Smoking tolerance level [1= very illegal 5=virtually legal]: 3 ---
Legislation: The penalty for possession of one ounce or less of marijuana is a misdemeanor and is punishable by up to one year in prison and a fine of up to $1,000. The court may defer the proceedings and grant probation for no less than one year. Upon granting probation, the court may require drug treatment. If the terms of the probation are fulfilled, the court can discharge and dismiss the proceedings.
There is a rebuttable presumption that any possession greater than one ounce is possession for sale.
Possession for sale or cultivation of marijuana is a felony. For amounts greater than one ounce the punishment is 4 – 10 years in prison and a fine of up to $25,000. For amounts of ten pounds or more the sentence can range from 5 – 20 years in prison and a fine of $15,000 – $50,000. For any amounts of 100 pounds or more the punishment is 6 -10 years in prison and a fine of $15,000 – $100,000.
Second convictions of possession, sale, delivery or cultivation can result in sentences up to twice that allowed for first offenses.
Law enforcement: They care about other drugs more.
Where to buy marijuana: Central Little Rock, 12 Street to begin, then follow the streets to higher numbers till you reach about 28th Street. All the streets in the middle are named after presidents, (Washington, Adams, Madison, Tyler, Monroe).
On the North side of the river – all down Pike AVE. from 4th and Pike all the way to 36th and Pike AVE. Lots of weed on the streets here. Especially around 17th street and Pike AVE. The police are really bad on the North side, but as soon as you cross the rive back to the South side of town, you can take a deep breath, you will be okay.
Marijuana prices: Never spend more than 20 dollars on the street. You would be better buying 10 dollars worth twice, than 20 dollars once.
10 dollars will get you a “blunt” they will tell you (large joint, small cigar)
25 will get you about 8 grams.
You will be surprised when you are expecting swag and you get some really good scunk weed. There is a lot of 50 on the street around here for regular price.
Marijuana brands: White Widow is the best thing around here, but you will never find it on the street. With lots of predomanate communities around here your average JOE is smoking the killer biller everyday before they go to work. Lots of High Quality stuff in the historic Hiscrest area and a lot of hippies in Stiff Station off of Capital (5th Street).
More information: So many people smoke weed around here. After you live here a while you are no longer surprised when you find out your Doctor or Lawyer Smoke. I am surprised when I meed someone who does not smoke in Cental Arkansas.

Multiple places have decriminalized non-medical cannabis in the United States; however, cannabis is illegal under federal law. Gonzales v. Raich (2005) held in a 6-3 decision that the Commerce Clause of the United States Constitution allowed the federal government to ban the use of cannabis, including medical use even if local laws allow it.
Most places that have decriminalized cannabis have civil fines, drug education, or drug treatment in place of incarceration and/or criminal charges for possession of small amounts of cannabis, or have made various cannabis offenses the lowest priority for law enforcement.

The Arkansas Medical Cannabis Act was not on the November 4, 2014 election ballot in Arkansas as an initiated state statute. Had the measure been approved by voters, medical marijuana would have been legalized in the state, allowing patients with certain medical conditions to obtain marijuana from nonprofit dispensaries.[1][2]
In November 2012, Issue 5, which would have legalized the medicinal use of marijuana in Arkansas, was defeated 51.44 percent to 48.56 percent. Due to the narrow margins, supporters of legalizing medical marijuana decided to try again in 2014.[1]
Two groups were attempting to land similar measures on a 2014 ballot: Arkansans for Compassionate Care 2014 and Arkansans for Responsible Medicine. Unlike the 2012 measure, neither 2014 proposal would have allowed patients to grow their own marijuana. The latter group decided to end their campaign for 2014 and, instead, focus on 2016.[2] According to Arkansans for Compassionate Care 2014, the two initiatives were similar, except the Arkansans for Responsible Medicine initiative did not contain a provision for hardship cultivation certification of low-income affordability.[3]

The Arkansas Medical Marijuana Question, also known as Issue 5, was an initiated state statute on the November 6, 2012 ballot in the state of Arkansas, where it was defeated.
The measure sought to allow the use of marijuana for medical purposes. Those who chose to use it for medical purposes would have been free from legal penalty. A group called Arkansans for Compassionate Care were sponsors of the proposed law, which was formally called, "The Arkansas Medical Marijuana Act," according to the ballot title.
According to reports, patients with possession of cards issued by the state Department of Health would have been allowed to purchase and carry marijuana for medical purposes. Medical marijuana would have been purchased from dispensaries or patients could have grown the cannabis plant themselves, but only a maximum of six plants per person.

Drug Policy Alliance: Reform in Arkansas. The Arkansas Alliance for Medical Marijuana faces a July 2, 2004 deadline to gather nearly 65,000 signatures for an initiative to be placed on the November election ballot. The group haggled with Arkansas Attorney General Mike Beebe over the language for the initiative, which is now called the "Arkansas Medical Marijuana Act." The measure would create state identification cards for medical marijuana users, who would be allowed to use the drug without being arrested or prosecuted for it.

Two medical marijuana initiatives will appear on November ballot; lawsuits fly

The Arkansas Secretary of State has certified two different medical marijuana measures to appear on the November 8 ballot. In early July, it certified Arkansans for Compassionate Care’s (ACC’s) medical marijuana initiative — the Arkansas Medical Cannabis Act — which would allow seriously ill patients who have a certification from their doctor to obtain medical cannabis from nonprofit compassion centers.
In addition, patients, or their licensed caregivers, could cultivate up to 10 cannabis plants at home provided they take steps to ensure it is secure. For a complete summary, please click here.

Proponents of the second measure, the Arkansas Medical Marijuana Amendment, continued gathering signatures after the Act qualified, despite warnings that two measures qualifying would likely split the vote and cause both to fail. On August 31, the secretary of state certified the constitutional amendment for the ballot. It offers more limited protections than the Act, but is better than the status quo. You can check out a comparison of the two initiatives here.
Now both campaigns are having to focus on defending against lawsuits seeking to kick them off the ballot. Thus far, three suits have been filed in total, and to date none have been ruled upon. Arkansas has some of the harshest marijuana laws in the nation, but despite increasing interest around the country for improvements to marijuana laws, the Arkansas Legislature has shown little interest in changing its cannabis laws. Possessing less than four ounces of marijuana is a misdemeanor carrying up to one year in jail and a fine of up to $2,500. Possessing an ounce of marijuana or more by those who have twice been convicted of possession is a felony punishable by up to six years in prison and a fine of up to $6,000.
Let your lawmakers know it’s long past time for a more proportionate and fiscally sound approach to marijuana. In 2012, there were at least 5,718 marijuana arrests in Arkansas. Of those arrests, over 90% were for marijuana possession. During the same year, 91% of all reported burglaries, including home invasions, and over 90% of all motor vehicle thefts went unsolved. Law enforcement should stop wasting time on marijuana-related offenses and use its resources to stop real crime.
In addition to wasting law enforcement time on victimless marijuana offenses, marijuana enforcement has been extremely unequal in Arkansas. African Americans in Arkansas are over three times more likely to be arrested for possession of marijuana compared with whites, although both black and white populations consume marijuana at similar rates. Arkansas 2016 Medical Marijuana Legalization Iniatitive Approved for Signature Gathering

LITTLE ROCK, AR — Marijuana reform activists in Arkansas can begin collecting signatures for a proposed 2016 ballot initiative to allow medical marijuana in the state, as the proposed Arkansas Medical Cannabis Act was certified by Attorney General Dustin McDaniel on Thursday.
Now, Arkansans for Compassionate Care, the group behind the initiative, can begin collecting the nearly 65,000 signatures required to place the measure on the ballot for the November 2016 presidential election.
“We have more than 600 volunteers across the state who are preparing to gather signatures starting in just a few weeks,” said Melissa Fults, Campaign Director for Arkansans for Compassionate Care.
Organizers had originally aimed to place the measure on the November 2014 ballot, but because only 80% of the required signatures had been collected as the July 7th due date approached, the group changed their focus to the 2016 election.

Arkansas Readies Medical Marijuana Law for 2016 - Ladybud
| While several states are gearing up for November with eyes on the legalization prize, Arkansas is getting ready to push forward with an initiative for the 2016 ballot.
The group backing the initiative, called The 2016 Arkansas Compassionate Care Act, is touting this as one of the most liberal and comprehensive medical cannabis bills written, and it does appear to be quite thorough.
The qualifying medical conditions in the state of Arkansas, should this bill pass, will include some 50 conditions. Additionally, any chronic or debilitating disease or condition that causes (or whose treatment causes) a number of symptoms.
Additional medical conditions or treatments may be added to the list in the future as well. Those who have been diagnosed by a physician with a qualifying medical condition may possess up to 2.5 ounces of cannabis. Those who qualify for hardship cultivation certificates may grow up 10 cannabis plants, five of which must be under a foot tall.
The law also provides for cannabis cultivation by caregivers and the establishment of non-profit Cannabis Care Centers, which will be allowed to transfer cannabis to legal patients, caregivers, and other cannabis care centers. Those care centers are required to donate cannabis to a state-run hardship program (up to 1% of their gross revenue), ensuring that those who are too sick to grow their own will be able to afford their medication.

