to curtail Amendment 2, supporters of medical marijuana are hard at work in the state house. Sen. Jeff Brandes (R – St. Petersburg) recently filed a bill to strengthen the medical marijuana industry by expanding the medical marijuana marketplace.
Sen. Brandes’ bill proposes eliminating the cap on the number of medical marijuana treatment centers and establishing four new types of licenses for growing, processing, transporting, and dispensing, as well as detailing a system for attaining medical marijuana ID cards and physician recommendations.

Prior the passage of Amendment 2, Florida had a flawed law that allowed a limited group of patients to access marijuana that was low in THC (less than 0.8%) and high in CBD.
The first dispensary of low-THC cannabis opened in Tallahassee on July 26, 2016. The legislature expanded this law in its 2016 session by passing HB 307, which would have allowed terminally ill patients to access other forms of medical cannabis. A summary of that law is available here.

Decriminalization policies adopted across Florida

Since June 2015, a new trend has taken root across Florida — several cities and counties have passed similar ordinances that give officers the discretion to replace arrests for possession of under 20 grams of marijuana with citations. These jurisdictions include Miami-Dade County, Tampa, Key West, and Orlando.
While this is a positive sign, in some jurisdictions, payment of the citation could still result in a criminal record, and some police departments have said that they will continue to arrest everyone in possession of marijuana, so caution should be exercised. Gupta: 'I am doubling down' on medical marijuana
This coming Tuesday (3/12), CNN is airing Weed 2- a second report by Dr. Sanjay Gupta in favor of medical marijuana.
Here's what Dr. Gupta wrote yesterday about the subject:

This campaign has always been about access to care and trust in our own doctors over politicians. Dr. Gupta joins an ever growing list of medical professionals who are defending access to marijuana based on scientific evidence of its benefits and their own eyes, as they personally witness its effects.
Dr. Gupta's coverage brought awareness to so many people last year. We really need to spread the word about this show as well.

Pot Opposition’s Smoky Motive
According to a recent Quinnipiac poll, Floridians support legalizing marijuana for medicinal purposes by a whopping 82-16 margin crossing all party lines. Frustrated by decades of inaction by the Florida Legislature, citizens have taken it into their own hands to put the issue directly before voters through a citizens’ initiative.
The issue should be whether Florida wants to join 20 other states and the District of Columbia in making medical marijuana available to its residents suffering from debilitating illnesses.
Instead, those in leadership positions in both the legislative and executive branches are busy trying to prevent the issue from making it to the ballot by filing briefs before the Florida Supreme Court. Their goal is to have the Medical Marijuana Citizens Initiative removed from ballot consideration even if the necessary 684,000 signatures are gathered.

Miami -- If a medical marijuana initiative makes Florida's ballot next year, it could pass with an astonishing 82 percent of the vote, according to a new Quinnipiac University poll released Thursday that finds voters also favor outright legalization as well. Support for the proposed constitutional amendment is strong among voters of every political stripe, age and income level, with independents lending the most support: 88 percent, the poll shows.
The overall 82-16 percent support for medical marijuana is the biggest to date. The previous high-point for Florida approval was about 70 percent in a poll taken earlier this year by the medical-marijuana advocacy group, People United for Medical Marijuana.
There are some differences in wording between the initiative and the Quinnipiac poll; the amendment says doctors can "recommend" marijuana, the poll asks if a doctor should be able to "prescribe" it.
Still, medical marijuana is clearly popular. And marijuana legalization is becoming more-liked as well, albeit narrowly.
Nearly half of Florida voters favor it — 48 percent — while 46 percent oppose pot legalization for personal use. That's within the margin of error, but it's a leading indicator of a shift in public opinion. Support for legalization is again strongest among independents (57-37 percent), and then Democrats (55-39 percent).
But Republicans are opposed 30-64 percent. Contrast that with GOP voter support for medical marijuana is solid: 70-26 percent.

Grimm: Florida GOP Leadership(?) fights yesterday’s war on pot
Last spring, in a burst of drug-war nostalgia, the Legislature passed a quaint throw-back law (32-2 in the Senate, 112-3 in the House) that outlawed sales of bongs and water pipes. In fact, selling any smoking device is now illegal in Florida other than a pipe “that is primarily made of briar, meerschaum, clay or corn cob.” Which is such a peculiar specification, it was as if legislators were puffing SleeStax X Skunk before the vote.
Meanwhile, 20 other states and the District of Columbia have legalized medical marijuana, eleven of those by statewide referendum. Most of those passed by more than a 60 percent margin. Perhaps something similar could happen in Florida, given that we’re stuck with the most arthritic, oh-my-aching-back/knees/elbows electorate in the western world. A group called United for Care has collected 200,000 names on a petition toward the 683,149 needed by Feb. 1 to get a medical marijuana initiative on the statewide ballot next fall.
This has not pleased the state’s attorney general, speaker of the House and president of the Senate, who have demanded that the Florida Supreme Court keep this measure away from the voters. Senate President Don Gaetz complained the pot petition appealed “to voters by using language that evokes emotional responses [that] are not appropriate for ballot titles and summaries of proposed constitutional amendments.”
Gaetz knows something about misleading ballot initiatives. As the Herald’s Rochelle Koff pointed out, Gaetz was one of the architects of a blatant misnomer called the “Health Freedom Act,” which was designed to torpedo the Affordable Care Act. Last year, the state Supreme Court said the Health Freedom act was misleading and needed to be rewritten. It was. And voters rejected it.

