TALKING POINTS: tba I am unavailable to appear but wanted to propose talking points Background: I've attached a copy of the felony sentencing guidelines grid.  The rows (numbers 1-10) is crime severity; the columns (letters A-I) are criminal history.  Where they meet is the gridblock which prescribes the presumptive sentence.  (as crimes get more serious, and records get worse, presumptive prison (yellow blocks; NW corner)  less serious, less record, presumptive probation sentences.  (different colors depending on custody and non-custody sanction units) Current law sez 150 grams mj is a 'substantial quantity' and elevates possession from level 1 to leve 6; and delivery or manufacture from level 4 to level 8. A positive thing about this proposal is it both increases the amount which is a 'substantial quantity' from 150 grams to 1 kilo (1,000 grams)  A negative thing is that it places mj at the same level as murder (10) Manslaughter in the first degree (reckless homicide under extreme indifference to the value of human life) (9) and Manslaughter in the second degree (simple reckless) and criminally negligent homicide (8) it is simply wrong to equate the possession of any amount of cannabis or any number of plants with the criminal taking of the life of another human being. One message we've been trying to get across at the legislature for some time is: NO PRESUMPTIVE PRISON FOR POT! So, be polite, be respectful, dress appropriately, and share what you appreciate about this proposal as well as what you do not. Expands offense of driving while under influence of intoxicants to include any drug that adversely affects person's physical or mental faculties to noticeable or perceptible degree.