Arkansas AG Rejects 2014 Medical Marijuana Ballot
| LITTLE ROCK, AR — The Arkansas Attorney General has rejected the language of a proposed 2014 ballot initiative, The Arkansas Medical Marijuana Act, that would legalize the medical use of marijuana.
Attorney General Dustin McDaniel rejected the wording Monday for “confusing and ambiguous points” contained within the language of the proposal.
In his decision, McDaniel’s says the proposed initiative isn’t clear enough about whether patients could grow their own marijuana at home:
McDaniel also says that there is contradictory language regarding non-profit medical marijuana dispensaries.
In a letter to the bill’s sponsor, Attorney David Couch of Arkansans for Responsible Medicine, McDaniel emphasizes that his office “does not concern itself with the merits, philosophy, or ideology of proposed measures,” simply the language of the bills to be placed before voters.
Couch says he will correct the issues and resubmit the proposal, which must be certified by McDaniel before signature gathering can begin in the hopes of placing the measure before voters in 2014.
A similar measure, Issue 5, was placed before voters in 2012, and was narrowly defeated at the polls. But medical marijuana remains a hot topic in Arkansas: in the 2012 election, more Arkansas voters cast ballots for the medical marijuana measure than they did for President Barack Obama, with more than 500,000 voters in favor of the marijuana issue and about 390,000 votes cast for Obama.

| Medical marijuana took one step closer to hitting the South on Wednesday, when Arkansas' Secretary of State office confirmed that the issue will be on the ballot there this November. Arkansans for Compassionate Care handed in 69,000 valid signatures – well over the necessary 62,507 – for the Arkansas Medical Marijuana Act, which would set up non-profit organizations to cultivate and sell pot, while allowing patients who live more than five miles from a dispensary to grow their own. The November vote will mark the first time that voters in a Southern state can decide whether to legalize medical pot, and could make Arkansas the U.S.' 18th medical weed state.
The proposed legislation has made Arkansas ground zero for marijuana reform in the South, where weed laws tend to be ultra-harsh. "We are in the Bible Belt – this isn't generally one of the states that is a hotbed for marijuana reform or policy," Ryan Denham, Campaign Director for the ACC, told Opposing Views earlier this year. "If passed, this will send a strong message nationally . . . Marijuana is medicine and it is time we recognize that on a national level."
The initiative qualifies medical marijuana for a variety of conditions – including cancer, glaucoma and post-traumatic stress disorder – as well as other diseases that produce symptoms pot is known to help soothe, like nausea, muscle spasms and seizures. While recognizing marijuana's illegality under federal law, the act would exempt from prosecution those who qualify for participation in the Arkansas program.

| (NaturalNews) Arkansas residents may see an initiative to legalize medical marijuana on the November 2012 ballot. The proposed law's sponsor, Arkansans for Compassionate Care, achieved its first victory when the Arkansas attorney general certified the proposal's ballot language. The group must collect 62,507 voter signatures by July 2012 for the issue to appear on the general election ballot next year, according to a Reuters report.
"We want to ensure that sick and dying patients in Arkansas have the ability to get the medicine they need and that is sometimes medical marijuana," Ryan Denham, campaign director, told reporters.
A similar effort to get the issue on the ballot in 2004 failed due to a lack of petition signatures. But Denham is confident that his Fayetteville-based group will recruit more support this time. Reuters reports that Denham has enlisted over 300 volunteers to obtain signatures.
The law would allow use of marijuana only to treat certain conditions, including AIDS, cancer, Alzheimer's disease, fibromyalgia, and glaucoma. Qualifying patients would be allowed to grow up to six plants at a time.

Hawaii's law was enacted by the legislature and signed by the governor in 2000, Vermont's was enacted by the legislature and passed into law without the governor's signature in May 2004, Rhode Island's was passed into law over the governor's veto in January 2006, and New Mexico's legislation was signed into law by Governor Bill Richardson on April 2, 2007.