More Miami Beachers vote for medical marijuana (64%) than leading mayoral candidate
Poll after poll has shown that about 60 percent or more of Americans and Floridians support medical marijuana, and Tuesday night's election results in Miami Beach showed it to be true.
More than 64 percent of Miami Beach residents approved a straw ballot question calling for medical marijuana. Now it's up to the city commission and the new mayor to decide how bound they will be to the nonbinding referendum, which asks them to urge the federal and state governments to decriminalize pot for medical reasons.
In raw vote terms, mayoral frontrunner Philip Levine is less popular than the medical pot issue. He received 5,639 votes last night; medical marijuana garnered 6,683. One reason for that: Levine faced four other opponents, the medical-marijuana issue was a straight up-or-down vote.
As for the future of medical marijuana in Florida, the real battleground is the state Supreme Court, which is reviewing the ballot summary of a proposed initiative that would legalize pot with a doctor's recommendation. Attorney General Pam Bondi has asked the court to reject the initiative, saying the ballot summary is misleading.

Medical marijuana ballot initiative push begins
Medical marijuana supporters received final approval Wednesday from the Florida Department of State to begin collecting signatures for a ballot initiative that would enshrine doctor-approved cannabis in the state constitution.
The medical marijuana petition now has an active serial number and backers can start working toward the nearly 700,000 signatures needed by Feb. 1 to put the issue before voters in 2014.
The constitutional amendment would allow patients to use marijuana if they have a “debilitating condition.”
Certain diseases such as cancer, glaucoma and Parkinson’s are specifically mentioned, but a doctor would have discretion to prescribe marijuana for any “conditions for which a physician believes that the medical use of marijuana would likely outweigh the potential health risks for a patient.”

On February 27, 2013, shortly after Sen. Jeff Clemens (D-Lake Worth) filed SB 1250, which would exempt seriously ill Floridians from criminal penalties for using marijuana with their doctors’ recommendations, the bill’s namesake – Cathy Jordan – was raided by the Manatee County Sheriff's Department. Ms. Jordan cultivates and uses marijuana to treat Lou Gehrig’s disease. If you live in Florida, please email your legislators today and ask them reject this madness by supporting medical marijuana; they’d join 70% of Floridians who do so as well.
The Cathy Jordan Medical Cannabis Act, which has also been introduced in the House by Rep. Katie Edwards (D – District 98), would allow patients with certain qualifying medical conditions, or their officially designated caregivers, to possess up to four ounces of marijuana and grow up to eight marijuana plants. It would require the Department of Business and Professional Regulation to license and regulate medical marijuana dispensaries and cultivation facilities. Florida should stop treating the sick and suffering like criminals; ask your legislators to support SB 1250 and HB 1139.

The war on marijuana is going up in smoke, and it’s about time. There is no bigger waste of money and resources in all law enforcement.
Failure is too polite a description for the long campaign to eliminate the pot trade in the United States. A colossal flop is what it is. After four decades and billions spent, marijuana is easier to get, and more potent, than ever.
More than 40 percent of all Americans over 12 have tried it, and at least 30 million people smoke it every year. The most recent national drug survey found that 18.1 million Americans had used it during the previous month.
Pot is now medically dispensed in 18 states and Washington, D.C. It’s the largest cash crop in the nation’s largest agricultural state, California.
A legitimate pain reliever for cancer victims, “medicinal” marijuana is now available for an assortment of other symptoms, some of them conveniently vague and impossible to discount. It’s not terribly hard to get a prescription.
In November, voters in Colorado and Washington dropped the pretense and approved the adult recreational use of weed. Other states will follow in coming years.
Absurdly, the government still classifies pot as a Schedule I Controlled Substance, the same as heroin and cocaine. Federal law prohibits medical marijuana use, and the Obama administration has taken action against dispensaries in California.
It’s a lost cause, and an expensive one. Any true fiscal conservative should be outraged by the waste and futility.

