Senate Bill 794 Sponsored by Sen. Prozanski
-- Relating to medical marijuana.
Summary:
SB 794 -- adds reciprocity and deletes requirement to designate a grower/grow site if you don't have one.
You can read the full proposed measure here:
SB794
Status:
In Senate Committee – Current Committee: Rules
· Senate Bill 794 is a modest bill that received a “do-pass” recommendation from Sen. Judiciary.
·
Senate Bill 794: Allows for out-of-state medical marijuana patients who are already authorized under their own state’s medical marijuana program, the same protection as an Oregon cardholder. The amount possessed or used by any out-of-state patient cannot exceed one ounce.
Four states currently allow this under their mmj laws. These states are Arizona, Maine, Michigan and Rhode Island.
Currently, Oregon allows medical marijuana cardholders from other states to actually apply for a card under Oregon’s program. This may take up to 60 days and requires approval by an Oregon licensed physician making it impractical for those just driving through or visiting for short periods of time.
· Senate Bill 794 eliminates the requirement to designate a grower for applicants who do not use a grower. Currently the application process for a medical marijuana card requires a qualifying patient applying for registration to identify a grow site and grow site address.
*NOTE: This bill as already had an amendment adopted and therefore it has to be reprinted after it gets through committee and comes out as an A-Engrossed bill. When calling you can simply refer to it as SB 794.
Was in Senate Judiciary Committee, had a Hearing. Senate Judiciary replaced the original language, adopted the dash two amendments and moved S B 794 to the floor with a "do-pass" recommendation. This was the bill that was dropped as a placeholder that originally proposed the ACMM meet five times a year.
The amendments include reciprocity for less than an ounce for out-of-state patients and deletes the requirement to designate a grow site on the OMMP application. These amendments will help protect our out- of- state patients and help reduce the "profile stops" at our borders. The deletion of the grow site requirement will mean patients no longer have to indicate a grow site when they have none. This will reduce the number of grow sites overall and enable the Program to get better numbers on actual grows. Next hearing:
