Connecticut expands medical program, considers ending marijuana prohibition | Medical marijuana Recent events: In 2016, both regulators and lawmakers expanded Connecticut’s medical marijuana program. In January, the Department of Consumer Protection approved three additional dispensaries. The following month, a legislative committee approved the department’s addition of six new conditions to the 11 already included in the state’s medical marijuana program. Connecticut is the only medical marijuana state that completely excludes minors, but that will change when a new law takes effect on October 1. On May 17, 2016, Gov. Dannel Malloy signed HB 5450, which will allow minors to qualify if they have been diagnosed with certain medical conditions, if they have two physicians’ certifications, and if their parents consent. HB 5450 will also allow dispensaries to provide medical marijuana to certain medical facilities and will allow nurses to administer marijuana at health care facilities.     Status of Medical Marijuana (Cannabis) in Connecticut.

    Connecticut has a MEDICAL MARIJUANA (cannabis) LAW.

    SUMMARY:   HB 5389 -- Signed into law by Gov. Dannel P. Malloy (D) on May 31, 2012 Approved: By House 96-51, by Senate 21-13 Effective: Some sections from passage (May 4, 2012), other sections on Oct. 1, 2012 "A qualifying patient shall register with the Department of Consumer Protection... prior to engaging in the palliative use of marijuana. A qualifying patient who has a valid registration certificate... shall not be subject to arrest or prosecution, penalized in any manner,... or denied any right or privilege." Patients must be Connecticut residents at least 18 years of age. "Prison inmates, or others under the supervision of the Department of Corrections, would not qualify, regardless of their medical condition." The option of home cultivation is not explicitly addressed under the statute.

    Any marijuana, paraphernalia relating to marijuana, or other property seized by law enforcement officials from a qualifying patient or a primary caregiver in connection with a claimed palliative use of marijuana shall be returned to the qualifying patient or the primary caregiver immediately upon the determination by a court that the qualifying patient or the primary caregiver is entitled to the palliative use of marijuana as evidenced by a decision not to prosecute, a dismissal of charges or an acquittal. Additional information for Connecticut patients and physicians regarding Public Act 12-55, An Act Concerning the Palliative Use of Marijuana is available online from the state Department of Consumer Protection.     Approved Conditions:   "Cancer, glaucoma, positive status for human immunodeficiency virus or acquired immune deficiency syndrome [HIV/AIDS], Parkinson's disease, multiple sclerosis, damage to the nervous tissue of the spinal cord with objective neurological indication of intractable spasticity, epilepsy, cachexia, wasting syndrome, Crohn's disease, posttraumatic stress disorder (PTSd), or ... any medical condition, medical treatment or disease approved by the Department of Consumer Protection..."     Possession/Cultivation:   Qualifying patients may possess "an amount of usable marijuana reasonably necessary to ensure uninterrupted availability for a period of one month, as determined by the Department of Consumer Protection." NOTE:   No personal or "home" grows allowed.

    PATIENT POSSESSION LIMITS:   One-month supply

    HOME CULTIVATION:   No

    CAREGIVERS:   Yes, a qualifying patient shall have not more than one primary caregiver at any time.

A primary caregiver applicant will only be able to access the online registration system if:

    • The patient’s physician indicates a need for a primary caregiver; and

    Dispensaries & other RESOURCEs:   Information provided by the state on sources for medical marijuana; "The Commissioner of Consumer Protection shall determine the number of dispensaries appropriate to meet the needs of qualifying patients in this state." The announcement stated that marijuana products were expected to be available "sometime this summer."

In a 34:10 vote on Tuesday April 12 a Connecticut legislative committee voted to allow state residents to use marijuana for the treatment of certain medical conditions. If passed, the legislation would prohibit the arrest and prosecution of qualified, state registered patients. The legislation was proposed by Democratic Governor Dannel P Malloy. A similar measure was vetoed by (then) Governor M Jodi Rell in 2007. The approvals came despite the view of some legislators that this would send ‘the wrong message’ about smoking dope. State Rep. Bruce V. Morris of Norwalk is one of the few Democrats to vote against the medical marijuana bill. We need to get the word out and people contacting reps and officials and get this legislation into law. Also, lets not forget efforts at the Federal level.