Cannabis’ demand is here to stay
First, acknowledging the obvious: It is time to end the nation’s nearly century-long experiment with marijuana prohibition and replace it with a system of legalization and regulation.
The ongoing enforcement of cannabis prohibition financially burdens taxpayers, encroaches upon civil liberties, engenders disrespect for the law, impedes upon legitimate scientific research into the plant’s medicinal properties, and disproportionately impacts communities of color. Furthermore, the criminalization of cannabis simply doesn’t work.
Despite more than 70 years of federal prohibition, Americans’ consumption of and demand for cannabis is here to stay. Voters’ passage of Amendment 64 in Colorado and Initiative 502 in Washington acknowledges this reality. These measures seek to stop ceding control of the marijuana market to untaxed criminal enterprises and seek to impose new, common-sense regulations governing cannabis’ personal use by adults and licensing its production.

Marijuana is the only drug Cathy Jordan says helps her fight Lou Gehrig's disease. The 59-year-old mother smokes two joints every night to relieve depression and muscle spasms, and to boost her appetite.
"It's keeping me alive," said Jordan in an interview at her home in Parrish. "Anti-depressants made me a zombie and other drugs had bad side effects. The crime is that people like me can't get it legally."
Floridians could vote for the first time next year to allow marijuana for medical use. A petition drive, started last week by an Orlando woman whose father has Parkinson's disease, would make the drug legal for any condition as prescribed by a doctor.
The last time such an organized effort to legalize marijuana occurred in Florida was 1997, just one year after California became the first state to legalize medical marijuana. But in Florida the petitioners fell hundreds of thousands of signatures short of getting to a state referendum.
This time the movement faces some of the same roadblocks, such as opposition from law enforcement and a lack of support by the majority of the medical community.
But the climate has become more favorable in ways that could shift the balance.
A dozen other states have approved medical marijuana since Florida last tried to get it on the ballot, and four state legislatures are currently considering proposals.

The new law, sponsored by Senator Steve Oelrich (R-Gainesville) and Representative Nick Thompson (R-Ft. Myers), passed as House Bill 173 during the 2008 Legislative Session and was signed into law by Governor Charlie Crist Tuesday. The bill was developed because of the increasing number of grow houses operating in the state and violent crime which tend to be associated with these operations.
The new law makes it a second-degree felony to grow 25 or more plants, targeting for-profit growers who exploit Florida’s previous threshold of 300 plants. The law will also make it a third-degree felony to own a house for the purpose of cultivating, packaging and distributing marijuana and a first-degree felony to grow 25 or more plants in a home with children present.

During the last few years, I have represented several clients in both State and Federal Court who have been charged with growing marijuana plants in their homes. Therefore, I was particularly interested to learn that on July 1, 2008 a new law went into effect in Florida called the Marijuana Grow House Eradication Act. The following is a news article about that Act:

Florida Bill Would Create Penalties Targeting Marijuana Grow Houses

Marijuana grow houses are becoming increasingly common in the suburbs of Florida, and new cultivation techniques are making it 15 times as potent as marijuana available 20 years ago. The Florida State Attorney General Bill McCollum has teamed with state legislators in creating a
bill that would stiffen penalties for home marijuana growers.
Among other provisions in the Marijuana Grow House Eradication Act are enhanced penalties for having a child present in a grow house and having illegal drugs present in close proximity to children younger than three.
"As Florida's Attorney General, my priority is protecting our children and our communities from the devastation of illegal drugs," said Attorney General McCollum. "This legislation targets those who grow marijuana for profit."
Florida is second only to California in the number of grow houses discovered last year. Almost two-thirds of Florida's counties, 41 out of 67, had at least one grow house in their boundaries. One pound of marijuana cultivated with these techniques has a street value equivalent to a pound of cocaine.
Growing 25 or more marijuana plants will earn a new, tougher penalty under the Act. Florida's current definition of trafficking has a minimum of 300 plants, while the federal government considers a for-profit grower a trafficker with only 100 plants. For-profit growers have taken advantage of those limits in the past. Owning a house specifically for the cultivation of marijuana will result in increased penalties as well.
The bill also makes a provision for seized grow house equipment, which is currently housed for preservation of evidence, to be destroyed by law enforcement without any civil liberty after photographs or video recording of the evidence is taken.

In 1978, Rep. H. Lee Moffit spearheaded the swift passage of the “Controlled Substances Therapeutic Act,” a legacy of compassion in Florida’s legislative history. With nary a nay in either camber, Florida statutes 486.XX, was enacted under newly elected Governor Bob Graham. Floridians with glaucoma or cancer had legal protection from criminal prosecution. The bill was repealed after five years when legislative funding for a patient qualification review board was requested.
The process of collecting the petitions throughout the state has produced two district benefits. Signatures are power. Piles of signed petitions by registered voters, one per page, are tools used to convince candidates that their constituents support candidates who support medical marijuana. The second advantage of collecting the petitions is the opportunity to interact with the public and educate them on the issue.