Law enforcement: The cops in greenwich hate younger people doing illeagel stuff, I live in this town and at least 5 smokers i know have been busted. When I got arrested they handcuffed me to a wall, i was arrested at 12 in the afternoon i wasn’t out of the jail on bail til 7:45 and that is solely because the cops don’t know how to do anything, like weigh pot, or take finger prints, they will all give you a stupid speach about how bad it is for you, i heard it atleast 20 times, there is one cop rumured to let kids go but i wouldn’t risk it, smoke on the beach, grass island, or one of the other dog walking parks, rarely does some greenwich mom even bother to glance your way but if they do no worries, bruce park is ok sometimes. Connecticut is the only medical marijuana state that completely excludes minors, but that will change when a new law takes effect on October 1. On May 17, 2016, Gov. Dannel Malloy signed HB 5450, which will allow minors to qualify if they have been diagnosed with certain medical conditions, if they have two physicians’ certifications, and if their parents consent.     Legislative history and background: Connecticut’s medical marijuana program was originally enacted on June 1, 2012. The program protects patients and caregivers from arrest and prosecution if they have a valid registration card and if the medical marijuana was obtained from the specific dispensary where the patient is registered.     Decriminalization Legislative history and background: Since 2011, possession of a half-ounce or less of marijuana has been a civil violation in Connecticut, punishable by a fine of up to $150, meaning it is not a jailable offense. Subsequent offenses are subject to increased fines ranging from $200-$500. Upon a third violation, offenders are referred to a drug awareness program. In addition to the fine, anyone under 21 who is found in possession of less than a half-ounce of marijuana faces a 60-day suspension of his or her driver’s license. Although Connecticut has improved its marijuana laws in recent years, adults are still being punished for possessing a substance that is less harmful than alcohol, while most crimes with victims go unsolved.

    Legalizing, Taxing, and Regulating Marijuana for Adults’ Use Recent events: On February 11, 2016, a group of Connecticut state representatives introduced HB 5236, which proposed legalizing and regulating the sale and use of marijuana for adults. While HB 5236 did not pass during this year’s short session, the lead sponsor, Rep. Juan Candelaria, held a public hearing and worked to educate his colleagues, which will help build the foundation for passage of similar legislation in the future.     Connecticut Becomes The 17th State To Allow For The Limited Legalization Of Marijuana As Medicine Democrat Gov. Dan Malloy s igned legislation into law on Friday, June 1, allowing for the state-sanctioned production, distribution, and use of cannabis for therapeutic purposes. The new law – Public Act 12-55, A n Act Concerning the Palliative Use of Marijuana – will take effect on October 1, 2012. “For years, we’ve heard from so many patients with chronic diseases who undergo treatments like chemotherapy or radiation and are denied the palliative benefits that medical marijuana would provide,” Governor Malloy said in a prepared statement. (Read it here .) “With careful regulation and safeguards, this law will allow a doctor and a patient to decide what is in that patient’s best interest.”

    Under the law, patients with a qualifyin g “debilitating medical condition” must receive “written certification” from a physician and register with the state’s Department of Consumer Protection (DCP). Qualifying patients and their primary caregivers will be allowed to possess a combined one-month supply of cannabis, the specific amount of which will be determined by a board consisting of eight physicians certified by appropriate medical boards and enforced through DCP regulations. Patients may obtain marijuana from certified pharmacists at licensed dispensaries, who will obtain it from licensed producers.     Meanwhile, voters support access to medical marijuana by wide margins — fully 90% of all voters support the medical marijuana program in Connecticut. Connecticut’s medical marijuana program was approved in 2012 and is now in the final stages of implementation. As of April, Connecticut had 1,990 patients, up nearly 50% from November of last year. That number will no doubt increase further once regular and safe access is made available to residents in the Constitution State.

    The state recently issued six licenses for dispensaries and four cultivation center licenses. Unfortunately, many dispensaries are finding it difficult to establish a foothold, despite the finding in the Quinnipiac poll that showed over two-thirds of voters would support having a dispensary in their town or city. Whether it is through zoning limitations, moratoriums on local business licenses, or the need to be managed by pharmacists, ongoing challenges have limited the roll out of the new regulated dispensary system. Nonetheless, officials estimate the program will begin operating during the summer months as businesses continue to secure locations and prepare to meet the needs of patients around the Constitution State.
